ROLL CALL Present: Commissioners Cistulli, Harvey, Jacobs, Sine, Taylor Absent: Commissioner Mink (excused) Staff Present: City Planner John R. Yost; City Engineer Frank C. Erbacher MINUTES - Upon motion of C. Jacobs, second C. Cistulli, the minutes of the July 28, 1980 meeting were approved and adopted. AGENDA - Upon motion of C. Jacobs, second C. Cistulli, order of the agenda approved. APPLICATION FOR ACTION 1. SPECIAL PERMIT TO OPERATE A CAR RENTAL AGENCY IN THE C-4 DISTRICT AT 1484 BAYSHORE HIGHWAY, BY GABRIEL MAALOUF OF FAIRWAY RENT -A -CAR & LEASING OF LAS VEGAS CP Yost reviewed this application to operate an "off -airport" car rental agency in the C-4 District. He noted staff comments, previous use of this site, adjacent uses and the property owner's long range plans. Reference staff report dated 8/7/80; Project Application & CEQA Assessment accepted by staff 7/23/80; aerial photograph and site drawing; July 10, 1980 letter from Susan M. Maalouf; June 9, 1980 letter from John G. O'Hara, Landlord to Gabriel A. Maalouf; July 22 and July 31, 1980 letters from John G. O'Hara to City Planner; July 31, 1980 memo from the Chief Building Inspector; July 28, 1980 memo from the Chief Fire Inspector; July 25, 1980 memo from the Traffic/Civil Engineer; Planning Commission minutes of January 22, 1973 granting special permit to Trans Rent-A-Car at this address; and City Council minutes of April 21, 1980 granting special permit to Call -A -Car Rental Company at 1470 Bayshore Highway. Staff had no objection to approval with six conditions as listed in the staff report. Discussion included: the Fire Department's policy that above -ground gasoline storage tanks be either removed or buried; the options of the applicant for fueling his vehicles. Gabriel A. Maalouf, president of G.A.M. Enterprises, Inc. dba Fairway Rent-A-Car System, Las Vegas, Nevada was present. He discussed his experience in this type of business. Further discussion: the proposed fleet size; expected utilization of the fleet; concern about the above -ground gasoline storage tank. John G. O'Hara, the property owner, advised this type of tank would soon be obsolete. Chm. Sine opened the public hearing. There were no comments and the hearing was closed. A further concern was expressed that this is an inappropriate use of the land in the waterfront commercial district, but there was general consensus to allow the use on a temporary (four year) basis. huyuat. � . , Burlingame Planning Commission Minutes Page 2 C. Jacobs moved for approval of this special permit with the following conditions: (1) the permit to operate Fairway Rent-A-Car be approved to Gabriel A. Maalouf, G.A.M. Enterprises, Inc., and be nontransferable; (2) the operation of the business shall be consistent with the July 10, 1980 letter from Susan M. Maalouf; (3) the site improvements identified in the July 31, 1980 memo from the Chief Building Inspector and July 28, 1980 memo from the Chief Fire Inspector shall be completed within three months; (4) a landscaping and irrigation plan for the area between the building and property line adjacent to Bayshore Highway shall be prepared to Park Department standards, with all improvements to be completed within three months; no Fairway vehicles are to be parked within this area, although paved parking for two Pacific Coach & Ambulance Sales Company customer vehicles may be allowed; (5) no vehicles associated with this business shall be parked on -street; (6) the gasoline storage tank shall either be removed or buried within 90 days; and (7) this permit shall be subject to review and possible amendment in one year, and shall expire May 1, 1984. Second C. Cistulli; motion approved 5-0 on roll call vote, C. Mink absent. Appeal procedures were advised. OTHER Chm. Sine requested that the CP report on Assembly Bill 978. CITY PLANNER REPORT CP Yost discussed preliminary 1980 census counts covering housing and population in Burlingame. ADJOURNMENT The meeting adjourned at 8:08 P.M. Respectfully submitted, Joseph E.
