ROLL CALL Present: Commissioners Cistulli, Garcia, Graham, Harvey, Jacobs, Leahy, Mink Absent: None Staff Present: City Planner John R. Yost; City Attorney Jerome F. Coleman; City Engineer Frank C. Erbacher MINUTES - Upon motion of C. Jacobs, second C. Graham, minutes of the March 23, 1981 meeting were approved and adopted. AGENDA - Upon motion of C. Cistulli, second C. Graham, order of the agenda approved. MEETING ITEMS FOR ACTION 1. ELECTION OF OFFICERS FOR 1981-1982 C. Cistulli nominated Ruth Jacobs as Chairman for 1981-1982, second C. Graham. The nominations were closed and Ruth Jacobs elected unanimously. C. Cistulli nominated " Charles Mink as Vice Chairman and Joseph Harvey as Secretary, seconded by C. Graham; the nominations were closed and Vice Chairman Mink and Secretary Harvey elected unanimously. Chm. Jacobs then accepted the gavel from Chairman Pro Tem Mink. 2. VARIANCES TO ADD A 487 SF SECOND FLOOR TO THE EXISTING NONCONFORMING HOME AT 1640 CARMELITA AVENUE. BY JOHN AND LYNNE HIGGS CP Yost reviewed this application to allow the addition of a second floor with two bedrooms and bath to the existing 1760 SF home. Reference staff report dated 4/9/81; Project Application & CEQA Assessment accepted by staff 4/1/81; aerial photograph; March 28, 1981 letter from John M. Higgs; April 10, 1981 memo from the Chief Building Inspector; and plans date stamped March 30, 1981. CP discussed the existing structure, variances required and issues involved. Staff recommended approval of the first variance, to allow remodeling of this house with a nonconforming side setback, and denial of the second variance, to allow the addition without providing a second on-site parking space. John Higgs distributed photographs and a drawing of the property indicating existing trees relative to the house and where the carport might be located. He also read letters from the following neighbors in support of his application: Suzi Walen, 1047 Balboa Avenue; Madeline Muzio, 1101 Cortez Avenue; Sidney and Emma Gorman, 1308 Alvarado Avenue; Frederick Sherman, 1100 Balboa Avenue. Mr. Higgs believed the present garage would be sufficient for his family's needs. He discussed his and his neighbors' enjoy- ment of the large yard with its many fruit trees and his hope not to lose any of this area to a carport or paved parking area. Helen Kurtz, 1104 Cortez Avenue, a next door neighbor, spoke in favor of the application and retaining all the trees. There were no further comments and the public hearing was closed. Discussion: Commission's responsibility to consider future owners of the property; setbacks and code requirements for parking spaces; possible alternatives; carport versus paved parking area. C. Harvey had no objection to granting the first variance to allow the addition of a second floor and found that it would be impractical to move the house. He further found there were exceptional circumstances with this older hone and present owner's need for more space, that it would not be detrimental or injurious to the neighborhood and would not adversely affect the comprehensive zoning plan of the city. C. Harvey then moved to approve the variance from a nonconforming side setback and allow the second floor addition consistent with the plans filed with this application. Second C. Mink; motion approved 7-0 on roll call vote. C. Mink then found there were several reasonable solutions to providing a second on-site parking space and C. Graham advised that the legal requirements for this second variance did not appear to be met. C. Graham then moved to deny the second variance. Second C. Mink; motion to deny approved 7-0 on roll call vote. It was noted that this denial will require that a second on-site parking space be provided at the time a building permit is requested for the addition. Appeal procedures were advised. 3. SPECIFIC AREA PLAN - BURLINGAME BAYFRONT: COMMISSION RESOLUTION NO. 1-81 Reference CP's 4/8/81 memo with attachments: Resolution No. 1-81 Recommending Specific Area Plan, Burlingame Bayfront and Planning Commission minutes of February 9, 1981. CP Yost noted the Final Addendum prepared by Torrey & Torrey Inc. and processing of this SAP to date. This Final Addendum completes the required due process. CA Coleman advised that staff was satisfied this was a complete and legal document. Staff also advised all changes would be made in the SAP at the time of final reprinting. C. Mink found the responses in the Final Addendum to be consistent with all previous discussion. He then moved for adoption of Resolution No. 1-81. approving the Specific Area Plan The Burlingame Bayfront, dated September 1, 1980, including the Final Addendum dated April 2, 1981, and recommendation to City Council for adoption. Second C. Harvey; motion approved 7-0 on roll call vote. APPLICATIONS FOR STUDY The following applications were set for public hearing on April 27, 1981. 4. SPECIAL PERMIT TO ESTABLISH A NEW SAVINGS AND LOAN IN A 950 SF OFFICE AT 1310 HOWARD AVENUE, BY BAY VIEW FEDERAL SAVINGS & LOAN ASSOCIATION CA confirmed this application was categorically exempt from the terms of the six month moratorium on construction in the downtown parking district. 5. VARIANCE TO CONSTRUCT A CANOPY OVER THE SERVICE YARD ADJACENT TO THE MARQUEE BUILDING OF THE HYATT HOTEL, AT 1333 BAYSHORE HIGHWAY Staff to take photographs of the area for the public hearing. 6. CONDOMINIUM PERMIT TO CONSTRUCT A 16 UNIT OFFICE CONDOMINIUM AT 345 LORTON AVENUE, BY D. L. WALKER ARCHITECTURAL SERVICES This project is also exempt from the moratorium on construction in the Burlingame Avenue area. Burlingame Planning Commission Minutes 7.. TENTATIVE SUBDIVISION MAP FOR THE ABOVE Page 3 April 13, 1981 8. CONDOMINIUM PERMIT TO CONSTRUCT A 2 UNIT TOWNHOUSE AT 1015 CHULA VISTA AVENUE, BY BARRY G. SMITH, AIA This is the first duplex condominium application to be received by the city. Application to be set for public hearing April 27 only if the CC&Rs are received and approved by the City Attorney prior to the date for sending notices of hearing. 9. TENTATIVE PARCEL MAP FOR THE ABOVE To be set for hearing at the time of the condominium permit. OTHER BUSINESS 10. AMENDMENT OF CURRENT REGULATIONS, BURLINGAME AVENUE OFF-STREET PARKING DISTRICT CP Yost discussed staff studies to date. Data to be provided for the next meeting will include a detailed map of the parking district, analysis of existing downtown businesses and gross floor area by type of use. This will be presented block by block and by zone. Neighboring cities have been contacted and their experience will be detailed. Commission discussion followed; several additional items and ideas which might be helpful were suggested by Commission. 11. REVIEW OF APRIL 7, 1980 SPECIAL PERMIT TO ALLOW DOLLAR RENT -A -CAR TO SELL USED RENTAL CARS IN THE DISTRICT AT 1815 BAYSHORE HIGHWAY Reference staff report dated 4/10/81; April 10, 1981 letter from James E. Saunders; April 7, 1980 City Council appeal hearing minutes and staff report for that meeting. CP Yost noted Planning Commission hearing, City Council appeal hearing and conditions of Council approval. An April 9, 1981 site inspection had confirmed the use of this property is consistent with the terms and limitations of both the 1978 permit and its 1980 amendment; staff advised no action is necessary at this time. Commission concurred. 12. LIMITATIONS TO CONDITIONAL USE PERMITS: APRIL 6, 1981 MEMO FROM THE CITY ATTORNEY CA Coleman discussed his April 6 memo, noting recent court rulings to the effect that conditional use permits must run with the land and that they cannot be personal to the owner or user of the property. He recommended that Commission no longer impose a condition limiting conditional.use permits to the applicant and that time limits to such permits be used sparingly. Chairman Jacobs welcomed new Commissioners Garcia and Leahy. ADJOURNMENT The meeting adjourned at 8:50 P.M. Respectfully submitted, Joseph E. Harvey Secretary
