HomeMy WebLinkAboutOrd 20241 ORDINANCE NO. 2024 AN ORDINANCE OF THE CITY OF BURLINGAME AMENDING SECTIONS 13.36.010 AND 13.36.020 OF CHAPTER 13.36, “PARKING LIMITATIONS,” OF TITLE 13 OF THE BURLINGAME MUNICIPAL CODE REGARDING PARKING RESTRICTIONS ON AIRPORT BOULEVARD; CEQA DETERMINATION: EXEMPT PURSUANT TO STATE CEQA GUIDELINES SECTION 15378 AND 15061(b)(3) WHEREAS, currently, Section 13.36.010(1) of the Burlingame Municipal Code prohibits parking at all times on the entire length of Airport Boulevard; and WHEREAS, at the same time, Section 13.36.020(2) of the Burlingame Municipal Code allows for limited parking on Airport Boulevard; and WHEREAS, the City Council wishes to resolve the conflicting regulations by removing the No Parking restrictions on Airport Boulevard; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME DOES ORDAIN AS FOLLOWS: Section 1. Incorporation of Recitals The Recitals set forth above are true and correct, and are hereby incorporated herein by this reference as if fully set forth in their entirety. Section 2. Amending Section 13.36.010 of Chapter 13 of Title 13 of the Burlingame Municipal Code Section 13.36.010(1) of the Burlingame Municipal Code is amended in its entirety to read as follows (1)Airport Boulevard, both sides from Bayshore Highway / Broadway to one - hundred and fifty feet (150’) east of Beach Road; DocuSign Envelope ID: DFC5E577-9444-4CA4-91BE-18D3099D0CA0 2 Section 3. Amending Section 13.36.020 of Chapter 13 of Title 13 of the Burlingame Municipal Code Section 13.36.020(2) of the Burlingame Municipal Code is amended in its entirety to read as follows. (2)Airport Boulevard, from one-hundred and fifty feet (150’) east of Beach Road to Lang Road, between 10:00 p.m. and 6:00 a.m. Section 4. CEQA Determination The City Council finds and determines this Ordinance is not a project within the meaning of section 15378 of the CEQA Guidelines because it has no potential for resulting in physical change in the environment, either directly or ultimately. In the event that this Ordinance is found to be a project under CEQA, it is subject to the CEQA exemption contained in CEQA Guidelines section 15061(b)(3) because it can be seen with certainty to have no possibility of a significant effect on the environment. Section 5. Severability If any section, subsection, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portion or sections of the Ordinance. The City Council of the City of Burlingame hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional. Section 6. Effective Date This Ordinance shall go into effect 30 days following its adoption. Section 7. Publication The City Clerk is directed to publish this ordinance in a manner required by law. Section 8. Codification Sections 2 and 3 of this Ordinance shall be codified in the Burlingame Municipal Code.
