Chairman Kindig vresidine. ROLL CAL: All members of the Commission answered the Secretary's roll call. PUR OSE OF MEETING Chairman Kindig announced that the meeting was scheduled to continue the public hearing on the Tentative Map Mills Estate No. 19, prepared by George S. Nolte, Inc., Civil Engineers, and to clarify certain matters in connection with the map which were questioned at the time of the pre- vious meeting. A report from the City Planner, prepared at the request of the Commission, advised in subnce as follows: 1. Eublic Schoo When the Mills Estate area was first projected, it was the decision of th-e School Board that a single large school plant was preferable to two smaller installations. Sufficient land was acquiredat the Benjamin Franklin School site for future expansion. The position of the Board and George White, Superintendent of Burlingame Elementary Schools, has not changed. 2. Firs Station. Fire Chief Moorby agrees that a :fire station will be re- quired at some future time in the Mills area. The .location adjacent to the park will be satisfactory provided that a site :sufficient in size can be prepared. The Fire Chief and' the Park Superintendent will cooperate to suggest grading plans for the purpose. 3. Access Ppevent'on to Trousdale. The City Attorney recommends that a narrow strip of land adjacent to the lots on the southerly line of Trous- dale Drive, on the block adjoining Skyline Boulevard, be shown on the map as a separate parcel and deeded in fee to the City. The City Attorney, in reply to Chairman Kindig, pointed out that the last block of Trousdale is proposed as a deceleration lane from Junipero Serra Freeway. The City's interest is in finding the means to prevent access to Trousdale at this location from the abutting properties. The City Attorney advised that the proponents of the map have agreed to convey a one foot strip to the City, as indicated on the map. A fee title will guarantee the City a legal right to use the property as it deems best to accomplish non -access. In reply to an inquiry from Commissioner Norberg concerning the tree area on Skyline Boulevard, Mr. A.L. Shapro, Vice President Eichler Homes, advised that the area has been indicated on the map as a separate parcel with a lot number and will be deeded in fee to the City. On the same subject, the City Engineer advised that the developer has agreed to pave five driveways to serve the properties fronting Skyline, according to the City's specifications c paving to be the same as city streets in the improvement plans. In a brief discussion concerning actual building sites, Mr. James Roemer of George S. Nolte, Inc., advised that the lots will be graded to an average flat pad minimum of 6700 square feet. Mr. Roemer advised also that a grading plan will be submitted to the City Engineer showing all lots draining to the street. The Chair invited comments from the floor. Mr. Harry K. Wolff. Jr., President, Mills Estate Home Owners' Association, spoke on the subject of architectural controls, which have been imposed by deed restriction upon every home owner in the Mills Estate. Advertising matter and brochures, prepared and distributed by the original owners and developers of the Mills Estate, setting forth statement of architectural controls and provisions for enforcement through an archi- tectural committee, were displayed. Mr. Wolff advised that the residents are deeply concerned over the ex- terior appearance of the homes which the Eichler Corporation will build,. Mr. Joseph Eichler, President, Eichler Homes, Inc.,, stated that the actual houses have not been planned as yet but "they will be guilt in the character of the type of house that we build". It is not then- intent to act in any way which will be harmful or detrimental to the area, Mr. E.L. Pierce, President, Burlingame Mills Estate! Improvement Association, Mr. J.C. Bauer, 42 Rio Court, Dr. Robert D. Jacobs, 296S Arguello Chive, Mr. Peter Salvaressa, 1830 Sebastian Drive, expressed concern that a uniformity of architectural design be maintained. In reply to Commission inquiry concerning procedure, the City Attorney stated that the State of California Subdivision Map Act and the City's Subdivision Ordinance shall apply. The scope of the City's authority is dictated by statute. The City Attorney stated that the Commission may not legally nor lawfully attempt to attach to a map conditions not pertaining to public improvements; nor deny approval of a map upon such conditions. The City Attorney pointed out that the law does not provide for exercise by the City of any degree of architectural control and, in reply to Commission inquiry, expressed the opinion that it would not be possible in the present situation to enact an ordinance for architectural controls. The Commission was advised that declarations of restrictions, as have -2- been filed in close to 20 subdivisions in the Mills Estate, are expressly limited to the subdivision for which they were filed. This is a private )contractural agreement between the developers and the subsequent owners ,,of the property and is not a matter of municipal concern. A motion introduced by Commissioner Cistulli to continue the hearing to the next regular meeting was seconded by Commissioner Edwards, and following considerable discussion was declared defeated on the following roil call vote: AYE: COMMISSIONERS: Cistulli, Edwards, Moore NO: COMMISSIONERS: Brauner, Kindig, Norberg, Stivers ABSENT COMMISSIONERS: None In reply to inquiries from Commissioners Cistulli and Edwards, Mr. Shapro made available to the Commission photographs of several Eichler -built residences. In considering the map, Commissioners requested and received commitments from the project engineers, as follows: 1. The name West Murchison Drive to be changed to Hunt Drive. 2. Hunt Drive to be increased from S4 feet to 60 feet in width. A motion was thereupon introduced by Commissioner #ypsrapprove the tentative map as submitted with the conditions that the name of West Murchison Drive be changed to Hunt Drive; the width of Hunt Drive be increased to 60 feet by moving the property line back three (3) feet on each side of the street - the map as amended to be forwarded .to the City Council for acceptance. Motion seconded by Commissioner Norberg and declared carried on the follow- ing roll call vote: AYE: COMMISSIONERS: Brauner, Edwards, Kindig, Moore, Norberg, Stivers NO: COMMISSIONERS: Cistulli ABSENT COMMISSIONERS: None The hearing was thereafter declared concluded, 1. Proposed Off -Street Parking, Burlingame Avenue and Fact Zane. Chairman Kindig announced that the Commission would consider at this time an off-street parking plan prepared by Commissioner Norberg at the request of Mayor Lorenz, utilizing the strip of land which parallels the tennis courts at Washington Park on Burlingame Avenue, between East Lane and the American Legion Hall parking lot. Commissioner Norberg, in reply to Chairman Kindig advised that some solu- tion must be found to relieve the parking congestion in the area. The streets and the Legion Hall lot are burdened with commuter parking; in addition to the automobiles generated by the park and the recreation center and the usual residential traffic. The Commission was aditised that the plan proposes 22 new off-street spaces. A drawing was submitted indicating an entrance from East Lane and exit to the Legion Hall lot. Some pine trees would be removed and the strip paved 03- The Chair recognized Edgar Arnold, member of the City Recreation Com- mission, who advised both the Park and the Recreation Commissions hope to have an opportunity of studying the proposal before action by the )City Council. The City Engineer, in reply to the Commission, advised that approximately 1200 square feet of paving will be required; the total cost of the project is estimated at $5500.00. Chairman Kindig and Commissioner Stivers agreed that the cost estimate was reasonable but objected in principal to an intrusion into the park area for the purpose of off-street parking. The City Attorney pointed out that the land is within the boundaries of Washington Park, purchased by the City for park purposes from the pro- ceeds of a general obligation bond issues For this reason, unlimited public parking would be illegal and in violation of the purposes of the park. The City Attorney stated that the City may install parking restricted to patrons of the park e with signs posted to that effect. A motion introduced by Commissioner Edwards favorably recommended the plan prepared by Commissioner Norberg to the City Council. Motion was seconded by Commissioner Cistulli and carried on the following roll call vote: AYE: COMMISSIONERS: Brauner, Cistulli, Edwards, Moore, Norberg NO: COMMISSIONERS: Kindig, Stivers ABSENT COMMISSIONERS: None 2. Lucky Market and Safeway Store: Maintenance of Hedges -,,E1,tCamino. Commissioner Norberg referred to the appearance of the hedges on the above properties which were described as poorly maintained and littered with debris, creating an eyesore along the E1 Camino Real. A motion introduced by Commissioner Norberg recommended that the City Manager and the City Planner remind the parties concerned of their obli- gation under the provisions of the variance grants to plant and properly maintain a compact hedge on the E1 Camino Real frontage. Motion seconded by Commissioner Moore and carried on the following roll call vote: AYE: COMMISSIONERS: Brauner, Cistulli, Edwards, Kindig, Moore, Norberg NO: COMMISSIONERS : Stivers ABSENT COMMISSIONERS : None 3. Land Reclassification: Por. Lot 1, Block 4, Burlingame Land Company, May No. 2. (1206 Bellevue Avenue). The City Planner advised that the boundaries of the Burlingame Avenue Parking District established by the engineers included all of the portions of Lot 1, Block 4, Burlingame Land Company. The lot had been subdivided a number of years ago into four parcels: two fronting California Drive, one at the corner of Bellevue Avenue and California Drive, used for gasoline station purposes; the fourth, fronting Bellevue Avenue is an old residence; -4- The City Planner stated that the City Council has relocated the line of the district to the gasoline station, thereby removing the Bellevue Avenue parcel. The Planning Commission has been directed by the City Council to conduct a public hearing for the purpose of reclassify- ing the property from commercial to residential zoning. A motion introduced by Commissioner Cistulli, seconded by Commissioner Norberg, and unanimously carried, scheduled a public hearing at the regular meeting, February 25, 1963, in the matter of reclassifying a portion of Lot 1, Block 4, Burlingame Land Company, Map No. 2, known as 1206 Bellevue Avenue, from C-2 District (Service Business) to R-4 District (Fourth Residential ( Multi -Family). ADJOURNMENT The meeting was regularly adjourned at 10:30 p.m., to be followed by the study meeting regularly scheduled for this dates .CALL TO ORDER Following a recess, the study meeting was called to order by Chairman Kindig at 10:35 p.m. _OR STUDY 1. RESUBDIVISION @ Lot 5, Block 1, Mills Estate No..1. E1 Camino Real, California Drive, Trousdale Drive. A resubdivision map prepared by Phillip G. Larson, Civil Engineer, for the owner, Continental Assurance Company, proposed to divide the above - described property into two parcels: Parcel A, having frontage on E1 Camino Real and Trousdale Drive; Parcel B fronting on California Drive and Trousdale Drive. The City Engineer advised that Parcel A has been improved for some time as a gasoline service station. Parcel B was recently paved and is used as a parking lot. The City learned that there was a change of ownership in the property o the two parcels are now separately owned. The City Engineer stated that the resubdivision map has been filed by the owner at the request of the City. The application was scheduled for public hearing on February 25, 1963. 2. SPECIAL PERMIT e Tank Repair on Trucks. Merit ".tank $ Body, Inc. A communication dated January 28, 1963, from the Law Offices of Burd, Hunt and Quantz, representing Merit, Tank and Body, Inc., advised that the latter company is planning to establish a new facility to re- pair aircraft refueling vehicles at 825 Hinckley Road in East Millsdale Industrial Park. John S. Burd, Jr., was in attendance, accompanied by Mr. Enrico Rosso, the applicant. The Commission was advised that it is planned to lease the front portion of a new concrete warehouse building. The owner of the building will -5- occupy the rear. The main operation will be continued at the Berkeley plant u about 10% of the business will be conducted in Burlingame. i Mr. Burd mentioned that fuel tanks requiring repair will be completely drained at the airport, moved along the airport private road and for a short distance on city streets to the plant. The route through Bur- lingame has been discussed with the City's traffic director. The City ?fanner advised that Howard Pearson, City Fire Inspector, has proposed five or six conditions for fire safety purposes. The City Planner advised further that the proposed use is legal in the district vrxth a permit from the Planning Commission. Communication from Cleo. B. McClanahan, A communication dated February 6, 1963, from Cleo B. McClanahan, 2244 Oakdale Road, Hillsborough, concerning the Cravalho property at Vancouver Avenue and Jackling Drive, was read and accepted for filing.
