CALL TO ORDER
A regular meeting of the Burlingame city council was held on the above
given date. Ueeting called to order at 8:OO P.m., - !{ayor Crosby in
the Chair.
At word from the Chair, all in the Council Chamber arose and gave the
Pledge of Allegiance to the Flag.

t{r. Easkins advised that the additional cost is the result of (I) equipment
rental increases; (2) the posting of a bond, necessitated by reason of the
calling for project bidsl (3) the increase in labor costai (4) the 2,OOO
yards of fiJ.J. required to be stock-piled, and in addition to rrhich (5) the
project is to proceed under a rigid set of specifications prepared by the
City Engineer.

that the award be made to the low bidder, Arthur llaskins, Inc., t^ras
concurred in by Council and RESOLUTION NO. 65-65 "Awardin g Contract for

TIDAL PTAIN (TP) DISTRICT REGUIATIONS
ayor Crosby announced that this was the tjme and place scheduled, in
accordance with published notice, to conduct a hearing on the creation
of a "Tidal Plain Distrlct" as reconmended b,y the Planning Corumission.
lrtre City Planner. in reply to the Chair, advised that the subject hras
heard before the Planning comnission on two occasioos, subsequent to
which it was the reconmendation of the Planning Conrmission, as enbodiedin its Resolution No. 3-65, that an ordirance be adopted creating a
Tidal Plain Di6trict and providing regulationa therefo4 that a series
of Findings to support the claim that tidal plain zoning is desiralrle,is attached to the resolution and that the ordinance proposed includes
" intent of regulations" and "permitted uses."

A comrunication received by the Planning Comission from the Ideal
Cement Company, under date of ltay 4, L955, referring to its statementa
made in a previous cormnunication of January 15, 1965 andl re-affirming
that "the proposed regulations are not necessary to give control to
the city r,rhich it already has, and zoning would be premature at this
time until it is known $rhat type of zoning will be appropriate, " was
read into the records of Council proceedings.
Councilman ilohnson intiiated a brief discussion concerning the \rords

To be consistent with prior action deleting references to "boating,
marinas or water-oriented sports area" from recently adopted Ordinance
No. 824, !{-l District Regulations, a motion was t]rereafter introduced
b1z Councilman Johnson, seconded by Councilman Diederichsea and unanimously
carried, that the proposed Ordinance No. 825 "Tidal Plain District" be
anended on its face hqr striking therefron the follotring language from
Section 25.45.010 "Intent of Regiulations" "to provide areas for water-
oriented recreation for the residents."
ORDINANCE NO. 825 "An Ordinance Add ing Chapter 25.45 to Title 25, zoning
of the 1965 tttunicipal Code of the City of Burlingame creating a Tidal
Plain (fP) District and Regrulating the Use of Real Property Included
within said District" was introduced by councilman Johnson and given
its first reading.

1. MILLS CREEK CULVERT CONTRACT ACCEPTANCE
A comunication from the city I'lanager, dated July 13, 1965, advised
that the Director of Public rrorks has verified that the contraetor has
fully compl ied with the plans and specifications for the Mills Creek
culvert in Ray Park and it was recornnended that the contract work be
accepted as fully cmplying with the plans and specifications originally
bid upon.
fhe Director of Public Vforks verbally confirmed his approval to the
completion of the project and advised that City forces have placed
additional fill to properly grade the area for the extension of the
playgrounds.

Ur. l{cFadden advieed that a review of the proposals for the Fourth sale
of Parking District Bonds ha6 indicated the J. Barth & Co., 4O4 Uontgomery
Street, San Francisco, to be the lorrest responsible bidder, having
submitted a per annum interest rate of 3.9509%.

2. SALE OF PARCEL FOR FREEWAY PURPOSES
A communication frour the City Uanager, dated July 15, 1965, advisedthat the proposed sale to the State of California of a small parcel
of land at Trousdale and Skyline has been revi.ewed and it has been
determined that the access rights of t}le City are adequately protected.
A reco nendation from the City Manager that legislation be enacted, was
concurred in by Council and RESOTUIION NO. 69-55 "Authorizin g D<ecutionof Right of Ylay Contract (state Eighway) and Grant Deed" was introduced
for passage on motion of Councilman ilohnson, seeonded by Councilman
Diederidrsen and unanimous!.y adopted upon Roll Cafl.
3. GAS TA)( ATISCATION (section 2107)
A cormunication from the City llanager, dated iluly 15, 1965, advisedthat the State Division of Eighways has submitted a resolution for
Council adoption budgeting an allocation of Section 2107 Gaa Tax monies
for maintenance of city streets and recmmended that the legislatj-on
be processed.
RESOLUTION m. 70-65 "Adopting Budget for Expenditure of Fund s Allocated
From the State Eighway Funds to Cities" was introduced for passage on
motion of Councilman Diederichsen, seconded by Councilman George and
unanimously adopted upon RoLl CalI.
1lhe City Engineer, stating that the action reque8ted is an annual
procedure, advised that the City is the recipient of an additional
apportionment of gas tax funds based on an increase in the city's
population and that allocations fron bot}l Sections 186.1 (Select
SyEtem streets) and Section 2107 (Al-1 city Streets) Gas Tax I'unds, a
sum of $8,780.00 will be profited \r the City.
4. REVOCABLE PERII,IIT TO PACIFIC TEI,EPHONE C!.
A comlunication from the City l{anager, dated iruly 15, 1965, advised
that the previ-ously reported request of the Pacific Telephone and
Telegraph Company for an easemeEt across City property between Uarsten
Road and the Bayshore Freeway to serve an underground telephone system
east of the Bayshore F reelray has been investigated and that it was
the recommendation of the City Attorney and his Office that a revocable
permit be approved.
The city Attorney and the City Engineer having indicated their verbal
approval, Councilman Johnson moved that Council concur with the recoln-
mendation granting a revocable permit to the Pacific Telephone and
Telegraph company, subject to a ninety day cancelJ.ation and upon
condition that improvements be restored subsequent to the placement
of cable. Ihe motion was seconded by Councilman Diederichsen and
unanimously adopted.
lftre City Uanager was authorized to so notify the Pacific Telephone
and Telegraph company by communication.
5. CORPORATION YARD II.{PROVEII{ENTS
A comunication from the City uanager, dated iluly 15, 1955, advised
that drawings, plans and specifications have been prepard, as
authorized by prior Council action, for the second stage construction
at the Corporation Yard and it was recotnmended that bids be obtained and
considered by Council thereafter at its regular meeting, August 16, 1965.

Council having previously reviewed plans and indicating its approval,
a motion eras introduced by Councilman George, seconded by Councilman
I{artin and unanimously carried, authorizing the advertisement of bids.
:Ihe City Engineer advised that the advertisement shall stipulate bids
to be received for opening on AuguEt 11, 1965 and a summary therefor
submitted to Council at the regular meeting of August J.6.
6. TINDERG ROT'ND WATER DISPOSAL (Sebastian way)
lItre City Engineer, in reply to the Chair's request for a verbal rePort,
advised of the considerable evidence of ground water during the improve-
ment conEtruction of ttre titills EEtate and the practice under such
conditions of reguiring the eubdivider to provide iJrterceptor pipes to
collect and to carry the ground water under the sidewalk through the
curb and into the street gutteri that the condition is aggravated in the
area of the particular properties under discuasion and prior to the
issuance of a buiLding perurit the subdivider was required to install a
perforated eight inctr pipe around the peri-meter of the lots to intereept
the ground water and carry it to the storzr drain gutterst and that the
system of coLlecting the rdater in the described manner is not an unusual
procedure.
A proposal from the city Ehgineer requiring the discharge of water to
the underground storm system, depicted in a sketdr prepared by the city
Engineer, explaining the syEta of the underground storm drain installation
in the area, was reviewed by council.
Follotring further discussion, Council concurred with the recommendation
of the city Ehgineer that property oerners on Sebastian Drive be invited
to confer with the city l{anager and his Office on t}re issue for report
to Council at the ner(t regular neeting.
7. RECREATION CONSTJLTATf,Tb ARRIVAL
A memo from the city tltanager, dated iluly 15, 1965, advising that the
Recreation Consultants authorized \r Council to conduct a comprehensive
recreation survey will arrive in Burlingame on July 25, was acknowledged
and placed on file.
8. TENTATIVE UAP "ANZA AI RPORT PARK NO. 2"
A coruuunication from the City Planner, dated iluly 13, 1965, adviEed that
at an adjourned regular meeting of the Planning Comission, Honday,
July 12, 1965, the mernbers considered a tentative map entitled, "Anza
Airport Park No. 2" subdividing property known as "Lands of Crocker-Anglo"
and portions of "Anza Airport Park No. 1"; that the tentative map before
Council is the result of considerable discussion wh ich led to a nunber
of changes and additions; that it is not, in form satiafactory to the
comission and recounended for approval \r Council .
Tihe tentative map was reviewed by Council with the City Engineer directing
attention to the street design restricting parking to one side of the street.
T'he City Planner, speaking on the off-street parking requirements, advised
that the building facilities are narrow because of the location of the
Pacific ca6 and Electric Company's po\f,er transmission lines; however,
one hundred forty feet at the rear may be used for off-street parking;
that the property adjoins an area planned as a City recreational facility
in the future and in re cmraend ing approval to the tentative map, the
Planning Corurnission stipulated that the map be amended to indicate an
additional five foot setback to tots 1 and 2.
A comnunication, dated iluly 15, 1965, from the city l{anager rePorted
in some detail, the findings of the city Engineer concerning an under-
ground water seepage condition on Sebastian way.

In the discussion following, Counc ilnan ltartin expressed the opinionthat a cul-de-sac, as indicated, and particularly within an industrial
area should be enlarged to a greater radius and the width of the
eaaement proposed as a street right-of-way increased to provide a
"full-sized" street.
With the consent of l{r. ceorge Keyston, one of the property ownera
included within the Anza Airport Park Unit No. 2" and in attendance,
action was withheld until the next regular meeting of Council pending
furthe! conference .
9. DONXELLY AVENUE REPORT
A cormunication from the Health, Safety & Traffic Comnission, dated
iluly 15, 1965, advised that with respect to a request from the Dorrntown
llerchants' Association that Donnelly Avenue be created into a thro-hray
street, it was the recommendation of the Corunission that aetion be
deferred pending receipt of a complete traffic survey report fron the
County Engineer.
The comnission further adviaed that a report would be given at ttte
next meeting of the Parking Conmission at which time a member of the
Health, Safety & Traffic Commission would be in attendance.
Ilhe City llanage r \.ras requested by Council to obtain a defiDite conmit-
ment on the availalcility of the traffie survey report at the meeting
of the Parking Commission on July 22, L965.
10. SUGGESTION RE: SEWER PI"ANT OPERATION
A conununication from Dr. H. wade l{aconbet, L275 California Drive,
dated Ju1y 13, 1965, offering a suggestion concelning the acquisition
of acreage irnmediately to seaward of the sehrage Disposal "effluent
strearn" to be filled and developed, was acknowledged and the subject
referred to the City Engineer.
11. REAR ENTRANCE BEAUTIFICATION
A communication was read from tliss Frieda Freund, 1230 Donnelly Avenue,
suggesting that a beautification program be initiated to improve the
unsigbtly appear.rnce of rear entrances of stores adjacent to off-
street parking Iots.
Ur. Charles Gfroerer, President, Burlingame Dq^mto\rn Merchants' Associa-
tion. in reply to Council inguiry, advised that the Chamber of Comerce
has been conducting campaigms to stimulate interest in the improvement
of property and that it is anticipated that within a period of one year
the reaults shall be favorable.

RESOLUTION NO. 79-65 "A Resolution Authoriz ing Settlement of Parcel
7-H" (wilson, $28,750.00) was introduced for passage on motion of

BT'DGET HEARING
I.{ayor Crosby announced that council has concurred to conduct a public
hearing on the proposed 1965-1966 budget on this occasion and referred
the subject to councilman George, Council Budget comnittee Chaiman.
Councilman ceorge, in a detailed explanation and in support of the
presentation, sulraitted the follorrring:

our percent salary increase for city employees i

council action last year, has pernitted the allocation of additional

In reply to inquiries from Itlr. Duncan Beardsley, representing the
ilunior Chamber of Cdumerce, I{ayor Crosby stated that it was the intention
of Council to appoint a citizens' committee to investigate and recorunend
to council the most appropriate procedure to acquire a new civic center.
Elaborating further, Councilman George stated that the Planning Commis-
sion has estimated an expenditure of $850,0O0.OO to complete the
acquisition, improvement and development of a City Hall and that the
sl,[tr of $2IO,0O0.OO allocated in the proposed budget shall be deposited
in a bank to accrrmulate interest to insure an adequate "down palument"
at the appropriate time.
Mr. Paul Constantino, Burl ingane Realtor, spoke in favor of the allocation
to provide off-street parking for the Broadhray business district.

Councilman Diederichsen voiced approval to the budget, expressing the
opinion that Council menbers have the interest of the taxpayers and
their objectives sha11 accmplish a better comnunity in which to reside.
Councilman alohn8on expressed concern that the proposed tax rate of $1 .28
per $10O.0O valuation, cannot be reduced further to compensate for the
considerable increase in the assessed valuations throughout the County.
Stating her obj ection to the $1OO,OO0.OO reserved for a partial improve-
ment to the sewage Disposal Plant, suggested that a campaign be activated
to place the issue before the electorate to complete the project in onestep. councilman .fohn son referred also to the appointment of a citizens
comnittee in 1960 to investigate a site for a new City Eal1, and statedthat it may be possible to raze the present city EaLI and to rebuild on
the same property.

Councilman Ittart in stated that in his opinion, the proposed budget"is not high enough"; that the four percent "across the board "salary increases faiL to corect inequities; fire and police compen-
sation scales are below those in the neighboring cities of San Uateo
and Ittillbrae and sdle categories are underpaid.
Commenting on the Capital Improvement budget, Councilman Martin
stated that monies allocated i-n the current budget represents only
ten percent of the total monies required to conplete the proposed
projectsr that insofar as the City 8a11, the Seurage plant and other
major expenditures proposed, bond measures will be necessary to
complete the projects and it is to the advantage of the City to bein a position to announce that a portion of the cost has been absorbed.
llayor Crosby, in concluding the budget hearing discussion, statedthat a four percent saLary increase was based on statistics indicating
that a three point nine percent increase was granted industrial workers;
that ineguities in t ime will be resolved by a survey; and while it is
desirable to maintain a low tax rate, mary capital Improvement projects
have long been delayed in the City of Burlingame.
lilr. Beardsley, speaking of his frequent attendance at the Council
budget sessions, stated that he was of the opinion that the public
would have no objections to an additional "few cents" added to the
tax rate if advanced an explanation concerning the allocation of the
revenue .
