ROLL CALL Present: Commissioners Cistulli, Harvey, Jacobs, Mink, Sine, Taylor Absent: Commissioner Francard (excused) Staff Present: City Planner John R. Yost; Director of Public Works Ralph E. Kirkup; City Attorney Jerome F. Coleman MINUTES - The minutes of the March 24, 1980 meeting were approved as sent. AGENDA - Order of the agenda approved. APPLICATIONS FOR ACTION 1. AMENDMENT OF 1978 VARIANCE TO ALLOW CURLEY-BATES COMPANY TO LEASE 14,000 SF OF WAREHOUSE SPACE; PROPERTY AT 860 STANTON ROAD IN THE M-1 DISTRICT CP Yost reviewed this application to amend conditions 2(c) and 2(d) of Planning Commission Resolution 8-78 (to reduce on-site parking to 33 spaces and to reopen a truck loading dock door), and allow Curley -Bates Company to lease 14,000 SF of unused warehouse space to another company. Reference staff report dated 4/9/80; Project Application & CEQA Assessment accepted by staff 3/21/80; site plan including proposed parking; March 17, 1980 letter from William R. Benevento, Vice President and Treasurer of Curley -Bates Company; April 9, 1980 letter from William R. Benevento; March 14, 1980 letter to William R. Benevento from Steven M. Rose, District General Manager, Cort Furniture Rental; Planning Commission minutes of November 27,'1978; Resolution No. 8-78 adopted by Commission 11/27/78; and draft Resolution Concerning Parking Variance, 860 Stanton Road. Staff recommended this minor variance amendment be approved and a new resolution be recorded to amend condition 2(c) and delete condition 2(d). William R. Benevento of Curley -Bates Company was present. It was determined that the findings of fact in support of the original variance could be applied to this amendment. Parking requirements for Curley -Bates Company and its proposed tenant were discussed. Chm. Jacobs opened the public hearing. There were no comments and the hearing was closed. C. Sine moved to approve this amendment of the November 27, 1978 variance and that Planning Commission Resolution No. 1-80, "Resolution Concerning Parking Variance, 860 Stanton Road", be adopted and recorded with the San Mateo County Recorder. SIGN EXCEPTION TO REPLACE FIVE NONCONFORMING SIGNS AT THE AIRPORT MARINA HOTEL WITH THREE "AMFAC HOTEL" SIGNS; BY D. C. JOHNSON OF AMFAC HOTELS AND RESORTS, INC.; PROPERTY AT 1380 BAYSHORE HIGHWAY, ZONED C-4 CP Yost reviewed this application, noting the changes requested, the applicant's justification for these changes; code exceptions required; and principal issues involved. Reference staff report for Item No. 2; March 31, 1980 letter from D. C. Johnson, Vice President, Amfac Hotels & Restaurants; Sign Exception application filed 3/31/80; details of the signage listed on Sign Permit form; Planning Commission minutes of May 25, 1970; drawing of the existing pole sign date stamped June 11, 1975; views of the hotel from various points in the City; and sign plans prepared by Federal Sign Company. Staff had no strong objection to approval but stressed the need for clear and specific findings consistent with the legal requirements for a sign exception. Upon a question from the Chair, CA Coleman discussed the City's past policy with regard to alteration of existing signs and advised that approval of the proposed roof sign would be a modification of an existing sign. Mr. D. C. Johnson was present and discussed his proposal, noting that sign coverage had been reduced and emphasizing Amfac's need for identification. Chm. Jacobs opened the public hearing. There were no comments and the hearing was closed. Discussion included: an objection to the proposed signage on the north side of the building; an objection to the roof sign; and the possible justification for the exception. C. Mink suggested possible findings of fact: that the three major competing hotels have direct visibility from the freeway; that the Amfac Hotel is some distance from the freeway and shielded by other buildings; that there are exceptional circumstances related to this hotel because of its location. The applicant's attempt to bring the signage closer to the City's requirements was noted. Following further discussion, C. Mink moved for approval of Sign A, the proposed roof sign. Second C. Cistulli; motion to approve failed to pass on a 3-3 roll call vote, Cers Harvey, Taylor, Jacobs dissenting, C. Francard absent. C. Mink then moved for approval of the application as submitted by the applicant. Second C. Harvey, and approved 4-2 on roll call vote, Cers Sine and Jacobs dissenting, C. Francard absent. Appeal procedures were advised. Recess 8:15 P.M.; reconvene 8:23 P.M. 3. APPEAL FROM THE UNIFORM BUILDING CODE REQUIREMENT THAT WINDOWS LESS THAN 20' FROM A PROPERTY LINE IN FIRE ZONE I BE PROTECTED; BY JOHN AND LAURA CHIAPELONE OF THE BURLINGAME GARDEN CENTER, 1427 CHAPIN AVENUE Reference 4/7/80 letter from John and Laura Chiapelone; drawing of the site; and April 8, 1980 memo from the Chief Building 'Inspector. DPW Kirkup reviewed this appeal, noting Building Code requirements. Photographs of the site were circulated. John Chiapelone, the applicant, was present and discussed the addition to his building. Planning Commission action in such an appeal procedure was explained. Discussion included: the windows in question; the location next to a public parking lot; and the possibility of conditioning this action with a resolution. C. Sine moved to sustain this appeal, and that a resolution be prepared to require the windows be brought to code should a structure be constructed on the adjacent property at some future time. FINAL SUBDIVISION MAP FOR BEACH PARK CONDOMINIUMS, A 7 UNIT PROJECT AT 747 EL CAMINO REAL IN THE R-3 DISTRICT DPW Kirkup reported the final map meets all tentative map conditions and is ready for recommendation to City Council. Chm. Jacobs opened the public -hearing; there were no comments and the hearing was closed. C. Harvey moved for approval and recommendation to City Council of this final subdivision map. Second C. Sine; all aye voice vote, C. Francard absent. APPLICATIONS FOR STUDY The following applications were set for public hearing April 28, 1980. 4. TENTATIVE PARCEL MAP; PROPERTY AT 811 ROLLINS ROAD (777 MORRELL AVENUE) DPW reported abandonment of a sanitary sewer easement will be required. 5. CONDOMINIUM PERMIT FOR MORRELL GARDENS, A 28 UNIT CONDOMINIUM PROJECT AT 777 MORRELL AVENUE IN THE R-3 DISTRICT, BY WILLIAM C. KUBACH, ET AL 6. TENTATIVE SUBDIVISION MAP FOR THE ABOVE 7. TENTATIVE PARCEL MAP; PROPERTY AT 733-737 FAIRFIELD ROAD DPW reported relocation of a storm drainage line will be required. 8. CONDOMINIUM PERMIT FOR SPRING TERRACE, A 12 UNIT CONDOMINIUM PROJECT AT 733-737 FAIRFIELD ROAD IN THE R-3 DISTRICT, BY ZEV BEN-SIMON Report on the landscaping from the Park Director was requested. 9. TENTATIVE SUBDIVISION MAP FOR THE ABOVE 15. STATUS THIMBLE, 311 PRIMROSE ROAD: AMBIGUITY HEARING OTHER BUSINESS 16. REVIEW OF 3/26/79 SPECIAL PERMIT TO OPERATE A CAR RENTAL AGENCY IN THE M-1 DISTRICT AT 875 MAHLER ROAD, BY AGENCY RENT -A -CAR Ref. staff report dated 4/9/80. CP Yost reported this company is no longer a tenant at 875 Mahler Road and has moved to San Bruno; no further action is required by the Commission. Burlingame Planning Commission Minutes April 14, 1980 Page 4 17. ACCESSORY BUILDINGS IN RESIDENTIAL DISTRICTS: DRAFT TITLE 25 CODE AMENDMENT Ref. April 8, 1980 memo to the Commission from the City Attorney and attached draft ordinance. CP Yost reviewed previous Commission discussion of accessory buildings and advised that the proposed ordinance addressed concerns expressed. There was Commission consensus the draft ordinance met these concerns. C. Sine moved for approval and recommendation to City Council of draft ordinance "Establishing Regulations for Accessory Buildings and Requiring Special Permits in Certain Circumstances". Second C. Taylor and all aye voice vote. 18. CONDOMINIUM CONVERSIONS: RECOMMENDED AMENDMENTS TO PRESENT PROCEDURES CP Yost reviewed staff report dated 4/8/80; summary, background, minimum State requirements for conversions, tenant protection measures, conversion limitations, and recommendations for study. Staff recommended (1) that tenant protection provisions be adopted; (2) that conversions be prohibited or limited in some manner as long as the present housing shortage exists; and (3) that the "Condominium Project Guidelines" be reviewed and redrafted, possibly with an ordinance amendment. Commission discussed this matter at length, with particular reference to tenant protection measures which might be appropriate in Burlingame and a policy for limiting condominium conversions. A majority of those present were in favor of regulations to control conversions. Staff was requested to draft a more detailed report for Commission consideration. 18a. ACKNOWLEDGMENT - Chm. Jacobs acknowledged receipt of the League of California Cities special bulletin on Proposition 9, the State Income Tax Reduction Initiative. 19. REVIEW OF FIELD TRIP, SATURDAY, APRIL 12, 1980 There was consensus the field trip to view previously approved projects had been a success. Suggestions: look more closely at requests for extended lot coverage; notify all property owners in advance of the proposed inspection. CITY PLANNER REPORT CP reported City Council actions at their April 7, 1980 meeting: 20. Council sustained Commission denial of sign exceptions for 16 SF logos at the fourth floor level, 433 and 533 Airport Boulevard. 21. Council sustained Dollar Rent -A -Car's appeal of Commission denial, and approved the sale of used vehicles at 1815 Bayshore Highway with five conditions.
