A letter hras read fro the City Planner, dated June 29, 1965, advieingthat in connection with the hearing before Council on the proposed
amendments to the !.{-1 District regulations, the guestion of permitting
marinas and water-oriented aports, referred bacl< to the PlanDing
Connission by Counci.l action, has been duly recoDaidered; that two
aspects were considered: (I) the inclusion of these uses in the
"conditional use" )-ist and (2) the question of complete prohibition;
since the second course had not been heard previously, the Cmmission
voted to hold a public hearing and thereafter unanimously recmmendedthat Section 25.42.O3O, "Conditional uses requiring epecial permit
be amended by deleting from sub-section "f" the rrorda "boating,
marinas, or water-oriented sports area.'l
In replying to Council inguiries, the city Attorney advised that
Council procedure requires consideration to the report from the Planning
Comaission; council concurring, the ordinance proposing amendaeDtato the lrl-1 District regulations tnay be "aEended on its face"i that
before Council on this occasion is its consideration only, to the
proposed deletion of categories within the proposed sub-section
that "prohibitive uaes" sha1l be before Council for considera-
tion in due course.
A motion was introduced thereafter by Councilman George, seconded by
Councilman Diederichsen, that "Section 25.42.O3O,'Conditional uses
requiring special permit' be anended by deleting from sub-section
"f" the words 'boating, marinas, or water-oriented sports area.'"
llhe motion was unaninously carried.

ORDINAI{CE NO. 824 "An Ordinance Arnendin 9 Chapter 25.42, u-l District
Regrulations, of Title 25, ZorLng, of the 1965 Municipal Code of the
City of Burlingame by adding a Statement of Policy, Deleting Certain
Permitted Uses, and Revising the List of Uses Requiring Special Permits"
was given its first reading and introduced by Councilman Johnson.
COMI,IT'NICATIONS
I. DRAINAGE COIIDITIO}IS ON SEBASTIAN DRIVE
A cormunication from the City Uanager, dated July 1, 1965, referred
Council to a cormunication frm Ur. ceorge F. Neel, 1785 Sebastian Drive,
under date of June 28, 1955, concerning "an unsatisfactoly drainage of
seepage water into the gutters in front of 1725, L735, L?45 and 1785
Sebastian Drive" and an explanatory report from the City Engineer,
dated June 30, 1965.
Attachments to Dlr. Neel's communication relatiJlg to the subject, included
copies of correspondence directed to "Ilhom it l,tay Concern of June l8, 1955"
bearing the signatures of orrners of the aforementioned properties, to the
"Alpha Land C@pany of ilune I8, 1965" and frcm the "Alpha Land Companyof June 24, L965 ."

including the origination of vrater creating the continual ground seepage
and additional infomation concerning the policlr of the City with respectto intercepting ground water in improvement construetion areas.
2. T,NDERGROI,ND EASEtrI.IENT EAST OF BAYSHORE
A conmunication from the city l{anager, dated .ruly 1, 1965, advised that
the Pacific Telephone and Telegraph c@pany has requested an underground
easement for serving the area east of Bay8hore Free\ray and recornmendedthat the legal document be revierred by the City Attorney.
llhe subject docrxnent was referred to the City Attorney for approval
and the preparation of appropriate legislation for Council action.
3. APPROVAL UILLS CREEI( CULVERT I{ITIIHEIJD
A cormunication fron the City Hanager, dated iIuly 1, 1965. advised that
the R. w. Stutz Construction Conpany, contractor, has completed the
conatruction of the Mills Creek Culvert in Ray Park, in conformancewith plans and specifications and it was recommended that the project
be accepted as comp].ete.
Councilman ltartin raised a point concerning the origination of the water,
questioning \.rhether the entire hillside area is in a "draining" condition
and expressing the opinj.on that more effective measures should have been
required of the subdivider to alleviate an "aggravating" situation,initiated sone discussion on the City's policy affecting irnprovement
conatruction, as set forth in the report frm the City Engineer.

Councilman George, informring Council of his personal visitation to
the construction site, advised that additional dirt will be requiredto grade the area sufficiently to extend the playgrounds.
fhe Assistant City Engineer, in reply to inquiries from the Chair,
stated that the project has been completed according to plans and
specificationsi that the plans were designed to permit a proper
drainage and confimed that an additional three hundred yards of soil
may be required to grade the area for playground purposes.
Following furttrer discussion, action on the acceptance of the lrtills
Creek Culvert project was deferred until the next regular meeting of
Council, and pending an official confirmation frm the Director of
Public works that the contractor has met the full reguirements of
plans and specifications.
4. BAYSIDE IUPROVEIT,TE}IT DISTRICT RESOLTITIONS
A c@munication frm the City llErnager, dated iluly 1, 1965, advised
that in the matter of an execution of an agreement with the Pacific
cas and Electric Company for the relocation of pole lines along
Carolan Avenue and Industrial way, as part of the Bayside ImprovementDistrict, deferred by Council at its last regular ueeting, llr. Xenneth
I. Jones, Attorney, repreEenting the DiEtrict, has advised his Office
that he is soliciting the Pacific Gas and Electric Company's approval
of a drange iI the contract to stipulate that costs of said relocation
shall be expended fron Bayside Improvement District funds.
U!. Jones, in attendance, advised that an addendum to the contract,
prepared by the City Attorney, has been approved by the Pacific cas
and Electric Company and Council therefore may authorize the execution
of the agreement.
RESOLIITION t{IO. 61-65 "A Resolution Authoriz ing D<ecution of AgreeBent
and Mdendum to Agreement Relating to carolan Avenue and Industrial
Way - Bayside Improvement District" was introduced for passage on
motion of Councilman John6on, seconded by Councilman Diedericlrsen and
unani:nously adopted upon RoII CaIl.
RESoLITT IoN l{o. 62-65 "A Resolution Ac cepting crant Deeds and Deeds of
Easement Bayside Improvenent District" (Properties included within
E<hibit "A") was introduced for passage on motion of Councilman .Tohnson
and seconded by Councilman Diederidrsen. on the question and in reply
to counciLman lr{artin, the City Attorney indicated his approval and a
Ro.]-l CaII vote was recorded as unanimous.
5 REPORT OT' MEETING WATER POLLUTION BOARD
A memo to Council, dated iIuly 1, 1965, from the City Uanager, advised
of a recent meeting his Office and that of the Director of Public
works attended witlr Mr. Dan Murphy of the staff of the water Pollution
control Board conceraing efforts expended by the City to correct
"bpr-pass" conditions to eli-uinate qrater pollution.
Ilhe City llanager recommended that subsequent to a review of cost
estjJaates, in the process of compilation, a report be subBitted to
the water Pollution control Board vrith respect to the City's future
course of action. The report rras acknowledged and placed on file.
6. " TIDAL PLAIN DISTRIqT" PI,IBtIC EEARING
A ReEolution frcm the Planning Comrnission, recomending the adoption
of an ordin.rnce creating a Tj.dal Plain District and provi.ding the
regulations therefor, was adcnowledged and a prdrlic hearing to be
duly advertised in the local ner.rspaPer, was scheduled before Council
at its next regular meeting, July 19, 1965.

7. REQITEST RE: DONNELLY AvElIIrE, lr{O-WAY STREET
A comnunication vra s received fro the Burlingame Avenue llerchanta'
Association, dated afune 18, 1965, requesting consideration of Councilin authorizing a new traffic survey of Donnelly Avenue and the advis-
ability of permitting a two-iray traffic system, particularly now that
parking district lote in the imnediate vicinity are available.
A conununication frcm the Health, safety & Traffic Comission, dated
iluly 2, 1954, advised that Donnelly Avenue is included in its over-all
study of traffic problems within ttre city and requested that action be
deferred until the traffic study has been completed.
Council concurred that the subject of Donnelly Avenue should be explored
and a decision made in the very near future.
lI}re City tianager was directed \, Council to request the Parking Counission
to place the item on the agenda of its next meeting and that Hr. aloseph
A. Aliamus, Chaiman, Health, safety & Traffic commission be invited to
confer on the iseue r'rith the members of the Parkiog conmission.
RESoLUIION No. 63-55 "A Resolution Calling for Bids on Sale of Improvement
Bonds - Burlingane Avenue area, Pourth Sale - $99,329.61" (final parking
district bonds) was introduced for passage on motion of Councilman llartin,
seconded by Councilnan Johneon and unanimously adopted upon RoIl Call .
RESOLUTION NO. 64-65 "A Resolution Authorizing settlement of Parcel 28
(George H. and Enma Sandidge, $44,0OO.OO) was introduced by Councilman
u artin, who moved its passage, seconded by Councilman Johnson and
unanimously adopted upon Roll CaIl.

budget is to be considered, be given more pubJ.icity.
