The regular monthly meeting of the Burlingame Planning Commission was
called to order on the above date at 8:00 p.m., Vice -Chairman Taylor
presiding in the absence of Chairman Mink.
ROLL CALL
A roll call recorded the above -named members present, Chairman Mink,
away from the city on business, was excused.
MINUTES
The minutes of the regular meeting of December 23, 1968, previously
submitted to members, were approved and adapted following an addition
to paragraph 2, page 5, as follows: ''Dr. Sandbulte reported that
equipment for freezing material remaining after surgery would be
installed in his establishment."
The minutes of the adjourned meeting and the study meeting of
January 13, 1969, previously submitted to members, were approved and
adopted.
MAPS
to RESUBDIVISION o GILBRETH AND STANTON ROADS. (cont.)
A resubdivision map prepared by Redmond Walsh, Civil Engineer pro-
posing to delete the common lot line of Lots 18 and 19, Block 4,
East Millsdale Industrial Park, No. 2, for the purpose of establishing
a single parcel at the northeasterly corner of Gilbreth and Stanton
Roads, was reviewed at the study meeting and scheduled for formal con-
sideration at this time.
A communication dated January 22, 1969, from Victor. B. Carboni,
1660 Gilbreth Road, owner of the property and principal in the appli-
cation to resubdivide, requested a 30 day continuance.
There were no objections heard from the floor.
A motion introduced by Commissioner Kindig, seconded by Commissioner
Cistulli and unanimously carried, referred the subject to the regular
meeting of February 24, 1969.
2. RESUBDIVISION o TO INCREASE LAND AREA LE BARON HOTEL SITE.
A resubdivision map of Lot 3, Smallcomb Industrial! Park, Burlway Road,
and portion of adjacent acreage being, the Le Baron Hotel site, Bayshore
Highway, prepared by Howard G. Hickey Civil Engineer, was reviewed at
the study meeting and scheduled for formal consideration at this time.
In response to Chairman Taylor, the City Planner explained that the
parking structure shown in the original plans for Le Baron hotel, pro-
posed to be constructed to the rear of the hotel proper, was found to
be not feasible; as a substitute, Le Baron organization purchased an
adjoining property on Burlway Road solely for the purposes of parking
and provided the resubdivision map to delete an internal lot line,
thereby combining the two lots.
Mr. Jerry Lamb, Le Baron representative in this area, was present.
The City Engineer, in response to Chairman Taylor, reported that sub-
sequent to the,,study meeting the map was modified as to certain tech.
nicai and engineering details ®d tracings before the Commission are
in order.
A question was raised by Commissioner Kindig concerning enforcement
of an existing 15 foot building setback on Burlway Road where property
is used exclusively for parking.
The City Planner stated that the rule applies only to structures, that
the setback was established in an attempt to encourage landscaping
between the street and the buildings, but since land is so costly :in
the industrial districts it is virtually impossib:ie to insist that the
area not be used and parking has been permitted.
Mr. Lamb advised that the parking diagram furnished staff includes
landscaping on the two interior property lines, adjacent to the Shell
service station on the one side, and the large warehouse on the ot'ier.
He pointed out that acquisition of the second parcel provides the
advantage of additional access to the parking areas and agreed to
landscape Burlway Road frontage if space is available.
There were no comments from the audience favoring or protesting the
map in response to the Chair's inquiry.
A motion introduced by Commissioner Kindig approving the resubdidâșision
of Lot 3, Smalleomb Industrial Park, and portion of adjacent acreage
being Le Baron Hotel site, Bayshore Eii.ghway, in accordance with the
map filed with the City Engineer, and authorizing the City Planner to
confer with the owners of the property to effect the maximum landscap-
ing possible in the secondary parking area. off Burlway Road, was
seconded by Commissioner Cistulli and carried unanimously on roll call

1. OFFICE BUILDING, BAYS110RE HIGHWAY AND STANTON ROAD
APPROVED IN PRINCIPLE.
Chairman Taylor announced a public Dearing on the; application for
special use permit filed by Safeway Stores, Incowporated, Oakland,
to construct an office building in the industrial. area at the south-
westerly corner of Bayshore Highway and Stanton Road - Lots 1
through 6, and 36 through 39, Block S. East Hillsdale Industrial
Parka Unit No. 2.
The applicant's communication dated January 13, 1.969, signed by
E.S. Collischonn, Manager Industrial Department, stated that a one-
story building containing 400000 to SO.000 square feet of floor
space with central patio and appropriate landscaping is being con-
sidered but that further studies may dictate construction of a
larger building, necessitating a two-story structure.
The communication stated further that the San Francisco Retail
Division of -Safeway Stores will be relocated to the new building.
The communication advised that in conjunction with the proposed
improvements, a request will be submitted to the City Council for
abandonment of certain public utility easements located within the:
area of the building site.
Easement descriptions, site maps legal description of the land, and
a plot plan were filed.
The City Planner, in response to the Chain, stated the applicants
have been informed that to slApplement the appl-ication for special
permit, a resubdivision map will be required for the Commission's
approval, and appropriate legal documents for City Council action
pertaining to abandonment of the easements.
The City Planner reported that the :nap is not available as yet; he
suggested that the Commission proceed with the hearing on the
proposed use, withholding final action pending receipt of the
resubdivision map.
Mr. Franz Collischonn, Safeway Storrs representative, upon recognition
by Chairman Taylor, advised that he was not familiar with procedures
involved in property resubdivision and failed to recognize the
importance of the map in relation to the application for the building.
He assured the Commission that arrangements will be made to expedite
the map.
Advising that negotiations in progress for acquisition of the property
are complex, Mr. Collischonn requested consideration to the use permit
and an indication as to whether the project is considered acceptable.
Commissioners Kindig, Cistulii and Brauner indicated willingness to
proceed with the hearing, Commissioner Brauner suggesting "approval

in principle" as a method of assisting the applicants and assuring
their compliance with conditions the Commissions may desire to impose.
The City Engineer summarized the two primary conditions: approval by
the Planning Commission of a resubdivision map of the building site
deleting interior lot lines, and agreement by the City Council to
abandonment of the public utility easements.
The City Planner explained that the applicant must assume the re-
sponsibility of preparing ana submitting the map and the legal
documents relative to the easements.
In commenting, on the application for the use, the City Planner stated
that the code specifically mentions office buildings as a conditional
use in the industrial district and the city has been successful in
preventing any form of retail use gaining a foothold by careful scrutiny
of all business license applications for offices. He stated that East
Millsdale Industrial Park has developed satisfactorily as an area of
attractive office building complexes and that the proposed Safeway
Stores installation should be a suitable addition,,.
There were no comments from the audience in response to the Chair.
A motion was introduced by Commissioner Brauner approving in principle
the application for special permit for construc):1.4>n of an office
building by Safeway Stores, Inc., at Bayshore Highway and Stanton
Road, conditioned upon approval of a resubdivision map of the lands
upon which the building shall be sited, and approval by the City
Council of abandonment of certain public utility easements. The
motion was seconded by Commissioner Cistulli and carried unanimously
on roll call.
Air. Collischonn was informed that the map and legal documents should
be filed promptly to expedite final approval of the special permit.
2. AUTOMOBILE SALES AND SERVICE FACILITY APPROVED
AIRPORT BOULEVARD
Chairman Taylor announced a public hearing on the application of Anza
Pacific Corporation for a special permit ,to maintain a "wholesale auto
service agency and related repair and body shop facilities" on
unsubdivided acreage in the 300 block of Airport Boulevard (behind
the Drive -In Theatre). Zone: M-1.
A site plan of the proposed facility accompanied the application.
Commenting at the request of Chairman Taylor, the City Planner explained
that two separate matters are proposed, which should be considered
independent of each other, as follows:
1. The use permit for construction of a building for the purposes of
storing and selling automobiles at wholesale, the drawing for the
building; indicates that a large portion of the interior will be devoted
to repairing automobiles, with body and fender repair equipment, steam
cleaning and other associated activities to prepare automobiles for
sale; additionally, there is a large external area where the auto-

mobiles will be parked prior to sale. The City F'larner explained that
the use is not mentioned in the zoning ordinance., neither specifically
nor by class, and, for that reason; the applicants were requested to
follow the special permit procedure.
2. Research disclosed that the site is unsubdivided acreage; there
are no public streets; there is a portion of a street right-of-way,
which eventually will be improved and dedicated. The City Planner
reported that: a parcel map dividing the property submitted by the
applicants must meet the requirements for subdivision maps because
of the public improvements,
Chairman Taylor recognised Mr. Cyrus J. McMillan, attorney for the
applicant. Mr. McMillan stated that an agreement: has been reached,
subject to approval of the use permit, whereby the building will be
built for a tenant holding a franchise from Chrysler Leasing Corpora-
tion to sell at -wholesale lease cars returned to the lessor by firms
such as Avis -Rent-A-Car, and other similar lessees. Mr. McMillan
stated that the sales are restricted in that the cars may be disposed
of only in quantity - Plymouths to Plymouth dealers, Dodges to Dodge
dealers, and the like.
Referring to applicable code provisions, Mr. McMillan stated that the
use, in part, may possibly qualify as warehousing; approximately one-
third of the operation entails automobile repairs, requiring approval
of a special permit.
Mr. McMillan identified the location 3eto the bay side of the drive-
in theatre" adjacent to a road used as a public street but not
dedicated; the building floor area approximates 40,000 square feet:;
a fence will be constructed and landscaping prov-ided to satisfy the
Commission.
Mr, David Keyston stated that.access to the site is available via
Beach Road and Airport Boulevard; at the present time the land consists
of a single parcel of unsubdivided acreage; the parcel map was filed
at the request of staff to establish three separate parcels. He stated
that street improvements are in process and that one side of the road,
from the boundary of Anza Pacific property abutting Coyote Point to the
bridge, will be completed to service the area upon approval of the
use permit.
Mr. Keyston stated that the building will be located on Parcel 1,
shown on the Tentative Parcel Map; that agreement with the tenant
provides that all three parcels may be used if the need arises; that
the fence_ will be constructed at the south boundary of the property
abutting Airport Boulevard, from the drainage channel on the west to
Coyote Point on the east, a distance of approximately 1000 feet - the
:fence to have walkways to provide access to the bay for fishermen.
In response to Commissioner Sine, the: City Engineer reported that
street .improvement plans fUTr_isheel by the applicants appear to 11-1eet
the city's requirements and suggested a conditioln requiring the city's
acceptance of the public improvement plans if the use is approved,
Mr. McMillan indicated agreement to the condition.

Following a discussionsf the precise area of land for the use, it
was agreed that the special permit would apply to Parcels 1,2,3 of the
tentative map.
Chairman Taylor inquired if the recommendations of the Bay Conservation
and Development Commission related to the use of the property.
In reply, the City Planner stated that B.C.D.C. :requested that the City
of Burlingame prepare a precise plan for its waterfront area, including
provision for public access to the area, such as a water frontage road
and the property would be involved to this extent.
In response to Chairman Taylor's further inquiry whether the city may
restrict the proposed use to incorporate such access, the City Planner
expressed the opinion that it would not be legaI.:ly possible to do so
under existing zoning regulations applicable to the property; he stated
that it would appear that a more restrictive zoning, providing for a
reserve strip along the bay front, would be the role method of assuring
public access to the water across private property.
Chairman Taylor suggested that some method should be available to the
city to negotiate for public access to the water across privately
owned lands.
Mr. Keyston, reported that Anza Pacific Corporation has reserved an
easement 84 feet in width in favor of San Mateo County fo--.r access to
its area; he stated further that, presently, no provision of the
B.C.D.C. report applies to the properties of Anza Pacific Corporation.
Commissioner Kindig stated that the facility would net appear to be
an attractive waterfront use, nor compatible with projected park and
recreation uses of the adjoining county lands.
In response to Commissioner Brauner, [fir. Keyston explained that Airport
Boulevard, from Coyote Point at the east and Bayshore Hiphway and
Broadway at the west, will provide access to the site. lie explained
further, in reply to Commissioner Brauner, that the existing road has
been adequate for dirt trucks and should be equally competent for
large automobile carriers. He stated that it is quite possible that
the cars may be driven to the'site, rather than transported by carrier,
because of the proximity to the Avis plant and other clients of
Chrysler Leasing Corporation.
Thence were no comments from the audience, in response to the Chair.
During a discussion concerning the fence and an area for planting,
Mr. Keyston advised, in response to Commissioner Sine, that a standard
chain link fence, six feet in height With barbed wire topping, will be
installed. He agreed in response to suggestions from s`wsff, to provide
and maintain a space five feet wide between the sidewalk and the fence
for landscaping. A combination fence of cyclone and wood slats was
mentioned, with the majority of the Commission appearing to favor the
standard cyclone type.
The hearing was declared concluded.
A motion was introduced by Commissioner Brauner approving the special
permit application of Anza Pacific Corporation for wholesale auto sales
and repair facilities on a portion of its property between the drive-
in theatre and the bay, and in accordance with the site plan on file,
conditioned upon installation of a security chain link fence six feet
in height extending the entire length of the south property line,
with a five foot wide reserve strip back of the ;property line for
landscaping.
Motion seconded by Commissioner Norberg and carried unanimously on
roll call.

The Chair declared a recess'at 9:50 p.m.
RECONVENE
The meeting was called to order at 10:00 p.m., by Chairman Taylor.

3. TENTATIVE PARCEL MAP - PORTION OF LANDS OF ANZA PACIFIC CORPORAi'ION.
A tentative parcel map of a portion of the Lands of Anza Pacific Corpor-
ation, lying between the drive-in theatre parcel and the waters of the
bay, prepared by Howard C. Hickey, Cavil Engineer, proposing to divide
an existing parcel of acreage into three parcels fronting Airport
Boulevard, was before the Commission for formal consideration.
The City Engineer'reported that the subdividers have been informed that
at least one-half of Airport Boulevard shall be :improved for the total
frontage of the proposed development approved by the Commission in the
preceding action.
The City Engineer stated that in addition to street improvements certain
utility installations must be completed.
In reply to Commission inquiry, Mr. David Keyston stated that two
traffic lanes and a parking lane will be constructed westbound.
Another complete lane eastbound is already existing. The individual
islands in the street right-of-way will not be developed but the
entire area will be landscaped.
In response to the Chair, there were no comments from the audience.
A motion introduced by Commissioner Brauner approving the Tentative
Parcel Map subdividing acreage of Anza Pacific Corporation into
Parcels 1, 2, 3 and recommending adoption of said map by the City
Council, was seconded by Commissioner Cistull.i and carried unanimously
on roll call.

NEW BUSINESS
to PROPOSED AMENDMENT TO SUBDIVISION ORDINANCE
RE: "LESS THAN FIVE LOT SUBDIVISIONS.91
Material prepared by the City Planner proposing certain revisions to
the Municipal Code relating to less than five lot subdivisions was
reviewed at the study meeting and before the Commission at this time
for formal consideration.
The City Planner explained that the proposed revisions specify the
detail that is to be shown on the map and adds a new requirement
for detail as "to existing and proposed contours of land and proposed
elevation at lot corners," and clarifies the areas to be considered
by the Commission.
Following a brief period of discussion, a motion introduced by Com-
dissioner Brauner, seconded by Commissioner Kindig, and carried
unanimously on roll call recommended the proposed amendments to
Municipal Code Sections 26.24.040 and 26.24.050 Q'less than five lot
subdivision" requirements to the City Council for adoption,
2. GENERAL PLAN
The City Planner reported that the citizens study group has completed
its discussions of the proposed General Plan and that the next step
in procedure requires public hearings before the Planning Commission.
He suggested that the Commission consider reserving time at the
February study meeting for an informal discussion of the Plan proposals.
ADJOURNMENT
There being no further transaction of business, the meeting regularly'
adjourned at 10:40 p.m.
