On September 16, 2021, Governor Newsom signed into law AB 361, which allows a local agency to
meet remotely when:
1. The local agency holds a meeting during a declared state of emergency
2. State or local health officials have imposed or recommended measures to promote social
distancing
3. Legislative bodies declare the need to meet remotely due to present imminent risks to the health or
safety of attendees
On September 20, the City Council adopted Resolution Number 007-2022 stating that the City Council
and Commissions will continue to meet remotely for at least thirty days for the following reasons:
1. The City is still under a local state of emergency
2. County Health Orders require that all individuals in public spaces maintain social distancing and
wear masks
3. The City can't maintain social distancing requirements for the public, staff, Councilmembers, and
Commissioners in their meeting spaces.
Pursuant to Resolution Number 025-2022, the Burlingame Beautification Commission Meeting will not
be open to the public for the April 7, 2022 Meeting.

The meeting video will be uploaded to the City's website after the meeting. Members of the public may
provide written comments by email to gborba@burlingame.org.
Emailed comments should include the specific agenda item on which you are commenting, or note that
your comment concerns an item that is not on the agenda or is on the Consent Calendar. The length of
the emailed comment should be commensurate with the three minutes customarily allowed for verbal
comments, which is approximately 250-300 words. To ensure that your comment is received and read
to the Beautification Commission for the appropriate agenda item, please submit your email no later
than 5:00 p.m. on April 7, 2022. The City will make every effort to read emails received after that time,
but cannot guarantee such emails will be read into the record. Any emails received after the 5:00 p.m.
deadline which are not read into the record will be provided to the Beautification Commission after the
meeting.
All votes are unanimous unless separately noted for the record.

Speakers may address the Commission concerning any matter over which the Commission has
jurisdiction or of which it may take cognizance that is not on the agenda. Additional public comments
on agenda action items will be heard when the Commission takes up those items. The Ralph M. Brown
Act (the State local agency open meeting law) prohibits the Commission from acting on any matter that
is not on the agenda. Speakers are asked to fill out a "request to speak" card located on the table by
the door and hand it to staff, although provision of name, address or other identifying information is
optional. Speakers are limited to three minutes each, although the Commission may adjust the time
limit in light of the number of anticipated speakers.

Draft Minutes March 3, 2022
The regularly scheduled meeting of the Beautification Commission was called to order via Zoom at 6:30
pm by Chair Kirchner.
ROLL CALL
Present: Chair Kirchner, Commissioners Bauer, Batte, Chu, and Ribera
Absent: None
Staff. Parks and Recreation Director Glomstad and Parks Superintendent/City Arborist Disco,
Recording Secretary Borba

MINUTES
Commissioner Batte made a motion to approve the November 4, 2021 minutes. The motion was seconded
by Commissioner Ribera and was approved 5-0.

OLD BUSINESS
1. Trees of Burlingame Ad Hoc Committee Members Update
Chair Kirchner stated that he had recruited the Parks and Recreation Foundation to help with the
brochure, and one of the members, Laura Heselgren, has agreed to take photographs of Palm trees.
Chair Kirchner reported that he is working on Eucalyptus trees and shared with the Commissioners
his findings.
2. Business Landscape Award and Residential Sustainable Landscape Award Outline
Commissioner Batte confirmed the sections for nominations of the Residential Sustainable Landscape
Award. Commissioner Batte selected section 2, Commissioner Chu selected section 3, Chair Kirchner
selected section 1, Ribera selected section 4, and Commissioner Bauer selected section 5. Chair
Kirchner requested the Commissioners take pictures of their nominees for both awards and include
the picture when submitting their nominations. Secretary Borba stated that the Business Landscape
Award nomination form was printed in the Live Play Burlingame brochure and will be posted in the
eNews once a month until June. Commissioner Bauer stated she would introduce Dale Perkins to
Commissioner Batte, and she can inquire if he is still willing to paint a picture of the Business
Landscape Award winner. Chair Kirchner requested the list of former winners of both awards to be
sent to the Commissioners. Secretary Borba stated she would forward the lists.
NEW BUSINESS
1. Arbor Day March 7, 2022, at Village Park at 2:30pm
Director Glomstad stated that we had received poems and posters for the event from the students.
Arborist Disco said that four Acer rubrum `Red Maples' would be planted. Secretary Borba reminded
the Commissioners that one of the trees planted would be in honor of the Residential Sustainable
Landscape Award winner from last year.
REPORTS
1. Director Glomstad
Director Glomstad informed the Commissioners the Anson Burlingame Public Art Project unveiling
and ribbon cutting would be on March 23, in Washington Park at 11:30 am. She stated the
Commissioners would be receiving an invitation.
Director Glomstad stated the Community Center is still on schedule. She stated that if any of the
Commissioners would like a tour, contact her to schedule a date and time.
Director Glomstad reported that she had scheduled a meeting with Public Works staff and the City
Attorney's office to talk about the paving planter strip areas and will have more information for the
Commissioners at the April meeting.
2. Parks Superintendent/City Arborist Disco
City Arborist Disco stated a large Eucalyptus was removed on Easton and Vancouver by PG&E. While
the power was out, the City Tree Contractor, West Coast Arborist, removed a Eucalyptus at 1704
Easton Drive. He states the City will be replanting both trees.
Arborist Disco informed the Commissioners that the City was working on the Eucalyptus trees on
California Drive near Oak Grove. He stated that 19 Eucalyptus were removed, and the rest were
trimmed.
Arborist Disco stated that the Winter Street Tree Planting is in progress, and the Tree Crew will be
planting 92 trees.
3. Commissioner Kirchner
Commissioner Kirchner asked Arborist Disco why the Eucalyptus tree on Easton and Vancouver was
removed. Arborist Disco stated he had monitored the tree for the last six years. He said the tree was
growing a sulfur fungus which is a sign of decay, and two years ago, he scheduled the tree for removal.
He stated that due to the tree being over high voltage wires, PG&E agreed to remove it with their
contractor trained to remove large trees over high voltage wires. Arborist Disco stated two Eucalyptus
trees would be planted in the planting strip area east of where the tree was removed.

Commissioner Bauer inquired about the Victoria Park ribbon -cutting ceremony. Director Glomstad
stated that Commissioner Batte attended. Commissioner Batte said that it has a very futuristic theme
and the children enjoyed playing on the new playground.

Subject: Information about Paving of City Planter Strips
RECOMMENDATION
Staff recommends that the Commission review the policies and information about paving of
planter strips and ask questions as needed.
BACKGROUND
At the November 2021 Commission meeting, Commissioner Chu asked for more information
about residents paving over City planter strips, remedial actions the City could take, and if it was
a prevalent issue in the City.
Since paving of planter strips involves three departments, the Parks and Recreation Department,
the Public Works Department, and the City Attorney's office, staff responded that they would bring
the item back as a future agenda item once they consulted with the other department staff.
DISCUSSION
On March 14, 2022, Park and Recreation Director Glomstad and City Arborist Disco met with
Public Works Division Manager Horne, Public Works Associate Engineer Voong, and Assistant
City Attorney Spansail to discuss the issue of paved planter strips.
Planter strips, identified as the areas between the curb and sidewalk typically used for tree
planting, are the City's right of way and belong to the City of Burlingame. The strip often contains
underground utilities such as sewer lines and cleanouts, water meters, gas lines, and
underground electrical wires.
The area is intended to be free of non -permeable hardscape that would prevent easy access to
underground utilities during routine maintenance or in emergencies. This strip also serves as a
planting area for City -owned trees. A tree list has been established that dictates the appropriate
size species of trees that will survive in the variety of planting widths that these planter strips
occupy. The property owner maintains the planter strips, and any hardscape, irrigation, and plant
material (other than the City street tree) is the property owner's responsibility.

Information about Paving of City Planter Strips April 7, 2022
Property owners must submit a permit for any work that is proposed to be done in the City -owned
planter strip. Permits are issued for hardscape, but only if the material is permeable and easily
removable for maintenance of underground utilities. This is typically in the form of pavers set in
the sand where water can permeate into the ground, provide moisture to street trees, and be
easily accessible for underground utility maintenance. In the past, planter strips were paved over
in concrete without City knowledge. According to Public works, there are a few of these areas,
but they are not overwhelming compared to the number of planter strips throughout the City.
There is no penalty for previously paved planter strips, and the City does not employ staff to
actively look for paved planter strips. Enforcement is complaint based. For example, if a complaint
was made to Code Enforcement that a property owner recently paved over an open and free of
hardscape strip, they would be notified by Code Enforcement staff to remove the pavement and
restore the area, or apply for a permit.
In addition, when Public Works staff encounter a paved planter strip during maintenance or
emergencies and needs to access the utilities below, they routinely remove the pavement and
leave the strip free of pavement when their job is completed.
Another way staff encounter a paved planter strip is when a new permit is requested through the
Community Development Department for property improvements. Public Works and the Parks
Division staff review the plans and make comments during plan checks. Public Works often
requires new sidewalks and curbs, and gutters to be installed and will require paved planter strips
to be removed. The Parks Division automatically requires the paved strips to be removed and
placement of one or two new street trees depending on the planter strip size.
The prevalence of paved planter strips thoughtout the City without a permit is unknown, however
staff estimate that approximately two per year are discovered by the above methods.
