When the behavior policy is violated in a way that the City Librarian believes could disturb or otherwise interfere with another patrons' use or enjoyment of the Library, the following steps will be taken: 1. The Patron in question is banned immediately for the remainder of the date of violation. The decision to ban for a single day will be made by the City Librarian or designee. If the patron refuses to leave, Burlingame police non -emergency will be called and will remove the patron. 2. If, after the single day ban, the patron commits a second violation within twelve (12) months, the City Librarian or designee may ban the patron for up to one (1) month. The patron will receive notice of the reason for their ban in writing or, if the patron is a minor, notice will be given to their legal guardian. 3. If, following the second ban, the patron commits a third violation within twelve (12) months of the first violation, the City Librarian or a manager may ban the patron for up to one (1) year. This ban will end one year after the date of the third violation. The patron will receive notice of the reason for their ban in writing or, if the patron is a minor, notice will be given to their legal guardian. 4. If a patron is given a one (1) year ban, they may appeal this decision by making a request for appeal, in writing, to the City Manager. Such request will include any and all evidence the patron believes the City Manager should consider in making his/her determination. The City Manager will act upon the appeal within 30 days of the date the City receives the notice. The action of the City Manager is final.
