Chairman Kindig ! The Secretary's roll call recorded the above members present. Commissioner No berg, absent from the city on business, was excused. MINUTES Minutes of the egular monthly meeting of August 27; the adjourned meeting and stu y meeting of September 11, 1962, previously submitted to members, wer approved and adopted. HEARINGS Public hearings, pursuant to published notice, were conducted as follows: 1. RESUBDIVISIGN - Parcel C of Lot 2, Block 1, Ray Park; and Lot S, Block S1, Easton Addition No. S. A resubdivision map entitled "Resubdivision Of Parcel C Of Lot 2, Block 1, Ray Park, And Lot 5, Block 51, Easton Addition No. S; filed with the City Engineer by the property owners, was submitted to the Commission for formal consideration. The City Engineer advised that the resubdivision involves a realignment of the common lot line between the two properties to locate a new lot line along the existing fence; there are no engineering problems; and both lots will meet street frontage and land area requirements. Motion seconded carried on roll call vote of 2. VARIANCE -ILynn Insurance Group. Height Variance C-3 District. A variance app ication filed by Lynn Insurance Group, represented by Congdon Constr ction Company, 1842 El Camino Real, Burlingame, requested a four (4) foo height variance for a commercial building at the south- east corner of the intersection of Ogden & Murchison Drives - C-3 District, rofessional Business. (Parcel J, Block 7, Mills Estate #3). A communicatio from the applicant, dated September 11, 1962, advised that considerable effort was expended in an attempt to design a three- story building having frontage on Murchison Drive, without exceeding the height limitation, but because of the slope of the lot, this has not been possible. The communicat on advised also that if the building were to face Ogden Drive, t e variance would not be required. The architectural de- sign is such t at the building would more appropriately face Murchison, rather than tho side street. A plot plan an4 elevations accompanied the communication. Chairman Kindi recognized Phillip G. Larson, representing the applicant, ! who advised th t the building will conform to the plans submitted. The' owners will oc upy a portion and rent the remaining space to others. The City Planner, in reply to the Chair, stated that he was familiar with the site. The slope of the land does present a problem and there would appear to be a reasonable basis for the variance request. Fronting on Murchison Drivc will work to the advantage of the individual development, but the buildi g, as proposed, will conform very well to the established pattern in the area. Commissioner M ore questioned whether parking requirements will inter- fere with the andscaping at the front of the building, as indicated on the plans. In reply, the ity Planner advised that there appears to be sufficient area to meet o f-street parking requirements, but this will be verified prior to issua ce of the building permit. MIENDIMENT T DIVISION 6, SECTION 1926, ORDINANCE CODE (ZONING). A public hearin , continued from the meeting of August 27, 1962, was scheduled to pr ceed at this time -for the purpose of considering an (- amendment to Part X, Article 50 (Zoning) of the Ordinance Code to pro- vide for reside tial lot sizes in newly annexed subdivisions. The City Planne , in reply to the Chair, advised that the amendment re- fers to the "Ar sby Estate Subdivision", which has been before the Commission in T ntative Map form but which has not yet become a part of the City of Bur ingame. At present, the City does not have jurisdiction. A recommendatio by the City Planner that the matter be dropped from the agenda of Commit sion business until such time that annexation proceedings have been compl ted was concurred in by members of the Commission. COMMUNICATIONS 1. F.D. Sperry Company re: Extension Of Use Permit. (co tinned from August 27, 1962). A communication dated July 26, 1962, from F.D. Sperry Company requested permission to r main in the temporary location at 1421 North Carolan for an addition l six months, to December, 1962. A second commun cation, dated September 14, 1962, advised that a perma- nent location i the City of San Mateo will be available upon completion of fill operatilocation ns and street work. All of the necessary permits have been secured frm the U.S. Army Engineer Corps and the City. The com- munication advied that it is hoped that the new location will be ready for occupancy b May 31, 1963, and permission was requested to remain in the Burlingame until that date. Chairman Kindig recognized Mr. Sperry who advised that work is under way and, barring unforeseen complications and a prolonged rainy season, the site should be teady by the date specified. The City Planne , in reply to the Chair, recalled that Mr. Sperry was granted a tempo ary permit approximately one year ago to operate from the North Carol n Avenue location, with the understanding that the business would be moved ithin six months. On that basis, Mr. Sperry was excused from the city's restrictions for a contractor's storage yard. The City PlanneLdnoted that the property is unenclosed and unsightly. This is the sec request for a time extension. The City Planner sug- gested that sho Id the Commission agree to the present request that it be qualified to a final date, with further occupancy on the basis of a new use permit ncluding all of the required restrictions. Commissioner Edwards referred to the many delays encountered by Mr. Sperry in his dealings with the various official agencies and thereafter intro- duced a motion extending the temporary use permit to a final date of May 31, 1963. Motion seconded by Commissioner Brauner and unanimously carried on roll call vote. 2. NORMA MOORE SCHOOL re: Amendment To Variance. Commissioner Mo re addressed the -Stair and advised that due to a personal el association in the past with the Norma Moore School, he would not partici- pate in the ac ion presently before the Commission. A communication dated September 11, 1962, from The Norma Moore School referred to a variance granted by the Commission in January, 1962, to permit remodeling and occupancy of buildings at 700=706 Peninsula Avenue for day school purposes. Cost of the proposed alterations were found to be excessive and it is now intended to demolish the two buildings and build a comple ely new structure. The communicat on requested that the variance be amended to permit the same use of th new buildings. Sydney P. Of Two Commissioners To Bay Front Study Committee. The City Planner advised that at the last City Council meeting, Councilmen Crosby and Martin were appointed by the City Council to meet with two members of the Planning Commission and representatives of the Joint Raylands Development Committee of Burlingame to discuss and recom- mend a general plan for development of the Bay Front lands. The City Plann r mentioned that there are a number of projects under way at the present time, not only on the city level, but among private develop- ers as well, w ich will affect eventual uses of the shorelands. City Pla r re: Ordinances No. 762 and 763 (Amendments to Zoning Article). The City %M#sification r reported that Ordinance No. 762 providing procedures for land and variance grants was adopted at the City' Council meetin of September 17, 1962. Ordinance No. 763 providing for setback li es, parking spaces and other building restrictions, scheduled for doption at the City Council meeting of October 1, 19620 was amended, a the request of the Fire Chief, to eliminate open off- street parking spaces in all areas except the rear, 3. Capital Improvement Study Meeting. Commissioners �cheduled a preliminary study of capital improvement projects for t e meeting of October 8, 1962. ADJOURNMENT Prior to adjou ment, Chairman Kindig acknowledged the presence of Councilman Cro by who spoke briefly on the proposed study of the shore - land developme t and the interest voiced by members of the Planning Commission.
