J. Marr, Dlrec-tor of PubLic Works, recommerd.ing the acceptance of the Kenmar tenrace Subdivlslon map and suggesting that the Clty Attorney ad-vlse of addltional lega1 conditlons that may be necessary wit}. the acceptar:ce of the subdlvj.sion. llpon belng advlsed by the City At-torney of the conrect procedure to be establlshed, Councllman Slmonds introdueed and moved the passage of Resolutlon No.7-55'A€-ceptlng the Subdivision Map of Kenman Terrace, seconded by Councll- man Love and adopted unanlmously upon roll call of members. Coun-clIman Slmonds moved that the map, as approved, be withheld andthe necordlng be delayed untl1 such time as the subdivlden entersLnto an agreement that he w111 perform all publlc improvementsthat may be required and submlts a bond to that effect. The motlon was seconded by Councilman Atwaten and unanlmously eannled. A letter dated Januany 5Or 1955, was read f?om G. J. Marn, Direct-on of Rtbl1c tr{orks, recommendlng the acceptance of a resubdivislon map of Lots 19 and 20, Block 4, Burltngame Park Subdlvlsion No. 4.The pol-nt yras nalsed as to the advlsabllity of dedicating the cu1-de-sac involved in the subdlvisj.on as a clty street or that lt beconsldered a private ::oad to be malntalned by the owner. Follow-1ng considerable dlscussion on the subject, Councllman Simondslntroduced and moved the passage of Resolutlon No. 9-53, Acceptlngthe Map, seconded by Counctlman tove and adopted unanlmously uponro11 caLl of members. Marr,Director of R.rb1lc Ifforks, submltting a letter f?om the PaciflcTelephone arrd Telegraph company, ln whlch the Telephone Companyadvlsed that durlng the constnuctlon of an undenground condultalong the westerly side of EI camino Rea1, between sanchez andLlncoln Avenues, a eucalyptus tree has been found to be decayedbelow the gnound llne. The eommunlcation requested permissibnflom the Clty. Councll to remove the tree pnlor to any ad.dltionalexcavation. The Dlrector of Publlo Works- ln his comiltunlcatlon recornmended that permisslon be granted. Questioned by members ofthe councll as to whether the tree was hazardous, pa::k supenLn-tendent Anderson advlsed that lf the wonk contempLated by- theTelephone Company p::oceeds, the tree would become a hazard. The motlon was seconded by'Councllman Love and unanimously car::Led. Mayor Byrd was temporarlly excused flom the meeting at this time andthe Chalr assumed by Vice-Mayor Slmonds. A letter dated January 26, 1955, w&s read from G. J. Marr, Dlrectorof Publlc works, submitting eoples of a revocabre permit f?om thesan F?ancisco Tfater" company, for the temporary lnstallatlon of a sump plt and pump on the san F?ancisco lt{ater" company property atCalifornia Drive and MaJ111a Avenue. Questloned by the Councll asto whether the nr:rnp would be statloned on Califonnie Dnlve, CltyEngineer Marr stated that lt may be removed to whenever it ls need-ed, but as tLre sump plt would be located on private property, itwas necessary to obtaln approval. Councllnan Love introduced thepassage of Resolution No. 8-55, authorizlng tJle Mayor to execute theagneement and permlt f?om the Clty of San Fbanclseo, seconded byCouncilman Morgan and unanimously adopted upon no11 ea1l of memLenspresent. A letter dated January 23, 1955, was read J?om the Burlingame Ctvl1Service Employees t Assoclation, requestlng that a State Retinement System acturial survey be conducted. The Clty Clerk was lnstructedto reply to the Employees t AssocLation stating that a representat-lve ftom the Council will eonfer wittr the AssoclatLon at a laterdate. A letter dated January 19, 1955, was read f?om the Offlce of clv1lDefense, requestlng authorlzation to purchase a siren and necessarTrequlpment in the amount of $4OO.OO, ?5% of whlch will be reimbunselfrom ttre Staters partieipating flrnd following the completl.on of theinstal-Latlon. The communi.catlon ftrther requested the purchase ofa siren to be lnstalled in Washlngton Park; three two-way radlos tobe installed on city equipment and a chest of :rescue tools to bestored for ressue teams. CounclLrnan Atwate:: moved that the slren,according to the terms outllned ln the letter, be purchased, second-ed by Councilman Morgan and unanlmously ca:rrled. Councilman Atwaterfurther moved that the second request for the purchase of materialsbe taken under advisement, second.ed by Councllman Morgan and. uaan-lmously carcled. A letter dated Jarurary 29, 1955, was read from Chanles E11et, ownerof property located at 324 Lorton Avenue, requestlng a.n aud.Lence be-forg the,Clty Councj.l to discuss th-e- lmprovement of the propenty andto i-ntroduce & prospectLve buyer. Mr, EI1et, in attendanee, adirlsedthe the prospective buyer was not present but the latten desired touse the orlglnal remodellng plans and lt was nequested that the Coun-ci1 reconsider and appnove the prevlous plans submltted. MP. E1let was infonmed by member.s of the Councll that inasmuch asthe matter has been pending for some tlme, the Council were opposedto fu::ther deIay. Councilman Morgan moved that the Councll rejectMr. -811etrs request, prohlbiting either Mr. E1let or a prospectLvebuyer to submit plans for the improvement of the propertyr secondedby Councllman Love and unanimously carried. Mayor Byrd, reappearlngat the meeting, moved that the Councll grant ldr. E11et forty days inwhLch to apply for a buildlng permit ln conformlty w:ith plan rnumber twor dlscussed at a previous council meetlng, and if, witnin thatperiod a permit 1s not lssued, the Councll proceed with eondemnatLonof ttre property. Tl:e motion was seconded by Councllman Love and un-anlmously carrled. Mayon Byrd assumed the Chair following a vote onthe motion.
