Pre sent Absent council-men: Councilmen: MINUTES The minutes of the regular meeting of October 19, 1964, previously submitted to Council , were approved and adopted- BURLINGAME HIGII SCHOOT STUDENT LEADERS PRESEMATION. I"layor Martin acknowledged and welcomed representatives of the Burl ingame Eigh School Student Council, who, before the meeting was called to order, had presented the City Council with individual Burlingame Spirit Pins and Leaque Passes. Mr. Bill Berry, Senior Representative, introduced IvIr. In accepting the Resolution, Mayor Martin assured the students of Council's contj.nuing interest in their activities; members of the City Council, individually thanked the students, in acknowledging the presentation. I'layor lrlartin announced that this was the time and place. scheduled by prior action, to conduct a public hearing in the matter of changes and modifications Bayside Improvement District (increasing Assessment Number 42) - In reply to I{ayor Martin. Mr. Robert I{. Haiqht, representing the law firm of Wilson, Harzfeld, ilones and Morton, counsellors to the District, stated th at Resolution No. 134-64, approved by Council at its meeting of October 5, L964, provided for increasing Assessment No. 42 from $244,461.Oo to $276, t31 .00, and scheduled a public hearing for this present tj:ae wherein Council shall consider the increase of assessment and hear all persons interested therein. fihere being no one present desiring to be heard and no communications received, the hearing was declared closed. RESOLUTIoN NO. 147-64 "A Resolution Ordering Changes and llodifications Bayside Improvement District" $/as introduced for passage on motion of councilman Crosby, seconded by councilman .fohnson and unanimously adopted upon Ro1I Ca11, (increasing Assessment No. 42). PLEDGE OF AILEGIATICE 106 CERTAIN ASSESSII'IENTS REDUCED BAYSIDE II{PROVEI{ENT DISTRICT. RESOLITTION NO. 148-64 "A Resolution Reducing Certain Assessments Bayside Improvement District" was introduced for passage on motion of Councilman Johnson, seconded by councilman Diederichsen, and unanimously adopted on RoII Call, following advice from Mr. Robert Haj.ght (attorneys' representative) that Council need not conduct a public hearing when reducing the assessments. AWARD OF CONTRACT F\)R WORK I'NDER SCHEDI'LE I BAYSIDE III,IPROVEMENT D ISTRICT A memo to Council from the City llanager dated October 30. 1964, stated that the City's Select System of Streets has been approved by the State Highhray Comnission making possible the award of Schedule 1 Improvement Contract - Bayside Improvement District, with matching credit funds from the State. The memo further informed CounciL that the project engineer, Mr. Eoward Hickey. and the City Engineer, recommend awarding the contract to the low bidder, Kunz Paving Company, i.n the amount of $42,571.56. Mr. Hickey. in favor of involved. in reply to Council inquiry, confirming his recommendation Kunz Paving Company, described generally the improvements RESOLU:IION NO. 149-64 "A Resolution Of Award of contract Bayside Improvement District, Schedule 1" (Kunz Paving company in the amount of $42.571.56) was introduced for passage on motion of Councilman Johnson, seconded by councilman Diederichsen, and unanimously adopted upon Ro11 CaLl. ORDINANCE NO. 815 ELECTRICAL CODE. Ir{ayor l{artin announced that this was the time and place scheduled to conduct a public hearing on proposed ordinance llo. 815 "Adopting By Reference" The National Electrical Code, 1962 Edition, And Ordinance No. 1630 of the county of San I{ateo. Declaring the hearing opened, the Chair invited cotrunents from the audience. IIe stated that he lras informed by the Building fnspector that some cities, following the County Code. arrange for an examining board to be appointed by the county. but it was decided that the City would not wish to follow this procedure, however, should council decide otherwise, the code may be adoPted without the omission and a determination made at a later date. t07 The City Attorney stated, with respect to all of the safety features, that these have not been altered. In repLy to an inquiry from Mayor Iqartin concerning policing should the section not be included, Councilman Diederichsen, speaking from personal knowledge and experience, described State of California licensing reguirements applying to all persons employed as electricians. Councilman Diederichsen thereupon informed Council that the City's codewill not be endangered to any degree by reason of the deleted section. llhere being no further conunents and no communications on file, the hearing was decl-ared closed. The City Attorney advised Council this time since i.t was introduced and read. that the ordinance may be adopted at at a prior meeting for first reading ORDINANCE NO- 815 "An Ordinance Re pealing Sections 1423 ftrrough L42A, Inclusive; 1,760 Through 1766, Inclusive, and 23OO Through 2322, Inclusive, of the 1941 Ordinance code of the city of Burlingame; Adopting by Reference the National Electrical Code, 1962 Edition, and Ordinance No. 1630 of the County of San Mateoi Establishing Minimum Regulations for the Installation or Alterations of or Additions to or Repairs of Electric Wiring Systems and the Inspection Thereof; And Providing Penalties for its Violation" was given its second reading and upon motion of Councilman Crosby. seconded by Councilman ,Johnson, said ordinance passed its second reading and was adopted unanimously upon RoI1 call- The Building Inspector, in reply to Councilman Diederichsen, stated that copies of the San llateo County Code, in pamphlet form, are available in his office. COMI"IUNICATIONS 1. PLY}IOUTH-BLOO}4FIELD ROADS INTERSECTION. A conununication from the City Manager dated October 30, 1964, concerned a letter from l'liss llargaret Caulkins. Public Health Nurse, dated October L3, 1964, to the City Council requesting a traffic survey of the intersection of Plymouth and Bloomfield Roads to determine whether arterial stop signs should be installed. lliss Caulkins' letter referred to a recent accident at the intersection. The City Manager's letter reported the results of a Traffic Deoartment investigation: There has been one accident at the intersection within the past year; volume of traffie is not sufficient to install stop signs on either the main or the seeondary streeti there are large trees on corner properties which obscure sight distance somewhat at the intersection, Referring to code provisions regulating height and Locations of plantings on corner lots, t}le City Manager recommended procedures available to the City to secure full compliance with the code. Concurring with the reco[unendations, Council directed the City Irlanager to proceed accordingly. A request from Councilman ilohnson that lliss Caulkins be informed of the action taken v/as concurred in by Council-. 2. PARKING ON PRIVATE PROPERTY ADJOINING LoT K. fn a memo to Council dated October 30, 1964, the City tlanager reported that, as directed by Council, the Parking Commission reviewed the request of Mr. H. Kent Atwater for ingress and egress rights over Parking District 108 Lot K to an adjacent privately-owned parking areai the Commission concluded that it lrould not be possible to assure ingress and egress since the parking limitations would not be identical on each property. In his letter, the Ci-ty llanager suggested temporari.ly withholding the three public parking staIls in front of the adjacent property until after experience with the parking situation in the area r+hen a final decision can be made on the best soLution for the City; in the mean- tire, Mr. Atwater to be notified that the city is unable, at this tirne, to permanently guarantee access to the property. Council concurred, di.recting the City Manager to proceed accordingly. Itlayor Martin suggested to the city Manager that he discuss lrith the City Attorney possible ways and means of preventing acquisiton of rights of ingress and egress over the public parking area by a private party. 3. STATE EI.{PIJOYEES RETI REIIIENT SYSTEIT{ - COORDINATED SOCIAL SECURIIY-STATE RETIREI{ETiIT. A memo from the City Manager dated October 3!, L964, informed CounciL that Ur. Thomas crocker and Mr. alohn Brophy have indicated they will be present at Councj-l 's study meeting, Thursday, November 5, L964, to discuss the State Employees' Retirement System progr.rm and an ernployee-coordinated Social Security-State Retj.rement plan. Because of a possible conflict in dates with the North county Council meeting, It{ayor }Iartin, at the suggestion of the City Attorney, announced that council will meet in study sessj-on on Thursday, Novemlcer 5 at 8:OO p.m., or Saturday, Novedbet 7, L964, at 9:30 a.m., whichever date a quorum is present . Councilman ,Johnson suggested that the City employees receive notifj-cation of the meeting. 5. RAD IO TRANS!4ISSfON TOWER INSTALLATIONS A letter from the City Planner dated October 27 , 1964, was accorupanied by a letter from B.Lanche Dawydicak, 2A26 Tiburon way, dated october 25, 1964, protesting a radio transmj-ssion tower atop a private residence at 2813 Tiburon way, trlills Estate . Executive Director, urging the City Council's cooperation in a proqram to protect valuable scenic resources, was acknowledged and referred to the Planning and Park Commissions for study and report to Council . A communication dated October 22, L964, from James V. Fitzgerald, Chairman, San Irlateo County Board of Supervisors, and John S. Rosselli, President, llayors Council, San lt{.ateo County, extending an invitation to Council to participate in a sympos iurn on city-county covernment problems, convening at 9:00 a.m., Friday, Novemlcer 6, 1964, at Hyatt House, Burlingame, was acknowLedged, Council members expressing interest and indicating their intentions of participating. lfhe communication alao referred to an all-day session on crime in San tjtateo county, Thursday, Novedber 5, suggesting that Council permit department heads and off- duty police personnel to attend. The City l4anager was requested by Mayor llartin to determine whether Park comnission minutes can be furnished to Council more promptly. An inquiry by Councilman Johnson concerning minutes of the Parking Commission initiated a brief period of discussion, following which the City Clerk was directed to mail "Notice of Meeting" reminders to Corwnissioners and the City l4anager to inform Commission Secretary Bruce Kirkbride of CounciL's request for copies of the minutes. BURLINGAI,IE PLAZA SI{OPP ING CENTER. A memo to Council dated October 30. l-964, from the city Manager reported that in investigating the unsightliness of the Burlingame Plaza Shopping Center (reported by residents of the Mi11s Estate), it was determined that the area is under divided qr'nership; some owners cooperating with their tenants in providing a clean-up service, others do not. The City Manager's communication stated that an attempt will be made to obtain names and addresses of the various ovrner s to inform them of their responsibility in maintaining the appearance of the over- al-1 area. Mayor Ivlartin recognized Mr. E. L. Pierce, member of the City Planning Commission, who reLated his experiences, when President of the Uills Estate Home Owners' Association. to persuade, without success, the tenants and property ouners to maintain the area. Mayor Irlartin acknowl-edged a communication from the League of California Cities pertaining to a hearing in San Rafael, Noveniber L3, L964, l0:OO a.m., of the Assembly Interim Committee on ltlunicipal and County Government. 111 I'NFINISHED BUSINESS EMPIOYEES ASSOCIATION DUES BY PAYROLL DEDUCTION. In reply to an inquiry from Councilman Johnson concerning a request from the Burl ingame Civil Service Enployees Association that Council consider authorizing payroll deduction of Association dues, the City Attorney advised that it is his opinion that the procedure is 1ega1 with respect to any consenting employee, under certain conditions. The City Attorney referred to a 1961- addition to the Government code with respect to public employee organizations and suggested that information on rules and regulations adopted by the League of Cal-ifornia Cities should be helpful . Councilman Johnson requested the City Manager to inform !1r. iIules Francard, Association President, of the information furnished Council by the City Attorney, also to conununicate with the League of California cities so that the program may be initiated by the first of the year, if possible. BAYSHORE FREEI,iIAY WIDENING BROADWAY OVERPASS RECONSTRUCTION. In reply to an inquiry from Councilman Diederichsen concerning the widening of Bayshore F reeway through the city of Burlingame, recently announced by the State Department of Highways and the City's plans for reconstructing the Broadway Overpass Structure, the City Planner reported that the City's program will not be jeopardized since there is ample area within the present Freeway right-of-way to support the proposed widening. SISTER CfIT CELEBRATION ACKNOWI,EDGED. I{ayor l{artin commended Mr. Ben L. Hechinger, Chairman, and the members of the Sister City Comnittee, whose efforts made possible the highly successful program. during the week of October 19, 1964, honoring the visiting dignitaries from Cuernavaca, litorelos, Ivlexico, Sister City of Burl ingame . Itlayor Martin requested the City Clerk to direct letters of appreciation, over his signature, to the following persons for their participation in the program: Adolfo G. Dominguez, Consul ceneral of llexico; Horacio l{acalpin, Delegate l{exican Tourism Department; Senora Graciela Tapia, Cultural Attache, llexican Consulate. Councilman ilohnson, council liaison to the Sister city conunittee, described the event as one of burlingame's finest community affairs, far surpassing the expectations of all concerned. Noting that there are many letters of appreciation to be written, Councilman Johnson stated that she has been informed by Mr. Hechinger that he is sending a total of thirty-two letters to those who donated their time and services; selected photographs will be compiled into album form to conmemorate the event. Councilman Johnson, expressing a desire to recognize outstanding performance in the coNnunity's interest, introduced a motion that lhe City Council issue citations as follows: To !1r. Ben L. NEAI BUSINESS 172 Councilman Johnson commented that the Committee is hopeful that a gJ-ass display case will be provided in the City Hall for its Purposes. Mayor lqartin requested a list of the persons who will receive the Letters f rom I*1r. Ilechinger. The City lrlanager \.ras requested by lt{ayor }lartin to deliver certain photographs to Mr. George White, Superintendent, Burlingame Elementary Schools, for display in the schools, and other photo- graphs to Granville Browning, Executive Director, Burlingame Chamber of cofiunerce. for distribution to local merchants. Mr. iloseph Siemont informed Council of the potential hazards of an open tunne]- to the rear of the Hasty Tasty Restaurant, easily accessible to children. The City PLanner stated that lrlr.
