A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME
DECLARING ITS INTENTION TO MODIFY THE MANAGEMENT DISTRICT PLAN
OF THE SAN FRANCISCO PENINSULA TOURISM MARKETING DISTRICT
(SFPTMD) AND FIXING THE TIME AND PLACE OF A PUBLIC MEETING AND A
PUBLIC HEARING THEREON AND GIVING NOTICE THEREOF
WHEREAS, the City Council of the City of Burlingame initially created the San Mateo County
Tourism Business Improvement District (“SMCTBID”) in 2001 pursuant to the Parking and Business
Improvement Area Law of 1989 by Ordinance No. 1648; and
WHEREAS, the City modernized the SMCTBID by forming a new District, the San Francisco
Peninsula Tourism Marketing District (“SFPTMD”), in 2023 pursuant to the Property and Business
Improvement District Law of 1994 by Resolution No. 120-2023 and Ordinance No. 2018, and adopted
the Management District Plan dated August 14, 2023; and
WHEREAS, the Property and Business Improvement District Law of 1994, Streets and
Highways Code §36600 et seq., allows cities to modify the Management District Plan (“MDP”) at the
request of the Owners’ Association; and
WHEREAS, the SFPTMD Owners’ Association, the San Mateo County/Silicon Valley
Convention and Visitors Bureau dba The San Francisco Peninsula (“SFP”), has requested modification
of the MDP to include the City of Foster City within the boundaries of the SFPTMD; and
WHEREAS, the City Council of the City of Foster City granted consent to the City of Burlingame
to include the City of Foster City in the SFPTMD and adopted Resolution No. 2023-94 on September
18, 2023.
NOW, THEREFORE,THE CITY COUNCIL OF THE CITY OF BURLINGAME DOES HEREBY
RESOLVE THAT:
1. The recitals set forth herein are true and correct.
2. The City Council declares its intention to modify the SFPTMD.
3. The SFPTMD currently includes all lodging businesses, existing and in future, located within the
boundaries of the cities of Belmont, Brisbane, Burlingame, East Palo Alto, Half Moon Bay,
Millbrae, Pacifica, Redwood City, San Bruno, San Carlos, San Mateo, South San Francisco,
and the unincorporated area of San Mateo County. The proposed modification of the SFPTMD
MDP will modify the existing boundaries of the SFPTMD to include the City of Foster City,
effective April 1, 2024, or as soon as possible thereafter, as shown on the map in Exhibit A and
the Management District Plan dated January 3, 2024.
4. The time and place for the public meeting for comments on the modified SFPTMD MDP are set
for February 5, 2024, at 7:00 p.m. or as soon as possible thereafter as the matter may be heard,
at the Council Chambers located at 501 Primrose Road, Burlingame, California 94010.
Following the public meeting, the City Council shall move to introduce and conduct the first
reading of the Ordinance to modify the SFPTMD MDP.

5. The time and place for the public hearing on modification of the SFPTMD MDP are set for March
4, 2024, at 7:00 p.m., or as soon as possible thereafter as the matter may be heard, at the
Council Chambers located at 501 Primrose Road, Burlingame, California 94010. The City Clerk
is directed to provide written notice to the lodging businesses assessed within the modified
SFPTMD of the date and time of the meeting and hearing, and to provide that notice as required
by Streets and Highways Code § 36623, no later than January 19, 2024.
6. At the public meeting and hearing, the testimony of all interested persons for or against the
modification of the SFPTMD may be received. If at the conclusion of the public hearing, there
are of record written protests by the owners of the lodging businesses within the modified
SFPTMD that will pay 50% or more of the estimated total assessment of the entire SFPTMD,
no further proceedings to modify the SFPTMD shall occur for a period of one year.
7. Following the public hearing, at the same City Council meeting on March 4, 2024, held at the
Council Chambers located at 501 Primrose Road, Burlingame, California 94010, the City
Council may conduct a second reading of the Ordinance to modify the SFPTMD to include the
City of Foster City within the SFPTMD’s current boundaries. At the conclusion of the second
reading of the Ordinance, the City may adopt the Ordinance, modifying the SFPTMD and levying
the assessments.
8. This resolution shall take effect immediately upon its adoption by the City Council.

January, 2024, and was adopted thereafter by the following vote:
