CALL TO ORDER
A regular meeting of the Planning Commission, City of Burlingame was called to order
by Chairman Jacobs on Monday, August 24, 1981 at 7:32 P.M.
ROLL CALL
Present: Commissioners Cistulli, Garcia, Graham, Harvey, Jacobs, Leahy
Absent: Commissioner Mink (on vacation; excused)

MINUTES The minutes of the August 10, 1981 meeting were unanimously approved
and adopted.
AGENDA - Order of the agenda unanimously approved.
ITEMS FOR ACTION
1. SPECIAL PERMIT TO CONSTRUCT A 1033 SF GARAGE/STORAGE STRUCTURE AT THE REAR
OF THE LOT AT 728 LAUREL AVENUE, BY MR. AND MRS. DONALD CORY
ZA Towber reviewed this application which had been referred back to the Planning
Commission by the City Council for consideration of revised plans. Reference staff
report dated 8/18/81; Project Application & CEQA Assessment accepted as complete
8/5/81; 8/11/81 memo from the Chief Fire Inspector; August 5, 1981 memo from the
Fire Chief; Chief Building Inspector's memo received August 17, 1981; and revised
plans date stamped August 4, 1981. ZA discussed code requirements, staff comments
and Commission concerns with the original proposal. Planning staff recommended
approval with two conditions as listed in the staff report.
Secy. Harvey read letters in opposition from the following: Edwin W. and Elsie M.
Kestier, 743 Winchester Drive and Stanley S. and Virginia J. Soult, 739 Winchester
Drive. Their concerns: size and location of the structure, possible conversion to
residential or a commercial operation, setting a precedent in the neighborhood.
Donald Cory was present and discussed his revised plans, noting his attempt to reduce
the size of the structure in response to concerns expressed about the original proposal.
Chm. Jacobs opened the public hearing. There were no comments in favor. James Waldron,
735 Winchester Drive spoke in opposition, objecting to the size of this structure
so close to his backyard. There were no further comments and the hearing was closed.
Discussion and concerns: phasing of the project; provision for on-site parking and
code requirements for same; possible alternatives to this revised design.
Based on the testimony presented and Commission comments, C. Harvey moved to deny
this special permit. Second C. Cistulli; motion to deny approved on a 6-0 roll call
vote, C. Mink absent. Appeal procedures were advised.

2. FENCE EXCEPTION TO INCREASE AN EXISTING 6' SIDEYARD FENCE BETWEEN 740/744 CROSSWAY
ROAD TO A NEW 8' HEIGHT, BY CLIFFORD LINDQUIST, 740 CROSSWAY ROAD
ZA Towber reviewed this revised proposal referred -back to the Planning Commission by
the City Council for its consideration. Reference staff report dated 8/19/81; 8/18/81
letter from Clifford Lindquist; revised fence plans date stamped August 18, 1981;
8/18/81 letter from Clifford Lindquist to Darrell Smith, the property owner of 740
Crossway Road. ZA discussed details of the revised plans, code requirements and
issues brought out in previous discussions. Staff felt findings in support appeared
to be balanced by arguments against the application; if approved, one condition was
suggested in the staff report.
Secy. Harvey noted August 21, 1981 letter from Eileen Goll, 744 Crossway Road,
requesting additional time to study this new proposal. There was Commission consensus
to deny this request for a continuance. Clifford Lindquist was present and discussed
his revised plans for a 7' permanent redwoodfence topped by 12" of temporary fiber-
glass material. He noted the need for privacy in his yard and addressed the concerns
of his neighbors. Commission discussion with the applicant: the difference in elevation
of the two properties; design and material alternatives to this proposal; length of
time required to grow a natural barrier to take the place of the temporary portion
of the fence; has the requirement that there are exceptional circumstances been
satisfactorily addressed?
Chm. Jacobs opened the public hearing. There were no comments in favor. Dennis Goll
presented a letter dated 8/24/81 from Eileen Goll and D. B. Goll, 744 Crossway Road,
objecting to the granting of this exception and requesting further time for their
contractor to study the new proposal. The applicant confirmed he had already installed
5' posts. There were no further audience comments.and the public hearing was closed.
Following further discussion regarding the height and material of the fence, C. Harvey
moved that this fence exception be granted as follows: construction of a 6' high
redwood fence on top of a 2" x 12" bulkhead and a temporary 1.'-0" high extension
of that permanent fence to be made out of redwood material which shall be a lattice
type configuration, final details to be approved by the Burlingame Building
Department. Second C. Cistulli; motion approved 4-2 on roll call vote, Cers Graham
and Leahy dissenting, C. Mink absent. Appeal procedures were advised.
3. SPECIAL PERMIT TO CONSTRUCT A 627 SF TWO CAR GARAGE AT 21.29 POPPY DRIVE, BY
PATRICK E. KELLEY
ZA Towber reviewed this application to replace an existing garage with a new structure
which exceeds three of the code requirements for accessory structures. Reference
staff report dated 8/18/81; Project Application & CEQA Assessment accepted as complete
8/3/81; July 23, 1981 letter from Patrick E. Kelley, August !i, 1981 memo from the
City Engineer; July 31, 1981 memo from the Chief Building Inspector; July 29, 1981
memo from the Deputy Fire Marshal; photograph of the site; aerial photograph; and
plans date stamped July 24, 1981. ZA discussed code requirements, details of the
application, staff comments and concerns, and applicant's justification of this
proposal. Planning staff recommended consideration of approval only if the possibility
of conversion had been addressed satisfactorily. If approved, three conditions were
suggested as listed in the staff report.
Patrick Kelley, the applicant, addressed Commission with the aid of slides depicting
the site when purchased, the improved property and the neighborhood. He discussed
the plans for his new garage (which would contain a service pit to be used for work
on antique and classic cars) and staff concerns.

Chm. Jacobs opened the public hearing. Secy. Harvey referenced petition in support
dated August 16, 1981 and signed by 47 neighbors, the majority in the immediate
area. There were no audience comments and the public hearing was closed.
Commission discussion and concerns: the service pit for auto work in a residential
neighborhood; height of the proposed garage; bulk of the structure; apparatus for
hoisting used by the applicant; CA confirmed the City does not prohibit portable
equipment in driveways; alternatives to this design which would bring it more in
line with code requirements; need to ensure no drainage on a ineighbor's property
should the roof line be changed.
C. Harvey moved that this application be denied without prejudice so that the
applicant could return to the Commission with a set of plans more in line with the
guidelines established in discussion this evening. Second C. Garcia; motion to
deny approved 6-0 on roll call vote, C. Mink absent. Appeal 1procedures were advised.
4. SPECIAL PERMIT TO ALLOW A CAR RENTAL OPERATION IN THE M-1 DISTRICT AT 1328 MARSTEN
ROAD, BY TROPICAL RENT -A -CAR
ZA Towber reviewed this application to operate a car rental agency in the M-1 (light
industrial) district. Reference staff report dated 8/19/81; Project Application &
CEQA Assessment accepted as complete 8/3/81; Rent-A-Car Questionnaire received
July 17, 1981; site drawing received July 17, 1981; July 16, :1981 letter from Art
Tsukamoto, Tropical Rent-A-Car Systems; August 11, 1981 letter from Joe Bommersbach,
Tropical Rent-A-Car; August 19, 1981 memo from the Chief Building Inspector; July 29,
1981 memo from the Deputy Fire Marshal; memo from the City Engineer; July 16, 1981
letter from the property owners, Waltz & Walch; detail of existing Burlingame Car
Rental Agencies, January 1, 1981; and aerial photograph of the site. ZA discussed
details of the application and the existing site, staff comments and concerns.
Planning staff recommended approval with three conditions as 'listed in the staff
report.
Art Tsukamoto, the applicant, told Commission there would be more than adequate on-site
parking for employees and fleet vehicles and that Tropical would comply with all
requirements of the City. He confirmed that the desk for completion of the rental
contracts would be located in the Burlingame office. Chm. Jacobs opened the public
hearing. Secy. Harvey read letters in support of this application received from the
following: W & W Machining & Manufacturing, Inc. and Interface Air Repair, Inc.,
1322 and 1324 Marsten Road; Arc Electric Co., 1330 Marsten Road. There were no
audience comments and the public hearing was closed.
Discussion: available off-site parking; applicant's proposal to keep all vehicles
on-site; concern about setting a precedent for allowing car rental agencies on this
side of Bayshore Freeway. It was noted that historically the City's policy has been
to locate these agencies closer to the hotel/airport oriented uses the other side of
the freeway.
Based on the public hearing and input of Commission this evening, C. Harvey moved that
this special permit be denied. Second C. Graham; motion to deny approved 4-2 on roll
call vote, Cers Cistulli and Garcia dissenting, C. Mink absent:. Appeal procedures
were advised.

5. CONDOMINIUM PERMIT TO CONSTRUCT A 15 UNIT CONDOMINIUM PROJECT AT 30 LORTON
AVENUE, BY WILLIAM F. HEIJN (ARCHITECT) FOR BRIAN CASSIDY CONSTRUCTION INC.
ZA Towber reviewed this application to construct 15 two-bedroom/two-bath units.
Reference staff report dated 8/19/81; Project Application & CEQA Assessment accepted
as complete 8/18/81; August 18, 1981 memo from the City Engineer; July 21, 1981 memo
from the Chief Building Inspector; June 24, 1981 memo and 8/14/81 note from the
Fire Marshal; aerial photograph; and plans date stamped August 17, 1981. ZA discussed
design details, compliance with zoning ordinance requirements and condominium guidelines,
and staff comments. Staff recommended approval with three conditions as listed in
the staff report.
William F. Heijn, architect for the project, was present and confirmed the three
suggested conditions were acceptable. Discussion confirmed there were no problems
with the turning radius for any of the parking spaces, that height of the fences
in the front yard setback would be kept to code requ.i' ements at the time of final
plan check and that provision for open space met the requirements of Planning
Commission Resolution No. 7-79. Chm. Jacobs opened the public hearing. There were
no comments and the public hearing was closed.
C. Graham moved for approval of this condominium permit with the following conditions:
(1) that the final working drawings for this condominium project be consistent with
the plans filed with this application and date stamped August 17, 1981; (2) that
the conditions recommended by the August 18, 1981 memo of the City Engineer,
July 21, 1981 memo of the Chief Building Inspector and June 24, 1981 memo from
the Fire Marshal be met to the satisfaction of each department; and (3) that the
final landscaping and irrigation plans be approved by the Park Department prior to
the issuance of a building permit. Second C. Cistulli; motion approved 6-0 on roll
call vote, C. Mink absent. Appeal procedures were advised.
6. TENTATIVE CONDOMINIUM AND PARCEL MAP FOR 15 CONDOMINIUM UNITS AT 30 LORTON AVENUE
Reference CE's memo dated August 18, 1981. CE Erbacher advised staff had reviewed
these maps together with the condominium plans. Staff recommended approval.
C. Cistulli moved for approval and recommendation to City Council of these tentative
maps. Second C. Graham; all aye voice vote.
7. EXTENSION OF NOVEMBER 24, 1980 SPECIAL PERMIT WHICH ALLOWS A BANKING FACILITY
AND A TEMPORARY BANKING UNIT AT 360 PRIMROSE ROAD
ZA Towber reviewed this request for an extension of the temporary banking unit use
to March 15, 1982. Reference staff report dated 8/18/81; letter from Foothill Design
Group, architects, dated August 11, 1981; letter of action to the banking institution,
Pacific Union Bank and Trust Company, dated December 2, 1980; and Planning Commission
minutes of November 24, 1980. Planning staff recommended approval of this extension
to the date requested.
There was no representative of the architect or banking institution present in the
audience. Commission discussed procedure; there was a desire expressed that the
applicant be present to discuss a time certain for the completion of the project.
C.. Graham moved for a 30 day extension of this special permit condition to September 30,
1981, staff to notify the applicant that his presence would be required at, preferably,
the September 14 meeting or the September 28 meeting. Second C. Cistulli; all aye
voice vote.

The following items were set for public hearing September 14, 1981.
8. CONDOMINIUM PERMIT, 35-51 EL CAMINO REAL
Applicant's desire to secure the guest parking was discussed.
9. TENTATIVE CONDOMINIUM MAP FOR THE ABOVE
10. AMENDMENT OF SPECIAL PERMIT GRANTED 11/8/80, CHINESE BIBLE EVANGEL,
HOOVER SCHOOL, 2220 SUMMIT DRIVE
PLANNER'S REPORT
CA Coleman advised that as of October 1, 1981 Margaret Monroe will be employed on a
contract basis as City Planner of the City of Burlingame.
He also noted the League of California Cities Conference to be held October 17-20,
1981 in San Francisco. Those wishing to attend should notify Planning staff.
11. BURLINGAME AVENUE COMMERCIAL AREA ZONING ORDINANCE TEXT REVIEW
CA reviewed with Commission draft "Ordinance Establishing Burlingame Avenue Commercial
Area, Auto Row Area, and Regulations Therefor" (reference CA's memo of August 19,
1981 with attached ordinance). Discussion: further clarification of uses in certain
areas; the retail core area; grandfathering of uses; parking requirements; in lieu
fees. There appeared to be some diversity of opinion during this discussion on the
subject of termination of nonconforming uses. CA will transmit Commission's
recommendations to City Council in the near future.
C. Graham distributed a proposed resolution addressing the immediate parking problem
and possible parking structure. Chm. Jacobs directed this be put on the next
Commission agenda.
12. REGULATION OF SECOND STORY ADDITIONS
Reference City Planner report distributed with the packet. This recommendation by
Planning staff will be discussed in detail at the September 14, 1981 meeting.
