CALL TO ORDER
A regular meeting of the Planning Commission, City of Burlingame was called to order
by Chairman Jacobs on Wednesday, May 27, 1981 at 7:33 P.M.
ROLL CALL
Present: Commissioners Cistulli, Garcia, Graham, Harvey, Leahy, Mink, Jacobs
Absent: None
Staff Present: City Planner John R. Yost; City Attorney Jerome F. Coleman;

MINUTES - Upon motion of C. Graham, second C. Cistulli, the minutes of the May 11, 1981
meeting were approved and adopted.
AGENDA - Items 7, 8 and 9 were continued to the meeting of June 8, 1981; items 15 and
16 added at the request of the Chairman. With these changes C. Harvey moved
for approval of the agenda, second C. Cistulli; order of the agenda unanimously
approved.
MEETING ITEMS FOR ACTION
1. CONDOMINIUM PERMIT TO CONSTRUCT A 2 UNIT TOWNHOUSE AT 1015 CHULA VISTA AVENUE,
BY BARRY G. SMITH, AIA WITH RONALD J. VERNALI OF JANUS BUILDERS
CP Yost reviewed this application to construct a 22 story duplex townhouse. Reference
staff report for the May 11, 1981 meeting; Project Application & CEQA Assessment
accepted by staff 4/6/81; aerial photograph; April 14, 1981 memo from the Chief Building
Inspector; April 13, 1981 memo from the Chief Fire Inspector; May 5, 1981 memo from the
City Engineer.; May 11, 1981 request for a two week continuance from Barry G. Smith; new
plans date stamped May 21, 1981; and staff memo for the May 27, 1981 meeting. CP
discussed compliance with zoning ordinance requirements, consistency with the condominium
guidelines and staff comments. Approval was recommended with three conditions as listed
in the staff report.
Barry Smith, architect representing Janus Builders, advised the plans had been revised
to add a second legal exit from the attic bedroom of each unit. Chm. Jacobs opened
the public hearing. There were no comments in favor. The following spoke in opposition:
Louis Berman, 1020 Laguna Avenue and Maureen DeLiegh, 1005 Chula Vista Avenue. Concerns:
an objection to placing the 22 story structure in this residential area; on -street parking;
privacy. Staff explained the architectural plans. Robert Leon, 1036 Laguna Avenue
inquired about appeal procedures. There were no further comments and the public hearing
was closed.
During discussion it was noted that the project complies with all zoning ordinance
regulations for the R-2 (duplex) district; that the application was before Commission
only because of the requirement for a condominium permit; and that it complies with all
of the condominium guidelines.

C. Harvey moved for approval of this application with the following conditions: (1) that
the final working drawings for this condominium project be consistent with the plans
filed with this application; (2) that the conditions recommended by the April 13, 1981
memo from the Chief Fire Inspector, the April 14, 1981 memo from the Chief Building
Inspector and May 5, 1981 memo from the City Engineer be met to the satisfaction of
each department; and (3) that the final landscaping and irrigation plans be approved
by the Park Department prior to the issuance of a building permit. Second C. Graham;
motion approved unanimously on roll call vote. Appeal procedures were advised.
2. TENTATIVE PARCEL MAP FOR 2 CONDOMINIUM UNITS AT 1015 CHULA VISTA AVENUE
CE Erbacher recommended approval. Reference his memo -of May 6, 1981. C. Mink moved
for approval and recommendation to City Council of this tentative parcel map. Second
C. Cistulli; motion approved unanimously on roll call vote.
3. SPECIAL PERMIT TO ALLOW THE CARDEN PRIVATE SCHOOL TO OPERATE A CO-EDUCATIONAL DAY
SCHOOL FOR GRADES K-8 AT ROOSEVELT SCHOOL, BY MRS. BERYL OLMSTEAD, DIRECTOR
4. SPECIAL PERMIT TO ALLOW THE PENINSULA EARLY LEARNING CENTER TO OPERATE A PRESCHOOL
AND KINDERGARTEN PROGRAM AT ROOSEVELT SCHOOL, BY MS. JOANNE BAILEY, DIRECTOR
CP Yost reviewed these two applications for programs at Roosevelt School, 1151 Vancouver
Avenue. CA Coleman advised a combined hearing would be appropriate. Reference staff
report dated 5/21/81; aerial photograph; April 8, 1981 letter from Glenn A. Stewart,
Director of Business Services, Burliingame School District; Bid Proposals summary dated
4/7/81; Roosevelt School Site Parking Considerations; Leasing Guidelines; Neighborhood
Criteria dated 2/10/81; May 6, 1981 letter from James E. Black, District Superintendent
with Exhibit A - Roosevelt School Space Allocation Chart and Exhibit B - Utilization
Chart; Boutique& Villager January 29. 1981 clipping re: PRIDE; May 14, 1981 letter
from James E. Black with attached letter from the San Mateo County Office of Education
giving information on the PRIDE program; May 7, 1981 letter from Lillian Lee Port,
Assistant District Attorney to Jerome F. Coleman, Burlingame City Attorney regarding
status of the PRIDE program; and February 5, 1981 memo from the Director of Recreation
listing Recreation Department use of Roosevelt School. Further references for each
application: project application, site drawing, School District letter, bid proposal,
description of the program and staff comments.
CP reviewed concerns expressed at the May 11 study meeting, responses to these concerns,
details of each application, cumulative parking schedule for all the proposed uses on
this property, staff comments and possible findings. There was no staff objection to
approval with four conditions for each application as listed in the staff report.
Initial discussion included: peak traffic hours, evening parking requirements, need
for a loading/unloading zone, the parking needs for the PRIDE program. Beryl Olmstead,
Director of Carden Private School and JoAnne Bailey, Director of Peninsula Early
Learning Center were present. Chm. Jacobs opened the public hearing. Dr. James E.
Black, District Superintendent supported the proposed programs and discussed the other
programs now in operation at Roosevelt School. A Hillsborough resident spoke in favor
of the Peninsula Early Learning Center, noting that this is a most suitable location
for programs of this type. There were no further comments and the hearing was closed.
Further discussion: student enrollment for each program (local and out of town); hours
of operation; number of students and staff when the school was in operation; suggestion
that the permits be limited to a certain number of students, and an application for
amendment be required to increase this number; expected length of tenancy of the PRIDE

program and the need for an application by them should their program be reinstated
in future; review period for these two applications. Concerns: traffic congestion;
earthquake and fire safety of the building.
C. Mink found that the applications by Carden Private School and Peninsula Early Learning
Center were consistent with the School District guidelines for leasing Roosevelt School,
that the uses were consistent with the zoning and that they would not place undue
hardship on the neighborhood. C. Mink then moved for approval of the special permit
by Carden Private School with the following conditions: (1) that the operation of the
school be consistent with the.May 12, 1981 letter from Mrs. Beryl Olmstead and other
materials filed with this application (with the exception that enrollment be limited
to 100 students); (2) that the conditions of the April 20, 1981 memo from the Chief
Fire Inspector be met satisfactorily; (3) that all staff parking be on -street, adjacent
to that portion of the building leased by Carden School; and (4) that this permit be
reviewed at the end of the 1981-82 school year. Second C. Cistulli; motion approved
on a 6-1 roll call vote, C. Graham dissenting. Appeal procedures were advised.
C. Mink then moved for approval of '.the special permit by Peninsula Early Learning Center
with the following conditions: (1) that the operation of the preschool and kindergarten
program be consistent with the May 13, 1981 letter from JoAnne Bailey and other
materials filed with this application; (2) that the conditions of the April 20, 1981
memo from the Chief Fire Inspector be met satisfactorily; (3) that all staff parking
be on -street, adjacent to that portion of the building leased by Peninsula Early
Learning Center; and (4).that this permit be reviewed at the end of the 1981-82 school
year. Second C. Cistulli; motion approved on a 6-1 roll call vote, C. Graham dissenting.
Appeal procedures were advised.
C. Mink requested that the Engineering Department review the situation with regard to
proper curb markings for loading/unloading zones at Roosevelt School. If necessary,
staff was directed to take this matter to the Traffic, Safety & Parking Commission.
Staff also was requested to contact the School Board advising that any future application
from the PRIDE program be brought to Commission for review and decision.
5. CONDOMINIUM PERMIT TO CONSTRUCT BIARRITZ CONDOMINIUMS, A 3 UNIT PROJECT AT 1299 EL
CAMINO REAL, BY GEORGE RESCALVO FOR R/G ENVIRONMENTAL DEVELOPMENT
CP Yost reviewed this application to construct a 3 unit, 3 story project at the corner
of E1 Camino Real and Easton Drive. Reference staff report dated 5/22/81; Project
Application & CEQA Assessment accepted by staff 4/22/81; aerial photograph; May 21, 1981
memo from the City Engineer; May 5, 1981 memo from the Chief Building Inspector;
April 21, 1981 memo from the Chief Fire Inspector; April 22, 1981 memo from the Park
Director; and architectural plans date stamped May 19, 1981. CP discussed the project
plans, compliance with zoning ordinance requirements, consistency with the condominium
guidelines and staff comments. Approval was recommended with three conditions as
listed in the staff report.
Jean Gorostiague, property owner and applicant was present. Chm. Jacobs opened the
public hearing. Mr. and Mrs. George O'Leary, 1505 Easton Drive, next door neighbors,
expressed approval of the project but requested a substantial fence be erected between
this property and their house. Mr. O'Leary also expressed concern about balconies
which might intrude on their privacy. The plans were shown to them and Mr. Gorostiague
agreed to erect a concrete fence as requested.

UNITS AT 1299 EL CAMINO REAL
CE Erbacher recommended approval of these combined tentative maps With one condition as
listed in his staff memo dated May 21, 1981. During discussion it was determined the
rear yard as shown on the architectural plans was correct, and that shown on the
tentative map in error. C. Mink moved for approval and recommendation to City Council
of these two tentative maps with the condition that the lot combination map include a
5' pedestrian easement along El Camino Real for possible future use. Second C. Cistulli;
all aye voice vote.
7. TENTATIVE PARCEL MAP - 1221/1225 CAPUCHINO AVENUE

CE Erbacher noted utility concerns which may affect a portion of the design of this
project. Staff and the applicant requested a continuance to the meeting of June 8,
1981 (Ref. CE's memo dated May 21, 1981). The Chair so ordered.
10. FINAL SUBDIVISION MAP FOR THE HIGHLANDER, A 6 UNIT CONDOMINIUM PROJECT AT
15 HIGHLAND AVENUE
CE Erbacher advised staff had reviewed this final map and recommended approval (Ref.
CE's memo dated May 21, 1981). C. Harvey moved for approval and recommendation to
City Council of this final subdivision map. Second C. Cistulli; all aye voice vote.
11. SIGN EXCEPTION TO ALLOW AD -CO SIGNS TO INSTALL A DOUBLE FACED ILLUMINATED SIGN
FOR CHANDLER INSURANCE AGENCIES AT 1011 CADILLAC WAY
CP Yost reviewed this application to erect a 3'-6" x 4'-4" projecting sign on the front
of the Chandler Insurance Agencies' building. Reference staff report dated 5/21/81;
Sign Permit application filed 5/12/81; Sign Exception application filed 5/12/81; aerial
photograph; drawings received May 12, 1981; and photographs of the site. CP discussed
this area of the city and code requirements. Staff believed the request was reasonable
and recommended approval if a determination could be made to support the legal require-
ments for a sign exception.

C. Mink found that in light of the total environment of the neighborhood in which this
building is sited and the previous uses of the building, approval would not constitute
a grant of special privilege, and that there are special circumstances with regard
to this property which has been a nonconforming use for some time in that zone.
C. Mink then moved for approval of this Sign Exception, the sign to be located and
erected in accordance with the information submitted and to be illuminated no later
than 2:00 A.M. Second C. Garcia; motion approved unanimously on voice vote. Appeal
procedures,rwere advised.

OTHER BUSINESS
12. AMENDMENT OF CURRENT REGULATIONS, BURLINGAME AVENUE OFF-STREET PARKING DISTRICT
Reference 5/20/81 memo from the City Planner: "Preliminary Assumptions and Draft
Policies for Discussion". CP Yost also referred to the attitude survey sent
Commissioners; several had been returned and a request was made that all be completed
as soon as possible. Staff will then correlate all answers with a report at the next
meeting.
Commission discussion addressed the headings of the City Planner's memo, particularly
development policies, zone boundaries, land use alternatives, parking/traffic policies,
parking exemptions, implementation questions and issues for further study. A special
meeting was called for Tuesday, June 2 at 6:00 P.M. in Conference Room B, City Hall
to continue this discussion, and staff was directed to forward the CP's memo to Council
for information.
13. ORDINANCE NO. 1206 - ESTABLISHING CONDOMINIUM CONVERSION APPLICATION PROCEDURES
AND REQUIREMENTS
City Attorney reported Council had adopted this ordinance at its May 4 meeting. He also
noted the need for adoption of commercial condominium -criteria.
CITY PLANNER REPORT
CP Yost announced his resignation as of June 22, 1981 to accept the position of Planning
Director, City of Napa. Commission extended congratulations and best wishes for
Mr. Yost's continued success in future.
OTHER
14. CITY PLANNER PRIORITIES
Chm. Jacobs requested that the City Planner concentrate his remaining time with the
city on the Off -Street Parking District study, his staff to support this effort in
handling material for P.C. meetings.

15. MEETING OF JOINT TRAFFIC, SAFETY & PARKING COMMISSION/PLANNING COMMISSION COMMITTEE
Chm. Jacobs and C. Harvey reported on this joint study to recommend changes in the
special permits granted Mike Harvey Oldsmobile. The committee's recommendations will
be brought to Commission at its June 8 meeting. Report is to be made to Council on
June 15.
ACKNOWLEDGMENT
Copy of City Planner letter of May 15, 1981 to Michael Eubanks of Payless Car Rental
System; CP advised that no further application to the Planning Commission is necessary
as a result of his acquisition of the car rental office at 1555 Bayshore Highway..
