ROLL CALL Present: Commissioners Cistulli, Harvey, Jacobs, Mink, Sine, Taylor Absent: Commissioner Francard (excused) Staff Present: John R. Yost, City Planner; Ralph E. Kirkup, Director of Public Works MINUTES - The minutes of the April 14, 1980 meeting were approved as sent. AGENDA - Order of the agenda approved with election of 1980-81 officers (#13) to be held at this time. ELECTION OF 1980-1981 OFFICERS Chm. Jacobs thanked all members of the Commission for their service during her two terms as Chairman, and opened the floor to nominations. C. Cistulli nominated Thomas W. Sine for Chairman and moved the nominations be closed; second C. Mink. C. Sine nominated Charles W. Mink for Vice Chairman, seconded by C. Cistulli; C. Cistulli moved the nominations be closed. C. Cistulli nominated Joseph E. Harvey for Secretary and moved the nominations be closed; second C. Sine. The following officers were elected unanimously for 1980-1981: Thomas W. Sine, Chairman; Charles W. Mink, Vice Chairman; Joseph E. Harvey, Secretary. Chm. Sine accepted the gavel, thanked Mrs. Jacobs for serving two consecutive terms and congratulated her on an excellent job as Chairman. APPLICATIONS FOR ACTION 1. THE STATUS THIMBLE, 311 PRIMROSE ROAD: USE DETERMINATION CP Yost reviewed this application to allow sewing classes at 311 Primrose Road and larger workshops in the Community Room of the main Public Library. He noted the issues raised, the proposed spring schedule of classes and the possible adverse impact on parking. Reference staff report dated 4/23/80; Project Application & CEQA Assessment accepted by staff 4/14/80; aerial photo of the site; April 9, 1980 letter from Marlo Faulkner; and The Status Thimble 1980 Spring Schedule of Classes. If scheduling could be arranged to minimize the parking impact, staff had no objection to approval of this application, with findings that the use is similar to permitted C-1 uses and that, within the specified hours and with a specific number of students, the classes would not be detrimental to the neighborhood. Marlo Faulkner, president of The Status Thimble Ltd., a California corporation, was present. She discussed her belief the proposed classes were not a school, but a use essential to the materials sold by the shop. She also noted that students are asked Burlingame Planning Commission Minutes Page 2 April 28, 1980 to park in city lots for daytime sessions, the location of all -day lots is listed in her brochure, and that the students are using city lots, carpooling or using public transportation. The arrangement with the public library was explained. Chm. Sine opened the public hearing. There were no comments and the hearing was closed. CP Yost read the list of permitted uses in the C-1 District. Commission discussed findings to support approval of this application as well as downtown parking, similar uses and Commission policy with regard to this type of school. C. Mink found that the proposal as submitted was incidental to the major purpose of the business, which is to market materials, and that patrons of the classes do not impact parking in the area significantly. He, therefore, moved that Commission determine the sewing classes are similar to those uses permitted in the C-1 District and unlikely to be obnoxious or detrimental to the neighborhood. Second C. Cistulli and approved 6-0 on roll call vote, C. Francard absent. Appeal procedures were advised. 2. TENTATIVE PARCEL MAP TO COMBINE LOTS 1, 2 AND 11, BLOCK 6, BURLINGAME SHORE LAND COMPANY; PROPERTY AT 811 ROLLINS ROAD (777 MORRELL AVENUE), IN THE R-3 DISTRICT; FOR WILLIAM KUBACH, ET AL DPW Kirkup reviewed this map which combines three lots into a single parcel; vacation of a sewer easement and possibly dedication of a water easement are required by Engineering. Reference April 22, 1980 memo from the Assistant City Engineer. Staff recommended approval. It was confirmed the applicant was aware of the possible water easement. Chm. Sine opened the public hearing. Roy Lundin, 828 Maple Avenue asked about the sewer easement; staff explained. There were no further comments and the hearing was closed. C. Taylor moved for approval and recommendation to the City Council of this tentative parcel map, subject to the conditions recommended by the Engineering Department. Second C. Cistulli and approved 6-0 on roll call vote, C. Francard absent. 3. CONDOMINIUM PERMIT FOR MORRELL GARDENS, A 28 UNIT CONDOMINIUM PROJECT AT 777 MORRELL AVENUE IN THE R-3 DISTRICT; BY WILLIAM KUBACH, ET AL CP Yost reviewed this application to construct a 28 unit three story condominium project. Reference staff report dated 4/23/80; Project Application & CEQA Assessment accepted by staff 3/31/80; aerial photograph of the site; April 1, 1980 memo from the Chief Building Inspector; April 1, 1980 memo from the Park Director; and March 7, 1980 memo from the Chief Fire Inspector. Staff recommended approval with four conditions as listed in the staff report. William C. Kubach was present, representing the applicants. Concerns and comments during Commission discussion: the need for a soils report and a determination of the water table at this location, as well as structural requirements that may be needed; size of several of the parking spaces and ability to get into the tenant storage lockers; need for adequate structural protection with regard to the swimming pool. Chm. Sine opened the public hearing. Marjorie Cecil, 829 Maple Avenue spoke in favor but expressed concern about on -street parking and traffic circulation. Roy Lundin, 828 Maple Avenue also spoke in favor but was concerned about privacy of the neighbors and possible surface water problems. Staff explained the plans to him in detail. There were no further comments and the public hearing was closed. Page 3 Burlingame Planning Commission Minutes April 28, 1980 Discussion noted that the project meets all the regulations of the City; that if this were an apartment project it could be constructed with a building permit with no Planning Commission approval required. Concerns and comments: a request that Commission be advised by staff of any changes shown on the working drawings such as elevation of the garage floor or of the location of the swimming pool; that the CBI's April 1 memo be deleted from the conditions of approval; DPW requested that Condition #3 be changed to state that "all condominium requirements of the code will be met as specified". A request was made that the reference to "architect" be changed to "designer". A further condition was discussed to mitigate the possible flood water problems, construction to be under the supervision of a soils engineer and/or a structural engineer. C. Jacobs then moved for approval of this condominium permit with the following conditions: (1) that the final working drawings for Morrell Gardens be consistent with the plans filed with this application; (2) that the condition recommended by the Chief Fire Inspector be met by the final plans; (3) that all condominium requirements of the code be met to the satisfaction of the Engineering Department; (4) that the final landscaping and irrigation plans be approved by the Park Director prior to the issuance of a building permit; and (5) that a structural engineer be responsible for the basement slab and drainage design. (It was noted by the Chair that the applicant had agreed to all conditions.) Second C. Taylor and approved 6-0 on roll call vote, C. Francard absent. Appeal procedures were advised. 4. TENTATIVE SUBDIVISION MAP FOR 28 CONDOMINIUM UNITS AT 777 MORRELL AVENUE Reference April 22 and March 10, 1980 memos from the Assistant City Engineer. DPW Kirkup advised this map is in conformance with the condominium plans previously approved; staff recommended approval. C. Taylor moved for approval and recommendation to City Council of this tentative subdivision map. Second C. Jacobs and approved unanimously on voice vote. Recess 8:50 P.M.; reconvene 9:00 P.M. 5. TENTATIVE PARCEL MAP TO COMBINE LOTS 6 AND F, BLOCK 7, BURLINGAME TERRACE; PROPERTY AT 733-737 FAIRFIELD ROAD IN THE R-3 DISTRICT, FOR ZEV AND NAVA BEN-SIMON DPW Kirkup advised this map would combine three lots into one parcel. Engineering would require the existing storm drain be relocated. Staff recommended approval. C. Jacobs moved for approval and recommendation to City Council of this tentative parcel map. Second C. Cistulli and approved 6-0 on roll call vote, C. Francard absent. 6. CONDOMINIUM PERMIT FOR SPRING TERRACE, A 12 UNIT CONDOMINIUM PROJECT AT 733-737 FAIRFIELD ROAD IN THE R-3 DISTRICT, BY ZEV BEN-SIMON OF GILCO CONSTRUCTION COMPANY CP Yost reviewed this application to construct 12 two-story townhouse condominiums. Reference staff report dated 4/24/80; Project Application & CEQA Assessment accepted by staff 3/28/80; aerial photograph of the site; April 22, 1980 memo from the Assistant City Engineer; April 1, 1980 memo from the Chief Building Inspector; and 4/15/80 memo from the Park Director. He noted staff concerns, some of which had been resolved this date: (1) a copy of the CC&Rs was not yet available for review; (2) a revised landscaping plan was received today and found to be satisfactory; (3) a revised plan for the basement garage was received today and the project now meets all zoning ordinance requirements; (4) Engineering Department's concerns were not yet fully resolved. Subject to the above comments, staff had no objection to approval with four conditions recommended in the staff report. He advised the CC&Rs would be available within a few days for the City Attorney's review. Chm. Sine opened the public hearing. There were no comments and the hearing was closed. It was determined that the items in the ACE's April 22, 1980 memo would be corrected on the final working drawings. A suggestion was made that Item #3 of the suggested conditions be deleted and a condition inserted to address the matter of the CC&Rs. C. Jacobs then moved for approval of this condominium permit with the following conditions: (1) that the final working drawings for the Spring Terrace Condominiums be consistent with the amended plans filed with this application; (2) that the engineering requirements specified in the April 22, 1980 memo from the Assistant City Engineer be met to the satisfaction of the Public Works Department prior to the issuance of a building permit; (3) that the CC&Rs be approved by the City Attorney prior to the issuance of a building permit; and (4) that the final landscaping and irrigation plans be approved by the Park Department prior to the issuance of a building permit. Second C. Cistulli and approved 6-0 on roll call vote, C. Francard absent. Appeal procedures were advised. 7. TENTATIVE SUBDIVISION MAP FOR 12 CONDOMINIUM UNITS AT 733-737 FAIRFIELD ROAD IN THE R-3 DISTRICT; FOR ZEV AND NAVA BEN-SIMON DPW Kirkup advised this tentative subdivision map is in conformance with the condominium permit previously granted; with the conditions placed on the condominium permit, staff would recommend approval. C. Taylor moved for approval and recommendation to City Council of this tentative subdivision map. Second C. Jacobs and all aye voice vote. 8. TENTATIVE PARCEL MAP TO COMBINE PORTIONS OF LOTS 4, 6 AND 7, BLOCK 4, BURLINGAME LAND COMPANY; PROPERTY AT 1125-1133 DOUGLAS AVENUE IN THE R-4 DISTRICT; FOR RICHARD & DARYL POPIN AND JULIETTE BUTCHER WITH FAR WESTERN CAPITAL CORPORATION DPW Kirkup advised this map combines several lots to form a single parcel. Staff recommended approval with the conditions listed in the April 17, 1980 memo from the Assistant City Engineer. Speaking to staff's suggestion that the sidewalk alignment be changed to parallel the driveway curvature, thus allowing a larger landscaped area between the curb and the sidewalk, one Commissioner stated his experience has shown that the small planting area as proposed by the developer provides a needed barrier between the public and private property. Irving Caster, designer, San Mateo was present representing the applicant. He advised that the developer would prefer to retain the proposed planting area for privacy and to keep the parking space defined from the sidewalk. C. Harvey moved for approval and recommendation to City Council of this tentative parcel map as submitted. Second C. Cistulli and approved 6-0 on roll call vote, C. Francard absent. 9. CONDOMINIUM PERMIT FOR A 9 UNIT CONDOMINIUM PROJECT AT 1125-1133 DOUGLAS AVENUE IN THE R-4 DISTRICT; BY S. LOGAN OWENS, JR. OF FAR WESTERN CAPITAL CORPORATION CP Yost reviewed this application to construct a three story 9 unit condominium project. Reference staff report dated 4/24/80; Project Application & CEQA Assessment accepted by staff 4/14/80; aerial photograph of the site; April 10, 1980 memo from the Chief Building Inspector; April 23, 1980 memo from the Park Director; Page 5 Burlingame Planning Commission Minutes April 28, 1980 April 17, 1980 memo from the Chief Fire Inspector; and April 17, 1980 memo from the Assitant City Engineer. Staff concerns were noted; if these issues can be resolved, staff recommended approval with three conditions as listed in the staff report. Irving Caster, designer, San Mateo was present. Discussion included: materials to be used for the driveway and front sidewalk; landscaping in the front. Chm. Sine opened the public hearing. There were no comments and the hearing was closed. Commission comments: "find it to be an exceptionally fine project . . . meets all City codes"; some "parking spaces that may be hard to get into"; a request for deletion of the CBI`s April 10, 1980 memo from any motion. C. Jacobs moved for approval of this condominium permit with the following conditions: (1) that the final working drawings for this project be consistent with the preliminary plans filed with this application; (2) that the requirements recommended by the April 17, 1980 memo from the Chief Fire Inspector and April 17, 1980 memo from the Assistant City Engineer be met; and (3) that the final landscaping and irrigation plans be approved by the Park Department prior to the issuance of a building permit, with special attention given to the selection of suitable trees adjacent to the sidewalk. TENTATIVE SUBDIVISION MAP FOR 9 CONDOMINIUM UNITS AT 1125-1133 DOUGLAS AVENUE IN THE R-4 DISTRICT; FOR RICHARD & DARYL POPIN, JULIETTE BUTCHER AND FAR WESTERN CAPITAL CORPORATION DPW Kirkup advised that all Engineering conditions had been resolved in the previous two items, and recommended approval. C. Taylor moved for approval and recommendation to City Council of this tentative subdivision map. Second C. Mink; all aye voice vote. 11. CONDOMINIUM PERMIT FOR A 6 UNIT CONDOMINIUM PROJECT AT 1348 EL CAMINO REAL IN THE R-3 DISTRICT; BY GIOVACCHINO AND ARMANDO DIODATI CP Yost reviewed this application to construct a 6 unit three story condominium project. Reference staff report dated 4/24/80; Project Application & CEQA Assessment accepted by staff 3/28/80; aerial photograph of the site; April 23, 1980 memo from the Assistant City Engineer; April 1, 1980 memo from the Chief Building Inspector; April 1, 1980 memo from the Park Director; and April 17, 1980 memo from the Chief Fire Inspector. Staff recommended approval with three conditions as listed in the staff report. DPW Kirkup noted code requirements for pavement, exterior and interior and discussed alternatives for electrical and telephone lines (underground or above ground). Concern for existing trees was expressed. Giovacchino Diodati, the applicant, was present. He advised a solution had not been reached yet regarding the power lines and stated his concern about the existing trees. Chm. Sine opened the public hearing. There were no comments and the hearing was closed. Considerable discussion followed regarding: the power lines; the existing trees; pavement materials. The applicant agreed to use concrete for the driveway ramp and to accept a condition that the power lines be underground. C. Taylor moved for approval of this condominium permit subject to the following conditions: (1) that the final working drawings for this condominium project be consistent with the plans filed with this application; (2) that the conditions Page 6 Burlingame Planning Commission Minutes April 28, 1980 recommended by the April 23, 1980 memo from the Assistant City Engineer be met; (3) that the final landscaping and irrigation plans be approved by the Park Department prior to the issuance of a building permit; (4) that the electrical lines be underground; and (5) that the driveway ramp be made of concrete. TENTATIVE SUBDIVISION MAP FOR 6 CONDOMINIUM UNITS AT 1348 EL CAMINO REAL IN THE R-3 DISTRICT; FOR GIOVACCHINO AND ARMANDO DIODATI DPW Kirkup recommended approval of this condominium map subject to the conditions listed in the Assistant City Engineer's memo of April 23, 1980. C. Mink moved for approval and recommendation to City Council of this tentative subdivision map subject to the conditions in the April 23, 1980 memo from the Assistant City Engineer. Second C. Taylor; all aye voice vote. OTHER BUSINESS 14. RESOLUTION NO. 2-80 GRANTING APPEAL FROM UNIFORM BUILDING CODE REQUIREMENTS - 1427 CHAPIN AVENUE DPW Kirkup reviewed this item, noting Resolution No. 2-80 will record the Commission's action at its April 14, 1980 meeting. C. Jacobs moved for adoption of Resolution No. 2-80. Second C. Mink; all aye voice vote. 15. REVIEW OF 5/14/79 SPECIAL PERMIT TO ALLOW THE OPEN STORAGE OF VEHICLES IN THE M-1 DISTRICT AT 960 DAVID ROAD; BY PAUL W. JACKSON CP Yost reported a site inspection had been made and it was found the required landscaping had been installed and properly maintained; the present use of the property is consistent with the terms and limitations of the 1974 permit and the 1979 extension (reference staff report dated 4/24/80). No further action is necessary. 16. CONDOMINIUM SUBDIVISIONS: RECOMMENDED TENANT PROTECTION MEASURES; POSSIBLE CONVERSION LIMITATIONS Continued to the meeting of May 12, 1980. 17. REGULATIONS FOR HOT TUBS, PORTABLE SPAS AND SIMILAR UNITS Reference April 22, 1980 memo from the Director of Public Works which notes existing regulations, an analysis of these regulations, and suggested code changes. DPW Kirkup requested Commission review of the suggested regulations for a possible draft ordinance. Staff is waiting for comments from the American Hot Tub Association. Discussion included: how other communities regulate hot tubs; Fire Department recommendations; safety requirements for fencing; water supply regulations; energy requirements; and location requirements. Staff was requested to draft an ordinance for Commission consideration. Burlingame Planning Commission Minutes Page 7 April 28, 1980 17A. REQUESTED CANCELLATION OF CONDITION #1 OF THE APRIL 23, 1979 SPECIAL PERMIT TO OPERATE AN AUTOMOBILE SALES AND SERVICE FACILITY AT 1007-1015 ROLLINS ROAD: APRIL 24, 1980 LETTER FROM MICHAEL R. HARVEY CP Yost reviewed this request for cancellation of Condition #1 that "the permit be approved to Mike Harvey of Mike Harvey Oldsmobile and be nontransferable". Reference April 24, 1980 letter from Michael R. Harvey; Planning Commission April 23, 1979 minutes; and staff report for the April 23, 1979 meeting. Staff requested Commission consideration. Commission and staff discussed the reasons for the request; Commission's past policy in granting a nontransferable permit; and the impact of present day service facilities. There was Commission consensus that more detailed information was needed about this request, the operation of the facility and the applicant's assurance to fulfill the intent of the original application. Item continued to the meeting of May 12, 1980. 17B. C. Taylor noted a complaint he had received from Rudona Bleicher, 1359 Columbus Avenue, and requested Commission consideration of an ordinance which would limit storage of recreational vehicles, boats, campers, trailers and other types of equipment in the R-1 District. Staff was requested to draft an ordinance for consideration at the May 28, 1980 meeting. APPLICATIONS FOR STUDY The following items were set for hearing May 12, 1980: 18. SPECIAL PERMIT TO OPERATE AN AUTO DETAILING SHOP AT 1244 ROLLINS ROAD 19. SPECIAL PERMIT TO OPERATE A BEAUTY SHOP AT 533 AIRPORT BOULEVARD CITY PLANNER REPORT 20. CP reported City Council sustained Call -A -Car Rental Company's appeal of Planning Commission denial of a special permit to operate a car rental agency and auto servicing/ detailing company at 1470 Bayshore Highway, and approved the application with conditions.
