Council, were unanimously approved and adopted on motion of Councilman

1. BURI,INGAIVIE SHORE LAND COMPAIiIY VARTANCES
Uayor Johnson announced that this was the time and place to conduct a
public hearing on the variances requested by the Burlingame Shore
Land Company with respect to the proposed construction on property
betvreen the Broadway Access Road and Carolan Avenue, said hearing
continued from tlre regular meeting of llay 20, 1963.
A communication from Cyrus af. Mcl*lillan, Attorney, representing the
developers, dated May 29, 1963, was read, requesting a continuance of
further hearings or proceedings on the application for rezoning and
variances presently pending, for a period of time until the existing
vacancy on the City Council has been filled.
Councilman Uartin briefly reviewed the position of the Council and in
indicating his objeetion to the reclassification, stated that a two
to one vote would not meet the "three affirmative votes" fegally
required to affect the zoning change.
Councilman llartin suggested that a presentation made under new hearings
conducted on the reclassification may better serve the interests of
the subidivider or that a time period be granted to permit the attorneys
to resolve the lega1 status of the issue.
Upon advice of the city Attorney, concurred in by the Attorney for the
project, Councilman tlartin moved that the hearing on the variances and
action upon Ordinance No. ?83, reclassifying the property. be continued
to the next regular meeting, 'June L7, 1963. Ihe motion was seconded by
Councilman Crosby and unanimously carried.

1. WATER POLIUTION CONTROT BOARD SAI{PLING PROGRAM
A conrnunication from the City !4anager, dated May 31, 1953, referredto conununications received from &1r. ifohn B. Harrison, under date of
May 17, 1963 and enclosing the water pollution Board's detailedspecifications for the 1963-1964 fiscal year waste characterization
program, and from the City Engineer, summarizing the requirements
set forth by the Control Board and the recommendations of his Office
to meet said requirements .
Councilman Martin moved that $1 ,OOO,O0 be reserved in the L963-1964
budget for the expenditure as recontrnended by the City Engineer and
that the City Manager be authorized to respond to the conrmunication
received from the Water Pollution Control Board- fhe motion was
seconded by Councilman Crosby and unanimously carri.ed.
Councilman llartj-n questioned the extent of authority vested in the
water Pollution control Board and the action that may be taken
should the city fail to comply with requirements.
fhe citlz Attorney, at some length, described the powers of the
Regional Board as provided by the Statutes of the state. Cities
must make such eorrecLions as the Board may require; the ControL
Board does not have 1ega1 counsel , however, violations of any of
the requirements by a person or in this instance, a "eity, " is
considered a misdemeanor and subject to prosecution by the Office
of the Distriet Attorney.
lfhe City Attorney quoted from Section 13055 of the water
granting authority to the Board to investigate pollution
stipulating the technical reports that must be furnished
accordance with the specifications of the water Pollution
Code
and

Control Board.
The Clty Engineer recommended that $1,OOO.0O be appropriated in the
1963-1964 fiscal year budget to finance labor, supplies and material
expenditures necessary to the sampling program required by the
Water Pollution Board.
Ihe City Attorney stated that the problem is one being shared by all
cities and suggested that perhaps it may be a proper subject to
bring to the attention of the San lilateo County Council of llayors.

2. REPORT TO BE SI'BIIITTED TO WATER CONTROL BOARD
A cormnunication from the City Manager, dated l{ay 31, 1963, advised
that a report must be submitted by June 14, 1963, to the water Pollution
Control Board, describing the status of the City DumP in complying
with its requirements together with a coPy of the City's monitoring
analyses for the first week of June, 1963.
Council concurred with the reconmendation of the City ltanager that
a report be submitted advising of the efforts of the City in sealing
the berm around the City Dump and that a request for a continuance to
August 1, 1963. to complete the project, including devratering of the
area within the berm, be forwarded to the water Pollution control Board.
In reply to council inguiry, the City Engineer explained the procedure
thus far in filling in and sealing the benu around the dump area,
subsequent to which the city shall be in a position to dewater within
the berm. Itre City Engineer advised that the issue is purely one of
an aestbetic nature, wherein the Water Pollution control Board is
empowered to require that the City eliminate pollution and a nuisance
created by odors.
3. PUBLIC ROAD TROUSDALE TO SKYLINE
A corununication flom the City Manager advised that in accordance r^rith
the Streets and Highways Code, the City is required to adopt a
resolution requesting the State Eighway Conmission to authorize apublic road connection from Trousdale Drive to Skyline Boulevard.
RESOLUTION NO. 40-63 "Re questing California Highway Cornmission to
Consent to Connection of Trousdale Drive with Skyline Boulevard" was
introduced for passage on motion of Councilman Crosby, seconded by
Councilman Marti n and unanimously carried.
4. CONTRACT PERSONNEL SERVICES RENEWED

A comnuni.cation from the Burlingame Chamber of Conunerce, dated
June 1, 1963, submitting a proposed Contract between the city of
Burlingame and the chamber of commerce for 1963-1964, was acknowledged.
RESOLUTION NO. 41-63 "Authorizing Execution of Contract for Advertising
and Promotion" was introduced for passage on motion of Councilmanllartin, seconded by Councilman Cro sby and adopted unanimously by

8. PLANNING COMIT{ISSION POLIry WATERFRONT DEVEIOPI{ENT
A Resolution, No. 2-63, unanimously adopted \z members of the
Burlingame Planning Conmission on May 27, 1963. detailing its
"Policy on waterfront Development" was unanimously endorsed and
approved by the Council- on motion of Councilman Crosby and seconded
by Councilman lrlartin.
9 REI,IOVAL OF ALUOND TREE PROTEST
A comnunication from Mrs. Aline Lorenz, 118 Occidental Avenue, dated
June 1, 1963, requesting Council to retain a largre almond tree on
City property to be converted into a parking facility, was referred
to the Off-Street Parking District Committee.
A communication from the City Uanager, dated May 31 , 1963, advised
that C.P.S. Hospitalization Insurance Rates will be increased due
to the heavy usage of the service by employee dependents and
recorunended that the City increase the contribution of an employee
from the current $6.00 to $7.47, the reby financially assisting
employees whether with or without dependents.

A comnunication from John E. Lynch, representing the law firm of
l{ilson, Harzfeld, Jones & l4orton, dated uay 31 , 1963, advised that
a settlernent has been effected on Parking District lots owned by
Grant Sv/eet, et al , and reconutended that a resolution authorizing
the palment of $63,000.00 be adopted.
