ROLL CALL A roll call recorded all members present. MINUTES The minutes of the regular meeting of January 22 and the study meeting of February 13, 1968, previously submitted to members, were approved and adopted. COMMUNICATIONS 1. REQUEST FOR EXTENSION OF SPECIAL PERMIT. A letter dated February I, 1968, from Nerli Construction Company, 3110 Canyon Road, Burlingame, signed by William Nerli, General Con- tractor, requested an extension of time to exercise the special permit approved in March, 1967, to operate a sales outlet for Lindal Cedar Homes on Lot 6, Anza Airport Park. The communication stated that the parties concerned have reached agreement on the many details and technicalities involved but that additional time is needed for the business to be established and operating in the location. The City Planner, in response to the Chair, explained that the permit was granted for display and sale of model homes `- of a vacation or secondary type mo or a portion of the Anza Pacific property at Airport Boulevard and Lang Road and that most of that area is still unimproved. He suggested, since conditions can change, limiting an extension to six months. Upon determination by the Chair that the applicant was not present nor represented, Commissioner Norberg recommended a continuance of two weeks, commenting that it was not unreasonable to expect s pro- ponent to appear to support an application. In reply to Commission.inquiry, the City Planner reported that to his knowledge Mr. Nerli was not notified to appear; accordingly, Commissioners Brauner and Pierce suggested that the Commission had sufficient information to proceed. A motion introduced by Commissioner Norberg, seconded by Commissioner Kindig and unanimously carried continued the matter to March 11, the applicant to be so informed. MAPS 1. RESUBDIVISION ROLLINS AND DAVID ROADS. A preliminary Parcel Map prepared by Howard G. rickey, Civil Engineer, for Coen and Company, 1510 Rollins Road, Burlingame, proposing to combine a number of lots in the industrial area, and a portion of an existing 140 foot drainage right-of-way to establish a single parcel, was considered at the meeting of December 27, 1967; action was with- held, at the request of the City Engineer, for the proponents to fur- nish details on a proposed underground storm drainage installation. Chairman Cistulli invited the City Engineer to comment. Referring to the map, the City Engineer called the Commission's atten- tion to a "Note" at the upper left-hand corner setting forth the applicant's proposal to improve and use a portion of the city's drainage easement for off-street parking; he reported that the drawings t were received and examined and that he agreed in general with the drainage detail. The City Engineer recommended the map to the Commission for approval. Mr. Daniel Hudson represented the applicants and reported that the parking area improvement probably would be started late in the year, depending upon the building expansion project; lie agreed to inform the City Engineer as to the contractor engaged to perform the work. In reply to Commission inquiry, the City Planner stated that plans for the parking must be supplied as a part of the building plans and that a building permit will not issue unless there are sufficient usable parking spaces. There were no comments from the audience in response to the Chair. On a motion introduced by Commissioner Pierce, seconded by Commissioner Mink and unanimously carried, the preliminary Parcel Map filed with the City Engineer "being a resubdivision of a portion of the 140 foot dra_Zn- age right-of-way, Lots 4,5,6,7 and portion of hot 3, Brock 8, Unit No, 5, Millsdale Industrial Park and Lot 3 of Edwards Industrial Pa k" was approved. 2. RESUBDIVISION LOT 9 AND PORTION LOT 24, KENMAR TERRACE. Chairman Cistulli announced that the Commission would consider at this time a resubdivision map drawn by William A. Bartlett. Licensed Land Surveyor, relating to properties in Kenmar Terrace Subdivision. -2- Chairman Cistulli recognized Dermot J. Fitzgerald, attorney repre- senting Dr. W.K. Wilner, Cuba, Illinois, the applicant and owner of f� Parcels l and 2 of Lot 24 as delineated on the map. Mr. Fitzgerald explained that the proposal is to divide the present Lot 24 into two parcels, delete the northeasterly boundary line of Lot 9 and combine said Lot 9 and Parcel 2 of Lot 24" into a single large parcel. He pointed out that the end result will not increase the number of lots but extend the area of Lot 9. In response to the Chair, the City Planner reported that Lot 9 is an improved property owned and occupied by Mr. R.C. Mayer, 16 Kenmar Way. The land Mr. Mayer contemplates acquiring is unimproved, approximately 65,000 square feet most of which slopes off the sides very steeply...a level piece adjacent to Lot 9 has been crisscrossed with surer easements. Referring to the neap, the City Planner pointed out that Parcel 2 has no street frontage of its awn and will acquire the frontage of Lot 9 on Kenmar Way. it the map is approved; since there may be but one dwelling on the property, there can be no residential construction for as long as the land remains a part' of Lot 9. The City Planner stated that Lot 24, originally, was quite large but was divided into two parcels by a prior resubdivision; Dr. Wilner subsequently sold off the smaller of the two. During a period of Commission discussion, the matter of passible future changes in the property was explored. The Commission was ,advised by staff that any proposal for further subdividing will require a proper map duly processed as required by code. Mr. Fitzgerald, in response to Commission inquiry, advised that Mr. Mayer is primarily concerned in preserving the canyon view and has indicated that the area will be preserved in its natural state. He advised further that the boundary lines on the map are correct property lines, established by survey to rectify an error in a prior survey. In response to the Ch air°s request for comments from the audience, Mr. High Connolly, attorney representing Mr. and Airs. Paul Constantino, stated. that his clients are negotiating to purchase as the-i.r own residence the home site formerly occupied by Dr. Wilner (designated Parcel l of Lot 24) and were agreeable to the resubdivision. Mr. Connolly confirmed Mr. Fitzgerald°s comments concerning an incorrect prior survey and the validity of the property lines now, proposed. Mr. JoC. Shea, 1S Kenmar Way, and fire W.H. Lambert, 2660 Summit Drive (owner Lot 19, Kenmar Terrace Subdivision), reported ne objection to the application; each expressed concern with future plans for the property and requested notification of any applications. The City Engineer reported no problems of concern to his department; The City Planner indicated no objections. Commenting that the sole desirable building site is occupied by the home on Parcel 1, he sug- gested that any proposal for further resubdivision must be examined -3- _ with care. There were no further comments. A motion introduced by Commissioner Brauner, seconded by Commissioner Kind-ig and carried unanimously approved the resubdivision in accord- ance with the map filed with the City Engineer. 3. RESDBDIVISION MALCOLM ROAD. A map prepared by Howard P. Grant, Civil Engineer, for Cramer and Company, Inc., 863 Malcolm Road, proposing a resubdivision of Lots 24 and 25, Block 4, East Millsdale Industrial Park, No. 2, was reviewed at the study meeting and before the Commission for formal consideration at this time. Air. David Cramer represented the proponents. The City Planner, in reply to the Chair, reported that there is involved simply a deletion of the line between the two lots to estab- ligh a single parcel to accommodate the owner's plans for extending the existing building and providing off-street parking. The City Engineer indicated no problems. On a motion introduced by Commissioner Kindig, seconded by Commissioner Pierce and carried unanimously on roll call the resubdivision was approved in accordance with the map on file with the City Engineer. 4C, MODIFIED PARCEL MAP BURLINGAME SHORE LAND COMPANY ACREAGE Chairman Cistulli announced that the Commission would consider at this time a Parcel Map of acreage owned by Burlingame Shore Land Company, et al., modified by the owners at the request of the City Council. The City Planner, in response to Chairman Cistulli, explained that the map is a part of proceedings at the City Council level relating to development and improvement of the property; he stated that subsequent to the Commission's action on the first map, several months ago, the City Council requested that a panhandle between Parcel X and Parcel B be eliminated and upon approval of the map the City Council can pro- ceed to the next step. In reply to Commission inquiry, the City Manner stated that the area of the former panhandle was added to Parcel B. In response to Commissioner Brauner as to whether the Commission may properly act upon an amended asap at this time, the City Attorney replied in the affirmative. Mr. Howard Hickey, Civil Engineer, in response to the Chair, reported that the map was amended at the direction of the property owners to meek; the Council's requirements. On a motion thereafter introduced by Commissioner Kindig, seconded by Commissioner Norberg and carried unanimously the modified Parcel Map prepared by Howard G. Hickey, eliminating a prier panhandle -4- and dividing acreage lying between Bayshore Boulevard c�nd Carolan Avenue, southeasterly of Cadillac. Way, into three parcels was approved HEARINGS €.
