URGENCY
ORDINANCE PRO`{IBITING PRESENCE IN ALLEYS AND
EASEMENTS DURING CERTAIN HOURS
Tii.E CITY COUNCIL of the CITY OF BURLINGAME does hereby ORDAIN
as follows :
Section 1. Chapter 10 . 14 is hereby added to the Burlingame '
Municipal Code to read as follows :
"CHAPTER 10 . 14
TRESPASS IN ALLEYS AND EASEMENTS
10 . 14 . 010 Trespassing in Alleys and Easements in Residential
Districts . It is unlawful for any person to be present in or upon
a public or private alley or utility easement in a residential
district between the hours of 7 : 00 p.m. and 7 : 00 a.m. without
the
permission of the owner or occupant of adjacent property or unless
such person is an authorized representative of a public utility or
public agency.
Notwithstanding the provisions of Section 1 . 12 . 010 of this
code, any violation of this section shall be punishable as a
misdemeanor • "
Section 2 . Urgency. It is hereby declared that this
ordinance is an ordinance for the immediate preservation of the
public peace, safety, health and welfare , and is an emergency
measure as provided by law, and shall take effect upon its adoption .
The facts constituting such urgency are as follows :
On October 31, 1985 , Halloween, considerable property
damage was caused in the vicinity of Hillside Drive in Burlingame,
as a result of a large gathering of persons , primarily juveniles .
Numerous city law enforcement personnel were involved in dispersing
those persons, and at least one auto collision was caused by the
conjestion created. Many of the persons involved hid in or
retreated to alleys and utility easements in the area and used such
alleys and easements for storage of projectiles such as fruit,
vegetables and eggs . Law enforcement officers have concluded that
restriction of use of the alleys and easement would assist their
controlling such a situation should it occur again . Adoption
of this ordinance as an urgency measure is necessary so that it
will be in full force and effect on Rolloween of 1986 .
