Mr,: t4ann stated that the total property does net contain sufficient land to divide into two 7000 square foot logs, Mr. Hann explained further that while a building could be constructed on either the northerly or southerly part of the now lot, a good portion of either site would be lost to front and near set -backs. The remaining parcel would be quite small. In addition, Mr. Hann stated, when the lot pattern was established the lots ware purposely laid out deep to include the creek. The present proposal to change the pattern by placing the frontages on Bengal Avenua is not particularly good land planning, particularly, as all of the remaining lots front on Devereux Drive, A drawing of existing developments In the neighborhood was submitted for the information of the Commission. Chairman Diederichsen invited membors of the Commission to comment, Commissioner Norberg stated that the proposed Lot 6B would not appear to be a proper building site Commissioner Martin introduced a motion that the app'.1cation be denied on the basis that the resubdivision does not conform to the citY''s minimum land area requirements,, Motion seconded by Commissioner Stivers and unanimously carried on roll call of members present. Diederichsen, the Planning Consultant advised that the ordinance requires that there be an open space of 10 feet be ;wean the proposed building and adjoining; properties, Mr,, Mann noted that this restriction does not apply to the garage structure Commissioner Norberg, through the Chair, stated that he was in sympathy with the need for expansion of Church facilities, however, in the interests of neighboring property ownars, there should be definite restrictions on sookal and recreational uses, Commissioner Norberg maintained that "b hall which will be used exte:rksively and rented to various organizations at various times will bo an objectionable feature to adjacent neighbors" . Commissioner Norberg mentionedthat lack of Church parking areas is presently a problem Mtn the neighborhood and questioned whether arrange- ments have been made to provide additional parking for the proposed building, Chairman Diederichsen recognized lair, Flarpole, member of the Church Vestry, who advised that for some time the parish :hall has not been available to activities of a commercial nature. A motion was introduced by Commissioner Martin to rescind the original action of the Commission approving the use permit. Cla-..rke, Lafayette, California, requested a permit to operate a public parking lot on property located at the corner of Donnelly Avenue and Primrose Road. In the matter of flood lighting, Hr. Clarke pointed out that there are two large street lights which reflect on the property and would appear to offer sufficient illumination for safety purposes. Mr. Clarke stated that the fence requirement "could be quite an expensive proposition" and he felt that shrubs placed in redwood tubs at intervals around the lots, and bumper strips as car stops, should be adequate. Mr. Clarke mentioned that he had been advised that the lot in its present status is non -conforming and questioned the jurisdiction of the Planning Commission insofar as his proposal was concerned. 'Eugene Umland, 1515 Arc flay, Burlingame, proposed a 50-unit apartment building on property con- sisting of three lots at Are 1','ay and El Camino Real. Permission was requested "to substitute hei<;ht for ground area.; to construct S floors, ri th 6 apartments per floor, plus one par'Lial floor .`ith penthouses, above two stories of garaEre area (one boneatii ground) ". "Notice of Protest", bearing signatures of 26 residents in the area of Are Way, 13Ialnut Avenue and 117illow Avenue, was acknowledged and accepted for filing. The Planning Consultant, in response to inquiry from Chairman Diede- richsen concerning zoning of the lots involved, advised that they are in an R-3 District and properly zoned for the proposed use. The Chair recognized Mr. Uril.and, who advised that he is not the owner but the lessee and optionee of the properties. Mr. Umland distributed to members of the Commission and throughout the audience a drawing describing property location, boundary lines and square feet area. Mr. Umland stated that it is the intent to build "something aesthetically attractive". to preserve monuments and land marks on Are today (particular reference was made to the trees); to attempt to relieve, if not remedy, the present parking congestion on Are Way and to build a structure that will be a credit and an asset to the city and to the neighborhood. Mr. 0. Rose, 842 Walnut Avenue, maintained that .the parking facili- ties were not adequate to provide for second care: in a family .nor for guest cars and that the narrow streets in the neighborhood were not intonded to carry the additional parking mad traffic that would result from a 50--unitapartraont building. Mr. Mitchell advised that there was space for 52 cars inside the building and an additional 20 spaces on the outside pa rkinq area. Mr. Henry Stephens, 339 Walnut Avenue, protested that the present height limitation of four stories, or 55 feet, was presumably astab- lished with lood reason and there would not appear to be a reasonable basis for disregarding it. The Planning Consultant, through the Chair, explained that the purpose of height and coverage limitations in the ordinance is to control population density, in accordance with the desiras of the community, and Burlingame wanted low density. Mr. Mann stated that at the time the ordinance was written, the principal method of control was by limiting the number of stories and the amount of usable land; however, at the same time, a new method of height -area limitation was used in the commercial zones where the ratio of 3.6 to 1 was established. Mr. Mann concluded that even with present ordinance provisions, the controls are not entirely satisfactory and some apartment buildings are being_ constructed where the population density_is far greater than was anticipated.
