Meeting called to order at 8:00 p.m. Chairman Kindig pre- siding. INTRODUCTION FRANK C1ST1'LLI I3r4 COMMISSION KriTIBER. Chairman Kindig introduced Frank Cistuili, newly appointed member of the Commission. MINUTES Minutes of the regular meeting of April 25, 1960, and study meeting of May 9, 1960, having been previously submitted to members of the Com- mission, were unanimously approved and adopted. PUBLIC FI ARLNGS Public hearings, pursuant to published notice, were held as follows: 1. VARIANCE - Mel K. Dollinger and Signal -Oil Company. To waive dis- tance requirements for MsolLne service stations. An application filed by Mel K. Dollinger, 400 First Avenue, San Mateo, and Signal Oil Company., Alameda, requested a variance from the pro- visions of.Section 1973 of the City Ordinance Code, establishing dis- tance requirements between gasoline service stations, to permit con- struction and operation of a service station on property located on the northwest side of Howard Avenue between East Lane and Myrtle Road, which would be less than the required 490 feet from the nearest exist- ing service station. A "Statement Support irgApplIeat Ion For Variance% dated April 29, 1960, filed by Mr. Dollinger as property owner, was read in full. It was pointed out that the property has been vacant and unused for a number of years. A survey of the area indicates that a gasoline service station could be profitably operated, that the use would be compatible with existing commercial users in the neighborhood, and that development of the property would react favorably on the entire neighborhood. The comiunication mentioned tiint the proposed site is separated from the n-arest service station by the Southern Pacific Right of ?gay and the two dity streets "Last Lane" and "California Drive". however, since the City requires that the width of intorvening streets be ex- oluded, the distance between the two service station properties is approximately 300 feet. A second communication from Mr. Dollinger, dated April 30, 1960, com- menting further on the proposed use, was read and accepted for Filing. Mr. George D. Ryerson, representing Signal Oil.Company, was in attend- ance, Drawings of the development were submitted to members of the Commission. The Planning Consultant, in repay to an inquiry from Commissioner Diederichsen,stated that he had Pat with Mr. Ryerson to discuss the over- all layout. The present plan is the result of the meeting. Commissioner Norberg questioned Mr. Ryerson concerning the design of the building and recalled that at the time of the study meeting (May 9, 1960) tiie Commission indicated that they would prefer a pitched roof structure rather than the "flat top" common to service stations. Mr. Ryerson stated that if a special design building were required, theirs could be the only one in the City of'Burlingame. His principals feel that in the present location, since there is no established neigh- borhood design to be maintained, the exty►a expense should not be neoesa sary. In reply to the Chair, the Planning.Consultant stated that the site is correctly zoned - the variance lies in the distance requirement. It must be determined whether or not the location is proper for a gasoline service station and whether theme is justification in the variance request. The Planning Consultant stated also that the present unkempt condition of the property has reflected unfavorably on the entire neighborhood so that if the site were property developed, this possibly would be an incentive to other owners to improve their properties. Chairman Kindig invited.00mments from the floor. Mr. Leo Myer, owner of properties with frontages on East Lane and Myrtle Road, in the same block as the subject property, expressed the opinion that a service station could be profitably operated and that Improvement of the property would aid in improving neighboring properties. Commissioner Norberg agreed that the property should be developed and thata service station was a proper use. However, the City should re- quire that the applicant provide something more than the average ser- vice station structure. A plot plan and building plan accompanied the application. A communication from Person & Wik, Inc., dated May 6, 19600 advised :that the site will be leased to Carter Trucking for a three year period With an option for an additional three years. Ray Moore, of Carter Trucking were in attendance. in;reply to Chairman Kindig°s Invitation to comment, Mr. Moore explained -that.they contemplate establishing an operation base as viell as pro- vide storage space for freight which would be held overnight. Mr. Moore stated that they do not have permanent quarters at the present time but have been using service station facilities for parking and storage. Per. Moore stated that the greatest activity will be between 7:30 and 8:30 a.m., and between 4:30 and 5:30 p.m. In the intervening hours, the gates will be looked and the premises vacated, with the exception of an occasional Incoming freight load delivery. Chairman Kindig invited comments from the floor. There being none, Commissioners were invited to question Mr. Moore. The Commission was advised that the property will be enclosed with cor- rugated aluminum fencing; a four foot planting area will be maintained In front of the fends facing Rollins Road. There being no protests received, oral or written, a motion was in. troduced by Commissioner Martin that the use permit be granted, provided that the operation shall conform to the plans submitted as part of the application, and that the property shall be enclosed with new cor- rugated aluminum fencing. VARIAITCE's — United Cerebral Palsy Association. Administrative Offices and Pre-IfursM School. a4 F-1 Camino Real A public hearing was held on s variance application filed by the United Cerebral Palsy Association of San Mateo County, Inc., request- ing permission to locate administrative offices and a pre -nursery school in a building at 744 31 Camino Real, Burlingame, formerly oo- eupied by a private school. A communication dated M.ay. 6r 1960, signed by Herman E. HeinrichsQ President of the United Cerebral.Palsy Association, advised that the .nursery school is licensed to accommodate 18 children, however, the maximum enrollment has.beer 12. The children, ranging in ages from 18 months to 4 years, attend school three mornings a week from 9:00 a.m. to 12 noon. Four regular employees, plus parent volunteers, supervise the sessions. An office staff of three is on duty each week day from 9:00 a.m. to 5:00 p.m. The letter mentioned also that parking facilities would be required for a maximum of 8 automobiles. A letter dated May 4. 1960, from Charles F. Schuetz, Jr., owner of the property, confirmed that the building was available on a rental basis, subject to conformance with local laws and regulations. Mrs. A.J. Franzi and Herman E. Heinrichs, representing the applicant, were in attendance. Chairman Kindig invited comments from the floor. Mrs. Raymond Hardy, 740 Fairfield Road, protested that the use. would aggravate an existing critical parking situation in the neighborhood. Councilman Lorenz, in attendance as City Council representative to the Planning Commission, advised that he had received a call from .W. Burns, 728 Fairfield Road, who complained that the additional traffic would create a nuisance. There were -no further remarks from the floor. In reply to the Chair's invitation to Commissioners to comment, Commissioner Martin recalled that a private school had occupied the premises for a great many years. Commissioner Martin further noted that the zoning is Third Residential suggesting an eventual apartment use with resultant parking and traffic. Mrs. A.J. Franzi advised that the First Baptist Church, .171 Canino Real and Palm Drive, had offered the use of their parking lot any time during the week, with the exception of Wednesday evenings and over the weekend. Mrs. Franzi stated that this area will accommodate the cars of all employees and visitors, eliminating on -street parking except during the brief time that the children are brought to school. Transportation is provided by the parents, usually in car-pool groups. A motion was introduced by Commissioner Martin approving the variance as requested, the operation to be in accordance with the provisions of the letter of May 6, 19609 filed as part of the application, Sub— ject to -the limitations as to personnel, mentioned in said letter, and to a total enrollment of 12 students; the accessory building at the rear of the property not.to be used for duelling purposes; the property of the First Baptist Church, Palm Drive and E1 Camino Real to be used for off-street parking, as described by Mrs. Franzi and —I,- as offered by the Church in their letter dated May 23, 1960, addressed '\\ to the Cerebral Palsy Association. Motion seconded by Commissioner Cistulli and unanimously carried on roll call vote. The Chair advised that the variance -would become. effective June 7, 1960, provided there was no appeal. The hearing was thereafter declared concluded. 4. VARIANCE C.L. Swanson. Encroachment side Yard setback. An application filed by Fir. and Mrs. C.L. Swanson, owners of property at 1262 El Camino Heal (southeast corner Lincoln Avenue and 31 Camino Real) requested a variance to permit encroachment into the Lincoln Avenue sideline setback to facilitate parking beneath a proposed apart- ment building. A statement of justification, dated May 10, 1960, submitted by Irving Forbes Brown, -architect, advised that the owner contemplates erecting a ten unit apartment building. The lot has a total width of 60.02 feet. After setbacks, there is Off feet of maximum building width and 45 feet of net usable parking width. Mr. Brown maintained RThis is too narrow a garage space for proper diagonal parking regard- less of the length or number of cars proposed". Arehiteetus drawings, Nos. 1, 2 and 3, dated May 10, 1960, were submitted to illustrate the proposed encroachment. Chairman Kindig invited -comments from the floor. F.W. Heilman, property owner 1256 Capuchin Avenue, requested information concerning the extent of the encroachment. Upon reviewing the plans, Mr. Hellman advised that he had no objections. Oscar F. Person, 1301 Paloma Avenue, stated that it was his understand- ing that the encroachment was very minor and that he, as a neighboring property owner, was in favor of the proposed development. W.E. Chambliss, member of t1jeoCity Park Commission, advised that the Commission has been ooncernW about landscaping design in connection with apartment developments, particularly on corner properties. In this instance, the design.appears to be satisfactory. There were no further comments from the floor. Commissioner Stivers stated that he felt a ten unit apartment building was too large for a lot originally designed for one family occupancy. The Planning Consultant stated that he was not inclined to agree with a proposal for using side yard areas for automobile parking, lest an unsatisfactory precedent be established. While the design offered in the present instance is good, other plans may not be.. In further com- ment, the Planning Consultant stated that in his opinion side setbacks should not only be maintained ^t their present ratios but as building heights increase the setbacks should be made greater. Commissioner Martin stated that although was too large for the lot the applicants their property under existing regulation. he felt a ten unit building were proposing a legal use of 5 for apartment house districts. The lot coverage was less than required and the parkin, area well de= signed. Commissioner Martin sta ted also thaat if the variance were not approved, the ovmers, by crowding,the parking could eliminate the need for a variance and proceed with the development. Commissioner Norberg, expressing concurrence with Commissioner Martin° s comments, introduced a motion that the variance be granted permitting an encroachment on the Lincoln. Avenue sideline setback, in accordance with the plan. submitted. Motion seconded by Commissioner Diederichsen and declared carried on the following roll call vote: AYES: COMMISSIONERS: Distulli, Diederichsen, Martin, Moore, Norberg NOES: COMMISSIONERS: Kindig, Stivers ABS^,i4T COMMISSIONERS: None The Chair advised that th6 variance would become effective June 7, 1960s Provided there was no appeal. Trousdale Construction Con=VZ Tract Sales Offioe Aimroved A letter dated May 2. i960, from Trousdale Construction Company requested that the permit to operate a tract sales office at 2500 Trousdale Drive j be renewed for an additional twelve month period from May 13, 1960, to May 13, 1961, under the same limitations previously imposed by the Com- mission. There being no protests received, a motion was introduced by Commissioner Stivers, seconded by Commissioner Norberg, that the permit be renewed as requested, subject to the same terms of operation as outlined in the Trousdale Construction Company letter dated April 17, 1958. Commissioner Moore Delegate To San Mateo County Advisory Planning Council Chairman Kindig reminded members of the Commission that for a number of years he has been Commission representative to the San Mateo County Advisory Planning Council and suggested at this time that the Commission consider appointment of a new delegate. Stating his willingness to serve as alternate delegate, Chairman Kindig offered the name of Commissioner Moore as delegate. On motion of Commissioner Norberg, seconded by Commissioner Martin, the appointments were unanimously con- firmed. 2. Election Of Officers, Chairman Kindig announced that this was the time scheduled for election of Commission officem for the ensuing year and declared nominations to be in order. a6- CHAP The name of Commissioner Diederichs©n was placed - in nomination by Commissioner Martin, seconded by Commissioner Norberg. There being no further nominations, nominations were declared closed. The Secretary was instructed to cast a unanimous ballot for W.H. Diederichsen for Chairman for the year 1960. Ther® being no further nominations, nominations were declared closed. The Secretary was instructed to caat a unanimous ballot for Everett K. Kindig for Vice Chairman for the year 1960. S1'CR-TARX The name of Commissioner Stivers c.-as placed in nomination by Commissioner Norberg, seconded by Commissioner Moore. There being no further nominations, nominations were declared: closed. The Secretary was instructed to east a unanimous ballot for D.A. Stivers for Secretary for the year 1960. Elections were thereafter declared concluded and official. 3. Councilman Lorenz Presence Acknowledged, Chairman Kindig acknowledged the presence of Councilman Joseph H. Lorenz, newly appointed Council representative to the Planning Commission. 4. Ordinance Amendments For Apartment House Districts, The Planning Consultant reported progress in preparation of proposed amdndments to the Regulations For R3 Districts (Third Residential).
