The monthly study meeting of the Burlingame planning Commission was
called to order on the above date at 8:00 p.m., Secretary Kindig pre-
siding in the absence of Chairman Cistulli who was, delayed by another
appointment,,
ROLL CALL
4 roll call recorded a quorum present; Commissioner Mink was excused,
having reported at the last ,meeting that he would be traveling out of
the state.
1. DENNY'S RESTAURANT SIGN.
A copy of a letter dated January 26, 1968, from the Office of the City
Planner to Anza Pacific Corporation, 1310 Bayshore Highway, Burlingame,
was read concerning the Commission's interest in st sign advertising
Denny's Restaurant, erected on the roof of an office building on the
opposite side of the street. The letter cited the code section pro-
hibiting off -site advertising signs or structures„ and invited a repre-
sentative of the firm to discuss the matter at the: Commission's study
meeting in February.
A communication in reply from George No Keyston, Jr., President, Anza
Pacific Corporation, dated February 1, 1968, stated that a former
restaurant on the premises now occupied by Benny's, was unable to sur-
vive on business generated solely in the industrial area, that the
present operators were unwilling to locate in the area without an
adequate freeway sign and, accordingly, established their district repre-
sentative in offices in the 1299 Bayshore Building.
The communication reported further that the question of Denny's tenancy
in the office building was explored by the building department prior to
approval of the sign permit.
During a period of discussion, the matter of strict interpretation of
the rules was discussed; it was noted that the principals apparently were
aware of the limitations on off -site advertising evidenced by an action
to assure a resident address in the building. It appeared to be the
position of the Commission that more attention must be paid to certainty
of conforming with the law.
The City Planner reported that the material studied by the Commission
several months ago on the -general subject of signs, and suggested
amendments to the ordinance, was forwarded to the City Council; following
a brief discussion at the most recent study meeting, the Council decided
to take no action at this time.
2. REQUEST TO EXTEND SPECIAL PERMIT.
A letter dated February 1, 1968 from Nerli Construction Company,
3110 Canyon Road, Burlingame, requesting an extension of time on the
special permit approved in March, 1967, to operate a. sales outlet for
Lindal Cedar Homes on Lot 6, Anza Airport Park, was referred to the
regular meeting of February 26 for formal consideration.
3. RESUBDIVISION - LOT 9 and PORTION LOT 24, K NMAR TERRACE.
A map proposing to alter existing lot lines for the purpose of combining
the above -described properties into a single parcel was reviewed.
The Commission was informed that Mr. R.C. Mayer, 16 Kenmar Way, owner
of Lot 9, intends to purchase and join to his lot that portion of Lot 24
designated "Parcel 2" on the map; the resubdivision will delete the
existing northeasterly boundary line of Lot 9, and establish a new line
dividing the present Lot 24 into two parcels.
The area proposed to be acquired by Mr. Mayer is unimproved and he has
stated that it will be preserved as open space to protect the view.
Comments from the staff indicated that some problems of utilities must
be resolved,
Mr. Dermot aJ. Fitzgerald, associated with Kane, Thraser and Galiigan,
Attorneys at Law, represented the applicants; in response to Commission
inquiry, Mr. Fitzgerald advised that the proposed lot line was established
by survey and follows actual property boundaries.
The applicat-on was scheduled for public hearing on February 26.
4. RESUBDIVISION G LOTS 24 and 25, BLOCK 4, EAST MILLSDAL9 PARK NO. 2.
A resubdivision map proposing to delete the common lot line between the
above -described industrial properties, for the purpose of creating a
single parcel fronting Malcolm Road near Gilbreth, was reviewed.
The Commission was informed that the lots are in a single ownership
with a building on one lot; the purpose of the resubdivision is to
allow the owner to extend the building and provide for off-street parking,.
The map was referred to the regular meeting, February 26, for public
hearing.
S. PARCEL MAP _ BURLINGAME .SHORE LAND COMPANY ACREAGE.
The City Planner reported that as a condition to the agreement between
the city and Burlingame Shore Land Company for development of the la.tter's
property, the City Council directed that the Parcel Maps, dividing acreage
into three parcels, be amended by eliminating a proposed panhandle

and including same within the area of Parcel B; the change has been made
.? and the map is in fors to be processed by the Commission.
Me subject was referred to the regular meeting of February 26,
6. VARIANCE FOR GASOLINE SERVICE STATION, BAYSHORE HIGHWAY.
An application filed by Barry Spivak, Spivak -Bollinger Company, Sacramento,
requested consideration to a variance for a gasoline service station at
a location which may be less than 490 feet distant from the nearest
existing service station o code section 25.74.020.
A map showing the site and a motes and bounds description of the property
were filed.
The application form noted that supporting data, including architect"s
conception, letter of justification and other material would be supplied
prier to the Commission's study meeting in March.
The Commission was informed that the property is at the foot of the
€ verpass, formerly the site of Luppi°s Nursery; that Mr. Robert Tarver,
attorney for the applicants, explained that a contract with the property
owners required a formal application to be filed with the city during
the month of February showing the intended use of the property; and that
the applicants request that the matter be continued on the Commission
agenda to March.
The City Planner trade the following paints: Indications are that Richfield
Oil Company is the principal in the application. A number of oil
companies, including Richfield, are adopting a program of specially
designed signs for freeway locations, of a height visible for great dis-
tances. The property is directly at the end of the new exit from the
south off the freeway, and at the entrance to the city a s B,.a Tsi de Park;
under these circumstances, cure must be taken to assure an imDr ovement
to complement the area.
The appl € atiov was preferred to the February 26 meeting,
