HomeMy WebLinkAboutReso - CC - 002-2023RESOLUTION NO. 002-2023 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME RATIFYING THE CITY MANAGER’S PROCLAMATION OF EXISTENCE OF LOCAL EMERGENCY, AND AUTHORIZING THE CITY MANAGER TO REQUEST FINANCIAL ASSISTANCE FROM FEDERAL AND STATE AUTHORITIES; CEQA DETERMINATION: EXEMPT PURSUANT TO PUBLIC RESOURCES CODE SECTION 21080(b)(4) WHEREAS, Section 3.36.060 of the Burlingame Municipal Code empowers the City Manager, as Director of Emergency Services, to proclaim the existence or threatened existence of a public emergency when the City of Burlingame is affected or likely to be affected by a public calamity and the City Council is not in session; and WHEREAS, conditions of extreme peril to the safety of persons or property have arisen within said City, caused by heavy rain storm and wind events beginning on December 31, 2022, with additional storm events forecast for the next seven to 10 days; and WHEREAS, the Burlingame City Council does hereby find that the aforesaid conditions of extreme peril did warrant and necessitate the proclamation of the existence of a Local Emergency; and WHEREAS, the recent and forecasted storms have and will cause the need to make emergency repairs and expe nd public money to protect the public and safeguard life, health and essential public services; and WHEREAS, the City Manager/Director of Emergency Services of the City of Burlingame did proclaim the existence of a Local Emergency within said City on the third day of January, 2023; and WHEREAS, the emergency will require financial and other assistance from State and Federal authorities. NOW, THEREFORE, BE IT PROCLAIMED AND RESOLVED that said Proclamation of Existence of Local Emergency, as issued by said City Manager/Director of Emergency Services, is hereby ratified by the Burlingame City Council; and IT IS FURTHER RESOLVED that the City Council finds based on substantial evidence that the public interest and necessity demand the immediate expenditure of public money to safeguard life, health, property, or essential public services and that the emergency will not permit a delay resulting from a competitive solicitation for bids, that this action is necessary to respond to the emergency, and that the City Manager’s actions in responding to the emergency is hereby ratified; and DocuSign Envelope ID: FA1D1F7B-2BFD-4AFC-96D8-2AB9BA81E044 IT IS FURTHER RESOLVED that the City Council finds that the emergency construction and/or repair to the public facility are necessary actions to prevent or mitigate an emergency and are exempt from CEQA under Public Resources Code Section 21080(b)(4); and IT IS FURTHER RESOLVED that during the existence of this local emergency, the powers, functions and duties of the emergency organization of this City shall be those prescribed by state law, by ordinances and resolutions of this City, and by the City's Emergency Operations Plan; and IT IS FURTHER RESOLVED that the City Manager is authorized to request financial assistance from the State of California and Federal Government on behalf of the residents and City Burlingame; and IT IS FURTHER RESOLVED that the Director of Emergency Services of the City of Burlingame is hereby authorized to execute for and on behalf of the City of Burlingame, and on behalf of the Central County Fire Depa rtment, a Joint Powers Authority providing fire and emergency services within the City of Burlingame, any agreement or application for, and to file the agreement with, the California Governor's Office of Emergency Services for the purposes of obtaining federal financial assistance; and IT IS FURTHER RESOLVED that said Local Emergency shall be deemed to continue to exist until its termination is proclaimed by the City Council of the City of Burlingame; and IT IS REQUESTED that the Governor of the State of California include the City of Burlingame in any emergency declaration by the State; ensure the City of Burlingame and the Central County Fire Department is included in any emergency declaration that may be issued by the President of the United States of America; waive regulations that may hinder response and recovery efforts; and make available California Disaster Act and State Private Nonprofit Organizations Assistance Program Funding.
