A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME APPROVING
THE VESTING TENTATIVE MAP (PM 22-02), LOT COMBINATION AND RESUBDIVISION
OF PARCEL 2 AT 810/821 MALCOLM ROAD AND 1669/1699 OLD BAYSHORE HIGHWAY;
AND FINDING THIS ACTION IS EXEMPT FROM CEQA PURSUANT TO STATE CEQA
GUIDELINES SECTION 15061(B)(3)
The City Council of the City of Burlingame resolves as follows:
WHEREAS, the legal description for this map action is a lot combination and resubdivision
of parcel 2 of parcel map filed June 15, 1989 in Book 62 of parcel maps at page 37, San Mateo
County records, and parcel A, lots 1, 2, 33 and 34, block 4, Map of East Millsdale Industrial Park
No. 2 Subdivision; and
WHEREAS, Burlingame Municipal Code Chapter 26.08 governs the process of approval
of tentative and final maps; and Section 26.08.020 requires that the Planning Commission make
a recommendation regarding approvals of tentative maps prior to consideration by the City
Council; and
WHEREAS, At the October 24, 2022 meeting, the Planning Commission reviewed and
recommended approval of the above described vesting tentative map by 4-0-3 vote; and
WHEREAS, the Public Works Department has reviewed the above described vesting
tentative map and recommends that the City Council approve the above described vesting
tentative map with the following conditions:
1. All frontage sidewalks, driveways, and curb and gutter within in the public right-of-way
shall be replaced with new improvements.
2. The existing structures must be demolished before the map can be recorded.
3. No raised structures shall be constructed in the public right-of-way.
4. A final parcel map must be filed by the applicant within the two-year time period as allowed
by the Subdivision Map Act and the City’s Subdivision Ordinance.
5. Proposed abandonment of public utility easement must be approved prior to map
recordation.
6. Relocation of a private storm drain easement for the benefit of 1755 Old Bayshore
Highway and separate instrument for its abandonment when dominant tenement
redevelops.
7. Proposed driveway easement for the benefit of 810 Stanton Road must be recorded with

the County prior to map recordation.
8. No developmental approvals are part of this mapping action.
9. All property corners shall be set in the field and be shown on the map.
10. The final map shall show the widths of the right-of-way for Old Bayshore Highway, Malcolm
Road, Stanton Road, Mitten Road, and Gilbreth Road including the centerlines of right-of-
way, bearings and distances of centerline, and any existing monuments in the roadway.
11. Project shall dedicate public pedestrian access easements surrounding the project site.
Ownership and maintenance shall remain with the development.
12. Permanent stormwater treatment measures and maintenance agreements are required
for each parcel. Agreements shall be recorded with the County prior to building permit
sign-off.
NOW, THEREFORE BE IT RESOLVED, DETERMINED AND ORDERED BY THE
COUNCIL, AS FOLLOWS:
1. The Vesting Tentative Map (PM 22-02) is approved with the conditions described
above.
2. Staff is directed to verify that all conditions of approval are met and arrange for the
recording of the Vesting Tentative Map.
3. This resolution is exempt from the California Environmental Quality Act (CEQA)
pursuant to State CEQA Guideline section 15061(b)(3), as it can be seen with
certainty that approval of the tentative map will not have an impact on the
environment.
