ROLL CALL Present: Commissioners Cistulli, Garcia, Giomi, Graham, Harvey, Leahy, Mink Absent: None Staff Present: City Planner Margaret Monroe; City Attorney Jerome F. Coleman; City Engineer Frank C. Erbacher MINUTES - The minutes of the May 10, 1982 meeting were unanimously approved and adopted. AGENDA - Order of the agenda unanimously approved. ITEMS FOR ACTION 1. FENCE EXCEPTION TO ALLOW A 7'-0" FENCE ALONG A PORTION OF THE SIDE LOT LINES AT 119 PRIMROSE ROAD, BY STEVE MUNKDALE CP Monroe reviewed this application to allow a one foot fence exception for a new fence along the side property lines of a condominium project under construction. Reference staff report for this item; Project Application & CEQA Assessment received 5/4/82; aerial photograph; "no comments/objections" memos from the Chief Building Inspector (5/12/82), Fire Marshal (5/10/82) and City Engineer (5/14/82); May 3, 1982 letter from Steve Munkdale, Munkdale Bros., Inc. and plans date stamped May 4, 1982. CP discussed details of the site, code requirements and applicant's justification for his request. Planning staff recommended approval with one condition as listed in the staff report. It was noted the plans indicate the fence would extend into the front setback on both Primrose and El Camino Real; staff did not believe the fence would increase the visual hazard on E1 Camino. Steve Munkdale, the applicant, was present. He stated the proposed fence would not extend into either of the setbacks, agreed to erect the fence behind the setback on Primrose and only as far into the El Camino Real front setback as the northwest corner of the 50/50 Muffler shop on El Camino. He advised the fence would be constructed of wood as shown on the plans with a wrought iron gate. Chm. Mink opened the public hearing. There were no audience comments and the hearing was declared closed. A concern was expressed about a 7' fence should the adjacent property on the north side be developed in residential uses in the future. C. Harvey noted Commission policy has been to base approvals on present site conditions and he was reluctant to penalize the applicant for something that might happen in future. He found there were exceptional circumstances, that the fence abuts a major concrete structure which would be unlikely to be torn down in the immediate future, that the apparent height of the fence on the other side would be only 6', that the existing eucalyptus trees on E1 Camino will not be removed and the fence would in no way Burlingame Planning Commission Minutes Page 2 May 24, 1982 create an additional public hazard; that the neighboring properties would not be materially damaged but rather the fence would serve as a visual screen, that the fence would improve the outlook for the residents of the new condominium, and that if this exception were not granted it would be a hardship upon the petitioner to provide the visual amenity he needs. C. Harvey then moved for approval of this fence exception, the fence to be erected in accordance with the plans date stamped May 4, 1982 and staff's understanding of the amendment as discussed this evening. SPECIAL PERMIT TO ALLOW AN AUTO STEREO REPAIR AND INSTALLATION FACILITY IN THE M-1 DISTRICT AT 833 MAHLER ROAD, BY PULSAR ELECTRONIC SYSTEMS CP Monroe reviewed this request to operate a car stereo repair and installation service. Reference staff report dated 5/17/82; Project Application & CEQA Assessment received 4/8/82; aerial photograph; site plans; April 20, 1982 memo from the Chief Building Inspector; April 20, 1982 memo from the Fire Marshal; 4/19/82 memo from the City Engineer; list of tenants - 833 Mahler Road; memo from the Zoning Aide dated 4/14/82; March 11 and 18, 1982 letters from the applicant; April 28, 1982 letter from the property owner, Dorothy M. Kruger; April 26, 1982 study meeting Planning Commission minutes. CP discussed details of the proposal, staff review, applicant's letters of explanation, on-site parking. Approval was recommended with five conditions as listed in the staff report. Paul Wilkinson of Pulsar Electronic Systems was present with Commission. Chm. Mink opened the public hearing. and the hearing was declared closed. Giomi moved for approval of this special permit with the following conditions: (1) that no retail sales occur on this site; (2) that 10 parking spaces be designated for the use of Pulsar Electronics and that employees on the site not exceed 8; (3) that the conditions of the Chief Building Inspector's memo of April 20, 1982 and the Fire Marshal's memo of April 20, 1982 be complied with; (4) that the commit- ments of the applicant's letters of March 11 and March 18, 1982 and the Planning staff's notes of March 14, 1982 be complied with; and (5) that this permit be reviewed for compliance with conditions of approval in one year or when the number of employees reaches six persons, whichever occurs first. SPECIAL PERMIT TO ALLOW AN OFFICE USE IN CONJUNCTION WITH A MEETING HALL AND CLASSROOMS IN THE M-1 DISTRICT ON THE NORTHWEST CORNER OF ROLLINS AND DAVID ROADS, BY WAYNE HOLLAND, ARCHITECT FOR SPRINKLER FITTERS LOCAL 483 CP Monroe reviewed this application for a 17,100 SF building in the M-1 zone for local union offices, training classes and leasing of office space. Page 3 Burlingame Planning Commission Minutes May 24, 1982 Barton, Business Manager, Local 483 (received after preparation of the staff report). CP discussed the proposed uses for this 17,100 SF building, parking provided, staff review, responses to questions raised at the study meeting. If approved, staff recommended five conditions as listed in the staff report. Wayne Holland, project architect, was present. He commented on the union's search for a suitable location in this area, the problems presented by the utility and access easements, design and placement of the proposed structure and proposed landscaping. Discussion: the building would be 35' high, within code requirements; relocation of the parking spaces in the access easement and possible need to reduce building by 200' if adjacent owner will not agree to union hall use of the required space within their half of the easement. Chm. Mink opened the public hearing. Ted Ajluni, owner of Ted's Deli directly behind the site, expressed concerns: disruption and noise during construction and repaving, availability of parking, safety of the deli's customers when the main access to the David Road property is in front of the deli, visual impact. There were no further comments and the public hearing was closed. Wayne Holland advised the visual impact on the adjacent property had been taken into consideration when locating the proposed building on this site. Discussion: hours of operation of the deli and of tenants of the new structure; Commission policy to require parking for such structures to meet code, each use can stand alone. C. Harvey commented that this application is before Commission only because of the office use in an M-1 zone; that a developer could erect a structure on this site which complies with all current codes with only a building permit and it would be unlikely many of the concerns affecting the deli and addressed by this project's architect would be taken into consideration. During discussion two further conditions of approval were suggested. C. Graham moved for approval of this special permit with the following conditions: (1) compliance with the conditions in the memos of the Fire Marshal (April 29, 1982), Chief Building Inspector (May 17, 1982) and City Engineer (May 17, 1982); (2) submittal of a letter from the property owner at 1530 Rollins Rd -agreeing to the relocation of four required parking spaces now in the access easement to the location shown on the David and Rollins Road site plan date stamped April 30, 1982 and marked "revised plans"; (3) submittal of a letter of agreement from the property owner at 1530 Rollins Road agreeing to let the Pipefitters Union office building meet their required parking by placing one space on the adjacent property owner's side of the access easement and recordation of this agreement as a part of the easement; (4) adequate exterior lighting, as approved by the City Engineer, to provide for the safety and convenience of those using the site in the evening hours; (5) compliance with the plans date stamped April 30, 1982 marked "revised plans"; (6) that one through lane of paved access be maintained to David Road during construction; and (7) that the applicant maintain the landscaping on city property. The Chair noted that the building permit would not be issued until the required letters from the property owner at 1530 Rollins Rd.are received by the city and all the easements with their conditions recorded. Appeal procedures were advised. 4. SPECIAL PERMIT TO ALLOW A RETAIL/SERVICE USE IN SUB -AREA D OF THE BURLINGAME AVENUE COMMERCIAL AREA, AT 212 CALIFORNIA DRIVE, BY WILLIAM J. MASTERSON CP Monroe reviewed this application to allow an office equipment center, retail and service outlet. Reference staff report dated 5/17/82; Project Application & CEQA Assessment received 4/2/82; aerial photograph; 5/10/82 memo from the Fire Marshal; 5/10/82 memo from the City Engineer; 5/12/82 memo from the Chief Building Inspector; Page 4 Burlingame Planning Commission Minutes May 24, 1982 April 5, 1982 letter from William J. Masterson, Universal Office Equipment Center, applicant; 5/14/82 letter from David Kimmel, property owner; and plans date stamped April 30, 1982. CP discussed code requirements and staff review. Approval was recommended with two conditions as listed in the staff report. William Masterson, the applicant, was present. Chm. Mink opened the public hearing. There were no comments and the hearing was closed. Discussion: number of service vehicles used by this company; the good business reputation of this firm in the City of Burlingame; the move is basically just across the street. C. Harvey moved for approval of this special permit with the following conditions: (1) compliance with the conditions of the Fire Marshal's memo of May 10, 1982 and the Chief Building Inspector's memo of May 12, 1982; and (2) that the right of access to bathroom facilities is maintained for this leased area at all times. SPECIAL PERMIT TO ALLOW CLASSES TO BE CONDUCTED AFTER REGULAR WORKING HOURS AT 329 PRIMROSE ROAD IN SUB -AREA A OF THE BURLINGAME AVENUE COMMERCIAL AREA, BY DIANNE SANLORENZO CP Monroe reviewed this request for a school above the first floor, operating outside of retail hours. Reference staff report dated 5/14/82; Project Application & CEQA Assessment received 4/21/82; aerial photograph; site plans; April 19, 1982 letter from Dianne M. Sanlorenzo, applicant; 4/23/82 memo to file from the Zoning Aide; April 30, 1982 letter from G. W. Williams Co., property owner; "no comments/objections" memos from the City Engineer (5/4/82), Chief Building Inspector (5/12/82) and Fire Marshal (5/10/82); May 14, 1982 letter from the Chief of Police. CP discussed details of the proposed classes, staff review. Approval was recommended with three conditions as listed in the staff report. Chm. Mink opened the public hearing. There were no audience comments and the hearing was closed. Dianne Sanlorenzo, the applicant confirmed the limitations on hours of operation, number of students and classes were acceptable. C. Graham moved for approval of this special permit with the following conditions: (1) compliance with the conditions of operation and advertisement outlined in the applicant's letter of April 19, 1982; (2) that classes be limited to a maximum of three students at any one time, offered only three times per week, not on weekends, and between the hours of 7:00 P.M. and 9:00 P.M.; and (3) that the applicant maintain her license from the State to operate this school of massage and her masseuse permit from the Burlingame Police Department. Second C. Leahy; motion approved unanimously on roll call vote. Appeal procedures were advised. 6. REVIEW OF 1/26/81 SPECIAL PERMIT FOR THE MALCOLM CENTRE COFFEE SHOP, 866 MALCOLM ROAD CP Monroe noted Planning Commission action at its 2/8/82 meeting, extending this special permit for a three month period. Reference staff report dated 5/17/82; Planning Commission minutes of February 8, 1982; May 6, 1982 memo from the Chief Building Inspector; staff report with attachments for the 2/8/82 Planning Commission meeting. CP noted the wooden wall had been reduced to six feet, now serving as a fence enclosing the patio area (as required by the February 8, 1982 action). Staff recommended approval of this use permit with four conditions as listed in the staff report. Page 5 Burlingame Planning Commission Minutes May 24, 1982 C. Graham moved to accept staff's review and approve this special use permit with the following conditions: (1) that the size, location and operation of this coffee shop be consistent with the materials filed with the January 26, 1981 use permit application; (2) that the conditions recommended by the Chief Fire Inspector and Chief Building Inspector in their respective memos of January 8 and January 9, 1981 be met to each department's satisfaction; (3) that the wooden wall remain no higher than 6 feet; and (4) that this permit be reviewed when a complaint is received or when the applicant requires an amendment. Second C. Leahy; motion approved unanimously on voice vote. 7. EXTENSION OF 5/27/81 TENTATIVE PARCEL MAP, TENTATIVE SUBDIVISION MAP AND CONDOMINIUM PERMIT FOR A 3 UNIT PROJECT AT 1299 EL CAMINO REAL Reference City Engineer's May 18, 1982 memo with attached letter from Jean Gorostiague, G+B Contractors, Inc. requesting a one year extension. CE Erbacher advised the applicant had applied for a building permit. He recommended approval of the request for extension. C. Graham moved for approval and recommendation to City Council of this one year extension. Second C. Garcia; motion approved unanimously on voice vote. CITY PLANNER REPORT CP Monroe reported Council actions at its May 17, 1982 meeting:. - granted traffic allocation to the BayBreeze office building, 1484 Bayshore Highway. - denied traffic allocation to the mixed use proposal, Legaspi Plaza, 350 Airport Blvd. - referred the matter of Oxford/Cambridge/El Camino signalization to public hearing before the Traffic, Safety & Parking Commission to determine whether the temporary measures now in effect could be made permanent. - agreed to send a letter to the Airports Commission requesting that Runway 19 be closed down. - set for hearing June 7, 1982 an appeal of Planning Commission approval of condominium permit at 518-524 Primrose Road. - acknowledged receipt of letters regarding Council's denial of a general plan amendment allowing mixed use in two areas of the city. REVISIONS TO THE C-1 AND C-2 ZONES TO CLARIFY RESIDENTIAL USES Reference staff report dated 5/19/82 with attached C-1 and C-2 District Regulations from the Zoning Code. CP Monroe recommended that all residential uses in C-1 and C-2 zones become conditional uses and that a section be added to the General Provisions of the Zoning Code regarding consistency with the General Plan, special area plans and CEQA. The suggested revisions were detailed in her staff report. Following some discussion staff was requested to return to the Commission for public hearing a proposed ordinance revision as detailed in the staff report. EIR-58P, ANZA OFFICE PARK, 477 AIRPORT BOULEVARD Commission acknowledged receipt of this Draft Environmental Impact Report. It is expected the Draft EIR will be heard at Commission's June 28, 1982 meeting. Burlingame Planning Commission Minutes Page 6 May 24, 1982 GUEST PARKING POLICY FOR CONDOMINIUM AND MULTIPLE FAMILY DEVELOPMENT Reference staff report dated 5/18/82 with attached memo from the Fire Marshal dated May 12, 1982. CP Monroe noted Commission's previous discussions regarding guest parking and the Fire Marshal's review of fire exiting requirements. A suggested guest parking policy was detailed in the staff memo, and Commission comments requested. During discussion it was pointed out there are many sites in Burlingame that do not lend themselves to normal architectural design and it is extremely difficult to provide a gate for guest parking in a manner that would not totally destroy the architectural concept of the garage. For example, the typical building module is such that it would have 6 spaces outside a gate. Further discussion: compact cars; concern about security; the fact that this suggested policy is only a guideline, not a code requirement, its purpose being to provide readily accessible guest parking off-street; staff's present procedure of meeting with applicants in the early design stage of a project. There was consensus to accept staff's recommended policy on guest parking: 20% of the required parking to be designated for guests, with at least four spaces outside the security gate except on E1 Camino Real where all guest spaces should be outside the security gate.
