An adjourned meeting of the Burlingame Planning Commission, from the
regular meeting of September 28, 1970, was called to order on the
above date at 8:00 p.m., Chairman Sine presiding.
ROLL CALL
The above -named members responded to roll call.
Commissioner Jacobs, traveling out of the country on business, was
.excused.
HEARINGS,
Chairman S'Negqunced that two public hearings,initiated at the
last regular/an ontinued to the present date, would proceed at
this time.

1. CHRIST EVANGELICAL LUTHERAN CHURCH
SPECIAL PERMIT FOR SCHOOL APPROVED.
Chairman Sine explained that at the meeting of September 28, 1970, the
matter of traffic problems in the immediate area of Christ Evangelical
Church, 2828 Trousdale Drive, was discussed at len§th in connection
with an application for special permit for school use of one of the
church buildings; that Commissioners were concerned that there be safe
and adequate ingress and egress on the church property and that the
hearing was continued for the applicants to attempt to develop a plan
for moving traffic that will be generated by the proposed school so
as not to compound existing problems.
The Chair stated that, following the last meeting, he again visited
the property and suggested to Reverend Millon, Pastor, a method
whereby access could be provided directly off Sebastian Drive to the
church parking area.
Reverend Millon, upon recognition by the Chair, distributed copies of
a report of a traffic count on Trousdale Drive, pointing out that
the heaviest concentration occurs at hours when the school would not
be in session. He stated that he spoke with Sergeant Chase,
Burlingame Traffic Director, who indicated there would appear to be no
need for additional traffic control, based on prior surveys but that
he would make a further survey, if required.
Referring to the suggestions from Chairman Sine for construction of
a driveway off Sebastian Drive, Reverend Millon reported that the
church is unable financially to undertake such an improvement.
In response to comments from members of the Commission indicating con-
cern that a hazardous situation could develop should vehicles line up
on the property, thereby forcing traffic to stop on the street
awaiting entry to the parking area, Reverend Millon reported that
there is sufficient off-street space for five (5) or six (6) vehicles
in line and that it is doubtful that any more than that number
would be on the property at one time.
Mrs. Patricia Barbera, Alpha School operator, stated that at Alpha
School in San Rafael the total number of automobiles per session
rarely exceeds nine (9).
Commissioner Mink referred to legislation enacted recently by the
City Council whereby the Planning Commission may revoke or suspend
a use permit or variance under certain conditions, questioned the
City Attorney whether a use permit granted in the present instance
may include'a restriction against vehicles entering or leaving
the property by means of a left-hand turn, and, upon the applicant
failing to comply, the Commission to call for a hearing to determine
if there are grounds for revocation of the permit.
The City Attorney indicated that the suggested procedure would be
acceptable.
Reverend Millon and Mrs. Barbera, in response to the Chair, indicated
no objection to the proposed restriction, and acknowledged that they
were aware of the consequences of non-compliance.
A motion introduced by Commissioner Mink and seconded by Commissioner
Cistulli, approved the application of Christ Evangelical Lutheran
Church of Burlingame for special permit for operation of a day
nursery school by Alpha Schools, in an existing church -owned building
on the property at,2828 Trousdale Drive, on the condition that no
vehicle transporting the children to and from the school enter or
leave the site by means of a left-hand turn.

The applicants were informed the permit would be effective Tuesday,
October 20, 1970, if not appealed.

SOUTHERN PACIFIC DEPOT,,BROADWAY.
Chairman Sine announced a public hearing continued from the meeting
of September 28, 1970, on the application of Joseph Fena for special
permit to dispense food and beverage at the Southern Pacific Depot
at Broadway.
Chairman Sine recognized Mrs. Frances Fena, 1447 Alvarado Avenue,
Burlingame, mother of the applicant in attendance to represent his
interests.
Mrs. Fena presented a copy of the lease for the premises, executed
between Southern Pacific Company and Joseph Fena, to the City Attorney
who, upon examination, indicated that the document was in order.
Mrs. Fena, in response to Commission inquiries, stated that the
building is not accessible to public use at present, with the exception
of an hour or two in the morning when the ticket office is open and
that the proposed structural alterations to be undertaken by her son
will result in improving the premises generally.,
During a discussion in connection with restricting hours of operation,
the City Attorney advised that it would be proper to do so if the
Commission believes that there may be problems ---noise or traffic, as
examples --that could be controlled or eliminated by establishing
opening and closing hours.
The City Planner pointed out that there are no residences close by
and that there is activity in the area at all hours of the day and
night, automobile traffic and trains running throughout the night.
A motion introduced by Commissioner Mink and seconded by Commissioner
Kindig approved a non -transferable special use permit to Joseph Fena
to dispense food and beverage at the Southern acidic Depot, Broadway
and California Drive; the operation to be conducted in compliance with
the terms of the lease with the Southern Pacific Company; granting of
the special permit shall not create a precedent for a similar or any
other use of Southern Pacific property or of any other unclassified
land within the City of Burlingame.

The Chair informed the applicant's representative that the permit
would be effective Tuesday, October 20, 1970, if' not appealed.
The City Planner reminded Mrs. Frances Fena that. the proposed struc-
tural alterations will require a permit from the! city building depart-
ment; additionally, the premises will be subject. to inspection by the
county health department.

NEW BUSINESS
1. REGULAR MEETING DATE CHANGED.
Because of a conflict in dates, arising from staff's attendance at the
League of California Cities Convention in San Diego the latter part
of the month, the October regular meeting of the Commission was
rescheduled to Thursday, the 29th, on a motion introduced by Com-
missioner Kindig, seconded by Commissioner Taylor and unanimously
carried.
ADJOURNMENT
The meeting was regularly adjourned at 8:55 p.m:, followed -immediately
by the mbnthly study meeting.
