ROLL CALL Present: Commissioners Cistulli, Kindig, Sine, Taylor, Jacobs Absent: Commissioners Francard and Mink Staff Present: John R. Yost, Assistant City Planner; Jerome F. Coleman, City Attorney; Ralph E. Kirkup, City Engineer MINUTES The minutes of the November 27, 1978 meeting were approved as mailed with the addition of a statement at the end of Item A, page 5 that the Curley -Bates Company was advised of appeal procedures by the Chairman. APPROVAL OF AGENDA - Order of the agenda was approved. MEETING ITEM FOR ACTION 1. RESOLUTION NO. 8-78 GRANTING PARKING VARIANCE TO CURLEY-BATES COMPANY FOR THE PROPERTY AT 860 STANTON ROAD Assistant City Planner Yost recommended approval of this resolution which records the conditions stipulated in the Commission's November 27, 1978 approval of a parking variance to the Curley -Bates Company. Commissioner Kindig requested under 2.(f) that the resolution specifically state ". . . including the removal of the 2,850 square feet of improvements authorized under the terms of this variance". Commissioner Kindig then moved for adoption of Resolution No. 8-78 with the above amendment; second Commissioner Cistulli and approved unanimously 5-0, Commissioners Francard and Mink absent. MEETING ITEMS FOR STUDY 2. CONDOMINIUM CONVERSION PERMIT FOR FLORIBUNDA CONDOMINIUMS AT 1210 FLORIBUNDA AVENUE 3. TENTATIVE SUBDIVISION MAP FOR 8 CONDOMINIUM UNITS AT 1210 FLORIBUNDA AVENUE Assistant City Planner Yost reviewed this condominium application to reclassify a building currently being constructed as an apartment; he noted that the Commission had approved a variance for the apartment in March, 1978 to permit 56% lot coverage. City Engineer reported construction of the apartments was consistent with Engineering Department condominium standards regarding water shutoffs, flood protection and sidewalk layout. Commission was advised the application is complete. George Sinclair, architect represent- ing the applicant, was present. There was some Commission discussion regarding the amount and location of the open space being provided; staff noted the absence of any specific open space requirements per condominium unit in the code. SPECIAL PERMIT TO SELL USED CARS IN THE M-1 DISTRICT AT 1315 ROLLINS ROAD Assistant City Planner Yost reviewed this request to sell used cars, on which the applicant had performed repairs, at 1315 Rollins Road; he noted the property had been approved by Commission in July 1975 for an auto service center. Staff found the application complete. Item set for hearing January 8, 1979. 5. DEVELOPMENT POLICY, ANZA AREA: NOVEMBER 30, 1978 PROGRESS REPORT 6. DEVELOPMENT CHARGE, BAYFRONT AREA Assistant City Planner Yost referred to the progress report by staff dated November 30, 1978 which was discussed by City Council at their December 6 study meeting. He noted several new ideas: (1) development should be consistent with the restraints of the road system; (2) the zoning ordinance may not give adequate control over the location of development in this area; a "specific plan" is proposed; (3) uses to be permitted should be selected on their ability to generate a high benefit -to -cost ratio to the city, and also their ability to promote public access to the shoreline; (4) a development charge should be considered so that development pays a fair share of the off-site road and public utility costs. More detailed land use and traffic studies will be made and a more detailed report will be made to Council in January. City Engineer Kirkup discussed the need for development charges and material contained in the progress report. Commission questioned: should the drive-in theater property remain M-1? how can the build -out rate be controlled? The need for city control of all future permits was stressed. Commission was informed an overlay zone had been discussed which could require a special permit for every project in the Anza area. The extremely large amount of money required for a freeway overpass was pointed out. It was requested the reference to "permitted uses" also include motels. Commission expressed appreciation to staff for the information given them and felt this report contained well thought out objectives and preliminary implementation plans. PROPOSED HEALTH SPA, 226 LORTON AVENUE, BY HOWARD ATKINS Assistant City Planner Yost told Commission of this new location for Mr. Atkins' proposed health spa. Drawings showing the proposed first and second floor plans were examined. After some Commission discussion Chairman Jacobs set this item for hearing on January 8, 1979, if staff finds the application is complete. OTHER BUSINESS 7. 1979 MEETING SCHEDULE The 1979 Planning Commission meeting schedule was approved unanimously by all members present. 8. WASTEWATER RECLAMATION PROJECT: SEPTEMBER 1978 REPORT City Engineer Kirkup explained that an environmentalimpact report is required on any study using reclaimed water on sewage treatment plants, and that the draft EIR requires a public hearing before the Planning Commission. During discussion Commission expressed its feeling that wastewater reclamation projects might better be county -wide. This item was scheduled for study on January 8 and public hearing January 22, 1979. Burlingame Planning Commission Minutes CITY PLANNER REPORT 9. ORDINANCE NO. 1140 AMENDING CODE SEC. 25.62.040 Page 3 December 11, 1978 Assistant City Planner Yost reviewed the petition received by Commission from the Burlingame Gate Improvement Club which questioned the 30' maximum front setback code requirement. Subsequently this was taken to City Council. Ordinance No. 1140 was adopted by Council on December 4, 1978 which deletes the 30' maximum setback requirement. OTHER Commissioner Cistulli brought up the problem of homes with one car garages and as many as four cars parked in the driveway or on -street. He also reported a large boat parked in the front setback at 1633 Marco Polo Way; staff advised the necessary abatement action will be taken. ADJOURNMENT The meeting adjourned at 9:10 P.M.
