ROLL CALL Present: Canmissioners Garcia, Giani, Jacobs, Leahy, Schwalm, Taylor, Graham Absent: None Staff Present: City Planner Margaret Monroe; City Attorney Jerome F. Coleman; City Engineer Frank C. Erbacher MINUTES - The minutes of the May 14, 1984 meeting were unanimously approved. AGENDA - Order of the agenda unanimously approved. ITEMS FOR ACTION 1. SPECIAL PERMIT TO ALTA CONSTRUCTION OF A STORAGE AREA ABOVE AN EXISTING, DETACHED GARAGE AT 1229 DRAKE AVENUE; BY THEODORE WERNER, JR. CP Monroe reviewed this request to exceed three of the maximum requirements for accessory structures. Reference Staff Report/5-29-84; Project Application & CEQA Assessment received 4/5/84; applicant's letter date stamped April 5, 1984; plans date stamped April 5, 1984; staff review: Fire Marshal (4/16/84); City Engineer (4/16/84); Chief Building Inspector (5/14/84); statement frau the applicant (May 15, 1984); photographs of the site; May 4, 1984 study meeting minutes; and Notice of Hearing mailed May 18 1984. CP discussed details of the request, code requirements, staff review, applicant's letters, study meeting questions. Two conditions were suggested for consideration at the public hearing. Commission oammented on the proposed stairs for access to the addition and the possibility of a pull-down ladder for access. Chm. Graham opened the public hearing. Ted Werner, applicant, was present. There were no audience caYments and the public hearing was closed. Discussion: plans received by Cannission are the plans received by the Chief Building Inspector, he felt these would be appropriate for planning approval; a revised set of plans providing more detail will be required for the building permit. Applicant advised he has owned this home since 1946, the swimming pool was added in 1956 with a building permit; he parks his car in the garage. C. Gicmi moved for approval of this special permit with the following conditions: (1) that the conditions of the Chief Building Inspector's memo of May 14, 1984 be met; and (2) that a building permit not be issued for this Page 2 Burlingame Planning Carmission Minutes May 29, 1984 project until the Chief Building Inspector has approved the plans as meeting all of his requirements and as being consistent with any planning approvals granted. C. Gimi camtiented the outside stairway was her only reservation about this application but she felt the low ceiling would discourage conversion to a second unit and these stairs would be a help in moving large items to the storage area. Second C. Schwalm, motion approved on a 5-2 roll call vote, Cers Jacobs and Taylor dissenting. Appeal procedures were advised. 2. CONDOMINIUM PERMIT TO CONSTRUCT A 12 UNIT, THREE STORY CONDOMINIUM AT 518-524 PRIMROSE ROAD; ZONED R-3; BY DIODATI CONSTRUCTION CP Monroe reviewed this request to allow construction of a project which had been approved originally in 1982 and extended in 1983. Extension time has expired and a new action is required. Reference Staff Report -5/29/84; Project Application & CEQA Assessment received 3/1/82; Negative Declaration ND -316P posted April 27, 1982; staff review: Chief Building Inspector (4/23/84 and 4/21/82), Fire Marshal (4/23/84 and 4/26/82), City Engineer (5/16/84), City Attorney (3/5/82), Director of Parks (3/31/82); letter frau the applicant dated May 16, 1984; City Council minutes, June 7, 1982; Monroe letter of action dated June 8, 1982; study meeting minutes, May 4, 1984; aerial photograph; Notice of Hearing mailed May 18 1984; and plans date stamped April 24, 1984. CP discussed details of the request, previous city actions, staff review, study meeting questions, applicant's letter. Five conditions were suggested for consideration at the public hearing. It was noted the negative declaration posted in 1982 referred to 18 units, this will be changed to reflect the 12 unit project. Staff advised there had been provisions for city enforcement in the previous CC&R's, these have since been removed. Chm. Graham opened the public hearing. Joe Diodati, applicant, was present. There were no audience cannents and the public hearing was closed. Discussion: elevation of the finished site in the rear yard, no concerns have been expressed by neighbors; requirement for undergrounding of all utilities; garage ventilation; there will be insulation between floors. C. Jacobs moved for approval of this condominium permit with the following conditions: (1) that the conditions recamended in the Fire Marshal's memos of April 26, 1982 and April 23, 1984 and the City Engineer's memo of May 16, 1984 be met; (2) that the city has no responsibility for enforcing the OC&R's; (3) that the final landscape and irrigation plans be approved by the Director of Parks prior to the issuance of a building permit; (4) that the property line fence at the rear of the property be limited to 4'-6" as measured frau the grade at 518-524 Primrose; and (5) that the final working drawings for this condominium project be consistent with the plans date stamped April 24, 1984 and filed with this application. Second C. Garcia; motion approved unanimously on roll call vote. Appeal procedures were advised. 3. TENTATIVE CONDOMINIUM MAP AND TENTATIVE AND FINAL PARCEL MAP, 524 PRIMROSE ROAD, LOT C AND PORTIONS OF LOT D, BLOCK 5, MAP NO. 2, BURLINGAME LAND CO. CE Erbacher advised these maps are ready for recanmendation to City Council subject to one condition as listed in his agenda memo. C. Garcia moved that Page 3 Burlingame Planning Commission Minutes May 29, 1984 the tentative condaminiun map and tentative and final parcel map be recammended to City Council for approval with the following condition: (1) that at least one of the existing structures be removed prior to the recording of the parcel map for lot cambination. Second C. Leahy; motion approved unanimously on voice vote. 4. SPECIAL PERMIT TO ALLOW A CAR RENTAL AND LEASING OPERATION IN AN EXISTING BUILDING AT 880 HINCKLEY ROAD, ZONED M-1, BY EUROPA RENTS CP Monroe reviewed this request. Reference Staff Report -5/29/84; Project Application & CEQA Assessment received 4/23/84; Rent-A-Car Questionnaire date stamped April 23, 1984; applicant's project description date stamped April 23, 1984; Towber mann to staff, 4/23/84; staff review: Fire Marshal (5/2/84), Chief Building Inspector (5/11/84), City Engineer (5/16/84); Towber memo to City Planner (5/22/84); copy of recent advertisement, Europa Rents; City Attorney's Warning Notice, 12/15/83; Coleman letter to applicant, 10/12/83; Towber code enforcement memos: 9/20/83, 11/10/83, 9/29/83; Towber letter to applicant, 9/16/83; study meeting minutes, May 4, 1984; map indicating Burlingame rent -a -car agencies, 5/29/84; aerial photograph and Notice of Hearing mailed May 18, 1984. CP discussed details of the request, city's code enforcement actions with regard to the use permit requirement, staff review, applicant's letter, study meeting questions. Four conditions were suggested for consideration at the public hearing. Camaission concerns: available on-site parking for all occupants of this building; lack of a specific site plan; lack of property owner's written consent to the application; no copy of the lease agreement and/or letter detailing its terms. Chu. Graham opened the public hearing. John Perroton, applicant, was present. His canments: all study meeting questions have been responded to in telephone conversation with Planning staff; landlord has been uncooperative in supplying information on the building and Building Department had no plans on file; shuttle van goes to the airport, not to local homes; presently 80% of the rentals from this location are local, rented at off peak hours. Square footage leased and available parking were discussed. There was a concern about towed/junked cars being parked on the site; applicant advised discontinuing this practice was no problem. Staff suggested a condition be added to prohibit storage of inoperable vehicles on the site. Canmission questioned whether the condition regarding parking areas should be further defined. Applicant commented his biggest problem has been from racquetball club patrons next door parking on his property, parking is difficult in this area, Europa put in fenced area to keep other people out, cars seen on the street this past Saturday were there for pickup. Further discussion: Europa does no vehicle repair work on site; CE wished to add a condition that no repair or washing of vehicles be done at this location. Commission discussed with applicant the proposed conditions of approval. Mr. Perroton stated the stipulation of compliance in 30 days was reasonable. It was noted total restriping of on-site parking could not be accomplished without consent of the landlord. There were no audience comments and Chm. Graham closed the public hearing. Additional Commission comment: would like site plan with dimensions; difficult to determine parking needs and available parking. Page 4 Burlingame Planning Commission Minutes May 29, 1984 C. Giomi moved for approval of this special permit with the following conditions: (1) that the conditions of the Fire Marshal's mew of May 2, 1984, the Chief Building Inspector's memo of May 11, 1984 and the City Engineer's mann of May 16, 1984 be met; (2) that a plan showing the proposed parking layout and restriping of the existing parking area assigned to Europa Rents at the rear of the building be submitted, approved by the City Engineer and implemented; this plan shall show three designated employee parking spaces and five spaces designated for returns; (3) that this car rental agency be limited to a fleet of 21 cars and a maximum of three employees on site at any one time; one shuttle vehicle, operating seven days a week; auto storage be limited to the 40' x 60' fenced in area and interior of the building when brought up to code with five auto return stalls designated; all employees shall be required to park on site; (4) that there shall be no storage of inoperable vehicles on this site; (5) that there shall be no auto repair, oil changing or car washing on this site; and (6) that this permit be reviewed in 30 days (June 28, 1984) for compliance with all conditions and reviewed in six months time (December 28, 1984) for continued compliance with the items of operation. Second C. Schwalm; motion approved on a 4-3 roll call vote, Cers Garcia, Leahy and Taylor dissenting. Appeal procedures were advised. 5. EXTENSION OF CONDOMINIUM PERMIT FOR A 5 -UNIT RESIDENTIAL PROJECT AT 1105 EL CAMINO REAL, ZONED R-3, BY SONNY MARTIN CP Monroe reviewed this item. Reference Staff Report -5/29/84; letter from the applicant, 5/14/84; Monroe letter of action, May 20, 1983; Planning Cammission minutes, May 9, 1983; Staff Report -5/9/83 with attachments. CP commented on the condominium permit approved in May 1983 and conditions for guest parking imposed at that time. C. Jacobs moved that this condominium permit be extended for one year (May 1985) with all conditions of the original approval. Second C. Garcia; motion approved unanimously on voice vote. AMENDMENT OF SIGN EXCEPTION - 1877 ROLLINS ROAD - BY JULIE DE KELAITA OF THE BACKALLEY DELI Requests: history of signage on this site and the master sign permit; is this the original property owner? do the other companies listed on the proposed sign agree to this signage change? Item set for hearing June 11, 1984. 7. PROPOSED GENERAL PLAN AMENDMENTS - (CONTINUED FROM 5/14/84) CP Monroe discussed the five proposed general plan amendment requests and reviewed in some detail with Cammission the 15 suggested amendments to the general plan map to improve consistency between the general plan land use designation and the zoning designation. Commission wished to study Item #4, change in land use designation from service and special sales commercial to office on the California Drive frontage from Broadway to Oak Grove, further and will give direction to staff at its next meeting. Burlingame Planning Commission Minutes Page 5 May 29, 1984 The following items were set for public hearing June 11, 1984: (1) change in land use designation from high density residential to service and special sales commercial on California Drive between Bellevue and Floribunda, applicant Pierre Derouineau; and (2) change in land use designation from hotel to office on a parcel located between 777 and 731 Airport Boulevard in the Anza Area, applicant David H. Keyston. Staff's proposed amendments (15) to improve consistency between the general plan land use designation and the zoning designation were set for public hearing June 25, 1984 with the exception of Item #5, frontage on California Drive between Juanita and Rhinette, which Commission wished to study further. All Planning Commission public hearings will be noticed in a newspaper of general circulation and to all affected property owners. - Commission review of guidelines for guest parking was continued to the meeting of June 11, 1984. Commission requested staff provide a map/data detailing on -street parking problems in multiple family residential areas. - CP reviewed Council actions at its May 15, 1984 study meeting and May 21, 1984 regular meeting. - Proposed Capital Improvement Program, 1984-89. .11 1116,1111;�4i01.►r The meeting adjourned at 11:00 P.M.
