CALL TO ORDER
A regularly adjourned meeting of Hay 5, l!61, was held on the above given date.

Hayor Johnson announced that this was the time and place scheduled to conduct
a public hearing on proposed Ordinance No. 782, "Adopting by Reference" the
l.restern Plumbing Officials Uniform Plumbing Code.
There being no one present to enter objections or to speak in favor and there
being no correspondence received, the public hearing was declared closed.

COHXUN ICATIONS
I. PARK ING LOT OPEN ING (ttil lbrae S. P. oepot)
A conrnunication from the City Hanager, dated l.lay 3, 1963, advised of the approximate
cost of partially improving an area within the City of Burl ingame adjacent to the
Millbrae Southern Pacific Station, suggested as a parking convenience to cormuters.
Council concurred with the recormendat ion of the City Hanager that the subject
be referred to the Traffic Department and to the Health, Safety and Traffic
Cormission for report to Counci l.
A communication from the City Manager, dated Hay 3, 1963, advised that the
Regional l,Jater Pollution Control Board has scheduled June l, 1961, as the date
requiring the City to cease creating sulfide violations in the City dump area
and additionally requiring that the enclosed area be dewatered.
A brief discussion concluded with Counci I concurring with a suggestion frorn
Councilman l,torgan that Hr. Wi lliam 0'Connel l, a specialist, be approached on
the subject of serving as an advisor to the City.
The City l,lanager was requested to cormunicate with Hr. 0rConnell to ascertain
whether he is in a position to assist the City and if so, the cost for his
services.
3. RECREATION SPEC IAL SERVICES
A cormunication from the City l.lanager, dated Hay 2, 1963, together with a
further breakdown of the Special Service Accounts in the Recreation Department,
was rece i ved.
Counci lman l{artin expressed dissatisfaction with the incomplete figures
indicated in the report of the Recreation Department.
2. REPORT ON REGIONAL WATER POLLUTION

The City llanager explained that it is a matter of minute accounting procedure
and that it may legally necessitate Council enacting an ordinance setting forth
fees for Special "l,l-40'' Accounts in the Recreation Department,
Following further discussion, it was regularly moved by Councilman l.lartin that
the Special Service Fund be explained to Council in more detail, seconded by
Councilman Crosby and unanimously carried.
4. PARK STORAGE FAC I L ITIES
A conmunication from the City llanager, dated Hay 2, 1963, advised that prel iminary
plans for proper storage garage and washroom facilities for the Park Department
have been prepared by the Engineering Department, with a preliminary cost
estimated in the amount of $18,000.00.
Counci I concurred with a suggestion made by Councilman Hartin that the Engineering
Department be authorized to prepare detai led plans and specifications and a
suggestion made by Councilman l,lorgan that the matter of financing the project
be referred to the City Hanager for consideration in the 1953-1964 Budget.
5. REqUEST TO I,/IDEN BAYSHORE FREEI.,AY
A cormunication from the City llanager, dated l{ay 3, 1963, advised that the Health,
Safety and Traffic Conmission has reconmended that Council petition the State
Division of Highways to widen Bayshore Freeway south of Burl ingame at Broadway.
A resolution to that effect was referred to Council for action.
The City Planner advised, in reply to Counci I inquiry, that the improvement has
been placed high on the priority list by the State.
RESoLUTt0N N0. 37-63 "Re quest ing the State Division of Highways to Add Another
Lane to the Bayshore Freeway for Traffic l.loving South from Burlingame" was
introduced for passage on motion of Councilman Crosby, seconded by Councilman
l.lartin and unanimously adopted on Roll Call of members present.
7. REQUEST FOR PAY}IENT ATTORNEY FEES OENIED
A cormunication from the City Hanager, dated Hay 2, 1963, referring to a request
received f rom Wi lliam A. Sullivan, Attorney, for the payment of fees with respect
to a claim filed by a City enployee was acknourledged. Counci I concurred with the
reco,nmendat ion of the City llanager that the subject be referred to the City
Attorney and to the City Hanager wi th a conmunication forwarded to l'1r. Sullivan
explaining that in this instance, the City is not legally ob'l igated for the
payment of the fee requested.
8. PURCHASE SCOTT AIR PACKS AUTHORIzEO
A merno to Council, dated llay 3, 1963, from the City l.lanager, recornmending the
purchase of Scott-Ai r Company I'Air Packs" was concurred in by Council and the
City llanager authorized to proceed with said purchase,
9. ABANDONHENT - BROADWAY PARKING DISTRICT
A comnunication from Wi lsey, Ham e Blair, dated Hay l, l!61, recommending the
abandonment of the Proceedings with respect to the B roadway Parking and Lighting
Assessment District was concurred in on motion of Councilman l'{artin, seconded by
Councilman Horgan and unanimously carried.
Councilman Hartin, in a statement indicating the desire of Council to assist
Broadway as funds are available, stated that one lot at least should be acqui red
whether or not an assessment district is formulated. The Richard L. Abbott lot
adjacent to a city-owned lot was briefly disucssed as a desirable lot for acquisition
by the City as a parking facility. The subject was referred to Councilman |'lartin.
IO. TOTLANO TUITION PROCEDURE PROTEST
A comunication from llrs. llary P. I'lartin, 1504 Alturas Drive,
protesting the procedure appl ied by the Recreation Department
of past due monthly tuitions at I'Totland" was acknoviledged.

The City llanager, in reply to the Chai r, advised that an incident occuring in
the Recreation Department, concerning the col lection of a fee for Totland, was
brought to his attention and the Department was reprimanded for its lack of

ci iplomacy. The City ltlanager explained th6t the service is in demand, Burl ingame
being one of the few cities operating a service ol this type, and there has
been a problem with respect to collections. The City l,lanager suggested that
a fee divided on a "three semester, basis may be advisable.
Councilman l,lartin referred to a number of instances wherein City employees
have exhibited a lack of good public relations and suggested that as a
matter of policy, the subject be settled with a reminder to all City employees
that they are employed to serve the interests of the public.
Follorving considerable discussion on the subject of public relations, the
subject of management and procedure in connection with the operation ofrrTotland,rr was referred to the City Hanager and to l{r. A. S. Honritz, Recreatlon
Conmissioner, in attendance and a participant in the discussion affecting the
Recreat ion Depa rtment.
II. SENATE BILL 344 (GAS TAX TUNDS)
A comnunication from James V. Fitzgerald, Supervisor, County of San l.tateo,
dated April24, 1953, soliciting favorable support of Senate Bill 344, pertaining
to increased revenue from gas tax funds, was acknowledged.
Hembers of the Council expressed the opinion that the increased revenue from
gas tax funds would primarily benefit the larger cities and the subject was
tab I ed.

(SFPCA) dated April 15, 1953, enclosing I iterature relative to an Aviation

A 'rUage Study Cormittee Report'r submitted by the North San }lateo County Council
of Cities, was acknowledged. A letter cormending llr. l.laurice K. Hami lton,
Councilman, City of San Bruno, for the cormitteers efforts in compi ling the
i nformat i ve material, was authorized.

RES OLUT I ONS
Dr. Niels Neustrup Property
The City Attorney advised that favorable proposals extended to the City of
Burl ingame by Dr. Niels Neustrup resulted in a dismissal by the City of a
condemnation suit initiated against the property of Dr. Neustrup on Laguna Avenue,
A grant of a "non-exclusive" easement for ingress and egress over the south-
easterly twelve feet of the subject property has been prepared for acceptance
by the Ci ty.
The City Attorney advised that the grantors shall construct a roadway over the
easement according to plans and specifications of the City, with the City, in
turn, maintaining the roadway, control I ing the traffic and establishing a one-
way traffic system; covenants and agreements to "run with the land" binding
future successors to the agreement.
RESOLUTI0N NO. 18:!3'Accepting Deed of Dedication of Easement" (Dr. Niels Neustrup
and Ruth h. Neust rup ) was introduced for passage upon motion of Councilman
l.lartin, seconded by Councilman Crosby and unanimously carried upon Rol I Call

The City Attorney advised that one Deed of Trust (Subordination Agreement) has
been relinquished by The Hibernia Bank to the City and one has been retained
by Hr. Richard L. Abbott.
Counci lman }lorgan suggested that prel iminary negotiations for the acquisitionof the Abbott property be considered inmediately, with Councilman |lartin recom-
mending that the sum of $10,000.00 be reserved in the forthcoming l!61-l!64
budget for sa id acquisition.
ORD INANCES
None
Councilman l,lorgan, speaking as the Cityrs representative to the San l,lateo County
Smog Control Board, referred to the large percentage of incinerators located
within the Smog Control area and suggested that a special code section pertaining
to incinerators be incorporated into the new building code.
Council concurred and the City Attorney was directed to prepare the appropriate
legislation.

2. A cormunication from James V. Fitzgerald, Area Coordinator, San ateo Unified
0isaster and Civil Defense, dated l,lay 3, 1953, requested the name of the Cityts
official representative to the Disaster Council Planning Board of Civil Oefense
and extended an invitation to attend a dinner at the home of l,lrs. Helen Lengfeld,
Friday, l'lay 10, l!51. The conmunication was referred to the Chair for reply and
an announcement with respect to the Cityrs representative to be made at a later
dat e.
ANNOUNCEHENTS
l. The Chair announced that the Peninsula Division, California Leage of Cities Dinner,
had been scheduled for Thursday, ltay 16, 1953.
2. Councilman llorgan was requested by the Chair to represent the Council at the two
meetings of the Planning Conmission during the ltlonth of l,lay. Councilman Crosby
was delegated the alternate at the respective meetings.
3. The Chair requested members of the Council to submit two names as potential
members of a citizensi conmittee to study and initiate the Cityrs participation
in a "S ister City program.
4. The city }lanager reported briefly on the fol lowing subjects:
(a)That a conference had been arranged for Thursday, l{ay 9, 1963, at which time
the City Attorney, l.lr. Frank Rochex, Appraisor, the right-of-way agents and
the condemnation attorney for Burl ingame Area off-Street Parking District would
confer with his office on the first approach to acquiring property for the
Parking D ist rict;
(b) That he had conferred with llr. J. Van Zandt, Engineer for the Off-Street
Parking Coflnittee, on the procedure necessary in reroving structures from
off-street parking lots proposed for the District; and
(c) ttrat permission was requested to use panels owned by the City of Burlingamein the forthcoming [Concou rse-D I E I egance" in Hi I lsborough.
The City l,lanager was granted authorization to approve the request.
