CALL TO ORDER
A regular meeting of the Planning Commission, City of Burlingame was called to order by
acting Chairman Harvey on Monday, June 23, 1980 at 7:32 P.M.
ROLL CALL
Present: Commissioners Cistulli, Jacobs, Taylor, Harvey
Absent: Commissioners Francard, Mink, Sine (excused)
Staff Present: City Planner John R. Yost; Director of Public Works Ralph E.
Kirkup; City Attorney Jerome F. Coleman
MINUTES
Upon motion of C. Jacobs, second C. Cistulli the minutes of the June 9, 1980 meeting
were approved and adopted.
Chm. Harvey addressed the audience, noting that there were only four Commissioners
present this evening. CA Coleman explained that the City ordinance requires any action
by the Commission be taken by four affirmative votes; with only four Commissioners
present, one "no" vote would defeat an application. The Chm. asked if there were any
applicants present who would like a continuance to the next regular meeting. At the
request of the respective applicants the following items were continued to July 14, 1980.
1. VARIANCE TO ALLOW AN EXISTING CARPORT, CONSTRUCTED WITHOUT A BUILDING PERMIT, TO
REMAIN WITHIN 12" OF A SIDE PROPERTY LINE; PROPERTY AT 1527 EASTMOOR ROAD, BY
VINCENT FLORES
2. SPECIAL PERMIT TO CONSTRUCT A 290 SF STORAGE SHELTER ADJACENT TO THE REAR PROPERTY

APPLICATIONS FOR ACTION
8. CONDOMINIUM PERMIT FOR PRIMROSE GARDENS, A 6 UNIT CONDOMINIUM PROJECT AT
119 PRIMROSE ROAD, BY SEYMOUR STERLING FOR MUNKDALE BROS., INC.
CP Yost reviewed this application to construct six 2 -story townhouses. In response
to staff concerns, amended plans had been received and circulated. Reference staff
report dated 6/16/80; Project Application & CEQA Assessment accepted by staff 5/29/80;
aerial photograph of the site; June 3, 1980 memo from the Chief Fire Inspector;
June 19, 1980 memo from the Park Director; June 18, 1980 memo from the Asst. City
Engineer; architectural plans date stamped June 17, 1980; and landscaping and irrigation
plans date stamped June 18, 1980. Staff recommended approval with four conditions,
as listed in the staff report and the ACE'S memo of June 18, 1980.
Chm. Harvey opened the public hearing. There were no comments. Acting Secretary Taylor
read June 23, 1980 letter from Arthur Samuel, adjacent property owner, expressing
concern about on -street parking. The public hearing was then closed. It was determined
the applicant had received a copy of the staff report and suggested conditions of approval.
Seymour Sterling, representing the applicant, Munkdale Bros., Inc., was present and
stated Munkdale's belief this project would upgrade the area. He confirmed that staff's
concerns regarding on-site parking have been resolved with the amended plans and that
the landscaping plan would be revised in accordance with the Park Director's suggestions.
C. Jacobs moved for approval of this condominium permit with the following conditions:
(1) that the final working drawings for this condominium project be consistent with
the preliminary plans date stamped June 17, 1980; (2) that the conditions recommended
by the June 3, 1980 memo from the Chief Fire Inspector be met; (3) that the final
landscaping and irrigation plans be approved by the Park Department prior to the
issuance of a building permit; and (4) that the three conditions recommended by the
June 18, 1980 memo from the Asst. City Engineer be met. Second C. Cistulli and
approved 4-0 on roll call vote, Cers Francard, Mink and Sine absent. Appeal procedures
were advised.
9. TENTATIVE SUBDIVISION MAP FOR 6 CONDOMINIUM UNITS AT 119 PRIMROSE ROAD, FOR
MUNKDALE BROS, INC.
Ref. June 18, 1980 memo from the Asst. City Engineer. DPW Kirkup recommended approval,
with the conditions of the condominium permit. Chm. Harvey opened the public hearing.
There were no comments and the hearing was closed. C. Taylor moved for approval and
recommendation to City Council of this tentative subdivision map with the three
conditions listed in the June 18, 1980 memo from the Asst. City Engineer. Second
C. Cistulli and approved 4-0 on roll call vote, Cers Francard, Mink and Sine absent.
OTHER BUSINESS
13. TENTATIVE SUBDIVISION MAP FOR 18 CONDOMINIUM UNITS AT 977 EL CAMINO REAL: REQUEST
FOR A 12 MONTH EXTENSION
DPW Kirkup discussed this request for a 12 month extension of the City's August 6, 1979
approval of the tentative map. Ref. June 2, 1980 letter from James E. Shypertt of
Martin M. Ron Associates. Staff recommended the extension be granted. C. Taylor moved
that this request for a 12 month extension be approved. Second C. Cistulli and
approved 4-0 on roll call vote, Cers Francard, Mink and Sine absent.

14. TENTATIVE SUBDIVISION MAP FOR 21 CONDOMINIUM UNITS AT 735 EL CAMINO REAL: REQUEST
FOR A THREE MONTH EXTENSION
DPW Kirkup noted June 16, 1980 letter from Wm. Jay Hammond requesting a three month
extension of the City's June 18, 1979 tentative map approval. Staff recommended the
extension be granted. C. Jacobs moved for approval of this request for a three month
extension. Second C. Cistulli and approved 4-0 on roll call vote, Cers Francard, Mink
and Sine absent.
15. REVIEW OF OCTOBER 2, 1978 SPECIAL PERMIT (AMENDED NOVEMBER 26, 1979) TO ALLOW
TRUE LEARNING CENTER, INC. TO HOLD CLASSES IN WASHINGTON ELEMENTARY SCHOOL,
801 HOWARD AVENUE; BY LARRY KRUSEMARK
CP Yost reviewed the permit approved in 1978 and amendment granted in 1979. Ref, staff
report dated 6/17/80 and June 16, 1980 letter from Larry Krusemark. No problems have
been observed and the City has received no complaints; staff recommended the 1979
amendments to the earlier permit be made permanent, with no further City review.
C. Jacobs moved that the 1979 amendments to this special permit be made permanent,
to allow (1) a maximum enrollment of 55 students, and (2) an additional classroom,
with the stipulation that no further review.by the City is necessary. Second C. Cistulli
and approved 4-0 on roll call vote, Cers Francard, Mink and Sine absent.
OTHER
Mrs. George O'Leary, 1505 Easton Drive asked the Chair for permission to speak on
the proposed condominium project at 1299 E1 Camino Real. She was advised her comments
would be welcome at the public hearing July 14, 1980.
ACKNOWLEDGMENTS
June 10, 1980 memo from the Director of Public Works advising of the appointment of
Frank Erbacher to the position of City Engineer. Mr. Erbacher will be Public Works
liaison with the Planning Commission.
June 13, 1980 memo from the City Attorney; subject: Agins vs. Tiburon, attaching
article from The Los Angeles Daily Journal, June 11, 1980, "Court Denies Damages for
Land Use Regulation".
CITY PLANNER REPORT
CP Yost reported on recommended ordinances which received first reading at the June 16
City Council meeting, second reading to be on July 7, 1980.
