HomeMy WebLinkAboutReso - CC - 119-2022RESOLUTION NO. 119-2022 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A NO-COST AMENDMENT TO THE PROFESSIONAL SERVICES AGREEMENT WITH POWERFLEX SYSTEMS, INC. DATED OCTOBER 10, 2021 WHEREAS, the City of Burlingame received a grant award from the California Electric Vehicle Infrastructure Project (CALeVIP) for the installation of electric vehicle (EV) charging stations at the Donnelly Parking Garage adjacent to the Main Library; and WHEREAS, installing Direct Current Fast Charging (DCFC) and Level 2 EV charging stations at the Donnelly Parking Garage would meet stated goals in the EV Action Plan, support California’s transition to cleaner transportation, and utilize the highly competitive CALeVIP grant award received; and WHEREAS, on October 10, 2021, the City of Burlingame executed a contract with Powerflex, Inc. in the amount of $312,000 to install EV Fast Chargers at the Donnelly Parking Garage, of which $300,000 would be reimbursed through the CALeVIP grant; and WHEREAS, due to operational complications related to the present electrical power supply at the Donnelly Parking Garage, Powerflex is currently unable to complete the scope of work; and WHEREAS, Pacific Gas and Electric (PG&E) offers an “EV Fast Charge” program for select participants and has offered to provide the additional electrical supply necessary to the City of Burlingame for this location, which would allow Powerflex to complete the contracted work; and WHEREAS, PG&E’s EV Fast Charge program conditions that selected participants will complete all work by specified milestones, and will operate under listed conditions, or be subject to repayment of all costs incurred by PG&E related to their project; and WHEREAS, the City believes accepting PG&E’s offer of participation in the EV Fast Charge program is in the best interest of the City, but the City can only do so after amending the current Powerflex contract to reflect the milestones and conditions present in the PG &E EV Fast Charge program. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF BURLINGAME RESOLVES AS FOLLOWS: 1. The City Council hereby authorizes the City Manager to negotiate and execute a no- cost amendment to the Powerflex, Inc. contract dated October 10, 2021, to reflect the conditions of PG&E’s EV Fast Charge program.
