HEARING BAYSIDE II.4P ROVEMENT DISTRICT
tlayor ltlartin announced that a public hearing on the proposed "Bayside
Improvement District" would be continued at this time from its initial
hearing on Septedber 24, 1964.
A comrnunication was read first from the City Planner, dated October 2.
1964, advising that the request of the Burlingame Shore Land Company
(one of the petitioners to the proposed District) for a six months'
extension of variances granted septedber, 1963, referred to the
Planning Commission, sras approved at its reqular meeting on Sept. 2A,1964.
Ir1r. Harold N. Blake, Attorney, representing the law firm of Wilson,
Harzfe1d, Jones and llorton, Iegal counsellors to the proposed District,
advised council of the procedure appropriate to the continuation of
the hearing and the Chair thereafter called for the reading of written
cormnunications.
A letter was read from John A. Cost, Attorney, dated septetdber
written in behalf of his client, Mr. Robe rt Williams, owner of
Peninsula General- Tire Company, Inc., LO47 Broadway.

fhe communication expressed concern with that phase of the assessment
district \^rith respect to the paving of Carolan Avenue in which his
client shal1 be (1) deprived of twenty feet of working spacei and(2) forced out of business if normal curbing is installed and cars
are unable to have ingress and egress to and from the various stal1s.
l,lr. Blake suggested that the installation of a row of curbs be
considered at the time improvements are underway.
Mayor Martin exPressed a sympathetic reaction to the problem presented,
stating, however, that the business is being conducted on a City-owned
right-of-way and paving work should not be deterred. It was suggested
by the Chair that the project engineer and the City Engineer confer on
a possible solution to assist Mr. Wil1iams.

Following a brief discussion, Mr. Blake expressed the opinion that
a reasonable compromise may be accompl ished.
There being no further comtnunications to be read and no oral presen-
tations, the hearing was decLared concluded.
Resolut ions appropriate to the procedure were explained by Mr. Blake
and action taken as follows:

I. CUERNAVACA DEI,EGATION TO VISIT CITY
A communication was read from Presidente Gor.zalez, Itlunicipal de
cuernavaca, dated October 2, 1964, advising that a delegation of
ten will arrive to participate in the Sister city celebration
scheduled October 21, 22 and 23, 1964.
APPEAI RE: VARIANCE GRANIED DR. POPOV
A communication, dated septedber 30, L964, bearing the signatures
of five residents of properties adjacent to 909 caPuchino Avenue,
was acknowledged and an appeal to Council to overruLe the decision
of the Burlingame Planning commission with respect to a variance
granted Dr. Nicholas Popov, \^ras set for public hearing before the
Council on October L9. 1954.
3. POLICE RE: I,oT AD,JACENT TO LIBRARY
A colununication was read from the City llanager, dated october 2,
1964, advising that the grading of the city-owned lot adjacent to
the Library is necessary to avoid drainage problems and reconmend-
ing that a decision be made on $rhether temPorary planning and
construction should be undertaken.

for a period of five years, a standard parking Iot installation is
justified.
Considerable discussion arose on the advisability of improving the
lot prior to the earking District' s acquisition of the adjoining
steinbeck property, currently under negotiation processing.

Council thereafter concurred with Mayor Martin's suggestion that the
City lilanager request the negotiator to expedite the acquisition of the
Steinbeck parcel and that the City Engineer prepare plans and specifi-
cations to include both parcels as one unit and to advertise for the
receipt of bids October J-9, 1964.
4. ATTORNEY TO ACCEPT 'QUIT CLAIM DEEDS''
A communication from the city Manager, dated october 2, 1964, advised
that Mr. John Lynch, representing the law firm of Wilson, Earzfeld,
Jones and Morton, has requested the passage of a resolution authorizing
the "attorney of record to accept qult claim deeds" in connection with
the acquisition of Parking District properties.
RESOIUTTON NO- 135-64 "A Resolution Authorizing Attorney of Record to
Accept Quit Clain Deeds" was introduced for passaqe on motion of
Councilman Johnson, seconded by Councilman crosby and unanimously
adopted upon RoII Call.
5. I,IILLS ESTATE PARK INSTAI,I,ATION ACCEPTED
A communication from the city lqanager, dated October 2, 1964, advised
that the San ,fose Steel co., has satisfactorily completed the fence
and backstop installatj.on in fu11 compl iance with plans and specifications.
A reconmendation from the Office of the City Manager and the Office of
the City Engineer that the project be accepted was concurred in by
Council and RESOLUTION NO- 136-64 "Accepting Installation of Fence
and Backstop at Alcazar Park - Job No. 64-2A" was introduced for
passage on motion of Councilman Crosby, seconded by Councilman
Diederichsen and unanimously adopted upon RolI ca1l.
6. PARKING EAST SIDE CALIFORNIA DRIVE
A communication from the City Manager, dated October 2, L964,
that a questi.on has arisen concerning the parking of vehicles
easterly side of the newJ-y widened area of California Drive.

A cornmunication from the city Manager. dated October 2, 1964, referred
to a cornmunication from !1r. llhomas F. Crocker. Assistant Actuary, State
Retirement System explaining the coordination of Social Security with
the City's State Retirement plan and the legislation necessary to execute
the coordinated coverage.
In reply to Council inquiries, the city llanager advised that the sum
of $5, 8OO . O0 and the approx.imate srim of $10 , OO0 . 00 represented the
City's share in the cost for the balance of the year and the forthcoming
year respectively and the adoption of an ordinance authorizing an amend-
ment to the contract is necessary prior to Decedber 1, 1964.
The City Itianager's statement that a vote taken among the employees
qualifying for the coordinated coverage indicated fifty percent in
favor and fifty percent against initiated a brief discussi.on wherein
the City llanager advised that the enployee's choice was based on an
evaluation of factors peculiar to the individual employee.

Ueribers expressed hesitancy to take an action without further study
and Council thereafter concurred with the suggestion of the Chair
that the subject be withheld until the regular meeting of October 19,
1964, with a study meeting scheduled during the i.nterim.
RESOLUTIONS

setting forth October 19, 1964, as time of public hearing, was

A request submitted by the Burl ingame Civil Service Bnployees'
Association, Inc.. for Council consideration in authorizing the
deducti-on of Association dues by payroll rnethod was referred to
the City Attorney for 1ega1 determination.

A communicatj-on was read from Eichler llolnes, dated Septetnlcer 3O,
1964, requesting an extension of tifie for completion and accePtance
of !1i11s Estate Unit 19 improvements.
The City Engineer indicated no objection and a motion was introduced
by councilman Crosby, seconded by Councilman .Iohnson and unanimously
carried that the request as stipulated be approved.
2. R.ESOLUTION PROPOSED BY CITY OF PORT IIUENEIqE
A resolution proposed by the City of Port Hueneme with resPect to
State Proposition No. 14, \.ras held for further study.
3. PENINSULA T}IEATRE DISPIAY
A communication from Mrs. Bruno Hammari, 724 Fairfield Road, protesting
the current motion picture display at the Peninsula Theatre hras
referred to the city uanager.

ACKNOWTEDGMENTS
The Chair acknowJ.edged receipt of the l{inutes of the Planning Commission
and in behalf of Council commended the City Planner for his brochure,
"Guide to Planning Commissioners. "
The Chair further acknowledged receipt of a comnunication from the
National llunicipal League announcing the TOth National Conference
on Government, to be held in San Francisco. Novedber tB - 21.
Mayor lrlartin introduced former Mayor and Councilman, U. S. S jronds, Jr.,
who. in turn, compl jmented Council and the administrative officials
on the completion of the widening of California Drive. Mr. sironds
suggested that the area bet\.reen the boulevard and the railroad tracks
be removed of al1 debris and a beautification progrirm initiated.
PARKING AREA ADJACENT TO '' I,OT K''
Mr. H. Kent Athrater, Burl ingame Realtor, representing urs. N. Forsythe
Bradley, referred Council to a privately-ohmed "landlocked" parcel
forty feet by seventy feet adjacent to Parking District Lot "K" and a
request from the owner that the property be included within the parking
plans for Lot "K" .
Mr. Atwater advised that the owner proposes to improve the property
to create four additional off-street parking spaces.

proposed would eliminate three public parking spaces and create

levelling a portion of the Primrose Road alley-way leading to Lot "K".

the portion referred to by Councilman Crosby is privately-owned.
In reply to councilman crosby's inquiries, the City Manager advised that
the agency engaged by the City to prepare feasibility reports on a pro-
posed golf course is currently working on preliminary plans to be
submitted to Council .

Ihe meeting was regularly adjourned at lO:15 p.m., in respect to the
memory of Sergeant James Kennedy, a member of the Burlingame Police
Department for the past twenty-two years, vrho passed in death on this
day, on a motion introduced by Councilman Johnson, seconded by
Councilman Diederichsen and unanimously carried.
