ROLL CALL Present: Commissioners Cistulli, Graham, Harvey (arrived 8:05 P.M.), Jacobs, Mink, Taylor, Sine Absent: None Staff Present: City Planner John R. Yost; City Attorney Jerome F. Coleman; City Engineer Frank C. Erbacher MINUTES - Upon motion of C. Jacobs, second C. Cistulli, the minutes of the March 9, 1981 meeting were approved and adopted. AGENDA - Upon motion of C. Mink, second C. Cistulli, order of the agenda approved. APPLICATIONS FOR ACTION 1. AMENDMENT OF SPECIAL PERMIT CONDITIONS, PROPERTY AT 1007-1015 ROLLINS ROAD AND 1008 CAROLAN AVENUE: REQUEST BY MICHAEL R. HARVEY OF MIKE HARVEY OLDSMOBILE CP Yost reviewed this request by Michael R. Harvey that the on-site employee parking requirement for the above sites be reduced from 44 spaces to 14 spaces. Reference staff report dated 3/19/81; January 14, 1981 memo to the Chairman of the Planning Commission from the Chairman of the Traffic, Safety & Parking Commission; March 2, 1981 letter from Michael R. Harvey; June 25, 1979 and May 8, 1979 letters of action to Michael R. Harvey from the City Planner; site plan; site development plan; proposed improvements at Carolan Avenue site; Planning Commission minutes of April 23, 1979 and May 30, 1979; Project Assessment for 1007-1015 Rollins Road; April 10, 1979 letter from Michael R. Harvey; Project Assessment for 1008 Carolan Avenue; May 16, 1979 letter from Michael R. Harvey; March 18, 1981 memo from the City Engineer; and March 1.8, 1981 letter from Arata Honda. CP discussed these special permits, concerns expressed about traffic and off-site parking and the applicant's March 2, 1981 request. In the absence of new information from the applicant and in view of problems experienced by nearby residents, staff recommended this request be denied. Discussion: there are a number of businesses in the area whose employees park on the street; Arata Honda is now in compliance with the requirements of its permit. Chm. Sine read March 18, 1981 letter in opposition from Arata Honda, 1020 Carolan Avenue.. He then opened the public hearing. Michael R. Harvey, the applicant discussed his meeting with the Traffic, Safety & Parking Commission, alternate plans for employee parking, and advised that he has 39 employees on-site during regular business hours; he also reported that approximately 26 vehicles are regularly driven to work by his employees. There was considerable discussion between the applicant and Commission concerning the actual number of parking spaces required. There were no audience comments in favor. Robert Hagen, business manager for Teevan Painting Company, 101.9 Rollins Road spoke in opposition to the amendment and noted his company's expansion and inadequate parking. There were no further comments and the hearing was closed. Page 2 Burlingame Planning Commission Minutes March 23, 1981 Further discussion: a concern about establishing fair parking standards for all businesses in the area; the "whole area is troublesome"; and the possible implementation of a shuttle service for employee parking on California Drive at Oak Grove. C. Graham moved to allow an amendment of the April 23, 1979 and June 18, 1979 special permits by reducing the on-site employee parking requirement to 19 spaces. Second C. Taylor; motion defeated on a 2-4 roll call vote, Cers Cistulli, Jacobs, Mink and Sine dissenting, C. Harvey abstaining (since he arrived late, and missed the public hearing). C. Jacobs then moved to allow an amendment to these special permits by reducing on-site employee parking to 14 spaces, with the requirement that Mike Harvey Oldsmobile implement a shuttle service for employees between the public parking lot on California Drive at Oak Grove and the company's service shop on Carolan Avenue, this this amendment to be reviewed in six months. Second C. Cistulli. Following a question on the motion, there was some discussion regarding the applicant's relationship with union employees and his ability to implement a shuttle service; Mr. Harvey reported that half of his employees at these sites are not union members. Motion failed on a 3-3 roll call vote, Cers Graham, Mink and Taylor dissenting, C. Harvey abstaining. C. Taylor then moved to allow an amendment on-site employee parking requirement of 44 six month trial period. Second C. Jacobs; C. Mink dissenting, C. Harvey abstaining. to the prior permits, reducing the present spaces down to 14 employee spaces, for a motion approved on a 5-1 roll call vote, Appeal procedures were advised. At this point in the meeting Chm. Sine moved to agenda items #13 and #14, having previously advised the audience that he and C. Taylor were retiring after a combined 25 years of service to the City. Secy. Harvey read.Resolutions of Commendation and Appreciation, signed by all Commissioners, and adopted by acclamation. The Chair recognized in the audience wives of the retirees, Kathryn Sine and Jane Taylor; Councilman and Mrs. Mangini; Councilman and Mrs. Amstrup; former Postmaster Larry Putman and Mrs. Putman; former Planning Commissioner Everett Kindig and Mrs. Kindig; former Mayor Charlotte Johnson. Councilman Mangini read letters of appreciation signed by the five members of City Council. Both he and Councilman Amstrup expressed appreciation for the many years of interest in and untiring service to the City; this was followed by a tribute from Mrs. Johnson and others in the audience. A short recess was then called for cake and coffee, with the audience invited to participate. Meeting reconvened at 9:25 P.M. 2. SPECIAL PERMIT TO OPERATE AN AUTOMOTIVE REPAIR SHOP FOR IMPORTED CARS AT 60 STAR WAY, ZONED M-1, BY MIKE O'DONNELL OF MICHAEL'S IMPORT SERVICE CP Yost reviewed this application to operate an automotive repair shop at 60 Star Way. Reference staff report dated 3/16/81; Project Application & CEQA Assessment accepted by staff 2/27/81; site plans; aerial photograph; proposed floor plan; February 13, 1981 letter from Michael O'Donnell; March 11, 1981 memo from the Chief Building Inspector; 3/5/81 memo from the Chief Fire Inspector; and 3/13/81 memo from the City Engineer. CP discussed the proposal, staff comments and issues raised by the application. Staff had no objection to approval with five conditions as listed in the staff report. Michael O'Donnell, the applicant stated his intention to meet the stipulations of the CBI and operate a safe and successful business at this location. Chm. Sine opened the public hearing. There were no audience comments and the hearing was closed. There were no Commission concerns or objections to this application. Page 3 Burlingame Planning Commission Minutes March 23, 1981 C. Jacobs moved for approval of this special permit with the following conditions: (1) that the permit be approved to Michael O'Donnell of Michael's Import Service, and be nontransferable; (2) that the operation of the automotive repair shop be consistent with the February 13, 1981 letter from Mr. O'Donnell; (3) that all vehicles being serviced shall be kept within the workshop area, and not parked or stored in the parking spaces adjacent to the building; (4) that the building improvements recommended in the March 3, 1981 memo from the Chief Fire Inspector and March 11, 1981 memo from the Chief Building Inspector be completed to each department's satisfaction prior to any auto service use of this property; and (5) that the permit be reviewed in one year, and be subject to possible modification at that time. Second C. Cistulli; motion approved unanimously on roll call vote. Appeal procedures were advised. 3. CONDOMINIUM PERMIT TO CONSTRUCT A 6 UNIT PROJECT AT 25 HIGHLAND AVENUE, BY HANS KASTRUP OF BAY INVESTORS CP Yost reviewed this application to construct six 2 -story townhouses. Reference staff report dated 3/13/81; Project Application & CEQA Assessment accepted by staff 3/5/81; aerial photograph; March 10, 1981 memo from the Chief Building Inspector; March 4, 1981 memo from the Chief Fire Inspector; March 16, 1981 memo from the City Engineer; March 3, 1981 memo from the Park Director; and architectural plans date stamped March 2, 1981. CP discussed details of'.the project, compliance with the zoning_ code and condominium guidelines, and staff comments. Approval was recommended. with three conditions as listed in the staff report. Louis Arata, representing the applicant, was present. Chm. Sine opened the public hearing. Timothy Coyne, 27 Highland Avenue expressed concern that the project might shade his solar panels, that the living quarters would face his property and questioned the proposed fencing along his property line. Staff and Mr. Arata discussed these matters, noting that the City has no regulations regarding solar panels, that the designer has attempted to minimize the height of the structure and that any fencing will be to code standards. There were no further comments and the public hearing was closed. It was determined that all on-site parking will be below grade. Commission comments: no objection to the project; it meets all existing codes and guidelines of the City. C. Jacobs moved for approval of this condominium permit with the following conditions: (1) that the final working drawings for this condominium project be consistent with the plans filed with this application; (2) that the conditions recommended by the March 4, 1981 memo from the Chief Fire Inspector, the March 10, 1981 memo from the Chief Building Inspector and the March 16, 1981 memo from the City Engineer be met to the satisfaction of each department; and (3) that the final landscaping and irrigation plans be approved by the Park Department prior to the issuance of a building permit. Second C. Graham; motion approved unanimously on roll call vote. Appeal procedures were advised. 4. TENTATIVE SUBDIVISION MAP FOR 6 CONDOMINIUM UNITS AT 25 HIGHLAND AVENUE CE Erbacher recommended approval; reference his March 18, 1981 memo. C. Taylor moved for approval and recommendation to City Council of this tentative subdivision map. Second C. Graham; motion approved unanimously on voice vote. 5. SPECIAL PERMIT TO OPERATE A SNACK BAR IN THE M-1 DISTRICT AT 851 BURLWAY ROAD, BY HARRY A. ROSE OF LA PETITE CAFE CP Yost reviewed this application to operate a snack bar on the second floor of the Wells Fargo Building at 851 Burlway Road. Reference staff report dated 3/13/81; Page 4 Burlingame Planning Commission Minutes March 23, 1981 Project Application & CEQA Assessment accepted by staff 2/26/81; aerial photograph; site plans; February 17, 1981 letter from Harry A. Rose; March 16, 1981 letter from Westates Management; minutes of the February 25, 1980 Planning Commission meeting approving a coffee shop at this location; and January 18, 1980 letter from John Douveas, the previous applicant. CP discussed the 1980 application and details of the present application. No complaints have been received. Staff recommended approval with five conditions as listed in the staff report. Harry Rose, the applicant advised that he did not intend to make any changes in the operation. Chm. Sine opened the public hearing. There were no comments and the hearing was closed. C. Mink moved for approval of this special permit with the following conditions: (1) that the permit be approved to Harry A. Rose and be nontransferable; (2) that the size of the coffee shop be consistent with the plan dated February 18, 1981; (3) that not more than 6 tables/20 chairs be available for customer use; (4) that the hours of operation not exceed 8:00 A.M. to 4:00 P.M.; and (5) that the permit be subject to review in one year and be subject to possible modification at that time. Second C. Cistulli; motion approved unanimously on roll call vote. Appeal procedures were advised. 6. SPECIAL PERMIT TO OPERATE A CAR RENTAL AGENCY IN THE M-1 DISTRICT AT 1299 BAYSHORE HIGHWAY, BY DALLAS R. WARD OF TRAVL-CAR RENT -A -CAR CP Yost reviewed this application to operate a car rental agency on the site used by Aero Rent-A-Car since 1971. Reference staff report dated 3/17/81; Project Application & CEQA Assessment accepted by staff 3/3/81; aerial photograph; site plans; January 26, 1981 letter from Dallas R. Ward; Rent-A-Car Questionnaire received January 23, 1981; Assignment of Lease by Aero Rent-A-Car to Travl-Car Rent-A-Car; March 3, 1981 statement of tenancy from Aero Rent-A-Car and Travl-Car Rent-A-Car; and staff comments as follows: from the City Engineer dated 3/13/81, from the Chief Building Inspector dated 3/6/81, from the Chief Fire Inspector dated 3/9/81. Further supplemental reference: Burlingame Car Rental Agencies, January 1, 1981. CP discussed details of this application and staff's observations of Aero Rent -A -Car's operation. There was: no objection to approval with four conditions as listed in the staff report. Cyrus J. McMillan, attorney representing the applicant, advised this operation would not expand the present use and confirmed acceptance of the proposed conditions. He advised that gasoline would be dispensed on-site from an existing gasoline pump. Chm. Sine opened the public hearing. There were no comments and the hearing was closed. C. Mink moved for approval of this special permit with the following conditions: (1) that the permit be approved to Travl-Car Rent-A-Car, and be nontransferable; (2) that the ooeration of the agency be consistent with the January 26, 1981 letter and January 23, 1981 Rent-A-Car Questionnaire filed by Dallas Ward with this application; (3) that all rental car servicing (except refueling), washing and interior cleaning be done off-site at locations with approved facilities; and (4) that the permit be subject to review and possible amendment in one year. Second C. Harvey; motion approved unanimously on roll call vote. Appeal procedures were advised. 7. SPECIAL PERMIT TO OPERATE A CAR RENTAL AGENCY IN THE C-4 DISTRICT AT 1640 BAYSHORE HIGHWAY, BY WILLIAM J. SHEEHY OF GOLDEN WEST RENT -A -CAR CP Yost reviewed this application to operate a car rental agency at the Vagabond Motel. Reference staff report dated 3/17/81; Project Application & CEQA Assessment accepted by staff 3/3/81; aerial photograph; site plan; February 13, 1981 letter from William J. Burlingame Planning Commission Minutes Page 5 March 23, 1981 Sheehy; Rent-A-Car Questionnaire received February 19, 1981; staff comments as follows: from the City Engineer dated 3/13/81, from the Chief Building Inspector dated 3/6/81, from the Chief Fire Inspector dated 3/9/81. Staff had no objection to approval with four conditions as listed in the staff report. Scott Becht, Burlingame office manager, was present representing the applicant. It was determined all vehicles would be washed off-site. Chm. Sine opened the public hearing. There were no audience comments and the hearing was closed. C. Jacobs moved for approval of this special permit with the following conditions: (1) that the permit be approved to Golden West Rent-A-Car, and be nontransferable; (2) that the operation of the agency be consistent with the February 13, 1981 letter and February 19, 1981 Rent-A-Car Questionnaire filed by William J. Sheehy with this application; (3) that all rental car servicing, washing and interior cleaning be done off-site at locations with approved facilities; and (4) that the permit be subject to review and possible amendment in one year. Second C. Mink; motion approved unanimously on roll call vote. Appeal procedures were advised. 8. AMENDMENT OF SEPTEMBER 22, 1980 CONDOMINIUM PERMIT CONDITION TO ALLOW DESIGN CHANGES FOR THE ARC WAY CONDOMINIUMS, 1500 WILLOW AVENUE: MARCH 3, 1981 LETTER FROM ZEV BEN-SIMON, GILCO CONSTRUCTION COMPANY CP Yost reviewed this request to allow design changes in the floor plans of the final working drawings for this project. Reference staff report dated 3/20/81; September 22, 1980 Planning Commission minutes approving the project; March 5, 1981 letter from Zev Ben -Simon, the new project owner; memo from the City Engineer received March 19, 1981; September 17, 1980 memo from the City Engineer; and amended architectural plans date stamped March 16, 1981. CP discussed the conditions of the 1980 permit, progress to date, the CE's concern about the driveway slope (two additional conditions of approval recommended), and the recent request by the new project owner. Staff had no objection to approval with three conditions as listed in the staff report. Discussion: the 26% driveway slope as opposed to the 20% indicated on the original plans; staff requirement for modification of the ramp to provide maximum feasible access. Zev Ben -Simon discussed the minor interior changes requested as well as attempts to attain a reasonable driveway slope. Chm. Sine opened the public hearing. There were no comments and the hearing was closed. It was determined all significant zoning criteria are identical to the 1980 plans. C. Jacobs moved to allow amendment of the September 22, 1980 condominium permit with the following conditions: (1) that the final working drawings for the Arc Way Condominiums be consistent with the amended plans date stamped March 16, 1981; (2) that the conditions recommended by the September 17, 1980 and March 19, 1981 memos from the City Engineer be met to the satisfaction of the Public Works Department; and (3) that the final landscaping and irrigation plans be approved by the Park Department prior to the issuance of a building permit. Second C. Cistulli; motion approved on a 6-0 roll call vote, C. Sine abstaining. Appeal procedures were advised. 9. AMENDMENT OF TENTATIVE SUBDIVISION MAP FOR 18 CONDOMINIUM UNITS AT 1500 WILLOW AVENUE. FOR GILCO CONSTRUCTION COMPANY Reference City Engineer's memo dated March 19, 1981. CE Erbacher recommended approval subject to two conditions as listed in his memo. Page .6 Burlingame Planning Commission Minutes March 23, 1981 C. Jacobs moved to approve and recommend to City Council this amended tentative sub- division map subject to the following conditions: (1) that the current owner agree to pay all map processing and City review costs for the previous map and the amended map; and (2) that the tentative map include by reference the architectural plans submitted by the current owner and received by the Planning Department on March 16, 1981. Second C. Cistulli; motion approved on a 6-0 roll call vote, C. Sine abstaining. 10. FINAL PARCEL MAP TO COMBINE LOTS 1, 2 AND 11, BLOCK 6, BURLINGAME SHORE LAND COMPANY; PROPERTY AT 811 ROLLINS ROAD (777 MORRELL AVENUE) Reference City Engineer's memo dated March 13, 1981. CE Erbacher advised this map combines the existing lots and that abandonment of an existing sewer easement is necessary. He recommended approval. C. Jacobs moved for approval and recommendation to City Council of this final parcel map. Second C. Mink; motion approved unanimously on roll call vote. 11. TENTATIVE SUBDIVISION MAP FOR 28 CONDOMINIUM UNITS AT 777 MORRELL AVENUE: REQUESTED EXTENSION OF MAY 5, 1980 COUNCIL APPROVAL Reference March 13, 1981 memo from A. M. Rebarchik and February 23, 1981 letter from William C. Kubach requesting extension of tentative map approval. CE Erbacher advised there was no staff objection to approval. C. Harvey moved to allow extension of this tentative subdivision map for a period of one year. Second C. Cistulli; motion.approved unanimously on voice vote. 12. FINAL SUBDIVISION MAP FOR 6 TOWNHOUSE UNITS AT 16 LORTON AVENUE, FOR THOMAS J. GLYNN Reference City Engineer's memo of March 18, 1981. CE Erbacher advised the final map is in full agreement with the tentative map; he recommended approval and transmittal to Council. C. Jacobs moved for approval and recommendation to City Council of this final subdivision map. Second C. Harvey; motion approved unanimously on voice vote. CITY PLANNER REPORT 15. AMENDMENT OF CURRENT REGULATIONS, BURLINGAME AVENUE OFF-STREET PARKING DISTRICT Reference March 9, 1981 letter to the City Council signed by all members of the Planning Commission; draft Urgency Interim Ordinance imposing a moratorium on new construction in the Off -Street Parking District; worksheet for study of permitted uses and conditional uses in the C-1 District; and location maps of the Burlingame Avenue Parking District and Broadway areas. Staff is preparing further study materials and will contact other cities for their input. 16. ANTHONY SCHOOLS OF SAN FRANCISCO PENINSULA, 1101 JUANITA AVENUE Reference City Planner's letter to Anthony Schools dated March 16, 1981. During further review staff determined the intended use at 1101 Juanita Avenue is specifically allowed by the Zoning Ordinance and no application was required; a refund of the filing fee has been implemented.
