ROLL CALL Present: Commissioners Cistulli, Harvey, Jacobs, Mink, Sine Absent: Commissioner Taylor (excused) Staff Present: City Planner John R. Yost; City Attorney Jerome F. Coleman; City Engineer Frank C. Erbacher MINUTES - Upon motion of C. Mink, second C. Cistulli, the minutes of the July 14, 1980 meeting were unanimously approved and adopted. AGENDA - Upon motion of C. Jacobs, second C. Cistulli, order of the agenda approved. APPLICATIONS FOR ACTION 1. SPECIAL PERMIT TO ALLOW THE POPLAR CENTER TO OFFER AN ADULT ACTIVITY PROGRAM FOR UP TO 65 HANDICAPPED PERSONS AT PERSHING SCHOOL, 1560 NEWLANDS AVENUE CP Yost reviewed this application to offer an adult activity program for handicapped adults, 21 to 60 years of age, at Pershing School. Staff comments and pertinent code sections were noted. Reference staff report dated 7/24/80; Project Application & CEQA Assessment accepted by staff 6/26/80; vicinity map; aerial photograph of the site; Pershing School site drawing; June 16 and July 23, 1980 letters from Elsie B. Vickery, Executive Director, Poplar Center; June 17, 1980 letter from Glenn A. Stewart, Director, Business Services, Burlingame School District; "Guidelines for Leasing School Facilities - Pershing School" dated 6/10/80; Burlingame School District Bid Proposal Form, prospective lessee: Poplar Center, Inc.; and minutes of the May 6, 1980 Neighborhood Meeting: Pershing School. Staff had no objection to approval with three conditions recommended in the staff report. CP described the existing site, with particular reference to the adjacent City owned playground. A concern was expressed about the availability of the playground for neighborhood children. Elsie Vickery, Executive Director of Poplar Center, was present. She discussed the Center's need for more space; the advantages of Pershing School economically and programmatically; and the proposed use of the playground area. One Commissioner noted the success of the Center in San Mateo, a well supervised program with no obvious neighborhood problems. It was determined this is a continuing program, 52 weeks of the year. Chm. Sine opened the public hearing. The following spoke in favor: Peter Schrager, 121 Occidental Avenue, a member of the Board of Directors of Poplar Center - the best use possible for Pershing School, Poplar Center needs the space; Vaughn Janssen, 121 Crescent Avenue - lives directly across from the school, has no objection to the use, use is very close to the guidelines for leasing agreed at the neighborhood meeting; Page 2 Burlingame Planning Commission Minutes July 28, 1980 Glenn A. Stewart, Director, Business Services, Burlingame School District -believe neighborhood's use of the playground for activities such as ballgames would take place in the late afternoon (after Poplar Center is closed), School Board endorses this use for the school. It was determined the building is not earthquake proof nor fire sprinklered; that all participants are over 21 years of age. There were no comments in opposition and the public hearing was closed. Commissioner Harvey advised he was a past member of the board of Poplar Center, and thought their program well organized and supervised. There was a general consensus of support for the Center. C. Mink moved for approval of this special permit. Second C. Cistulli; approved 5-0 on roll call vote, C. Taylor absent. Appeal procedures were advised. 2. APPEAL FROM BUILDING CODE REQUIREMENT; BY LEWIS S. CASE, OWNER OF 1824 BARROILHET AVENUE, ZONED R-1 Reference July 20, 1980 letter from Lewis S. Case; July 21, 1980 memo from the Chief Building Inspector with notation dated July 23, 1980 from the City Engineer; July 24, 1980 memo from the Chief Fire Inspector; July 24, 1980 memo from the City Attorney; and drawings of the proposed addition date stamped July 14, 1980. CP Yost distributed photographs of the house. CE Erbacher reviewed this appeal from the Building Code requirement that the average ceiling height of a new second floor bathroom be increased 6". He discussed the applicant's modifications to this home and Building Department inspections. He noted that the Building Code requires either removal of the nonconforming bathroom or modification of the roof and side walls to meet code requirements. Lewis S. Case, the applicant, was present. He discussed his restoration of this home and his hope to maintain the original roof line. In response to Commission question, he explained the drawings submitted. Chm. Sine opened the public hearing. Mary Susan Case, 1824 Barroilhet Avenue urged Commission grant the appeal in order to maintain the design of the original building and noted they had received positive comments from their neighbors and others. There were no comments in opposition and the public hearing was closed. C. Harvey found that a very small area in relation to the overall floor space was involved; that it would be better aesthetically to retain the original design of the home; that, from the photographs submitted, the water closet and other fixtures would not be affected by the lower ceiling height. C. Mink found that a bathroom is an occasional use as compared to use of the other living quarters; he believed the appeal was justified, and Burlingame code does allow the Planning Commission to approve alternate construction. There was general consensus with these findings, and support for the renovation of this older home. C. Mink then moved to sustain this appeal. Second C. Cistulli; approved 5-0 on roll call vote, C. Taylor absent. The applicant was advised that this decision by the Commission was a final determination. 3. SPECIAL PERMIT TO ALLOW RETAIL CLEARANCE SALES IN AN EXISTING WAREHOUSE AT 1535 ROLLINS ROAD, ZONED M-1; PROPOSED LESSEE: THE EMPORIUM-CAPWELL COMPANY Continued to the meeting of August 25, 1980 at the request of the applicant (reference July 24, 1980 letter from Cyrus J. McMillan, attorney representing Eugene L. Friend of Howard Properties, Inc.). Burlingame Planning Commission Minutes Page 3 July 28, 1980 4. VARIANCES TO CONVERT 12 PARKING SPACES TO TWO MEDICAL OFFICE SUITES WITHIN THE EXISTING PENINSULA PROFESSIONAL CENTER, 1828 EL CAMINO REAL; ZONED C-1 Continued to the meeting of August 25, 1980 at the request of the applicant, Robert Podesta, Peninsula Professional Center (reference July 22, 1980 letter from Mr. Podesta). 5. TENTATIVE AND FINAL PARCEL MAP TO ADJUST THE PRESENT PROPERTY LINE BETWEEN 11 AND 15 GUITTARD ROAD; ZONED M-1; BY LOUIS ARATA FOR GUITTARD CHOCOLATE COMPANY Reference July 21, 1980 memo from A. M. Rebarchik, Department of Public Works. CE Erbacher advised this is a proposal to adjust the lot line between two existing parcels, thus allowing one of the parties additional storage area. Some restructuring of the landscaping and an easement for drainage, as shown on the parcel map, is required. Staff recommended approval. During discussion CE explained the proposal for provision of additional parking area and the drainage easement requirement. C. Jacobs moved for approval and recommendation to City Council of this tentative and final parcel map. Second C. Mink and approved unanimously on voice vote, C. Taylor absent. OTHER BUSINESS 6. RESOLUTION OF COMMENDATION AND APPRECIATION TO JULES L. FRANCARD Secretary Harvey read this resolution into the record. Chm. Sine expressed his appreciation for Mr. Francard's years of service on the Commission and enrichment of all in the community. APPLICATION FOR STUDY 7. SPECIAL PERMIT TO OPERATE A CAP, RENTAL AGENCY AT 1484 BAYSHORE HIGHWAY Requests: the termination dates'of the leases for the other businesses on this property; a timetable indicating the property owner's plans for bringing this site into conformance with the code. Set for hearing August 11, 1980. CITY PLANNER REPORT CP Yost reported the condominium permit approved for Biarritz Condominiums at 1299 E1 Camino Real had been called up by Council and scheduled for public hearing August 4, 1980.
