The Chair announced that this was the time and place to conduct a public
hearing before the Council on an appeal submitted by Mrs. Edwin J.Marino, 75O wa1nut Avenue, to reseind the action of the Planning
commisElon, approving a variance permitting ltlr. A. R. carpenter to erect
an addition to his apartnrent building on property zoned R-I.
A letter dated September 4. 1963, was read from the City Planner, advisingthat the property consists of Ipts 22, 23 and one-half ot 24, frontingon the EI Camino Real and Lot- 2I, fronting on Willoe, Avenue i a twenty-five unit apartment fronting on El Camino Real is structurally soundbut in need of repair; a duplex and accessory buildings, fronting onWillow Avenue and on an R-I zoned lot is in poor condition. The applicant
proposed to demolish the duplex to add an "ell-ahaped wing" of elevenunits to the apartrnents, to modernize the apartment and to use Lot 21for a swimming pool. parking and open space (total coverage, 5L.5%;

The City Planner further advised that by a four to two vote (one
medber absent) the Comnission approved tie variance, vrith themajority concurring that the "reconstruction would result in a good
apartment building with ample open space as a substitute for therear setback r that the amount of supplied parking was proportion-ately greater than the presently available; that the uEe of theWillow Avenue frontage for garden, pool and parking vas not anintrusion into the R-1 District; that the removal of the duplex was
advantageous and that a hardship exists in the pecutiar shape ofthe property. "

It{r. A. R. Carpenter, the applicant, requested Council to considerthat the apartment itself is not encroaching upon R-l zoned property
and that there is more than adequate space to accomodate the construc-tion proposed on the property currently housing the duplex.

Mrs. Edwin ;f. !!arino, 75O Walnut Avenue, from whoae appeal thepublic hearing was scheduled on this occasion, subnitted to Councila petition, bearing the signatures of sixty-tr.ro reaidents andproperty owners on walnut Avenue and on WiIIow Avenue, opposing thepotential hazard with respect to parking and traffic, the "trendof converting R-l land to R-3" and the "precedents that have al-
ready b€en set to encroach upon the rights of owners of residential
properties . "
Mr. Ferd cebhardt, representing I|trs. Ruth essner, 1515 l{illow Avenue,
urged Council to uphold the zoning as provided in the Code and to
heed to the wishes of the residents lrith respect to denying the
variances.
!{r. James Carro1l, 848 Walnut Avenue. vice-President, BurlinganE
suburban Protective Association, read from a prepared statement,
opposing the variances granted by the Planning Commission and settingforth in considerable detail, reasrons to justify the opposition of
the organization to the proposed construction. A copy of the
statement wag aclnowledged and filed with the city Clerk.
Ur. H. V. Burton, 766 Walnut Avenue and Mrs. Bd\din J. lfarino, 750
walnut Avenue. also spoke personally in oppoeition to the grantingof the variances.
A copy of the propoEed project plan on file in the Office of the
City Planner, was reviewed and dieeussed, with particular notice
given to the "leEs than required open parking spaces."
Mr. Carpenter, at the conclusion of the reviev, of plans, announced
his intention to eliminate the construction of the swimming pool
to provide additional open parking spacea and landscaped areaE. A
brief discuEsion on the proposed revision in the plan indicated that
the open parking spaceE h,ould be only one, or possibly t\ro, less than
that provided in the ordinance requireflEnts.
A personal opinion exprensed by councilman George earlier in the
Proceedings, that a pergonal visitation to the eubject proPerty would
clarifir the iEsue, walt concurred in following a poll of Council and
the hearing was continued thereafter to the regular meeting of
Counci.l, Novenber 4, 1963.
At the request of Councj.lman Martin, Mr. CarPenter, the applicant,
congented to the submission of a new plot plan, elininatinq the
swimming pool and indicating additional open par)<ing sPaces.
1. REPORT ON DUUP CONTRACT NEGOTIATTONS
A communication tas acknoeledged from the City tlanager, dated October 4,
1963, reporting on a proposition submitted jointly my l.{r. R. Joly
and the Skilak oil conpany to operate the city Dump. fn essence,all the provisions stipulated in the present contract sha1l be
complied with. in addition to rrhich (1) the dumP rates shall be ad-justed to those imposed within the county; (2) the operator ahallretain the fees, furnieh dirt and be responsible for the dike, includ-
ing the dewatering; (3) the operator shall meet requirements outlined
by the City Engineer; and (4) the City to provide sufficient dirtto cover the refuse prior to the change in the present operation.
The subject was continued, pending additional study by the city
uanager fnd his recommendation to council at a later date.
PROPOSED ACQUTSTTTON WATER FRONT PROPERTTES
A comnunicatj.on from the City lt{anager, dated October 3. 1963, advisedthat the Burlingrame shore Iand company haE notified his office that
the city may acquire the 5.75 acres of water land either by : (1)
trading the city-orrned filled land of 2.976 acres for the 5.75
acres or b,y (2) the purchase of Eaid property at their appraised valueof 920s,000.00.

Baylands waterfront Comittee and their joint recommendation that(1) the trade be rejected; that (2) the City obtain an j,ndependent
appraisal; and that (3) the City seek to acquire the ten acres of
