On September 16, 2021, Governor Newsom signed into law AB 361, which allows a local agency to meet remotely when: 1. The local agency holds a meeting during a declared state of emergency 2. State or local health officials have imposed or recommended measures to promote social distancing 3. Legislative bodies declare the need to meet remotely due to present imminent risks to the health or safety of attendees On September 20, the City Council adopted Resolution Number 007-2022 stating that the City Council and Commissions will continue to meet remotely for at least thirty days for the following reasons: 1. The City is still under a local state of emergency 2. County Health Orders require that all individuals in public spaces maintain social distancing and wear masks 3. The City can't maintain social distancing requirements for the public, staff, Councilmembers, and Commissioners in their meeting spaces. Pursuant to Resolution Number 036-2022, the Burlingame Beautification Commission Meeting at the Recreation Center portables will not be open to the public for the May 5, 2022 Meeting. Welcome! Members of the public may view the meeting by logging into the Zoom meeting listed below. The meeting video will be uploaded to the City's website after the meeting. City of Burlingame Page 4 Printed on 4/28/2022 BURLINGAME BEAUTIFICATION COMMISSION Draft Minutes April 7, 2022 The regularly scheduled meeting of the Beautification Commission was called to order via Zoom at 6:30 pm by Chair Kirchner. ROLL CALL Present: Chair Kirchner, Commissioners Bauer, Batte, Chu, and Ribera Absent: None Staff. Parks and Recreation Director Glomstad and Parks Superintendent/City Arborist Disco, Recording Secretary Borba Others: None MINUTES Commissioner Bauer made a motion to approve the March 3, 2022 minutes. The motion was seconded by Commissioner Batte and was approved 5-0. CORRESPONDENCE None PUBLIC COMMENT None OLD BUSINESS 1. Trees of Burlingame Ad Hoc Committee Members Update Chair Kirchner stated he put together a chapter on Eucalyptus trees which was forwarded to the Commissioners via email to review and make comments or edits. Commissioner Bauer pointed out a grammatical error to Chair Kirchner to correct, and she stated Chair Kirchner did a wonderful job on the chapter. Chair Kirchner informed the Commissioners he would be working on the Palm tree chapter next and calling Arborist Disco for input. 2. Business Landscape Award (BLA) and Residential Sustainable Landscape Award (RSLA) Outline Commissioner Batte reported the Commissioners could continue inspecting locations for nominations of the awards. She also stated Secretary Borba emailed out the list of former winners for each award. Commissioner Chu asked if multifamily residents could be nominated and if would be RSLA or BLA. Director Glomstad replied it would be RSLA. Commissioner Chu asked if he could only nominate BLA nominees within his zone. Director Glomstad reported the BLA is the entire City for each Commissioner. Commissioner Bauer asked the date for submissions. Secretary Borba stated the Commissioners would submit their nominations at the Beautification Commission meeting on June 2, 2022. Commissioner Ribera asked if she could talk with the homeowners or just take pictures. Director Glomstad stated that commissioners could talk to homeowners. NEW BUSINESS 1. Review of Policies Regarding Planter Strips City Arborist Disco read the staff report. Commissioner Chu thanked the staff for meeting with Public Works, the City Attorney's office, and Community Development to provide information about planter strip areas. He asked if a permit could be issued for non -permeable surfaces. Arborist Disco stated no permits are for permeable surfaces only. Arborist Disco stated if non -permeable surfaces have been installed, it was not with a permit. Arborist Disco stated when he is reviewing plans for remodels and new construction, he inspects the planter strip area also. If it has a non -permeable surface, he requires it to be removed as part of the construction permit. Commissioner Kirchner asked if the City was installing a new waterline, could staff remove the non -permeable surface at that time. Arborist Disco stated Public Works removes all the non -permeable surfaces if they come across them during public works projects. Commissioner Chu asked if there was a way to educate the residents about planter strip areas. Director Glomstad informed the Commissioners the Urban Forest Management Plan has a section on planter strips, and it is a good reference for residents. Staff would also put information in Live Play Burlingame and the eNews. REPORTS 1. Director Glomstad Director Glomstad stated the Community Center is still on schedule, and she is hoping to have the ribbon -cutting the week of June 13 in the afternoon and some activities in the building during that time. 2. Parks Superintendent/City Arborist Disco City Arborist Disco stated there are a lot of park improvements going on this spring and summer, including the Lions Club landscaping in the front and side, the J-Lot parking lot is getting re - landscaped, and an edible garden in the back of Washington Park is being installed. Arborist Disco also informed the Commissioners that Parks Lead worker James Delaney carved a wishing well out of a Cedar tree trunk. Arborist Disco stated that the Parks Division will start the April Planting of 60 trees at the end of the month and has also been encouraging residents to water their trees. Arborist Disco stated there might be an appeal next month regarding the denial to remove a Fir tree at 1812 Montecito Drive. 3. Commissioner Kirchner Commissioner Kirchner reported Arbor Day had students from St. Catherine, and three trees were planted. He also attended the Anson Burlingame Principal of Eternal Justice Art installation in Washington Park. He commented the benches, portals, and art was very moving. 4. Commissioner Bauer Commissioner Bauer requested a tour of the Community Center. Director Glomstad said she would send out an email with possible dates. 5. Commissioner Batte None 6. Respectfully submitted, Gina Borba Administrative Staff BURL.INGAME STAFF REPORT To: Beautification Commission Date: May 5, 2022 From: Margaret Glomstad, Parks and Recreation Director Bob Disco, City Arborist Subject: Appeal of the Denied Removal of One Fir (Atlas Cedar) Tree at 1812 Montecito Way RECOMMENDATION Staff recommends that the Commission deny or uphold the appeal based on the information presented in the staff report and Commission meeting. BACKGROUND The Parks Division received a Protected Tree Removal Permit application (Exhibit A) on March 22, 2022, to remove an Atlas Cedar tree at 1812 Montecito Way. The permit stated the tree was in good condition but was hitting the light post and jeopardizing pedestrians. The tree is located in the front of the house and has multiple co -dominant limbs but appears to be healthy and structurally sound. The City Arborist inspected the tree and determined the tree's structure is fair but could be improved with proper pruning following ANSI Standards and Best Management Practices. In a letter to the homeowner, the City Arborist denied the removal because the tree is in good condition with no sign of disease or decay and does not meet the criteria for removal under the Urban Reforestation and Tree Protection Ordinance (Exhibit B). The homeowner appealed the denied removal. In a letter to the City Arborist (Exhibit C), the homeowner acknowledged that the tree is in good condition but is growing around the light post, jeopardizing pedestrians, and blocking the window view of the neighbors at 1811 Montecito Way. A neighbor has also complained to the property owner about the tree and requested the tree be removed. In addition, the homeowner stated that the cost of pruning would be a financial burden to them, and the tree is a risk to the public. DISCUSSION Atlas Cedars, a coniferous tree, typically have a pyramid shape with a central leader reaching a height of 40-60 ft. The tree in question appears to have been pruned several times to create a round canopy with multiple limb attachments. The tree's canopy appears to be sound and does 1 Appeal for the denied removal of 1 Fir (Atlas Cedar) tree at 1812 Montecito Way. May 5, 20: not pose an immediate hazard at this time. The estimated age of the tree is 40-50 years old. canopy surrounds the light pole, but the Parks Division staff is not aware of any issue with function of the light caused by the limbs. Pruning coniferous trees is different than pruning deciduous trees. If done correctly, decidu trees tend to grow back at the point where they were trimmed. Conifers do not and, if improp cut, will leave unsightly stubs. Pruning coniferous trees should be done by a licensed, quali tree service company. Municipal Code, Chapter 11.06 Urban Reforestation and Tree Protection Ordinance, Sectic 11.06.060 (d) (1-7) (Exhibit D), lists the criteria the City Arborist reviews when determining Protected Tree Removal Permit. If a protected size tree meets any criteria and cannot be easi mitigated or does not meet the criteria, the permit is approved or denied. However, tr Commission may overturn the decision of the City Arborist if new information or points of view ai revealed during the appeal process that justifies any criteria in the Ordinance. Action The Commissioners are asked to weigh the content of the staff report and supportin documentation and listen to the interested parties before making a decision. Staff recommend one of two options to the Commission with the grounds stated in the Ordinance justifying th decision of the Commission. The options include: 1. Deny the appeal since the tree does not meet the criteria for removal based on th Municipal Code Chapter 11.06 Urban Reforestation and Tree Protection Ordinanc 11.06.060. 2. Uphold the appeal based on the email from the resident at 1812 Montecito Way and alli removal, since the tree interferes with the neighbors view and it is an economic obligati to the homeowner, and replace it with a new 24" box landscape tree. That is a beautiful tree and in good condition indeed. However, it is time that this huge tree needs to come down. First, it is hitting the lamppost on the sidewalk and jeopardizing to pedestrians. The safety is always our top priority. Second, it is totally blocking the window view of our cross -street neighbor and bringing down his property value. The homeowner has complained and requested many times since we have moved in. The procedure and cost of pruning the tree would be a big financial burden for us. Since this is a fast-growing tree and the risk to the public, we are adopting his suggestion to remove this huge tree and plant a manageable tree in the same area. Finally, this is an outstanding huge tree and lacking in harmony in our neighborhood, we plan to plant a math up tree in concordance with others.
