Kenneth I. alonea, Attorney, of the law firm of wilson, Earzfeld, Jonea and llorton, and representing petitioners requesting the formation of a Burlingame Avenue Street Lighting District, vras recognized by the Chair and invited to cooEent on the appropriate procedure to undertake a street l ighting program on Burlingame AveDue. lilr. \rones advised that a petition has been circulated among the oh,ners of property of a deai.gmated area included within a atreet lightingdistrict proposed for Burlingane Avenue, between EI Canino R€al and California Drive and portions of Primrose Road, Lorton Avenue and Park Road t that forty-two percent of the area oymers have signified their consent by written approval, t\renty percent of the area owners have indicated approval, but have not signed the petition. because of the position of their tenants and thirty-eight percent of the area owners have not replied either \l verbal or hy written notice; ttre proposed improvement shall proeeed under provisions of the ltunicipal IDprovement Act of I9I3, with the City Engineer to prepare a written report, to include: (a) Plans and specifications. Jones atated that a substantial amount of the preliminary work has been accoupl ished and the property ohrners have been made aware of the project through a brochure distributed by the Chanber of Comerce. Ee estimated that the report from the engineer rould be available within thirty daya and a public hearing scheduled within a th irty day period folloringthe eubniseion of the report from the engineer. Councilman lt{artin's inqui.ries concerning the excluaion of portions of Park Road and Primrose ltoad propertieg from the propoaed ligbtingdi.strict boundaries, srere referred to l,tr. Granville Browning, General llanager, Burlingame Chamber of Comerce, who explained that properties eouth of Burlingame Avenue were inter-connected wit}t the Eouatd Av€nue Lighting District and the northerly portions are included in the proposed Burlingame Avenue project to complete the circuity of the system. !lr. Brorrning further explained that the Lorton Avenue electricalcircuit is connected with the California Drive and the upper Bellevue Avenue electrical Eystem and that it is anticipated that an i.uproved l ighting syatem prograD for tbe Lorton Avenue area ehall be initiatedin the future. Requested b!/ the Chair to coEBent on the current position of the City in relationehip to the ilater Pollution control Board's requirements affecting the City Dump, the City Attorney advised that the water Pollution coBtrol Board has requested the Office of the District Attorney to issue an injunction order against tlre City because of an alleged dump pollution "nuiEance"; that as a reault of a conference with City officials and the District Attorney, it was recomrended that the City (f) employ an expert to report on \^rtether a "nuigance " does exist; that (2) erays and means be deterained to abate the 'nuisance' and that (3) costs be Eubnitted estirnating the expenditures necessary to eliminate said "nuisaace. " ltre City Attorney continued by advising that the Office of the DiBtrict Attorney is to be inforted thereafter of the findings and to take into consideration whether an action against the City is, or is not, justified; that the services of !tr. IYiIl iaro O'Coanell, an expert in this particular fie1d, has been retained to conduct a survey of the dump area and a cmunication to that effect is being forvarded to the office of the District Attorney. lrhe City l{anager explained that the City ie to obtain coat esti.Eatea on dredging or on sealing the dump area entirely. Concurri.ng with a recomendation frqn the City l{anager that the services of the consulting expert'be confirmed by Council, Councilnan ltartin moved that !tr. William O'connell be retained to agaist the City in eo-piling a report to deternine the total coEt of cmpletely sealing the drmp and to further agsist the City in resisting the legal action requested \z the Regional water Pollution Control Board. Ihe motion was seconded by Councilman Diederichsen and unaninously adopted. For the further infotration of council, the City llanager advised that ltr. o'connell, in a prelininary investigation, has indicated that no "nuisance" existg; that leakage frou the dump is of an iasignJ.ficant type and that the City should be "allotred a little rdilution' zone. " llhe City llanager further advised that a compilation of information ahall be conpleted within a period of ten days for transittal to the Di8trict Attorney. 200 RESOLUTION RE!
