I,ORENZ ET'LOGY llayor Johnson announced the passing in death of Councilman and former Irlayor, Joseph II. Lorenz, eulogizing his devotion to duty as a member of the City Council and his service to the community at large. A telegram from Mayor Joseph Verducci, City of DaIy City, conveying the condolences of the DaIy City Council on the passing of Councilman Lorenz was read and acknowledged. None Ihe minutes of the previous meeting of October ?, L963, submitted to Council . were unanimously approved and adopted upon motion of Councilman Crosby and seconded by Councilman ceorge. Mayor Johnson advised that at an informal meeting. a membe r to filL the vacanry on the Council was selected unanirnously and requested that action be initiated to formalize the selection. Councilman ceorge moved that Werner H. Diederichsen, 750 Winchester Drive, be appointed to complete the unexpired term to April, 1964, filling the vacancy on the Council created by the passing of Councilman lJorenz. The motion was seconded by Councilman !4artin and unanimously carried. Ihe Oath of Office was administered by the City Clerk. Ur. Diederichsen in assuming his position, spoke briefly on his pride and humility in being selected to serve as a City Councilman and introduced his wife, uary. Garvey, San Mateo City Councilroan and a Director of the Peninsula Division, League of California Cities, hrho expressed condolences to the Council and to the citizens of the City of BurJ.ingame on the loss of Councilman Lorenz and extended congratulations and good wishes to nevrly appointed Council"man D iederichsen . Smith, total $59,1I3.90) was introduced for passage on motion of Councilman Itlartin, seconded by Councilman George and unanimously adopted upon Roll Call . COMIII'NICATIONS 1. REFERENCE TO PARK COMIT{IS S ION AC?ION A conununication from the Director of Public works, dated October 14, 1963, advised that his investigation with respect to correspondence mailed to business establishments in the 1800 block of El Camino ReaI, by direction of the Park Conunission, under date of August 21 , L963, has failed to determine an illegality in the placement of sidewalk and parking improve- nrents in the area. Itre Chair advised that medber s of the Park Cormission, under the impression that a "street tree" ordinaDce proposed some time ago had been adopted, were now cognizant that the comnunications lrere mailed in error and have advised that a retraction will be for*rarded to the parties concerned. To avoid a repetition of an incident in the future, Councilman llartin moved that all cornmissions be requested to cooperate by clearing their respective correspondence to an individual, individual s, an organization, or organizations, through the Office of the City Uanager. The motion was seconded by Councilman ceorge and unanfunously carried. 2. PARKING DISTRICT DEMOLITION WORK ACCEPTED lrhe city uanager referred to a communication dated October 4, 1963, forwarded by his Office to the La velle construction Company, concerning the withholding of palment due that company for Off-Street Parking District demolition !'rork, in view of pending litigation. Questioned by Council, the City lrlanager advised that claims have been fileil by the Telephone Company in the amount of $4OO.OO and by !1r. Bruno I{ariani, 248 Primrose Road, in the amount of $1O,0O0.OO for alleged damages resulting from bulldozer operations. Ihe City l{anager further advised that the La Vel1e construction company is adeguately protected by insuranee to meet any and all claims and it was his recqnrnendation that the work, performed satisfactorily in accordance with plans and specifications, be accepted and a warrant issued to the company. Acting upon advice of the City Attorney, Councilman Martin moved that the claims be rejected and referred to the construction company's insurance carrieri that the City Attorney prepare legislation accepting the work performed for Council's adoption at ttre next regular meeting and t&at in the interin, a payment be made to the La vel1e construction cotnpany. llhe motion was seconded by councilman crosby and unanirnously carried. CURRENT ESTIMATED POPULATION A communication from the City lilanager, dated Octobet 23. 1963, advised that the State Department of Finance, in a report requested by Council, has estimated the current population of the city of Burl ingame, Septeriber 1, 1963, as 25,700, an increase of L,664 over the last census figure of ApriJ. 1, 1960. ltre communication al-so submitted new figures in anticipated gas tax funds, distributed on a per-capita basis. Ihe corununicati.on was acknowledged, cotrunented upon and placed on file. 4. EDWARDS INDUSTRIAL PARK EASEI{ENT ABANDONI,IENT A communication from the Director of Public Works, dated October 10, 1953, advised that the City has no further use for tv/o easenents requested by the owners of the "Edwards Industrial Park" in the development of their subdivision and reconmended that each be officially abandoned. NO. 86-63 "Ordering the Vacation and Abandonment of a Certain Basements on Subdivision Map Entitled 'Edr+ards Industrial Park Burlingame San I{ateo county, California"' seconded by Councilman llartin and unanimously adopted upon Ro1l CaI1 of menibers. RESO],UTIONS CONTRACT EICHLER IIOMES RE: WATER CAPACITIES Ihe Director of Public Works, in response to Councilman llartin's ingui.ry, advised that the proposed agreement with Eichler Homes, Inc., to provide for the enlargement, increase in capacity and improvement of the City's lrater system is 1n proper and satisfactory form. RESOLUTION NO. 87-63 "Authorizin g Execution of Agreement with Eichler Homes, Inc., a Corporation, for Construction, Installation and Increase of Capacities of I'lunicipal Water System and for Sharing Cost" was introduced for passage on motion of Councilman ltlartin, seconded by Councilman crosby and unanimously carried upon RoII call of menbers. ORDINANCES Consideration thereof : ORDINANCE NO. 789 "Authorizin g the Issuance of Permits for the Burning of carbage i-n an Approved Incinerator" was given its second reading and upon motion of Councilman llartin, seconded by Councilman Crosby, said ordinance passed its second reading and was adopted by the fol lowing vote: Ayes: Councilmen: Noes: Councilmen: Absent Councilmen: Cro sby-Diede rich sen-George-aIohn son-ltart in None None IJNFINISIIED BUSINESS In reply to Councilman George's inquiry concerning a pedestrian bridge over Easton Creek at Cabrillo Avenue, the city Engineer advised that one bid received in the sum of $2,1OO.OO j.s in excees in his opinion and advised that his office is considering the place- ment of a used railroad flat car bed that may be purchased at a nominaL fee . 1. CABRILIO AVENI'E DRAINAGE Councilman Crosby introduced and moved the passage of !gE@. 353 I'NITED NATIONS DAY CELEBRATION The Chair announced that Council has received an invitation to attend a United Nations cel-ebration, San Bruno Park, Crysta1 Springs Road and CIT)ress, Saturday, October 26, 1963, 1:30 p.m. Mayor Johnson appointed Councilman Diederichsen to serve as Council liaison member to the City Planning Commission. Mayor ifohnson, alanes Case and criminals. on behalf of the City Council, cormnended Grarles Seril-, for recent heroism in the Police Officers apprehension of COI'NCILI4AN GEORGE TO ATTEND GOVERNOR CONFERENCE Councilman ceorge announced his plans to attend the forthcomj-ng Governor's Conference, Noveniber I, 1963, as "Disaster Preparedness. " students from Burlingarne Intermediate School and Capuchino High school ,in attendance, were welcomed by the Chair on behalf of the Council . ANNOI'NCEMENTS !1r. Granville Browning, General Manager, Burlingame Chamber of Commerce. on behalf of the President and the mernbers, compli:nented Councilman Diederichsen on his appointment to the Clty Council and as a point of interest, announced that Anerican Flags r+ill be displayed on sidevralks in the downtown area of Burlingame on fhursday, October 24, 1963, United Nations Day. llayor Johnson gave a brief report on the League of california Cities' Conference in San Francisco, October 2L, 22, and 23, particularly referrinq to a session on "sister city" participation and a session with respect to City Attorneys relationship with City Councils.
