PROIOSED SENATE BILL NO. }368 (San Mateo County Flood Control Dlstrict)
Mayor Johnson announced that the adJourned meetlng was cal-led for tho
purpose of discussLng the posltlon of the Clty of Burl lngame ln rela-
tlon to the proposed fonmatlon of a Sen Mat€o County Flood Control
Board.
A telognam received from Louls I'rancis, Assemblyman, 25th Dlstrlct,
was read, requestlng th6 Counclf to advise by June 5, 1959, whether
ther:e are obJections to Sonate 8111 No. 1568, as amendecl, estab-llshing a Flood Control Board rvithln the County of San Mateo.
Excerpts were r6ad from the mlnutes of December 15, 1958, recordingthat the Counc1l, upon belng advlsed of the proposed leglslature
ostabllshlng the San }lateo County Board of Sup rrvlsors as the govern-
lng body of a San Mateo County Flood Control and rtr/ate!. ConservationDlstrlct, had endonsed the proposal ln prlnciple, provlded the Clty
of Burllngame 1s glven credlt for expendltures made and obllgations
lncurred prior to the formatlon of the dlstrict.
The City Attorney advlsed that Sectlorl 22 of the Senate 8111 No. 1368provides a crodlt allorance to such cLtles performing fLood control
work by contract wlthln nLne years prior to the effectlve date of the
proposed loglslation; honevorr the Boaxd of Suparvisors sLraLl bo em-
powered to determine (1) whether the work ls an lntegral portlon ofthe Dlstrlct ptoject; (2) whlch portlon and whlch project is bene-flclal to the entlre zone; and (3) the amount of credlt to bo allowed.
fn response to Councll inqulr'les, the Clty Attorney explained theproposed creatlon of zones wlthin the Dlstrlct and the Board of Super-visors authorlty to levy separate assessments wlthln tho varLous zones.

posed zone, the City Attorney advised that tho B11l provides thattflfteen pencent of the voters may protest ln wrltlng to the Boardthe establishment of sald zono and ..... tf a maJor.ity ofthe voters vote agalnst tho lnclusLon of lts terrltory lt shall be

Followlng further dlscussion, a motion was introduced by CounciJ.man
Rooth that the Clty Attorney be lnstructed to wlre Assemblyman
Louls Francis, advislng that the Ctty of Burllngame has no obJectlonto the present B11I, as amendod, provlded no other: Clty wlthln theproposed Distrlct 1s permJ.ttod to be excluded through future amond-
mont s of the 8111. The motlon was geconded by Councllman Morgan
and unanLmously carrled.
