At word from the Chair, all in the Council Chambere arose and gave the Pledge of Allegiance to the Flag. Present - Councilmen: AJrsent - councilmen: crosby, Diederichsen, ceorge. COITIII{I'NICATIONS 1. UODIFICATION OF AGREEMENT FOR PURCBASE OF OPEN SPACE LAND. A comtrunication dated lloveEber 30, L967, from the City ltanager Eubmitted for Council's approval an agreement executed by the Board of supervisors, san llateo county, modifying a prior agreement between ttre City and the County for acquisition of certain recreational and open-space land; the cormnunication reconmended adoption of a resolution authorlzlng execution of gaid agreement. A letter dated Novenbe r 20, L96?, froE E. R. Stallings, County Uanager, advised that the modification of agreement deletes the reguirement that the City'a application for federal funda must be approved before County funds can be released for purchase of bayfront properties. Mayor Diederichsen announced that the City vill receive an anount of $58,O8O.00 frqn the county. A memo from the City Planner dated Novenber 27, L967, suhnitt ing sug- gestions for amend ing the regulations applying to free-atanding sigms, waE acknotrledged and held for study. A comunicatisr dated November 2A, L967, from the Reg ional water Quality Control Board, signed by John B. narriaon, Executive Officer, reportedthat at a regular meeting on October 19, 1967, the Board unanimously adopted a motion commending the City Council and the Electorate of the City of Burlingame "for their action for sewage effluent vhiclr is presently being diecharged after prinary treatment to San Francisco Bay." Counci.lnan ceorge, on behal f of the Council, stated that the cqnmendation was especially gratifying becauae of the City's prior difficultiee in meeting the requirement8 of the Board. In reapon8e to !lr. Duncan Beardsley, Council authori.zed the City llanager to furniah thirty copies of the comunication for distribution to the City Inprovement C@ittee. REQUEST TO USE DRAINAGA RIGIIT-OF-WAY FOR PRIVATE DRIVEWAY. A letter dated Novedbe t 30, L967, from the American Turko-Tatar A8aoc-iation, Inc., Burlit4l ane, requeated permission to improve a five foot drainage right-of-way "allegedly belonging to the City of Burl inganre "for driv*ay purpoaes on the property located at 1258 El camino Real, aouth of Lincoln Avenue. fhe corununication was s igned by shanil H. Ibrahin, President. A copy of a letter from the Office of ttre Director of Pub1ic Worka, dated Novenber 20, 1967, addressed to the American Turko-Tatar Association Inc., vras read wherein reference iras made to a document of record, dated January 17, 1916, granting to the city of Burl ingane title to the south- easterly five feet of the property, the cmnunication stated that actual property frontage, therefore, measurea fifty-five feet on BI camino Real, with a aoutheasterly side setbacl< of eix feet five inches, thereby elininating the proposed driveryay on that side of the property. (councilman llartin arrived. ) The city Engineer, in reply to llayor DiederichEen, advised that the petitioners are in the procesa of renodeling and inproving the property at 1258 El camino Real for church purposea, in accordance with a use permit granted by the Pl.anning commigsion (February, 1956) r to facilitate ingress and egress to a parking area at the rear, a circular driveway is proposed to be constructed. 1Ihe city Engineer stated there is a reinforced concrete bo:< drainage structure on the property along the southerly boundary line, five feet on each side of the property line; and that ttre recorded inEtnment indicated that the ten foot strip was granted to the City in 1916. 4. Ihe city Attonrey referred to an incdtrplete preliminary title report dated February 1, 1966, stating that it vould appear the petitioners pur- chased the property through a court sale in an estate settlement, and that the title co|npany issued a title policy subject to the City'8 easenent. Itre City Attorney requeated, and was furnished, a complete copy of the preliminary report. Councilman Crosby referred to a protest on file fro the san ltlateo- Burlingame Board of Realtors, auggesting that it be acknonledged with an explanation of the reasons for legislation by the local governmenta. Stallings, county llanager, dated Augruat 15, 1967, presenting a series of questions regarding formation of a Huoan Relations Comrigsion for san uateo county. Council ind icated no objection to fomation of such a conmission on a county-eride basis, providing that each city retains the right to attenpt to settle its orrnr problema before the County Comission qroul.d intervene.
