CALL TO ORDER
A regular meeting of the Planning Commission, City of Burlingame was called to order
by Chairman Jacobs on June 25, 1979 at 7:35 P.M.

The minutes of the June 11, 1979 meeting were approved as mailed.
AGENDA - C. Cistulli moved for approval of the order of the agenda.
APPLICATIONS FOR ACTION
1. SPECIAL PERMIT TO CONSTRUCT AN OFFICE PROJECT IN THE BURLINGAME AVENUE OFF-STREET
PARKING, DISTRICT AT 1440 CHAPIN AVENUE, BY ANNCO PROPERTIES INC.
ACP Yost reviewed this application which was continued from the meetings of May 30
and June 11, 1979. The variance from parking standards was withdrawn at the June 11
meeting and new parking plans to code requirements have been received (ref. plans
date stamped June 19, 1979). The State of California Department of Rehabilitation
has reviewed the project plans and clarification has been received regarding handicapped
access. (Reference June 20, 1979 letter from the Department of Rehabilitation and
CA Coleman's memo of June 21, 1979). Staff recommended approval with conditions #1
and #2 as listed in the staff report dated 5/23/79; that the basement level be in
conformance with the plans date stamped June 19, 1979; condition #3 as listed in the
staff report dated 5/23/79; that the changes in the May 24, 1979 memo from ACE Rebarchik
be incorporated in the plans; and that all handicap facilities as specified in the
letter from the State be incorporated in the plans.
Mark A. Coffey, the applicant was present. It was determined the plans had not been
changed with regard to the windows and mansard roof at the rear of the project.
Chm. Jacobs opened the public hearing. Secy. Mink referenced two letters in favor:
(1) June 6, 1979 letter from Robert W. Gates, 1426 Burlingame Avenue; and (2) June 6,
1979 letter from Kenneth L. & Estelle Wentz, 460 Pepper Avenue, Hillsborough. Those
speaking in favor noted the unique design concepts of the project and felt it would
enhance the community. They were: Jack Webb, 1442 Burlingame Avenue; Tom Chigas,
Penthouse Realty, Burlingame; Dr. Gerald Sandbulte, 1317 Bayswater Avenue; Marvin
Clausen, 110 Park Road; Dick Gates, Burlingame Avenue merchant. Seymour Sterling,
1421 Bellevue Avenue reviewed letters in favor from the following: Alfred D. Fregosi,
438 Bucknell, San Mateo; Harold E. Jackson, 940 Santa Inez Avenue, Hillsborough;
C. Alvin Glass, president of Kerns Jewelers, 1298 Burlingame Avenue; Jack H. Howe,
1290 Howard Avenue; Kenneth L. & Estelle Wentz, 460 Pepper Avenue, Hillsborough;

Robert W. Gates, 1426 Burlingame Avenue. Mr. Sterling also presented a petition in
favor signed by seven neighboring businesses. Commission determined that Mr. Sterling
was general project manager of Annco Properties. George Gurs, president of Annco
was also present and advised that only one of the proponents of the project may have
a direct interest in it. There were no further comments in favor.
Arthur Dudley, associated with Nicolaides & Son, 1009 California Drive requested
consideration be given to the height of the roof and windows at: the rear of the project
as they might affect his company's condominium project on Bellevue Avenue. Those
speaking in opposition, particularly with regard to the height., were: Mrs. Janis
Paslin, 1435 Bellevue Avenue; Dr. Leo I. Paslin, 1435 Bellevue Avenue; and Richard
Varni, 1617 Sanchez Avenue. Ms. Ramon Martinez, a Burlingame resident, inquired about
the adequacy of the parking provided. There were no further comments and the public
hearing was closed.
Items of discussion and concerns were: entry into the basement parking level; adequacy
of the parking for tenants and clients/customers; number of standard and compact spaces
provided; requirements for height, lot coverage and gross floor area in the Parking
District; ground water problems at the site; privacy and loss of sun for the
condominium located directly behind the project; possibility of softening the design;
height of the mansard roof and the aesthetics of the building without it, as well as
the height of the other proposed buildings. It was suggested that 3' be cut from the
height of the mansard roof adjacent to the back property line; the applicant confirmed
this was architecturally feasible, and agreed to amend the plains.
C. Sine moved to approve this special permit with the following conditions: (1) that
a parcel map to join the several separate lots that form this 'property be approved
by the City and recorded prior to the issuance of a building permit; (2) that all
construction and site improvements be in general conformance with the plans date
stamped May 7, 1979 (as amended by the oral understanding between the Planning
Commission and Mark A. Coffey, for the applicant, relating to the modification to
the height of the rear building), and the revised pians for parking received June 19,
1979 with 72 standard spaces and 13 compact spaces; (3) that the changes recommended
in the May 24, 1979 memo from the Assistant City Engineer be made in the final plans;
(4) that prior to the approval of a building permit a landscape and irrigation plan
be prepared to the satisfaction of the City; and (5) that the final plans incorporate
all handicap facilities as specifically identified in the June 20, 1979 letter from
the Department of Rehabilitation, State of California. Second C. Mink and approved
5-1 on roll call vote, C. Cistulli dissenting, C. Harvey absent. Appeal procedures
were advised.

2. SPECIAL PERMIT TO CONSTRUCT AN OFFICE PROJECT IN THE BURLINGAME AVENUE OFF-STREET
PARKING DISTRICT AT 360 PRIMROSE ROAD FOR ANNCO PROPERTIES INC.
ACP Yost reviewed this application to construct a 3 -story office building at the corner
of Primrose Road and Donnelly Avenue. Reference staff report dated 6/19/79; Project
Assessment revised 6/20/79; May 30, 1979 letter from Mark A. Coffey of Annco
Architectural Associates; June 5, 1979 memo from the Assistant City Engineer; and
June 5, 1979 memo from the Park Director. A special permit -is required because the
project exceeds code requirements for height, lot coverage and gross floor area in
the Parking District. Mr. Yost explained the Parking District regulations, credits
established when the District was formed, and the matter of payment -in -lieu for parking
deficiency. There was no staff objection to approval; the design meets zoning ordinance

requirements and three conditions for approval, as listed in the staff report, were
l recommended. A June 25, 1979 letter from David John Rivera, project architect, was
distributed this evening; this letter responded to memorandums from the Asst. CE and
Park Director dated June 5, 1979 and the staff report from the ACP.
David John Rivera was present and reviewed his June 25 letter. Items of Commission
discussion and concerns: the number of encroachments into the public right-of-way;
overbuilding of the lot; the need for 7'-6" minimum vertical clearance at the driveway;
existing street trees. Suggestions: better long range planning by the developer,
particularly with regard to additional on-site parking; amendment of the design to
reduce or eliminate the proposed encroachments; request by Engineering staff that
flood protection be provided 6" above top of curb at the property line.
Chm. Jacobs opened the public hearing. There were no comments in favor. Frieda Freund,
1230 Donnelly Avenue spoke in opposition; her main concern was the need for more off-
street parking. After further discussion the public hearing was' continued to the
meeting of July 9, 1979 to allow staff adequate time to review Mr. Rivera's June 25
letter and Commission concerns.

3. SPECIAL PERMIT TO OPERATE AN AIRPORT PARKING FACILITY AT 615 AIRPORT BOULEVARD
BY ANZA PARKING CORPORATION
ACP Yost reviewed this application to allow Anza Parking Corporation to continue its
parking facility at 615 Airport Boulevard and noted the history of the several permits
granted by the City for Anza Parking. The current application reduces the total area
to approximately 12.6 acres and concentrates the facility within the central portion
of the site that is presently being used. Reference staff report dated 6/19/79;
Project Assessment revised 6/20/79; Exhibit A (special permits approved 1971, 1975
and 1976); Exhibit B (1978 special permit and current application); May 31, 1979
letter from David H. Kenston, Anza Shareholders' Liquidating Trust, property owner;
City Council minutes of the May 15, 1978 meeting with conditions of approval; aerial
photo received June 22, 1979 identifying the approximate area of the current application.
Staff recommended approval with eight conditions as listed in the staff report.
David H. Keyston, Anza Shareholders' Liquidating Trust was present. He stated that
the condition requiring abatement of the existing billboard within three months was
acceptable. He then requested that his application be amended to allow airport
parking on Lots 14, 15 and Parcel B for a period of two years. Discussion included:
the desirability of limiting this permit to a site(s) specific; airport parking,
general parking storage and time limits of the permit for each type; access to the
property; fencing; the present status of the Sheraton Hotel parking; the location
of the gas pump and diesel pump; the desirability of including in the conditions
that "all other permits are void and this permit shall be nontransferable". George
Keyston, Anza Shareholders' Liquidating Trust was present and explained the airport
rental parking business.
Chm. Jacobs opened the public hearing. There were no comments and the hearing was
closed. C. Mink moved for approval of this special permit with the following
conditions: (1) that this permit be approved to Anza Parking Corporation, that it
be nontransferable, and that all earlier similar permits shall be void; (2) that
developer agrees to assume all responsibility for flooding or storm drainage problems
and to hold City harmless from any claims arising from such problems; (3) that all

parking spaces be striped for a standard 9' x 20' space; (4) that there shall be no
vehicle washing or service facilities on the airport parking facility site except
for washing of shuttle buses at a wash rack acceptable to City; (5) that overflow
parking of rent -a -car agency vehicles and storage of other vehicles is permitted;
on -street unloading or loading of such vehicles is not permitted; (6) that off-site
parking and shuttle bus service for local employees is permitted; (7) that there
shall be no sign exceptions; abatement of the existing billboard per Sec. 25.41.030(d)
will be,completed by the property owner within three months of this permit; (8) that
this permit shall expire May 15, 1988 for Lots 8-12, Block 5; Lots 1 and 4-13, Block 7;
and State Leasehold Parcel #1; that the permit for Lots 14, 15 and Parcel B shall
expire May 15, 1981; and (9) that airport parking shall be limited to the area shown
on the air photo date stamped June 22, 1979, to be totally fenced by January 1, 1980.

procedures were advised.
4. FENCE EXCEPTION TO ALLOW A 7 FOOT HIGH FENCE ALONG THE SIDE PROPERTY LINE AT
721 BAYSWATER AVENUE. BY HANK SAUER
ACP Yost reviewed this application to allow a 7' high fence which had been constructed
for a dog run without benefit of a building permit. Reference staff report for Item
No. 4 P.C. 6/25/79; letter from the applicant and site diagram received June 20, 1979;
and photographs of the site. There was no staff objection to approval if exceptional
circumstances could be found to apply. The applicant, Hank Sauer, was present.
Chm. Jacobs opened the public hearing. Secy. Mink paraphrased letters from the
following neighbors strongly in support: Lloyd C. Fleming, 712 Bayswater Avenue;
and Richard Codeson, 716 Bayswater Avenue. He also noted two further letters in
support from: Mrs. Marguerite A. Lappe, 715 Bayswater Avenue; and Mr. and Mrs. J. D.
Cesace, 711 Bayswater Avenue. There were no audience comments and the hearing was
closed.
During discussion it was noted this 7' fence as well as several) other site improvements
had been made without the necessary City permits. A concern was expressed about the
view from the bedroom window of the neighbor on Arundel Road. A low voltage wire
at the top of a 6' fence was suggested; the applicant stated his strong opposition
to this type of fence. The possibility of the dog being able to jump over a 7' fence
was discussed. The applicant advised his dog was not an excessive barker and he had
received only one complaint in three years. A further suggestion was made that a wire
screen be placed across the top of a set of 6' high fences to unclose the area of the dog run
Based on the letters which Commission received from the neighbors and testimony received
tonight, C. Mink found that there were exceptional circumstances and that the 7' fence
would not be a detriment to the neighborhood. C. Mink then moved for approval of
this fence exception, as built. Second C. Francard; motion to approve effectively
denied on a 3-3 roll call vote. Cers. Cistulli, Sine and Jacobs dissenting, C. Harvey
absent. Appeal procedures were advised.
5. AMENDMENT OF 10/25/78 SPECIAL PERMIT TO ALLOW THE SALE OF WINE AND BEER AT PRIME
TIME RACQUET CLUB, 1730 ROLLINS ROAD
ACP Yost reviewed this request by Prime Time Racquet Club to sell beer and wine at
poolside and in the lounge area. Reference June 2, 1979 letter from Jim Loustalot
and Nick Bichard; June 18, 1979 memo from the Chief of Police indicating no major
concerns regarding this request; October 25, 1978 Planning Commission minutes; and
October 2, 1978 letter from Charles N. Bichard and James C. Loustalot.

Jim Loustalot was present; he advised.Commission this request was prompted by a
request from their adult members for this service. He stressed that the club is a
private club, open to members and guests only, and noted a survey made of other
such clubs who reported no problems when incorporating beer and wine service. Chm.
Jacobs opened the public hearing. There were no comments and the hearing was closed.
There was no Commission objection since this was a request of the members, the beer/wine
lounge would not be open to the public and the Police Chief had no concerns. C. Mink
moved that the amendment to the October 25, 1978 special permit be granted with the
condition that hours of sale be 10:00 A.M. - 10:45 P.M. Second Cers. Francard and
Cistulli, and approved 6-0 on roll call vote, C. Harvey absent. Appeal procedures
were advised.
6. AMENDMENT OF OCTOBER 25, 1978 SPECIAL PERMIT TO ALLOW THE SALE OF WINE AND BEER
AT BURLINGAME RACQUET CLUB, INC., 1600 GILBRETH ROAD
ACP Yost reviewed this request to sell beer and wine between the hours of 10:00 A.M.
and 10:00 P.M. daily. Reference June 12, 1979 letter from Kenn Edwards; June 18, 1979
memo from the Chief of Police indicating no major concerns; October 25, 1978 Planning
Commission minutes; September 21, 1978 and October 13, 1978 letters from Kenn Edwards.
Kenn Edwards was present. Chm. Jacobs opened the public hearing. There were no
comments and the public hearing was closed. C. Mink moved that the amendment to the
October 25, 1978 special permit be granted with the restriction that the hours of
sale be limited to 10:00 A.M. - 10:00 P.M. daily. Second C. Cistulli and approved
6-0 on roll call vote, C. Harvey absent. Appeal procedures were advised.
The next item was taken out of order to accommodate the applicants.
14. REVIEW OF JUNE 26, 1978 SPECIAL PERMIT TO ALLOW WALL, FLOOR AND WINDOW COVERINGS
TO BE SOLD AT RETAIL IN THE M-1 DISTRICT AT 1675 ROLLINS ROAD, BY ARIAS INTERIORS
ACP Yost reviewed this item. Reference staff report dated 6/20,179; June 26, 1978
Planning Commission minutes; and May 12, 1978 letter from Rinda and Edward Arias.
Staff confirmed no complaints had been received and the business has been kept
wholesale oriented. C. Sine moved that the special permit be continued without
amendment or further limitation. Second C. Cistulli and all aye voice vote.
7. CONDOMINIUM CONVERSION PERMIT FOR A 4 -UNIT APARTMENT NOW UNDER CONSTRUCTION AT
1220 PALOMA AVENUE. BY MARTIN M. RON ASSOCIATES FOR DANIEL CROWLEY
ACP Yost reviewed this application to classify the 2 -story, 4 -unit apartment building
now under construction as a condominium. Reference staff report dated 6/20/79;
Project Assessment revised 6/20/79; June 4 and June 20, 1979 memos from the Asst. CE;
June 11, 1979 memo from the Park Director. Staff recommended approval with two
conditions as listed in the staff report.
James Shypertt, Martin M. Ron Associates was present representing the applicants. Chm.
Jacobs opened the public hearing. There were no comments and the hearing was closed.
ACP Yost confirmed that the project meets all condominium engineering requirements and
City minimum standards for landscaping. C. Sine -voiced his objection to such
condominium conversions, noting the need for more apartment units in Burlingame.
C. Taylor agreed.

C.. Mink moved for approval of this condominium conversion permit with the following
conditions: (1) that the engineering requirements specified for condominium projects
be met to the satisfaction of the Director of Public Works; and (2) that the
landscaping and irrigation system be installed to City standards prior to the final
inspection of the project. Second C. Cistulli and approved 5-1 on roll call vote,
C. Sine dissenting, C. Harvey absent. Appeal procedures were advised.
8. TENTATIVE CONDOMINIUM MAP FOR 4 CONDOMINIUM UNITS AT 1220 IPALOMA AVENUE
ACE Rebarchik referenced his memos of June 4 and 20, 1979. Tentative map approval
was recommended with the condition that items 4 and 5 in his June 4 memo be satisfied.
Chm. Jacobs opened the public hearing. There were no comments and the hearing was
closed. C. Mink moved for approval of this tentative condominium map subject to the
following conditions: (1) that a satisfactory drainage plan be provided, including
all necessary piping and structures; and (2) that separate water system shutoffs
for each unit or acceptable alternate be shown on the plans. Second C. Francard
and approved 4-2 on roll call vote, C. Sine abstaining, C. Taylor dissenting,
C. Harvey absent.
9. TENTATIVE AND FINAL PARCEL MAP TO RESUBDIVIDE LOTS 27, 28, 29 AND 30, BLOCK 5,
EASTON ADDITION NO. 1, PROPERTY AT 1188 EL CAMINO REAL FOR HOME SAVINGS AND LOAN
ACE Rebarchik advised of Home Savings' purchase of an additional parcel at this
location; the present map combines the additional parcel with the previously approved
map. Engineering recommended approval with the same terms and conditions as the
previous map. Chm. Jacobs opened the public hearing. There were no comments and
the public hearing was closed. C. Sine moved for approval of this tentative and final
parcel map, this map to have the same terms and conditions as the previous map
approved January 22, 1979. Second C. Cistulli and approved 6-01 on roll call vote,
C. Harvey absent.
10. TENTATIVE AND FINAL PARCEL MAP TO MERGE LOTS 9 AND 10, BLOCK 7, EAST MILLSDALE
INDUSTRIAL PARK NO. 2, PROPERTY AT 855 MAHLER ROAD, FOR THOMAS LEONARDINI
ACE Rebarchik advised this map combines two lots into a single parcel; there were no
conditional requirements and approval was recommended. Chm. Jacobs opened the public
hearing. There were no comments and the hearing was closed. C. Sine moved for
approval of this tentative and final parcel map. Second C. Cistulli and approved
6-0 on roll call vote, C. Harvey absent.
11. TENTATIVE AND FINAL PARCEL MAP TO MERGE PARCELS A AND B OF PARCEL MAP RECORDED
IN VOL.36 OF P.M. PAGE 50, PROPERTY AT 600 AIRPORT BOULEVARD, FOR BURLINGAME
BAY LTD.
ACE Rebarchik advised there are no conditional requirements for this map; it is simply
erasing a lot line. Engineering recommended approval. Chm. Jacobs opened the public
hearing. There were no comments and the hearing was closed. C. Sine moved for

12. APPEAL OF STAFF DETERMINATION THAT A PROPOSED DIRECTIONAL SIGN FOR VICTORIA
STATION RESTAURANT AT THE CORNER OF AIRPORT BOULEVARD AND ANZA PACIFIC PLACE
WOULD BE OFF -PREMISE ADVERTISING, BY DAVID H. KEYSTON OF ANZA SHAREHOLDERS'
LIQUIDATING TRUST
ACP Yost reviewed this item, noting pertinent code sections. Staff and the City
Attorney were in agreement that the proposed sign would be off -premise advertising
And therefore prohibited by the City's Sign Code. Reference staff report for Item
No. 12 P.C. 6/25/79; drawing of proposed sign received June 18, 1979; June 14, 1979
letter from David H. Keyston.
David H. Keyston was present and stated his belief that the prohibition of off -premise
advertising signs was included in the Sign Code to prevent large highway billboards
and commercial signs on rooftops, not this type of directional sign. He felt the
proposed sign was dignified and subdued, and stressed the need for a sign to direct
patrons to the entrance of the project.
The possibility of an amendment to the Sign Code was discussed. There was a minority
opinion expressed that the sign should be allowed; several other Commissioners felt
that under the current code it is a prohibited sign and this was the intent at the
time the code was adopted. C. Taylor moved to sustain staff's determination that
this is an illegal sign. Second C. Mink and approved 4-2 on roll call vote, Cers.
Cistulli and Francard dissenting, C_. Harvey absent. Appeal procedures were advised.
13. REVIEW OF JUNE 26, 1978 SPECIAL PERMIT TO OPERATE A RESTAURANT AT 819 MITTEN
ROAD, BY JACK FONG WOO
ACP Yost reviewed this item. Reference staff report dated 6/20/79; and June 26, 1978
Planning Commission minutes. Staff confirmed this business has been in compliance
with the conditions of the special permit and no complaints have been received.
C. Taylor moved that this special permit be continued without amendment or further
limitation. Second C. Mink and all aye voice vote.

15. RESOLUTION NO. 4-79 RECOMMENDING LANDSCAPING AND OPEN SPACE STANDARDS FOR
RESIDENTIAL CONDOMINIUM PROJECTS
ACP Yost reviewed this item, noting the resolution was drafted in accordance with
comments made by Commission at their recent meetings. Staff recommended this
resolution be made a part of the Condominium Guidelines. C. Taylor moved for adoption
of Resolution No. 4-79. Second C. Sine and all aye voice vote.

CITY PLANNER REPORT
ACP Yost reviewed the following ordinances for information: (1) Ordinance No. 1151,
Establishing development fees for road improvements; (2) Ordinance No. 1152, Making
gasoline storage facilities in commercial and industrial zones a conditional use;
and (3) Ordinance No. 1153, Providing for compact car spaces in commercial and
industrial zones. All were adopted by City Council on June 18, 1979.
The status of the proposed ordinance regarding parking of campers, trailers, boats
and recreational vehicles was discussed by the City Attorney. Reference CA's memo
of June 12, 1979 to City Council.
