Mayor Martin referred to a comnunication from the City llanager advising
that the Director of Public Works has informed his Office that the
Select System Map designating the various arterial and collector streets
within the City, will be approved by the llighway Commission at its next
meeting and that in conjunction with the Bayside Improvement District,
a portion of Anza Boulevard is designated as one of the select system
streets, the City is entitled to matching credit funds for the construc-
tion of the street.
It was reconunended by the City Manager and the City Engineer, in order
to qualify for the matching credit, that the contract for performing
work under Schedule X of the Bayside Improvement District, be withheld
at this time.

The City Manager advised that the low bids are below the amounts
appropriated by counciL for said purchase and his recommendation
that purchase orders be issued to the ifones-Minto Ford Sales Company,
the 1ow bidder, was concurred in by Council .
There being no one present to object and no communications received,
the hearing was declared closed.

RESOLIITION NO. 142-64 "Orderin g Destruction of Noxious and Dangerous
weeds and Rubbish a Nuisance in the City of Burlingame" was introduced
for passage on motion of Councilman Johnson, seconded by Councilman
crosby and unanimously carried.
2. DR. NICHOLAS POPOV VARIANCE APP EAL
Ivtayor llartin announced that an appeal from the decision of the Planning
Commission granting Dr. NichoLas Popov a variance to permit a rear waII
five foot property line setback, would be considered by Council on
this occasion -
A communication was read from the City Pl-anner, dated October 5, 1964,
relating the history of the lot and advising that in 1958, an amendment
to the ordinance code, qualified this particular lot as a 1ega1 lot;
the zoning, in effect since 1941 is R-2, DupLexi the request for a
variance results from the peculiar trj.angular shape of the 1ot and
the proposed building meets front and side setback requirements but
the rear wa1I is five feet from the angular line at the south side;
the average rear setback exceeds the required fifteen feet.
Mayor Martin declared the hearing opened and invited Dr. Nicholas
Popov, the applicant requesting the variance, to speak.
Dr. Popov confirmed that the property is appropriately zoned to
construct a duplex. and only a smal1 portion of the rear setback is
less than the requirements; at the time the variance was before the
Planning Conunission. the property owners in the neighborhood entered
objections mainly on the basis of parking and traffic conditions.

T'he City Planner, in reply to the Chairrs inquiries, advised that a
portion of the rear structure i"s five feet from the angular line and
the remaining portion of the building averages more than the required

an additional parking space provided on a section of the 1ot.
The City Planner further advised that considerabLe discussion arose
before the Planning Conunission on the off-street parking problems,
at which time he advised that he would refer the matter to the Police
Department i a reply from the latter advised that follo\^ring a survey
of the area, "no particular problem" was indicated.; however, the
street is narrow and the only solution would be to "prohibit parking
on one side of the street. "
Urs. Uarietta Pratt, 919 Capuchino Avenue, IUrs. Anna Pay, 9I8 Capuchino
Avenue and lr{r. Pio L,anini, 914 Capuc}rino Avenue, the appellants,
spoke on the parking inconveniences and hazards to the residents in
the area, with Mrs. Pay calling particul"ar attention to the prevalence
of cars using her driveway as a "turn-around." at the dead-end of the
street .
From the Chair's inguiries to the City Planner, Council ascertained
that the property is a lega11y zoned R-2 Duplexr a 1ot coverage offifty percent is permissible; (applicant to use less than ttre require-
ment) and only one corner of the 1ot does not comply with ordinance
regulations.
Councj-1 individually expressed a sympathetic reaction to the incon-
venience to the residents by parking conditions. wi.th Mayor ltartin
reconunending that the subject of parking hazards be referred to the
Ilealth, Safety and Traffic Corunission and to the Pol-ice Department
for investigation and recommendation.

A motion was thereafter introduced by councirman Johnson that theFindings of the planning commission be upheld and that a buildingpermit be issued to Dr. Nichoras popov. The motion was secondedby Councilman Crosby and unanimously carried.

A comrnunication from the City Manager, dated October 16, L964,advised that L- c. smith co., contractor, has satisfactoriry compreteoall requirements of the plans and specifications for the californiaDrive widening and it was recommended that the project be accepted.

2. CALIFORNIA DRIVE PARKING REGULATIONS
from the City Uanager, dated October 15, L964,
following regulations wj-th respect to California Drive:

Drive from Oak Grove Avenue to North Lane be eliminated;
2. That no change be made on the east side vitrere parking has beenprohibited; and
3. fhat legislation be directed to permit parking on the west side
between 4-6 P.M.
The City Manager also advised that the off-street parking area used
by commuters is not filled and the newly widened section of
California Drive should not be used by the corunuters.
Council concurred with the recommendations and the City Attorney lras
directed to prepare the necessary legislation for Council action.
A communication from the City Manager, dated October 15, 1964,
advised that the Reynold C. ilohnson Company, operating a volkswagen
parts warehouse j-n the East Mi1lsda1e Industrial area, has requested
permissi-on to lease a fifty foot strip of land owned by the City
and used as a drainage ditch.
The Johnson Company proposes to construct a culvert in accordance
with requirements set forth by the City Engineer, to bridge the
ditch to provj.de an ingress and egress to the rear of the warehouse
to permit all shipping and receiving of merchandise and thereby
eliminate traffic congestion on Burlway Road.
It was recommended by the city Manager that the city indicate its
intention to cooperate providing all interests of the City are
protected and that the City Attorney be directed to prepare a proper
document for Council's review and action.
COMMI]NICATIONS
3. PERIIISSION TO USE CITY DRAINAGE DITCH
Mr. A- w. Hansen, Executive Vice-President. Relmold C. Johnson Company,
in attendance, and replying to council inquiries. advised that his
company is agreeable to negotiating with the city Itlanager with
respect to an appropriate fee to lease the parcel on a tvrenty-five
year basis; that the proposed pJ-an will eliminate trucking hazards

Follovring further discussion, Councilman Johnson suggested that the
Ordinance affecting the change be introduced on this occasion with
Council reserving the privilege of determining final disposj.tion at the
second reading of said ordinance.
Council indicated no obj ection and ORDINANCE NO. 816 "An Ordinance of the
City Council of the City of BurJ.ingame Authorizing an Amendment to the
Contract Between the City Council and the Board of A&ninistration of the
California State Retirement System" was introduced by Councilman Johnson
for first reading.
5. PARKING IIII,IITATIONS ].OT K LOT C LOT E
A communication from the City Irlanager, dated October 16, 1964, advised
that the Parking Conunission has recommended that Lot K, Lot C, Lot E
and the balance of Lot E, remaining core area lots recently improved,
be restricted to two-hour parking lfunits between 9:30 A.M., and 6:00 p.!I
Council concurred $rith the recommendation d the City llanager that the
City Attorney prepare legj-slation to effectuate the restriction in
parking hours.

Some discussion arose on an appropriate policy in which to operateparking lot facilities, with the consensus of opinion beingf that it
may be best determined on a "trial and test,' basis for possibly aperiod of one year.

Mayor ltlartin referred to a copy of a letter addressed to the Eealth,
Safety and Traffic Corunission from the Burlingarne uills E6tate Eome
On'ners' Association, citing the unsightly appearance and health
menace prevalent in the Burlingame Mi1ls plaza area.
The subject matter was referred to the City [Ianager,
Councilman Crosby initiated a brief discussion on the unsightly appear-
ance of the Burlingame Avenue-California Drive area and questioned
the frequenry in which the street sweeper operator clears the area.
Ihe City Manager suggested that overnight parking of vehicles
registered to guests of a nearby hotel may be hindering early
morning sweeping operations.

Project was made to First Arizona Company in error. The correct award
should have been made to cross and company as the highest responsible
bidder. The Resolution of Award of Bonds was correctly filled in with

1. SISTER CITY INFORMATION
Councilman ,fohnson requested that the City Manager direct a communication
to the California League of Cities advising that the City of Burlingame
and the City of cuernavaca, IrloreLos, l,lexico. are affiliates through the
establishment of the "People-to-Peop1e Program. "
Mayor I{art in suggested that the City }lanager also advise the American
Municipal Association of the affiliation of the two cities.
A schedule for the forthcoming visit of dignitaries from Burlingame's
Sister City. Cuernavaca, was reviewed with respect to the program
and meeting places of scheduled events.
Councilman George expressed his pleasure on the response of the merchants,
the private individuals and the City employees who contributed funds
tourard the support of the Sister city Program.

A Council study meeting was scheduled for Thursday, November 5, L964,
at 8:OO p.m. The City !1an3gs1 hras requested to invite Mr. ilohn Brophy
to be present to discuss the Social Security-State Retirement System
coordinated p1an.
