HomeMy WebLinkAboutReso - CC - 069-2022DocuSign Envelope ID: 6BB48008-4C40-4D7A-9B8F-F98764F10B06 RESOLUTION NO. 069-2022 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME DECLARING A WATER SHORTAGE EMERGENCY AND IMPLEMENTING LEVEL 2 OF THE BURLINGAME WATER SHORTAGE CONTINGENCY PLAN WHEREAS, over the past year, the Governor has taken unprecedented actions to target reduction of water use within the state; and WHEREAS, on March 28, 2022, Governor Newsom issued an Executive Order directing the California State Water Resources Control Board and local water agencies to enact shortage response actions consistent with local drought contingency plans; and WHEREAS, on May 24, 2022, the California State Water Resources Control Board adopted emergency regulations for each urban water supplier that has submitted a water shortage contingency plan to the Department of Water Resources to implement, at a minimum, the shortage response actions adopted under Section 10632 of the Water Code for a shortage level of up to twenty percent (Level 2) by June 10, 2022; and WHEREAS, the City's 2020 Urban Water Management Plan, which contains the City's Water Shortage Contingency Plan, was adopted on September 7, 2021; and WHEREAS, per the requirements of Chapter 15.06 of the Burlingame Municipal Code, a declaration by the City Council that a water shortage condition exists is required to formally authorize staff to implement these water reduction measures; and WHEREAS, staff recommends that the City Council declare a water shortage condition, and adopt the following new restrictions from Level 1 and Level 2 of the Water Shortage Contingency Plan: Level 1 • Potable water shall not be used to water outdoor landscapes in a manner that causes runoff onto non -irrigated areas, walkways, or other hard surfaces. • Potable water shall not be applied in any manner to any driveway or sidewalk, except when necessary to address immediate health or safety concerns. • Restaurants and other food service operations shall serve water to customers only upon request. Level 2 • Residential and commercial landscape using overhead sprinkler irrigation with potable water is prohibited between the hours of 8:00 a.m. and 6:00 p.m. and no more than two (2) days per week. Drip, bubbler, hand -watering with a shut-off nozzle, other water -efficient irrigation systems, and new landscaping installed in the plant establishment period (typically less than two years) are exempt. • Prohibit installation of single -pass cooling systems. • Prohibit vehicle washing except with the use of recycled water DocuSign Envelope ID: 6BB48008-4C40-4D7A-9B8F-F98764F10B06 WHEREAS, the California State Water Resources Control Board emergency regulation includes a drought response action that prohibits the use of potable water for the irrigation of "non-functional turf' at large commercial, industrial, and institutional sites. "Non-functional turf" is defined as turf that is solely ornamental and not regularly used for human recreational purposes or for civic or community events. Non-functional turf does not include sports fields and turf that is regularly used for human recreational purposes or for civic or community events. Exceptions to this rule include residential lawns, parks, and irrigation as necessary to ensure the health of trees and other perennial non -turf plantings or to the extent necessary to address an immediate health and safety need; and WHEREAS, to help ensure that the City's water customers will comply with the water demand reduction actions, staff will take an educational approach prior to issuing fines or penalties. In the event of multiple warnings and repeat violations, staff will issue administrative fines in the amount of $100, $200, and $500 as authorized by Municipal Code Chapter 1.12.010; and WHEREAS, the City has been conducting outreach to the community to conserve water and has sent numerous eNews articles emphasizing the importance of water conservation along with indoor and outdoor conservation tips; and WHEREAS, staff will further intensify the public outreach and enforcement efforts to ensure that water conservation targets are met. NOW, THEREFORE, be it RESOLVED, and it is hereby ORDERED, that the City Council of the City of Burlingame hereby declares that a water shortage condition exists in accordance with Section 15.06 of the Burlingame Municipal Code; and BE IT FURTHER RESOLVED that the City Council hereby adopts water use restrictions consistent with State regulations, the Municipal Code, and Level 2 of the City's Water Shortage Contingency Plan as set forth above; and BE IT FURTHER RESOLVED that City staff is authorized to implement modifications to the emergency regulations as updated by State Water Resource Board from time to time to address the water conservation needs; and BE IT FURTHER RESOLVED that City staff is authorized to interpret and implement the provisions of this resolution, including enforcement of violations of the restrictions listed here through the provisions of Chapter 1 of the Municipal Code.
