ROT.T. rAT.T. The above -named members were present. Commissioner Jacobs, on vacation, was excused. 1. PARCEL MAP - EDWARDS INDUSTRIAL PARK. Mr. Morris Ross, representing Ogden Investment Company, and Mr. Richard Lavenstein of Lavenstein Real Estate were presentto dis- cuss a proposed resubdivision of Lot 5 Edwards Industrial Park, Rollins Road and Edwards Court. Commissioners were furnished copies of a plat showing a proposed new property line dividing Lot 5 into two parcels, namely "A" fronting Edwards Court and "B" at the corner of Edwards Court and Rollins Road. Following comments from staff -that there are no problems of public improvements and that the land -is vacant, the Chair referred the matter to the regular meeting of September 28, 1970 for formal con- sideration. The City Engineer requested delivery of a proper parcel map to his office for examination prior to the date of the next meeting. 2. TRUCKING TERMINAL, ROLLINS ROAD. An application for special use permit filed by Wits Air Cargo Service proposed "operation of trucking terminal in M-1 District" at 1348 Rollins Road. The applicant's letter dated September 14, 1970, signed by Rod Brandt, District Manager, stated that the local concern is a branch of Wits, Inc., Seattle, Washington, air freight forwarders, and that the equipment consists of one 18 foot bob tail truck and four van type trucks. The City Planner reported that the subject property was built as a freight terminal and has been used as such by a number of different tenants, all without benefit of use permits, that. the building and fire inspectors noted some conditions requiring correction during a recent inspection and that the principal problem that he observed is a lack of paving in the area to the front of the loading dock. He stated that crushed rock has been laid; consequently, the cost of a suitable top coat should not be too great. He advised that the matter of paving was discussed with Mr. Brandt. In response to Commissioners, Mr. Brandt stated that their lease, assumed from Golden Bay Freight Lines, the prior tenant, will run for approximately 40 months, that his principals intend to cooperate fully with City of Burlingame rules and regulations but feel there is some inequity in their being required to assume improvement costs at this late date, when the property has been used for years as a freight terminal. Commissioner Kindig commented that the Commission has attempted to be consistent in requiring adequate surfacing to support\the traffic where properties are used by trucking operations. Commissioner Mink suggested that Mr. Brandt approach the landlord, since it would appear that the continued use of the property will be --conditioned upon the work being done. The application was scheduled for public hearing at the regular meeting of September 28. 3. SPECIAL PERMIT FOR CHURCH SCHOOL. Christ Evangelical Lutheran Church of Burlingame, 2828 Trousdale Drive, submitted an application for special permit to use a portion of an existing building on the church property for school purposes, limited to children of pre-school age; Monday through Friday 9:00 a.m., to 3:30 p.m. The applicant's communication dated September 14, 1970, signed by Stewart D. Millon, President, stated that the facility will accommodate ages 2-1/2 to 5 years, that the school, known as "Alpha Schools," has been in operation in Marin County for six years --at the present time, and for the past three years using the premises of Trinity Lutheran Church, San Rafael-- and is desirous now of locating in the northern Peninsula area. The communication stated that total enrollment will be determined by the county agencies having jurisdiction in such matters and that it would appear that 50 children may be permitted, based on experience in the San Rafael operation. -2- A plot plan of the propertyt6howed the area to be fenced for playground purposes. Reverend Stewart D. Millon, Pastor, Mrs. Patricia C. Barbera, operator Alpha Schools, and Mr. O.E. Sandkuhl were present. In response to a series of questions, the Commission was informed that the children will be transported to and from school in car pools organized by the parents,"that the building is equipped with proper restroom facilities, and that there will be morning and afternoon sessions so that all of the children will not be on the property at one time. Mrs. Barbera stated that the county welfare department has jurisdiction in licensing the premises and that, in response to a request for an inspection and report, she was informed that the agency will not visit the premises prior to the city's approval of the use permit. There were comments in connection with the existing heavy traffic on Trousdale Drive and car movements that will be generated by the school. Reverend Millon stated that the children will arrive and leave between the hours of commuter traffic. Mrs. Barbera explained that parents are made aware that _children may not be deposited nor met outside of the school grounds and that the subject property has adequate drive- ways and parking areas, thereby eliminating any need for off -site parkinc; . Commissioner Mink stated that he was concerned about congestion on the property and the chances of accident, particularly where there is a -large group of small children. In response to Commissioner Kindig's inquiry whether the use permit, if approved, may be granted to the church for Alpha School operation exclusively, the City Planner agreed that this would be proper. Reverend Millon and Mrs. Barbera indicated no objection. The City Planner reported that any proposal for a sign display must be processed separately from the application for use permit. Chairman Sine informed the applicants that a public hearing will be held at the regular meeting of September 28 on the request for use permit and that hopefully a report will be available at that time from the county agency. 4. SPECIAL PERMIT - COFFEE SHOP, BROADWAY RAILROAD DEPOT. An application filed by Joe Fena, 1035 Chula Vista Avenue, requested approval of a special permit to operate a "snack bar" in a portion of the Southern Pacific Depot waiting room at Broadway and California Drive. The applicant's letter dated August 10, 1970, stated that some altera- tions will be made to enlarge a portion of the building and that food'service will be offered commuters and residents in the area. -3- The City Planner referred to an amendment to the zoning ordinance adopted some months ago defining "unclassified lands" within the city and regulating the uses of such lands, and advised that, because all of the lands of the Southern Pacific Company were declared to be "unclassified" the applicant's proposal will require approval of a special permit by the Planning Commission, in accordance with the pro- visions of the ordinance. The City Planner suggested that, at the time of the public hearing, the Commission should be furnished information as to the applicant's lease arrangement, a drawing indicating his intentions for the building, hours of operation; that the permit, if approved, should be non -transferable, granted to Mr. Fena personally for the terms of his lease arrangement, and that a separate application will be required if there is to be other than a sign for purposes of identifi- cation. The City Planner requested also, should the Commission's action be favorable, that the record show that the granting of the special per- mit shall not create a precedent for a similar or any other use of Southern Pacific property, or any other unclassified land. Mr. Fena informed Commissioners that he has negotiated a five year lease. The application was scheduled for formal hearing at the rQgular meeting of September 28.
