NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME RESOLVES AND ORDERS the following: 1. Authorizes the City to apply for an energy efficiency loan from the California Energy Commission to implement energy efficiency measures. 2. Understands that the project follows the California Environmental Quality Act (CEQA), the City finds that much of the project is exempt under Guidelines of Title 14 California Code of Regulations sections 15301 because the project consists of alterations to the existing public structures and/or facilities involving negligible or no expansion of use. For the wastewater treatment plant, the City may need to perform additional studies to comply with CEQA requirements and the City is committed to perform these studies and meet CEQA requirements. In the alternative, this resolution is exempt pursuant to section 15378 because it is not a “project.” 3. If recommended for funding by the California Energy Commission, the City Council authorizes the City to accept a loan amount up to $3,000,000. 4. The amount of the loan will be paid in full, plus interest, under the terms and conditions of the Loan Agreement and Promissory Note of the California Energy Commission. 5. The City Manager or the City Manager’s designee is hereby authorized to execute on behalf of the City all necessary documents to implement and carry out the purpose of this resolution and to take all actions necessary to fulfill the purpose of this Resolution.
