CALL TO ORDER
A regular meeting of the Planning Commission, City of Burlingame was called to order
by Chairman Sine on Monday, June 9, 1980 at 7:37 P.M.
ROLL CALL
Present: Commissioners Cistulli, Francard, Harvey, Jacobs, Mink, Sine, Taylor
Absent: None
Staff Present: City Planner John R. Yost; Director of Public Works Ralph E. Kirkup;

MINUTES - Upon motion of C. Jacobs, second C. Cistulli, the minutes of the May 28, 1980
meeting were approved and adopted. -
AGENDA - Upon motion of C. Jacobs, second C. Cistulli, the order of the agenda was
approved, with the addition of a report by C. Jacobs on attendance at a
housing conference.
APPLICATIONS FOR ACTION
1. VARIANCE FROM CODE SEC. 25.28.060 TO CREATE A 3,295 SF LOT (WITH A 41' FRONTAGE
ON EDGEHILL DRIVE) AT THE BACK OF 841 FAIRFIELD ROAD, BY STEPHEN C. KIRCHER
CP Yost reviewed this application to create a new lot at the back of the existing single
family home at 841 Fairfield Road; the two new lots would be substandard. Reference
staff report dated 6/6/80; Project Application & CEQA Assessment accepted by staff
6/2/80; letter from Steve Kircher received May 29, 1980; aerial photograph of the
site; copies of 1906 subdivision map, 1911 subdivision map and the 1980 Assessor's map.
CP noted issues raised by the application and staff's belief there were several problems
with the proposed lot split.
It was determined all property owners within 300 feet of the site had been notified
of this hearing and that the applicant had been advised of the four legal requirements
for variance approval. Discussion included: contiguous lots; other lots in the area;
and the 1906 and 1911 subdivisions.
Stephen Kircher, the applicant, was present. He presented a petition and two letters
from neighbors in favor of the proposal. Addressing the four variance requirements,
he noted he had purchased this property with the intent of splitting it; that there
are several types of land use in his neighborhood; that the neighbors had indicated
they would prefer an additional R-1 single family home. Mr. Kircher felt he should be
allowed to maximize the use of his property to the fullest extent and noted the sub-
standard lot depth would not be visible from the street; that he was proposing a
lot depth equal to his neighbor at 1429 Edgehill Drive; that the house to be put on
the new lot would have a footprint of less than 1300 SF (the maximum allowed by code);
that a new house on this lot would be an improvement to the neighborhood and that his
proposal would not infringe on anyone's property rights. It was determined the
applicant had been in his present home for two years.

Chm. Sine opened the public hearing. There were no comments and the hearing was
closed. Secy. Harvey read the following in support of the application: June 9, 1980
petition signed by 12 neighbors; June 9, 1980 letter from Douglas J. Spaulding,
1412 Edgehill Drive and June 9, 1980 letter from James J. Hamrock, 852 Fairfield Road.
June 4, 1980 letter in opposition from Virginia J. Hvid, 845 Paloma Avenue was also
read.
There was general consensus that the testimony presented did not meet the requirements
of the code for granting a variance. There was a favorable opinion expressed about
creating additional lots, but concern about substandard lots; inadequate street
frontage and less than minimum lot size which do not meet the purpose of the General
Plan. C. Taylor moved that this application be denied. Second C. Mink; application
denied on a 7-0 roll call vote. Appeal procedures were advised.
2. FINAL PARCEL MAP TO COMBINE PORTIONS OF LOTS 28 AND 29, BLOCK 6, EASTON ADDITION
NO. 1; PROPERTY AT 1056 EL CAMINO REAL; FOR JOSEPH W. BRONZINI
DPW Kirkup advised this parcel map complies with the conditions of the tentative map,
and recommended approval, with abandonment of the public utilities easement at the
rear of the lot. Chm. Sine opened the public hearing. There were no comments and
the hearing was closed.
C. Jacobs moved for approval and recommendation to City Council of this final parcel
map with the condition that the public utilities easement at the rear of the lot be
vacated. Second C. Cistulli and approved 7-0 on roll call vote.
3• FINAL PARCEL MAP TO COMBINE LOTS 6 AND F, BLOCK 7, BURLINGAME TERRACE; PROPERTY
AT 733-737 FAIRFIELD ROAD, FOR ZEV AND NAVA BEN-SIMON
DPW Kirkup recommended approval of this final parcel map with recommendation to City
Council when the existing buildings are removed or satisfactory bond for their removal
is posted. The indeterminate storm drainage was discussed, the applicant to bear any
cost of redistribution. Chm. Sine opened the public hearing. There were no comments
and the hearing was closed.

There are some problems with the basement parking layout. Amendments to the plans
are being prepared.

Most of the technical problems with this difficult lot have been worked out with the

OTHER BUSINESS
14. RESOLUTION NO. 3-80 RECOMMENDING ADOPTION OF TENANT PROTECTION MEASURES IN
CONDOMINIUM CONVERSIONS
Ref. Resolution No. 3-80 and additional information required by staff at the time of
application for a conversion. There was general consensus the resolution fully
expressed Commission discussion and intent. Discussion included: the possible length
of time required for a conversion to be processed; the possibility of smaller buildings
being converted; one Commissioner again expressed his opposition to this type of
regulation.
C. Mink moved for approval of Resolution No. 3-80. Second C. Cistulli and approved
6-1 on roll call vote, C. Francard dissenting.
15. POSSIBLE RECLASSIFICATION OF ELEMENTARY SCHOOL SITES FROM RESIDENTIAL TO
OPEN SPACE: MAY 19. 1980 COUNCIL REOUEST FOR REVIEW AND RECOMMENDATION
Ref. Planning Commission Resolution No. 4-78 "Regarding School Site Zoning"; City
Attorney's June 5, 1980 memo to the City Council, subject: rental or lease of vacant
school properties with attached draft ordinance; and May 30, 1980 memorandum to the
City Council from Dr. James Black, Superintendent of the Elementary School District.
CP Yost reviewed this item, noting the intent of the proposed ordinance is to allow
limited commercial uses of School District properties, whereas the present ordinance
allows only public or private schools. Reference was made to the discussions between
City Council and the School District as well as neighborhood meetings which have been

held or are planned. Mr. Yost also reviewed Planning Commission Res. No. 4-78
determining school site zoning, and Council request that Commission consider whether
the present zoning is adequate protection for the City and nearby neighbors.
Discussion included: the Pershing School neighborhood meeting and criteria reached;
the School District hopes for flexible use of the schools; the status of unclassified
land; the possibility of reclassifying the school sites to open space; feasible uses
for each of the schools. There was general consensus that the draft ordinance
would meet the objectives of the City and the School District, allowing the City to
have control of the use and the School District the opportunity for flexibility.
Following further discussion regarding reclassification of certain school sites to
open space, C. Harvey moved that Planning Commission Resolution No. 4-78 Regarding
School Site Zoning be amended to change the zoning for Burlingame High School and
the Peninsula Tennis Club from unclassified to open space. Second C. Sine; motion
denied on a 6-0 roll call vote, C. Mink abstaining (conflict of interest).
16. POSSIBLE CODE AMENDMENT TO REQUIRE CITY APPROVAL FOR INSTALLATION OF NEW
UTILITY POLES
DPW Kirkup reviewed this item. Reference June 5, 1980 memo to Commission from the
Director of Public Works, with attachment: April 25, 1980 memo to the Undergrounding
Committee from the Asst. City Engineer. He discussed past City policy with regard to
the proliferation of utility poles, the comparative costs for overhead poles versus
undergrounding; the policy of the utility company; Undergrounding Committee discussion
and the decision to refer this matter to the Commission. Mr. Kirkup asked if
Commission wished to consider a code amendment to require City approval for installa-
tion of new power poles.
Commission and staff discussed: the possibility of conditioning special permits and
condominium permits; notification in advance to a developer that undergrounding
would be required; the specific areas staff was referring to; complaints about
additional poles received from the public; the purpose and actions of the Undergrounding
Committee; the cost to a developer for going underground versus above ground installa-
tion; and costs related to residential versus commercial areas. Staff was requested
to prepare a draft ordinance for review at a future meeting.
16a. Chm. Sine brought up the proliferation of newsstands throughout the commercial
areas of the City, noting there are no City regulations. Concern was expressed about
the driving habits of the people who service these stands. There was general consensus
a regulation to control, not prohibit, newsstands should be studied. Staff will
prepare a report for Commission consideration.
16b. C. Jacobs reported on her attendance at the San Mateo County Community College
District conference, subject: "Housing Crisis: Strategies for San Mateo County".
She noted the business affiliations of the majority of those in attendance, and
commented on the discussions.
CITY PLANNER REPORT
CP Yost referenced June 4, 1980 memo from Commissioner Harvey to the City Planner with
regard to the proposed ordinance establishing minimum dimensions for parking spaces,
aisles and driveways. In explanation of his "no" vote at the May 28 meeting, C. Harvey
advised he believed the proposed ordinance a good code amendment but suggested several
engineering technicalities which might be improved. CP discussed these in detail.

During discussion C. Mink referred to Section A.(6), accepting C. Harvey's suggested
change from 3" to 6" but adding "that the columns be placed in such a way that they
do not interfere with doors or with turning movements". There was consensus that
these revisions would strengthen the proposed ordinance.
C. Jacobs moved the revisions be madebefore transmittal to City Council, including
C. Mink's suggestion this evening. Second C. Taylor and approved 7-0 on roll call
vote.
ACKNOWLEDGMENT
June 6, 1980 letter to all Planning Commissioners from Terrill Timberlake, 10 Guittard
Road, Burlingame with reference to the Home Savings building at E1 Camino and Broadway.
