A regular meeting of the Burlingarue City Council was held on ttre
above given date. Meeting called to order at 8:1O P.m., t{ayor alohnson
in the Chair.

HEARINGS

HOTEL COMPLE:X BROADWAY AREA
uayor ilohnson announced that this was the time and place acheduled
to continue the hearing on the application of cregory & Sons to con-
struct an hotel-office building on Burling.uBe Shore Land Conpany
property abutting the City's proposed Bayside Park area.
!lr. A. w. Hall. President, Gregory & Sons, Construction and llortgage
Conpany, Inc., was invited by the Chair to report to Council on the
most recent developments affecting the construction.

fhe cormunication, dated Noveniber 18, 1968, advised that a plot plan
and isometric (on display) indicated the changes in the building
that have been made in conformance with discussion at the former
hearing; that the office structure nq.r is shown as a separate building
of 36,000 square feet, raised one story above the ground to allow for
parking beneath the buildingr the hotel and reataurant are shown as a
combination to provide 300 roons with facilities for banquet and public
space, a 7,O0O square foot reataurant and that parking for the entire
project will accommodate 507 cars.
A second conmunication received by Council on this date, uaa read
from William spangle & AsaociateE, city and Regional P1anners, under
contract to the City of Burlingame for the preparation of a "Genera1
P1an. "
The comnunication signed by I{r. Georgre s. Mader, emphasized the
importance of the relationehip between the proposal of cregory & sons
and tlre "Preliminary ceneral P1an, " and recomDended that Council con-gider the advantages and disadvantagea of taking a final action before
the city reacheE a solution with respect to the Broadway-Bayshore
Fretray interchange.
Mr. HaIl elaborated on the current proposal with respect to the complex,
and referring to the drawing on dieplay, pointed out the on-ground
parking areas, the parking areas beneath tlre office structure, the pro-

posed 350-rooru hotel structure now reduced in height to 120 feet, plus
a penthouse, the restaurant in one corner, and to the change in the
hotel by placing it to face in another direction from that originally
proposed .
ur. HaIl re-confirmed that the construction would include the rebuilding
of the intersection of Broadway, the details of whidt to be tt orked out
with Council and the State Highway Department, the conaection of the
sewer system to the Sewage Disposal Plant, the necessary connections
to the water line and drainage ayatem and ttre installation of fire
hydrants, aII as previously discussed with Council and agreed upon by
the developer.
continuing. ur. Hall comented on the plans to adequately landscape
the project, and to provide planting strips around the entire periphery
of the structuresi that with reference to the seventy-five feet of prop-
erty the Highway Department has indicated it will require for i.mprove-
ments to the Broadway interchange, the area is so indicated on the plot
plan and, that on the basis of a ratio b€tween the land and buildings
and estimating that the property will encompaas five and one-half acres
after the highway acquisition, the actual ratio is less than one to one.
To councilman cros\r's inguiry concerning the drange in plan fron that
agreed upon in principle by council at the prior hearing, Mr. Hall
explained th at a personal viEit to the Howard alohnaon headquarterE in
New York, revealed the reluctance of the latter to conibine a hotel-
office complex for reaaons of "security" and the type of tenants each
individual business will attract.
Inquiries directed b!' Councilman tlartin concerning the office building
parking area and the ratio of parking areas provided in the zoning code
were repliecl to b,y !lt. Irvin Shapiro, the project architect, and the
City Planner. l{r. Hall atated that the anst ers indicated that theproject woul,d more than exceed parking requirements.
The Pire Chief replied to Councilnan piederichsen, advising that from
his brief review of the current project, he could foregee no problems
but that it would be advisable to erect balconies as previously recom-
mended by his department for fire access.
!{r. HaIl, i.n expressing his consent, further pointed out that the
current plans, with its added meane of accesses, will inprove the fire
facilitieg considerably.
fhe Chair referred to the Acting City tlanager for comments, who, in
turn, advised that on this afternoon his office was the recipient of
a "tentative" Overpasa plan prepared and sulmitted by the Highway
Department.
:[he Acting City Uanager atated from his prelirninary review of the
tentative map, the only access to the development would be through the
City's proposed park area and that one of the City'a ball dianonds
would be elirninated.
Sone discussion arose thereafter on the tentative highway plan, with
ur. Richard E. slater, Realtor, rrith intere8t in the propoaed develop-
ment recalling his vieit in company with ur. Hall to the state llighway
Department and discuseions on alternatives under consideration by thelatter, rptrerein the subject property is within seventy-five feet of
the state's right-of-way plan and nherein iul accesa can be provided.
The Acting City Uanager, referring to the highway plan, advised that
one of the drawn lines depicted on the rendering indicates a raisedstructure that could be raised to a higher degree to permit an under-
crossing.

I.Ir. Duncan Beardsley, 1229 Cabrillo Avenue, referring to information
related by the highway representative at the last hearing wherein it
was noted that the current proposal is to take a "minimum of 150 feetof the City's park property, " stated that the final plan may increasethat amount and that it was his suggestion that Council taJce cogni.-
zance of Spangle & Associatesr statements relative to the development
before a final action is taken by Council.
Councilman Irlartin, also rrith reference to the current overpass plans
on display, stated that it now appeara that the plan proposes the
demolition of the existing structure entirely and expressed hie dis-
pleasure with the State Highway Department's new proposals for the
interchange irnprovement.
Ittr. Irving Amstrup, 2708 Trousdale Drive, questioned the reluctance
of the subdivider to conatruct a dual hotel-office structure and
spoke of his personal knowledge of one located in an eastern State.
f{r. Hall reiterated his previous statement in that the Eoeard ifohnson
enterprises are particularly concerned with "security" and the two
individual tlpea of tenants to occupy the complex and referred to
cornbination hotel-office structures located in other atates rrhere
experience has proven that it is not the ideal business situation.
A series of i.nguiries were directed by Councilman l{artin to Ur. Shapiro,
the project arclritect, rrho, after some discussion, concurred that a
structural plan could be designed for a dual usage with a miniraura
duplication of facilities.
llayor Johnson questioned the objection of Council to the proposed
second building.
Follorring a brief discussion betrreen Councilman uartin and the city
Attorney concerning the legal position of the city with respect to
the application for a conditional usage and the withholding of an
action by Council, a receas was declared by the Chair at 9:35 p.m.
The meeting was reconvened at 9:55 p.n., and the Chair declared the
hearing on the application of Gregory & sons continued.
Councilman ltartin. for purposes of clarification, stated that a
nodified proposal waa approved in principle by Council, based on the
construction of a three-hundred-room hotel, a restaurant comprising
7,000 to 8,000 square feet, 3,600 square feet of office apace and
parking spacea to accomnodate 5O0 cars and that a new plan proposing
the erection of a separate building for office use has norr been
presented.
Continuing, councilman Martin advised that it appeara evident that
the two-building complex will be vetoed by a Council majority and
that it waE his suggestion that the applicant request a thirty-day
extension of ttre hearing to consider the elirninatioD of the separate
office building and to reconsider ttre c.onstruction of a conbination
hotel-off ice structure.
Mr. HaIl advised, in reply, that he would confer immediately with the
Nery York headquarters of H@ard arohnson for a decision and that he
wouLd therefor reguest the extension of thirty days.

modifying the original proposal of the applicant and approving, in
principle, a combination hotel-office usage.

Councilman litartir stated his reluctance to approve "any office space"
and his preference that the atructure be limited to motel uaage
excluaively.
councilman Diederichsen stated hie preference also, to the plan approved
in principle at the last hearing, adding that a second structure
restricta the "open-space " area.
Councilman Diederichsen further stated his approval to the re-positioning
of the hotel building and his hope that if another structure ie designed,
it would face in the direction depicted in the drawing.
Councilman crosby concurred with the opinions of Councilman Martin
and Councilman Diederichsen, stating that the second building appears
to "block off" the park and its construction would possibly create
addit ional traffic problems .
Councilman ceorge, absent at the initial hearing, abstained from
corurenting.
A motion was thereafter introduced by Councilman trtart in that the
hearing be continued to the regular meeting of Council on Decenber 16,
seconded by councilman Crosby.
On the question, the city Planner suggested, witlr Council thereafter
concurring, that in the interim staff net bers study factora presented
this evening, with respect to the most recent Overpass design and the
stated intention of the applicant to rebuild the intereection at Broadway.

Mayor Johnson announced that thig was the time and place sclreduled to
conduct a public hearing on the application of eary F. Aloise and
Irobert J. I{arren, requeating a "certificate of Public convenience and
Neceasity" for the operation of trro taxicabs within the city of Burlingame.
The application was read and r*trerein the petitionera set forth their
propoaal to operate tvro taxicabs, to install a taximeter in each and
to paint the taxicabs "blue and white" with "black" lettering, reading
"Courteay Cab Coupany. "
Folloring a series of inguiries to the applicants, Council expressed
hesitancy in taking Ern action until further details with respect to
the operation of the comp.rny are made available and recorunended that
the applicants seek advice from qualified persons.
t'he applicants expresEed their concurrence and the public hearing on
their petition thereafter waa continued to the regular meeting of
Council on alanuaaT 20, L969.
COM!,[I'NICATIONS
1 GENERAL PI"AN @N?RACT
A communication from the city Planner, dated November 13, 1968, refeEed
to a corEtrunication from willian Spangle & Associates, City and Regional
Planners, dated Novenber 12, advising that by making trro dranges in
Phase III of the ceneral P1an, the sum of $5,4OO.OO will be acceptable
to conclude the final paldent sdredule.
Council thereafter concurred with the reconunendation of the city Planner
and instructed the City Attorney to prepare a new contract for the last
pha8e of the program.

A communication was read from Ur. silvio Belletto, 2404 HiUside Drive,
reconunending that Council consider the installation of an additional
sign on Hillside Drive, to control excessive speed particularly
near his residence.
A communication fronr the Hea1th, Safety & Traffic Commission, dated
November 18, 1968, also referred to the request submitted to the
Commission at its laEt regular meeting and the subsequent reconrmenda-
tion that conditions do not warrant the additional installation.
llhe Chief of Police, in attendance, questioned for his opinion by
Council, stated that he was in agreement with the recommendation of
the Health, Safety & Traffic Comniesion.
llhe Chief of Police, in replying to Councilman ttartin, advised that
the Commission has taken under study, the three-way intersection stop
at vancouver Avenue and Hillside Drive and that a sign has been ordered
and will be instal.led to alert motorists to a "pedestrian-crossing"at the intersection.
A brief discussion was initiated by councilman l.{artin concerning the
speed limitation on Hillside Drive, i'rith the observation that it
may be "too slorr. "
lfhe Chief of Police stated that speed limits are determi.ned on the
basis of how eighty-five percent of the motorists are observing the
regulations and advised that his department will survey the street.
Councilman l.tart in referred to an outside curb on Hillside Drive in
an unincorporated area, made particularly hazardous with the removal
of trees and requested that the City Engineer confer with the County
of San Mateo.
3. POLICE DEPARTUENT COM}IENDA? ION
A corununication was aciknowledged from l{r. and Mrs. walter J. Lucett,
1428 Benito Avenue, dated Novembe r 5, 1968, commending ttle medbera
of the Burlingame Police Department, assisted by men from the sheriff's
Office, for their efficiency in guelling the riotous actions of eeveral
hundied teenagers on Hallor.re I en Night in the area of Hillside Circfe
and nillside Drive.
The Chief of Police, replying to Councilman llartin's inquiries, com-
mented briefly on the damage that occurred that evening and confirmed
that newspapers reporting the incident were considerably exaggerated.
4. REQUEST FOR NA}IE CHATIIGE:
!4ARSTEN TO NORTII CAROLAN ROAD
A conmunication was read fron the California I'till Eguipment Company,
1362 North Carolan Avenue, dated Novenber 8, 1968. calling attention
to the difficulty experienced by custsners in locating its office
and suggeEting that Council consider changing the name of a snall
portion of Marsten Road, having no business establishments thereon,
to North Carolan "road, " "court," or "street."
Counci.I concurred rrith a reconmendation from Councilman l.lartiJt that
staff subrnit a report folloring an investigation, that the city
Attorney prepare an ordinance for introduction at the next regular
meeting of Council on Decenber 2, and that in the interirn, ProPerty
drners within the area affected by the proposed change be so notified
in writing.
2. ITILLSIDE DRIVE SPEED LIUIT

A cmunication frqn the County of San l{ateo, dated Novenber 13, 1968,
referred to Assembly Bill 1036, amending Section 3A7 92 of the covernment
Code, permitting general lan cities nore flexibility in setting dog
Licenge fees.
llhe communication advised that the County of San Uateo is therefore
proposing a new fee schedule (made a part of the conuuunication) to
become effective on January 1, 1969 and recormend s that each city arnend
its ordinance to coincide wittr the revised schedule.
Council was further advised that the effect, county-w5.de, will increase
the annual revenue to tlre Peninsula Humane Society by approximately
$2 3, 0O0 .00 .
fihe City Attorney was directed by council to prepare an old j.nance for
introduction and first reading at the next regular meeting of Council
on Decentbe r 2, L964.
A communication from ur. Albert w. Kahl, City HaIl architect, dated
Novetdber 8, 1968, requested an early meeting with Council to consider
a number of items reconunended in the construction of the net City HalI
and a schedule affecting bid advertisement and opening.
Council thereafter scheduled lilonday evening, November 25, at 8:00 p.n.,
ifi the City Engineer's Conference room to meet with the architects.
Ttte Acting City Manager rras requested to send notices to Council
reminding the menibers of the scheduled meeting in advance.

I. CIVIL DEFENSE COI'NCIL
councilman ceorge, Council liaison to the city-county civil Defense
and Disaster Preparednesa Council, advised that at the next meeting
of the Civil f,iefense Counci.l on November 21, he will be requeated to
vote on the County of San Mateo'e "micro-wave " proposal, initiated in
Pebruary of 1965, and th at he recently called a meeting sith !tr.
williatn C. Hindtcliffe, Mminiatrator, San lilateo County Operational
Area, Mr. alohn K. Wright, the Acting City Uanager and the Chief of
Police in attendance, to discuss the City's participation jJt the
pro9ram.
Councilman George reported in some detail the functions of the pro-
posal and advised that the sum of approxirnately $1I,O00.OO has been
projected as the City's share.
Recalling his previous negative votes on the iasue, Councilman George
stated that it now appeara obligatory that the City participate.
Council-man ceorge referred to a connunication he directed to the
Department of Housing and Urban Development on Novenber 8, 1968,
renewing the city's request for an allocation of $15O,500.00 under
the Sederal's "open-space" progran.

uayor ilohnson acknowledged, on behalf of Council, a presentation from
the Chanber of Cot@erce, including an up-dated industrial directory
and cormunity statistics.
Claims, for the month of Novedber, 1968, Nos. L672-LA75, in the total
amount of $253,7A9.26, duly audited, were approved for pallraent on motion
of councilman crosby and eeconded by councilman Diederichsen.

Payroll Warrants, month of lIove ber, 1968, Nos. 1456-1981, in thetotal surn of $154,599.52, lrere approved on motion of Councilman Crosby
and seconded by Councilman Diederichsen.
A claim from the California Trucking Association, dated Novenber 7,
1968, for expenEea incurred rrhen the premises were flooded on July 26,
1968 by reason of a stoppage in the Burlingame sewer aystem, was acknorl -
edged and on motion of Councilman llartin, seconded by Councilman
Diederictrsen and unaninously carried, said clain in the amount of
$37.55, vas denied.
Ehe City Engineer referred to several miscellaneous items requiring
work order changes with respect to the Sewer Treatment Plant construc-
tion and requested Council authorization to proceed with the directive.
Following a brief discussion on the improvement replacements required,
and the City Engineer's confirmation that there is contingency funds
to meet incidental expenditures, counciL authorized the city Engineer
to proceed with the current work order and to preaent eaclr subsequent
change to Council for further authorization.
ftrere being no further transaction of business, the meeting uas
regularly adjourned at 11:55 p.m.
