A. POLICY PLANNING
1. GENERAL PLAN REVISION/REZONING STUDY
Chairman Mink announced this topic for Commission consideration and
requested report from City Planner Swan.
The City Planner prefaced his remarks by noting that this top
priority item, and other policy items, had been scheduled ahead of
regular applications to allow for full discussion on this long agenda.
Toward this effort on the General Plan, much staff work had been
expended on full documentation and maps.
The City Planner stated this subject entails a comprehensive set of
changes to revise the General Plan, amend the zoning code, and amend
the zoning map. He reviewed that Council had referred to the Commission
the matter of consistency between the General Plan and the zoning map..
The directive was to make the General Plan identical to the zoning
in R-1 and R-2 zones. In late November, the Commission had elected
to study this matter in detail, make a thorough investigation, and
report back to Council in sixty days, a target date of about
January 25. He considered that results of discussion at this meeting
could be finalized at the January 27 hearing meeting, with a report
to Council at that time. He added that request had been received
for report on Burlingame Park area at the Council study meeting of
January 15, 1975.
City Planner Swan presented two concepts: an RD District (restricted
density multi -family uses), and a medium low density residential
area. In an RD district, not more than three families would be
permitted on a lot larger than 9,000 SF. Larger projects would
only be permitted with a special permit. He suggested this restricted

density could be established in the zoning code but no district
need be shown on the zoning map. An RD District in the Corbitt
Tract would be an exception to be considered for a zoning map change.
.The City Planner used the R -3A District as a precedent for this
.procedure. R -3A is in the code, but is not on the zoning map.
Similarly RD, another step down the buffer area, could be in the
code but the zoning need not be established. Consideration might
be given to changing zoning map to include an R -3A district now and
at some future date the addition of an RD district. He demonstrated
on a map the concept in Burlingame Park Area of R-3 along El Camino;
a 100' wide band of R -3A adjacent to it; and a future RD District
beyond. The latter would extend only part way into the present
medium density area on the General Plan. A revised General Plan
would reduce the area for medium density residential and change most
of the remaining area to medium low residential density.
The City Planner discussed scope and scheduling of work necessary in
this General Plan revision which would include areas designated as
P, Corbitt Tract; Q, Rollins Road; R, Burlingame Park; and S. East
Burlingame; along with other small areas, T,A,B,C,D, such as Skyline
Terrace and Quesada. These latter would be susceptible to actual
rezoning because of their present useage. He noted the Broadway
areas, E and F, would require considerably more study because of
the circulation system, and length of time to complete could not be
estimated. He spoke of the necessity for thorough research in this
endeavor with the General Plan so that facts and figures can be
used for decision making. He stressed that anything that is changed
will have an effect on people's property which is of great importance
to them. In this relation, he spoke of work with sample areas of
the city, and the fact that the actual density has been found to be
nearly the same in typical R-1 and R-2 areas.
City Planner Swan referred Commissioners to table on Page 1.3 of
Technical Memorandum on General Plan revision. This table compares
densities of general plan classifications and zoning classifications.
General Plan densities of "low", "medium" and "medium high" compare
respectively to R-1, R -3A, and R-3. There is no general plan counter-
part for R-2 or RD, proposed as"medium low." R-1 and R-3 figures are
substantiated by 1970 census data. A following table showed a
tabulation of density in 12 representative sample areas, and a
graph fixed the density points of R-2, RD, and R3 -A on a curve between
established points of R-1 and R-3.
Discussion followed on methods of calculation and the criteria for
the RD zone. For clarification, the City Planner compared uses of
a standard 5,000 SF lot. If R-1 zone, one dwelling unit would be
permitted. If R-2, 2 dwelling units; and if RD still only 2 units
permitted. However, if two lots were combined for a total of
9,000 SF, 3 units would be permitted with special permit and building
permit.
Commission comments included the statements that this would solve
the problem of the R-2 zones which are virtually dead zones in the
city, and that the use of RD would be most probable in areas which
have already begun to show signs of conversion.
City Planner Swan explained exhibits of the Corbitt Tract, Area "P".

Maps showed present zoning and present general plan density, with
overlays showing proposed zoning and general plan changes. For this
area, the general plan shows medium high density; zoning is R-2
with the exception of small corner zoned C-1. The proposal is to change
major portion to medium low density, RD zoning; and low density,
R-1 zoning for lots fronting on Park Avenue. The Assistant City
Planner remarked this would affect 59 lots resulting.in a new loss
of.172 dwelling units, and a long term net loss of 133 people. City
Planner Swan added this would happen only if each lot were developed
to its full capacity.
He added that private redevelopment is usually gradual and that only
10% would probably take place by 1980. There was question if the
past growth of Burlingame was being used as a criteria and how judgment
was made. Both the City Planner and Assistant City Planner agreed
that experience and judgment indicated that 50% development could be
expected in a 20-25 year period. Another commissioner stated that
the Corbitt tract now is and has been a poor land use because of the
depth of lots with single family residences. The City Planner stated
that after General Plan changes were made reducing the density of
this tract from medium high to medium low and low, zoning map changes
could be made.
Commissioners discussed the proposal of several years ago to change
this area to R -3A, and the fact that residents had wanted it changed
to R-3 instead. One commissioner considered RD a good solution to
this area since R-2 is not used, but warned that undergrounding is
substandard and this must be worked out if the density is raised.
Chairman Mink, noting that census figures indicate density is lower
thaft 10 years ago, suggested this may be because of the shift to
smaller families, leading to insufficient utilization of the land.
He added that growth rate is below sustaining in this particular
area. There was comment this could be because families have grown
UP.
City Planner Swan requested Commission direction in this area.
Chairman Mink reviewed that this would necessitate revising the
General Plan, revision of zoning map, and addition of RD zone to
Title 25. He questioned if there was general agreement that this
direction should be taken in Area P, adding that any statement is
tentative. He stated he considered this a sensible solution to
this area. Several Commissioners agreed, one pointing out that
because of legal problems involved, identity between the General
Plan and zoning could be achieved in certain areas, but in general
it was not feasible. One commissioner reserved comment pending
public input.
Discussion then centered on Area Q - Rollins Road between Oak Grove
and Toyon, for which the General Plan projects a strip of medium
high density along Rollins Road and one area of commercial use.
The City Planner pointed out proposed General Plan and zoning map
changes on maps. These would entail amending the General Plan
designation of 45 medium high lots to 10 medium, 18 medium low, and
17 low. Also 22 service and special sales lots would be changed to
medium high, medium low and low. This total of 67 lots projected
a dwelling unit loss of 127. Zoning map changes would include 5
R-1 lots raised to R-3 or R -3A; 7 R-3 lots downzoned and 4 R-3
lots changed to C-1. It was emphasized that medium low density, RD,
would be permitted in this area only by special permit. Average
lot size of 50' x 125' would still require the combination of two
lots. Considerable Commission discussion followed.
Chairman Mink reviewed necessary changes to the General Plan and
zoning, and the City Planner's presentation took up the subject
of the Burlingame Park area.
City Planner Swan showed existing R-3 district boundary and pointed
out some apartments which are located both on R-3 and R-1 lots and
permitted by use variance. He then demonstrated the General Plan
areas of medium and medium low density and showed proposed density
decrease in this area. Proposed is medium high area of 150' from
E1 Camino; medium density area 100 to 150' wide beyond that and
then medium low density extending to low density R-1 area,
Commission discussion followed. There was comment that this would
legalize a number of non -conforming and illegal dwellings. The
City Planner pointed out this was a secondary result. Since two lots
must be combined for RD, it was felt this type of development would
not be frequent. One commissioner also pointed out the undergrounding
was substandard in this area and suggested as a condition of the
special permit that the undergrounding be brought up to standard
and that the developer pay for it, rather than have a property assess-
ment. This would give the city control over all such developments.
The City Engineer agreed that developing without upgrading services
would cause problems.
Following this discussion, the Commission considered the area of
East Burlingame between Burlingame Avenue and Peninsula. The
City Planner pointed out that this area has a narrow R-3 zone and the
rest is R-1, but there are many other actual uses there. This is
medium density on the General Plan. The proposed change in the
General Plan would decrease medium density to medium -10w and low.
This would be accomplished by having an R -3A 100' wide area buffering
the R-3 zone. This would involve 182 lots and decrease the holding
capacity of the area by 223 dwelling units. No RD zoning would,be
considered, but RD could be used with a special permit. Discussion
followed. Undergrounding was again discussed and the usefulness of
RD.
The Planning Department was complimented for the thoroughness of its
preparation and excellent explanation.
Commissioners then discussed mechanics of hearings and code amendments
with priority of scheduling. The City Planner reported that 60%
of staff work had been completed.
Because of the scope of the presentation and public participation
anticipated, there was suggestion that a temporary moratorium be
declared on planning applications. However, this was considered
inadvisable. Area "R", Burlingame Park; and Area "S", East
Burlingame were set for public hearing January 27. Areas "P",

Corbitt Tract; Q, Rollins Road; and T,A,B,C,D were set for public
hearing at the adjourned.meeting of February 10.
RECESS:
There was a short recess at 9:30, after which the meeting reconvened.
2. BURLINGAME SHORELINE BICYCLE/PEDESTRIAN TRAIL.
City Planner Swan presented progress report on this project. He
explained diagrams transmitted by Hart.Krivatsy.Stubee illustrating
seven different access routes possible to the bike path along the
shoreline. These included Broadway and Peninsula Avenue. Memo
of January 10, 1975 from the consultant indicated that all of these
routes had been evaluated with respect to safety, travel experience,
t'rail continuity, accessibility, maintenance, and implementation.
Route E, Winchester Drive, was highest. The City Planner noted this
was a longer distance, but considered more advantageous. He stated
the consultant wishes input on this proposed route, and they hope
to present a draft report to Council at the February 20 meeting.
There was some discussion. The City Planner noted that access from
Millbrae or San Mateo would involve negotiations with these cities.
He added that the first phase of the bicycle trail may be possible
with funds available for bike paths. A request had been submitted
for money to construct a bike path along the easement which parallels
the inner lagoon. This would involve 3,700 feet of bike path, and
could be built when financing is available. There was question of
the safety requirements along the lagoon and the City's responsibility.
The City Planner indicated this had not yet been detailed.
3. COMMISSION REPORT OUTLINE ON ANZA MASTER PLAN EIR-28P
Chairman Mink reported that Commission subcommittee had met on
Friday, January 10, and progress had been made toward a report to
the City Council, The Chairman considered it possible that this report
might be drafted within 30 days, and invited Commissioners interested
to participate in the preparation.

He considered this should be $75.00 in all districts, and not lower
in R-1 and R-2, since most special permits in this area are for types
of heavy uses quite different from R-1 use. He noted Council suggestion
had been that appeal to City Council should not be subject to fee.
He mentioned there often is additional staff work required on appeals.
He compared revenue received for 1974 with revenue from proposed
fees. The City Planner reported these fees are referred to Council
for consideration.
City Attorney Coleman pointed out that fees are not to be considered
revenue, but are for recovery of administrative costs. There followed
considerable discussion on the cost of processing different types
of applications and whether or not it is covered by fees. The
City Planner noted the Council has the option of changing fees month
to month as they wish.
Final Commission recommendation was that the fee for applicant appeal
to City Council be $25.00 except in R-1 and R-2.
5. PROCEDURE FOR PROCESSING MINOR PERMITS
City Planner Swan proposed that minor permits such as appeals,
fence variances, ambiguity hearings, sign applications, be considered
after 9:00 P.M. at the second Monday meeting of the Planning Commission.
Notices could be sent out ten days prior to the meeting so that
hearing could be conducted. He added that if sufficient information
was not available at this meeting, the application could be held over
to the fourth Monday meeting. City Attorney Coleman questioned the
use of "fence variance" as a minor permit, since it is in the zoning
code. City Planner Swan preferred the term "fence exception" and
quoted Code section 25.78.05 which states "Fences of a greater height
than herein permitted may be approved by the Planning Commission
upon presentation of a petition." He considered that the minor permit
approach would be expeditious. There was Commission suggestion that
the code be amended, taking out the word "variance" from this
section.
Commissioners discussed procedure of handling minor permits at both
Monday meetings and approved. It was thought the question of
fence "variance" or "exception" should be cleared up. Chairman Mink
requested staff to prepare appropriate information to forward to
the City Council for policy approval.
6. SIGN CODE AMENDMENTS
City Planner Swan discussed proposed addition to sign code, Chapter
22.64 Enforcement. This deals with signs which are in violation of
the sign code and has an amortization schedule for all roof signs.
He stated that the 8 year period for amortization of roof signs
over $10,000 value is a compromise, since the generally accepted
period of time is five years. He quoted information received from
the State Department of Transportation. Commission discussion followed
with agreement that amortization was a high priority item.
City Planner Swan presented the problem of "sign variance." He
suggested that the term "variance" be clarified as in fence "variance.
He questioned if the Commission wished to keep the 32 SF sign limit
or if they would prefer 50 SF. Some Commissioners indicated a
preference for 50 SF. Chairman Mink suggested that the sign limit
be 32 SF in areas of short sight distance; 50 SF in areas of long
sight distance, such as M-1, and possibly the same consideration
could be given to C-2.
7. FLOOD PRONE AREA
City Planner Swan displayed map showing Burlingame's flood prone
area over a hundred year period. This map was drafted from information
furnished by the State of California. The City Planner stated that
HCDA projects may not be located in a flood prone area. This map
substantiates the fact that Burlingame's proposed HCDA site is outside
the flood area.
City Engineer Davidson remarked that his office is appealing several
areas which they think do not belong in the 100 -year map. The map
was examined and discussed.

S. GENERAL PLAN NOISE ELEMENT
City Planner Swan reported that the noise element of the general plan
is due in September, 1975. Because of the highly technical nature
of this work, it would be preferable to have it prepared by a
consultant in that field, since noise analysis work includes field
measurements, design of noise abatement strategies, etc. He stated
one proposal had been received from Earth Metrics Inc. of Mountain
View. Funds have not yet been allocated for this work, andit requires
City Council commitment. There was discussion. Question was raised
of time scheduling after a consultant was engaged. The City Planner
stated he would research and report tD the Commission in February.
There was a suggestion that Hillsborough be contacted toward a
joint venture and a split consultant fee.
9. CITY COUNCIL REFERRAL: EIR-30P. SETBACKS IN M-1 DISTRICT:
LANDSCAPING IN M-1 DISTRICT.
City Planner Swan reported that the City Council had referred this
EIR back to the Planning Commission for review of setbacks and
landscaping in the M-1 district. Mr. David Keyston and Mr. Robert
Brown had met with the Council subcommittee considering these
amendments and had requested changes. Part of their request was
that setbacks be limited to Rollins Road and Bayshore Highway. The
City Planner stated he did not have full information on their
request.
Mr. David Keyston addressed the Commission, stating there was
serious objections to side and back setbacks on M-1 corner and
narrow lots, as well as the 25' front setback proposed on all M-1.
Also some clarification was requested of landscaping in the front
setback area. There was some discussion. Chairman Mink requested
the City Planner to obtain specific information so that the
Commission could review this request at a later meeting.
10. CITY PLANNER REPORTS TO CITY MANAGER AND CITY COUNCIL
a. HCDA - Proiect Area.
City Planner Swan displayed map of this proposed Housing and Community
Development area which is bounded by Burlingame Avenue, Humboldt
Road, Peninsula Avenue and the SP railroad tracks. Report has been
transmitted to City Council.
b. Avis Car Sales
The City Planner stated report on this subject had been written to
the City Council as requested.
C. Planning Tasks for future Council study._
City Planner Swan reviewed list of topics for the coming year. This
included such items as Burlingame Transit Policy, Shoreline Bicycle
Trail, Shoreline Specific Plan, EIR procedures, elements of General
Plan, etc.
11. FINAL PARCEL MAP, BEING A RESUBDIVISION OF LOTS 12 AND 13, '
BLOCK 32, LYON & HOAG SUBDIVISION (APN 029-274-230) BEING VACANT
PROPERTY AT CLARENDON AND HOWARD AVENUE, ZONED R-1, BY EDWARD

City Engineer Davidson reported that this final map, recently
reviewed by the Commission as a tentative map, was technically
correct with the exception of some documentation such as receipts
for paid taxes. it was set for hearing January 27, 1975.
12. TENTATIVE PARCEL MAP, THE ANSEL, A CONDOMINIUM PROJECT AT
606 ANSEL ROAD, BEING A PORTION OF LOT 9, BLOCK 6, BURLINGAME
LAND COMPANY MAP NO. 2 (APN 029-131-330) BY REDMOND WALSH FOR
JOSEPH G. AND M.L. LOMBARDI
City Engineer Davidson stated this is a subdivision map for a three
unit condominium which is already built. Building permit was obtained
in April before a condominium permit was required. Landscaping is
in and has been approved by the Park Director. The City Engineer
stated he had the CC & R's but they must yet have the two parking
spaces assigned for each unit. Also the 4' side setback automatically
makes this condominium non -conforming since code now requires 5'
side setback. This could cause problems if this non -conforming
building were more than 50% demolished and must be rebuilt to code.
There was discussion of whether or not this building would require
a condominium permit in view of the date of its erection. The owner
stated he had always intended this to be a condominium - it was
not a conversion. After discussion it was the opinion of staff that
no condominium permit was required. The map was set for hearing
January 27, 1975.
13. SPECIAL PERMIT FOR CAR RENTAL AGENCY IN M-1 DISTRICT AT 808
BURLWAY ROAD (APN 026-111-120) AND CAR STORAGE AT 855 MAHLER
ROAD (APN 026-322-190) BY DOMINIC ACCETTA FOR AZTEC RENT -A -CAR
(CONTINUED FROM DECEMBER 30, 1974 AND AMENDED.1
Assistant City Planner Yost reviewed circumstances of this application.
There had been question of adequacy of parking for this operation.
He informed Commissioners applicant had made provisions to lease
25 parking spaces on an adjoining lot at 855 Mahler in addition to
8 parking spaces on the location at 808 Burlway Road. Documentation
has been received from property owners to this effect.
Discussion followed. It was suggested permit be conditional upon
the execution of both leases. It was noted signage application
will be submitted later. This application was set for hearing
January 27, 1975.
14. SPECIAL PERMIT FOR OFFICE BUILDING IN M-1 DISTRICT AT 1511
ROLLINS ROAD (APN 025-280-310) BY DENNIS KOBZA, ARCHITECT FOR
AIR TRANSPORT WORKERS.
City Planner Swan distributed plans for this office building with
meeting hall and service areas. He considered additional information
was necessary for parking, number of meetings to be held, and number
of people attending. Also needed was information as to whether or
not hall was to be sublet to other groups for meetings or social
functions.
The representative of Air Transport present stated he had been
informed a general meeting would be held probably four times a year
with a possible attendance of 400 people. He did not have other
information as to meetings. Ten poeple would be employed in the
building. He stated that a Mr. Tyler, union representative, was to
have brought a letter of agreement to the meeting which verified
that the Plumbers Building at the rear would have approximately 100
parking spaces available for cross use. He displayed rendering of
the exterior of the building.
The City Planner indicated he did not have sufficient information
to determine if this building met requirements. City Engineer
Davidson questioned if the owner would allow an access easement along
the banks of the creek so that the City could maintain the creek.
The representative considered this could be arranged.
After discussion, it was determined that the applicant should
furnish documentation of agreement with Plumbers Union to share
their parking lot; description of use of building, especially of
meeting hall uses, whether for hire, etc.; analysis of building and
parking requirements; agreement for City access to creek. The
Chairman requested that a representative of the Union be present at
the hearing meeting. The City Planner requested that this information
be made available to him by January 15 so that EIR determination could
be made. Chairman Mink stated this application would be set for
hearing January 27 if information was available to City Planner by
date requested.
15. APPEAL OF A DECISION BY THE CHIEF BUILDING INSPECTOR THAT AN
EXISTING ELECTRIC METER BOX MUST BE MOVED TO A NEW POSITION
ON A BUILDING AT 1308 EL CAMINO REAL, ZONED R-3 BY DONALD E.
DAMON.
It was determined Mr. Damon was not present at this meeting because
of previous commitment. The City Planner explained Mr. Damon was
appealing the decision of the Building Department that he was in
violation of the electrical code because his exterior electric
service panel is less than 30" from the ground. This item was set
for hearing January 27, 1975.
16. APPEAL OF A NOTICE OF SUBSTANDARD BUILDING AND AN ORDER BY THE
BURLINGAME FIRE DEPARTMENT TO VACATE PROPERTY AT 201 VICTORIA
ROAD, ZONED R-1, BY CARMEN ROSE POINDEXTER._
City Attorney Coleman explained that this building had been badly
damaged by fire about two years ago. Since that time Mrs. Poindexter
has lived there without benefit of gas, water, and other services.
No repairs have been made, and this building is now considered
hazardous. Notice had been filed with Mrs. Poindexter under the
Dangerous Buildings Act that this building must be either repaired
or vacated. Mrs. Poindexter is appealing this notice.

Fire Inspector Howard Pearson told the Commission the fire occurred
2'� years ago and the person responsible had been apprehended. He
verified the bad condition of the house, and stated he had
substantiating photographs. The City Attorney added a report
from the County Health Department could be provided. This appeal
was set for hearing January 27, 1975.
17. FENCE VARIANCE (EXCEPTION) TO CONSTRUCT A 7' HIGH FENCE ON A
REAR PROPERTY LINE AT 1151 EASTMOOR ROAD, ZONED R-1 BY LEO
AND E STHE R AYE RS .
Assistant City Planner Yost reported to the Commission this application
was for 7' fence on the rear of the property overlooking El Camino.
The City had recently constructed a foot path along this section, and
the fence is to provide privacy and visual screening from the people
using this path. He added he understood the adjacent property
owners had no objection.
Mrs. Ayers confirmed that P.G.E. access would be arranged as desired.
This application was set for hearing January 27, 1975.
CITY PIANNER REPORT
City Planner Swan again brought up the subject of minor permits.
He thought this involved policy procedures and perhaps code changes.
Chairman Mink questioned City Attorney Coleman if the Planning
Commission could handle minor permits if contemplated procedures
were established. The City Attorney agreed the Commission could
handle such matters.
Chairman Mink stated that unless there was objection he would like
to have the City Council informed of the proposed procedures for
their review.
