JOHNSON LEASE PORTION MILLS CREEK Reference was made to a request from the R. c. Johnson company, submitted previously to council, for authorization to construc.t a conerete box culvert over that portion of IvU.lIs creek abutting the Johnson property fronting on Burlvray Road. A proposed lease to be entered into with the R. C. Johnson Co., for possession and use of a portion of MiLls Creek. terms and conditionsstipulated therein, \das app roved and a RESoLUTIoN, No. 52-65 "Auth-orizing and Directing E:<ecution of Lease of the Portion of t*tills Cr€€k Channel to R. FUTURE DUMP OPERATION ltle Chair declared the discussion open on consid.ering the City of Burlingame's future dump operation service. A letter hras read first from Arthur Haskins. Inc., dated Uay 17, 1965, confirming a verbal discussj.on with the City Engineer and submitting two proposals in connection with the construction of a dike to encirclea 7.9 acre debris dump site. Ihe Chair advised that the foregoing was in response to a Council request as suggested by the san Mateo county scavenger company, one ofthe interested parties in the operation of the dump. fhe City Engj.neer presented an engineering sketch entitled "BayaidaPark Area" and indicated the area wherein a dike may be located. Reference was further made to a proposal from the San ltlateo County Scavenger company, dated i{ay 5, L965, and, on this occasion, a sub- sequent proposal, dated Uay 19, 1965, was presented, offering t'ooperate a " five acre or more dump area" at existing rates and that at such future date as the dump area is fj-lled, the company be perqitted to construct and operate a transfer station on property to be selected by the City. Eurther stipulations were set forth. A reconunendation from councilman Uartin that the file be closed tofurther proposals as of this date. was concurred in by council. Inquiries through council to l{E. Louis Devincenzi. Secretary, san Mateo County Scavenger Company. indicated that the operational functions of a "Transfer Station" would be limited to local- usage. with trucks depositing debris antl others removing it to designated areas outside the City; the transfer station would be inclosed and wou Id not create an od.orous or deblis-scattering nuisance; the station can be constructed on the present dump site or at a location selected by the city; "wet" garbage will be disposed of by truck and other transfer stations will be established along designated routes of the disposal comPany: CALL TO ORDER ROLL CALL I]NFINISIIED BUSINESS 271 Referring to an excerpt in the minutes of a joint Park Commission meeting. objecting to a "regional" transfer Councilman Martin questioned l{r. Councilman Martin stBted that. the City has an investment of $450.000.00in this particular area and questioned I.{r. Devincenzi whether a fee forthe use of the property has been given consideration. Mr. Devincenzi confirmed that a rental fee can be negot j,ated. It was further agreed by Ur. Devincenzi that the problem of dust, odor and wind would have to be kept under control. Referring to the type construction of a transfer station, the City Planner stated that a qualifieil architect could prepare an appropriate design. fihe attention of the Council was directed by Councilman George to ftem No. 3 stipulated in the latest proposal of the Anza Pacific Company concerning an "over-a11 county dump program involving pickup stations and canyon disposal site" currently under consideration by the Countyof San llateo and his inquiry to Mr. Keyston that "no assurance isgiven that you (Anza Pacific) will be awarded a contract by the county. " !lr. -Daiid Keyston suggested that to obtain the commitments the Cityseeks. it may be advisable to advertise for bids. councilman Uartin, clarifiring the p€sition of the city with respect topresent negotiations, stated that terms of a ne$, contract to continuethe operation of the dump, presented by Anza Pacific Co., vrere not favorable to the City and it was at this point that recommendations were made to sol-icit offers from other companies. Questioned by Councilman Martin, Mr. George Keyston confirmed that theonly difference in the current proposal from that just prior, is astipulation that the Anza Pacj.fic corporation will be lrj.lling toconstruct a levee around the 7.9 acre parceJ- at. no cost to the City. Councilman Uartin referred to the Engineer's sketch "Bayside park Area" and designating a specified locatj-on, suggested that the area be drained,a dike be constructed and soil removed from a depth of from twelve tofifteen feet belok, the present ground level be deposited on property that may be acquired adjacent to the fdeal Cement Company's property. councilman l{artin pointed out that only the proposal received from the San lrlateo Disposal Company permits the city to retain the fil-l material. counci.lman .uartj-n expressed his interest in negotiating with the San Mateo Disposal Company, stating that in his opinion, its proposal would best serve the interests of the City- Mr. ceorge Keyston concurred that "it is a better proposal" stating thata "long term comnitment is involved, holrever. " A point debated by Mr. Keyston that a formal request to obtain a transferstation be submitted through competitive bidding tas referred to the CityAttorney, who advised that the City is only required to call for bidsfor "the constructj.on of public improvements" and that "in this case it isnot required. " A recess was declared ty the Chair at 9:45 p.m. CAI,L TO ORDER tlhe meeting reconvened at 9:55 p.m RECE SS 212 DUMP PROPOSALS CONTINIiED eouncilman Martin suggested, rrith council concurring, that further negotiatj.ons with the Anza pacific corporation be discontinued and that members of the city's staff revj.ew the proposal of the San ltiateo Disposal comPany. Several inquiries coneerning the construction in the future of a transferstation were directed by Councilman Martin to lrtr. Devincenzi, whoreplied in the affirmative on the following issues: 1 A land rental fee to be paid to the cityt 2. Council to have the author ity to select the type of transfer stationto be constructed; the rental fee to be based on the type of buiJ-ding constructed i 3. Council to determine the rates to deposit debris. counci.lman Martin further recommended., with council concurring, that thecity Attorney determine the legal aspects of the proposal. A discussion was held on h,hether the use of a trans fer station should be limited to residents of Burlingame only, with the consensus of opinion expressed that this issue can be resolved w,hen reviewing the terms of the proposal and stipulated accordingly within the contract. A motion was introduced thereafter by councilman uartin that, the proposal of the San Mateo Disposal company be referred to medbers of the city's staff for negotiation and on details to be included within the contract. :Ihe motion was seconded by councilman George and unani.mously carried. Council members individually expressed appreciation to both Mr. George and Mr. David Keyston in acknowledgrreEt of their service to the city of Burlingame. 3. IAND ACQUISITION RNPORT A communication from the City ltlanager, dated uay 19, 1965, and in reply to a request from Council at the regular meethg of May 17, advised of his most recent discussion with !lr. lltromas !{cf,}onald, the new Right-of-way Agent for the state Division of Highirays, indicating that the city of Burlingame shall reeeive priority action with respeet to its offer to purchase state-owned land along the Bayshore FrCetrtay and within the city limits. llhe report was acknowledged and placed on fi1e. councilman Martin ex pressed apprehension that the continuing delay in receiving a reply from the state Highway Division may indi-cate an increasein the ogiginal price of the property. The city uanager stated that a higher appraised valuation may increase the price initially stipulated. 4. SALARY-FR INGE BENEFTT REQI]ESTS Council acknowledged receipt of a 'tsa1ary and Eringe Benefits Proposal 1965-1956" submitted by the Burlingame civil Service Employees' Associa- tion, Inc. through the office of the city lqanager. Ihe city Manager advised that the proposal sha11 be evaluated by his Office with a report made to Council at the regular meeting of June 7. 5. BROADTiAY OFF-RAMP PROPOSAL A comrm:nication was read from Mr. David H. Keyston, E ecutive vice President, Anza Pacific corporation, dated uay 17, 1965, recalling a meeting attended by state Highway Department representatives, the city Manager and he personally, wherein a proposal was mad.e by his comPany to instal-I a northbound off-ramp at the Broad\^tay-Burlingame Overpass and a proposal made by the State Highway Department indicating that a sum of 213 $50,000.00 can be budgeted for the project by that Agency lvithout approval from the main office; that a plan submitted by the Highway Department to provide additional safety factors "for a d.angerous situation as far as traffic is concerned" approximates a cost of $1OO, O0O.OO or a sum of $5O,OOO.O0 in excess of the Statets limitationof $50,O00-OO. Mr. Keyston advised that in the interim, the subject has been discussedwith a number of landowners in the general area of the Keystonproperties who are of the opinion that if the sum of $25.000.00 can be budgeted bD/ the City to add to the State's $50,000.00, private landowners in the area h,i1l be solicited to provide the additional balance of $25, O0O.00. ft was suggested by Mr. Keyston that the subject be discussed with members of the city's staff and that councj.l ascertain if it is in thebest interest of the city to allocate a sum of $25,000.00 to alleviatea part of the problem in the area of the Overpass. Ihe City Manager advised that at the meeting referred to, the Highway Departnent appeared receptive to the Keyston proposal and it was his recomrnendation that the plan be evaluated by members of the City'sstaff. fhe City Planner, replying to Council inquiry, spoke on the advantagesof the proposal if it becores a realty, stating that "it is possible that the plan may fit in with the future design" af the Broadway Overpass improvements. lhe subject was referred to thethe City Planner for review and meeting. June 2, 1965. I{ETER POLLUTION CONTROL BOARD RE: REPLY TO CIT' RESOLUTION NO. 47-65 A co[ununication was acknowledged from the Regional Water Pollutioneontrol Board, dated Uay 17, L965. referring to the City's adoptionof a Resolution, No. 47-65 ("Establishing Proposed Schedule for Compliance with Requirements of Regional Water Pollution Control Board. san Francisco Bay Region" ) and requesting that the citysubmit "on or before June 15, 1965" a supplement to the resolutionto i.nclude a nrimber of stipulations. ltre City Engineer stated that the reference pertains "stridly to a treatment plant matter" and in explaining the corunents concerning"the by-passing of raw sewage from sewers during storms" advisedthat all cities find it necessary to "bypass" during the heavywinter rains. f'o11o\^,inqf a brief discussion wherein it vras observed that the communica-tion merely refers to the existence of a "nuisance condition,, ratherthan a "health menace" the subject was referred to the study rlEetingof June 2 for further analysis- 7. "BL@KING" BIJRLTIIGAI\,TE AVENUE fhe City Manager advised that a canvass of merchantsLorton Avenue indicated no obj ection to the proposed Burlingame Avenue from Park Road to Lorton Avenue on from 9:00 a.m. to 5:00 p.m. to permit an art displaythe creation of a new dovrntor^rn area parking 1ots. on Park Road and b1-ock ing off of Saturday, June 12, and to commemorate Counci.Iman Martin moved that permissj.on be granted as outlined forthe one day, ,fune 12, seeonded by Councilman George and unanimouslycarried . 274 CfIY OF BRISBANE RE: TA)( RATES A communication from the City of Brisbane concerning tax rates for 1965-L966, was acknowledged and referred for Council attention at the ,fune 2 study meeting. ..FEDERAL ECONOMIC OPPORTUNITY ACT., A corurunication was ackno\^rledged from E. R. Stallings, County llanager,reporting on the County of San llateors activj.ties and developrEnts with regard to the Pederal Economic Opportunity Act. and the forma-tion of a County "Human Resources Commission. " BURGI,ARY PRECAUTIONS Councilman uartin referred to publicity concernj.ng a recent burglarythat occurred in the Public Works Department, initiating a discussion on the inefficient system of the City in the management of monies received. the City Engj.neer explained circumstances prior to the burglary in which the employee involved admitted to "carelessness." Suggestions were made that departments having monies on hand either use a banks " Night Depository" or transfer funds daily to the Offj.ceof the City Treasurer. Ihe City l{anager was requested to determine a policy to safeguard arepitition of the occurrence . Speaking briefly of his concern on " account.ingi procedures" of theCity, councilman Martin sugrgested that it may be advisable to have the City Ii{anager re-evaluate his proposal with respect to a " finance Director.
